Cold pizza employee no longer employed

LACEY, Wash. – A pizza shop worker who was suspended after telling KING 5 News that the owners ordered the heat turned off says he has now been fired. But, the owners say both sides have parted ways amicably.
Dan Baxter says he arrived at the Lacey Pizza Time Monday afternoon at the request of the owners, presumably to go back to work. He said at the time that he would take the owners up on their offer.
Baxter later called KING 5’s Jesse Jones to say that when he arrived at the store at about 4:30 p.m., he was officially being fired.

KING 5 News contacted the owners Monday. They say they parted ways with Baxter amicably. The owners also say they will not challenge any unemployment claim by Baxter.
They also say that Baxter had been suspended before the story aired on KING 5.
On Friday, Baxter revealed that the heat in the store had been shut off and the owners left a note for the employees saying if they didn’t like it, they could leave.
Baxter says the chilly move came after employees forgot to turn off the furnace at closing one night.
Co-owner Luke Benjamin confirmed on Friday what happened.
There is a space heater inside the store’s office where Benjamin’s wife runs an accounting business.
Baxter said then he expected to be fired for talking about it. He now says he also has had a few job offers since the story first broke.
Baxter says another employee was fired, but he doesn’t know if it’s related to the story.
The Washington State Department of Labor and Industries says there is no law regarding the temperature of a room you have to work in, unless you’re working in extreme situations like cold storage or foundries.
