TORONTO – A married Canadian woman is suing her cell phone company, saying its billing practices exposed her extramarital affair and ruined her life.

The Toronto Star reports Gabriella Nagy is suing Rogers Wireless, Inc. for $600,000 for invasion of privacy and breach of contract.

The newspaper reports that in 2007, Rogers sent a monthly bill for Nagy's cell phone to her home under her maiden name. In June of that year, her husband decided to add Rogers internet and home phone service to the house.

The Star reports the following month that Rogers mailed a "global" invoice to the Nagy home that included an itemized bill for Nagy's cell phone service. Nagy's husband discovered several hour-long phone calls to a single phone number.

Nagy tells the paper that her husband called the number and the person on the other end confirmed the affair.

"My husband didn't tell me that's how he found out, he just left," said Nagy.

The statement of claim alleges that Rogers "unilaterally terminated its cellular contract with the plaintiff that had been in her maiden name and included it in the husband’s account that was under his surname."

Rogers, in a statement of defense, denies terminating Nagy's contract. It also says the company "cannot be held responsible for the condition of the marriage, for the plaintiff's affair and consequential marriage break-up, nor the effects the break-up has had on her." Rogers does admit consolidating invoices sent to the couple, saying it saved the couple money and increased administrative efficiency.

Since her husband left, Nagy says she was so distraught that she lost her $100,000 per year job. Her statement of claim reportedly states "The plaintiff wept uncontrollably at her workplace ... and became incapable of performing her employment duties."

“It was a mistake,” Nagy reportedly said about the affair, “But I didn’t deserve to lose my life over it.

“I want others to know what a big corporation has done. I trusted Rogers with my personal information. We had a contract — and agreement that put my life right in their hands.”

The couple has two children, ages 6 and 7.

She's just a typical lib, blaming the consequences of her actions on someone else and trying to make a buck off it to boot. It's like smokers trying to sue the tobacco companies because they got cancer. The sad part is, is that some lib judge will agree with her and make her a wealthy woman. Even with money, she'll still have flies following her around.

Fair is fair, she had an affair and got caught. She deserved to lose (at least part of) her life over it, since part of her husband's life ruined by her cheating. Yeah, Rogers should be penalized, but just a bit (maybe $100 or $1000) for unilaterally combining accounts using two different names. There's an issue of privacy involved here, but to what extend will depend on the laws there in Canada. But it's pretty scummy to blame your cellphone service for a ruined marriage. Don't see her showering praises on them for helping furthered her affair.

I had a boyfriend live with me for a year and I added an email account to my Comcast account for cable and internet. He was never attatched to the bill itself. We broke up and he moved to Oregon where he got Comcast service for his apartment. The person helping him asked if he wanted his email account transferred down there. Whereupon they transferred my email and accounts to him. In the end they refused to give me back the account until i jumped through hoops to get it back. Later they erased all my files and information from my email account. They gave it all away to him with no problem but had a great deal of difficulty just giving it back. They need to be more concientious and aware of privacy issues. Just because someone says "sure" does not make it right whether you are married or not. In this case I suspect the husband was already suspicious.

It is karma that she was exposed for her cheating and lying, and for this, I agree, it is completely her fault. The only error I do hold against Rogers is that they did consolidate accounts (and with this account information/privacy) without consent. But really....how does she expect to sue for damages based on this? The company did not ruin her marriage and cause her emotional distress, that was all on her actions. Chase Bank has made errors on both mine and my dad's account by merging information and payments when the ONLY similarity is our last name, Different accounts and types, and addresses....A complete mess to try to fix. Still haven't figured out why and neither have they.

How can anyone hold a phone company responsible for your infidility..your choices made your marriage fail, not the company providing a service to both your and your husband....if you had a seperate account, you should have taken better mesures to keep your accounts seperate........its not thier fault "you made a mistake"" you did a bit more than that.......grow up and accept responsibility for your own actions and humble yourself for viloiting your vows....I would have left too.....you obviously need to think about you own responsiblity in this and stop trying to blame others for your own actions.....

I'm clearly in the minority here even stating something that doesn't include the message "it's her own fault!". With that said I think the cell phone company does bear some responsibility for breaching of her privacy. Just because two people share a mailing address the company can combine their bills? They had different last names, for all they knew they could have been roommates in a boarding house. When I got married I had to send proof of my marriage to even change the last name on my own cable bill, it seems odd to me they can just consolidate accounts of two separately named people without both people having to verify they are ok with it.

It's called taking responsibility for your actions. And then there's having to face the consequences of it. Taking it out and blaming the cell phone company is denial. And that's totally obvious. Facing up to it and really seeing who's the culprit would have been better then having the WHOLE story in the news.

Politiciansstink: I agree - personal responsibility would be great but unfortunately seems to be fading from my memory these days. Can't remember the last time I saw/heard someone take any... However, while the woman is clearly not the brightest bulb in the pack, the cell company should NOT have combined her PERSONAL bill with the family bill...that just strikes me as WRONG. If I establish a contract in my own name, I expect it to STAY in my name unless I change it. NickC: I'd be careful who I call Idiot or learn how to use the correct words and punctuation: "...get rich from there (THEIR) own stupidity and wasting are (OUR) tax dollars(.) Hmm, she had her cell phone bill sent, in her maiden name to her home........ husband opened a new account with same company........ Bills sent to the same address consolidated......... Somebody making 100K a year should have been able to figure at least with the first one, that she could have gotten figured out! No sympathy for her, sorry. Court should shut her down, and award custody of the kids to the father, as well as marital support, and child support. Maybe she will learn? Doubt it. Dumb is as Dumb Gets!

i think the point is that the company shouldn't have consolidated their bills without her permission. had they not taken those steps without first confirming with her, then she wouldn't have been caught. on the flip side....did she really think she was going to get away with it? she ruined her own life by the choices she made, so putting the blame on a cell phone company is a waste of time and energy....grow up lady!

I only hope that the cell company can get a court order that she must reimburse them for legal costs of defending themselves from an obviously frivolous lawsuit. The other customers shouldn't have to have their bills padded so the company can defend themselves.

What is wrong with people today, that they can't take responsibility for their own actions? If the cell company hadn't exposed the affair, it would have come to light eventually. I don't buy that she was so distraught after her husband left, he should be the one "distraught" since his wife cheated on him. I hope the cell company fights this and wins, but I see a settlement in their future and this cheater cashing a big check. Unbelievable and disgusting.
