This is the second sibling to file legal action against DSHS for alleged neglect and abuse perpetrated by the father and stepmother, who are each serving eight years in prison.

In the earlier case brought by Shayne Abegg, DSHS settled for $5 million. DSHS believes that settlement fairly compensated Shayne to meet any special needs he may have in the future.

Efforts to mediate Joey's claim have been unsuccessful so far.

Joey's claim is different from Shayne's and needs to be addressed separately in a court of law. That's why DSHS cannot discuss the particulars in the news media.

DSHS can say that following the first case, the Children's Administration enhanced social worker training on how to recognize malnutrition and continued efforts to lower caseloads.
