MOSCOW, Idaho — Wednesday marks a key day for the defense in the trial against Bryan Kohberger. In a hearing on February 28, the court ordered that the defense must provide an alibi by April 17 if Kohberger intends to use said alibi in his defense.
According to court documents, “The alibi must state the specific place or places at which the defendant claims to have been at the time of the alleged offense and the names and addresses of the witnesses upon whom he intends to rely to establish such alibi."
Kohberger is accused of murdering four University of Idaho students in 2022.
In an August 2023 filing, Kohberger’s attorney argued, “Mr. Kohberger has long had a habit of going for drives alone. Often he would go for drives at night. He did so late on November 12 and into November 13, 2022. Mr. Kohberger is not claiming to be at a specific location at a specific time; at this time there is not a specific witness to say precisely where Mr. Kohberger was at each moment of the hours between late night November 12, 2022 and early morning November 13, 2022. He was out, driving during the late night and early morning hours of November 12-13, 2022.”
The prosecution argued the alibi was far too vague.
If Kohberger does not provide a more concrete alibi by Wednesday, the defense will not be able to use the alleged alibi as a defense during the trial.
Kohberger is expected back in court next month for a hearing to move his trial out of Latah County.
