New push for smoke-free apartments in Wash.

UNIVERSITY PLACE, Wash. - There's a new push to limit smoking at apartment buildings in our state. Non-smoking tenants are taking a stand against neighbors who choose to light up and the landlords who allow it.

Nan Hogan enjoys the fresh air outside her University Place home. She's had asthma for years. But today, she's breathing a lot easier now that she no longer lives at the Lawn Court Apartments. When a smoker moved in one floor below, Nan says she had no choice but to move out.

"I just had no idea that smoke could come up through floors and walls and through the vents and into cracks and that kind of thing," she said.

Roberta Kowald used to work for the health department. Now, she works with Nan to try to change the landlord tenant law through the People United for Smoke-Free Housing, or PUSH.

"It's about something that's really having a serious health impact on people and on their rights to be in their apartment," says Kowald.

The group's goal is to include secondhand smoke as a nuisance in the landlord tenant act.

"Work with the smoking tenant, the non-smoker and the landlord and figure out something specific for their specific situation," says Kowald.

The county health department plans to consider PUSH's proposal next month.

I am a non-smoker. I live in a complex where the units have all been converted to non-smoking units. This means that smokers must stand outside in order to smoke. The tenant who lives in the other half of the duplex where I live is a smoker. Instead of smoking in her own unit, she now has to smoke outside. This just isn't right. Smokers should be able to smoke in their own apartments. As much as possible, I avoid smoke, but when it's outside, less than ten feet away, it's pretty hard to avoid.

This "legal discrimination" is possible because these politicians that pass this sort of legislation do not fear being assassinated. They believe the sheep will continue to be led into believing that We live in a democracy. A democracy is nothing more than tyranny by many. It doesn't matter if they pass unconstitutional legislation. If it is repugnant to the Constitution, it is void, and it is not to be followed. But please leave the law enforcement agencies out of it, and soley target the politicians and judges. We need the law enforcement agencies on our side after We have rid our once free country from tyranny. Freedom is worth fighting for, and these politicians deserve to be in the dirt.

thank you fredrickanne well stated! there are perfumes, food smells, etc i find very offensive. do i try to get the state governement behind me to ban them? no, i deal with it. at the very least, i believe it should be at the discretion of the establishment owners (as i personally believe with bars in this state) to decide if they want to be a smoking establishment, a non-smoking establishment, or both with designated areas. so many people keep shouting that big brother is in our personal lives too deep... smoker or not, this would be inviting government policies into our homes. might want to stop and ask yourselves if that's something you really want. i do NOT and your point about the taxes this state makes from smokers i had stated to my husband before. can you imagine the amount of revenue lost if every smoker suddenly stopped as it appears many would prefer?!! how this 'legal discrimination' is possible is beyond me.

you know as a non-smoker I think you people are a piece of work you made it so they can't somke anywhere now you are gonna make it so they can't smoke in thier own home. Get over it if you don't like it move or buy a house so you never have to have this problem. The state keeps raising taxes on smokes to the point that they are expensive because they need to raise funds and people quit and they are dumbfounded when they don't make as much, then they limit where you can smoke so people quit, again not making money, now you want to take away smoking in thier homes so it is quit or you can't get an appartment so then we have more homeless or they move out of state...so who will pay the extra taxes that the state will lose? I think you non-smokers need to get a life and quit picking on the smokers they have done nothing to you.

It seems strange at a minimum, and borderline mentally ill, to move into an apartment building that allows smoking, if you don't like smoke. The only thing I can imagine is someone held a gun to your head, and forced you to live there. This is America, where you always have a choice. If you need to find non-smoking apartment buildings, move to Portland, Oregon, the anti-smoking nazi capital of the world.

As a smoker I can say this. It would be illegal to discriminate against someone because they arent married, or because they drive a ford van- when it comes to housing. It is not right to once again raise the bar on those who smoke. We pay far more taxes for smokes than YOU DO when YOU BUY candy or soda. WE PAY MORE TAXES for smokes than YOU DO when YOU BUY a lottery ticket. That said, - give us a break. If you do not like smokers- dont hang out with them. It is not good PR for Pierce county to even think of this. Remember Tacoma is "the other Seattle". Want to talk about what stinks in Pierce County? Look at the smelly paper mill you smell on I 5 going near the Tacoma Dome.. now THAT STINKS. Why doesnt pierce county try and wipe out their own "stink" before they invade my home. Idiots

Smokers stink - disgusting. I do not want to smell you in the elevator after you go outside for your 5 minute smoke break (7 or 8 times a day). QUIT SMOKING! Smoking in a car with children or pets in the car - how stupid is that? VERY! QUIT SMOKING! YOU STINK!

Rig, that even goes so far beyond smoking. I got cancer from a bar I had to go to, got fat from a burger I had to eat, killed people because I played video games, got a ticket from a camera for running a red light. No one wants to accept responsibility for themselves.

Why do non-smokers become addicted to smoking environments such as bars and apartments that allow smoking ? Once a non-smoker becomes addicted to a smoking environment, who is supposed to protect the non-smoker from themself ? One possibility would be adding a sales tax to alcohol, which would fund a support person for each addicted non-smoker. The support person could walk around with the addicted non-smoker all day, and when the non-smoker couldn't help themself, and went to a smoking bar, or tried to get an apartment that allowed smoking, the support person could take them by the hand, and gently pull them away, whispering "Hey, don't go there, you don't like smoke". It would cost millions, but it may be the only way to truly protect the addicted non-smoker from themself. They need to be teaching the children more about the dangers of non-smokers becoming addicted to smoking environments.

first, we cant smoke in resturants or bars. next parks and zoos. now in our own homes? really? where is this going to stop? we are supporting the econamy every time we light up and helping keep your taxes low. when are we going to get a brake?
