Washington Governor Chris Gregoire says the state will appeal a federal judge's ruling that the state cannot force pharmacies to sell Plan B.

Gregoire issued a statement Wednesday afternoon announcing the action, saying she fully supports the appeal that will be filed by the office of Attorney General Rob McKenna.

The state's rules require pharmacies stock and dispense drugs for which there is a demand, but some pharmacies have stressed religious objections to carrying emergency contraceptives.

U.S. District Judge Ronald Leighton's ruling last month did not strike down Washington's stocking and dispensing rules for pharmacies, but said simply that the way they were applied to the plaintiffs in this case was unconstitutional.
