Does radio transmission reveal deputy having sex on duty?

EVERETT, Wash. – KING 5 News has obtained a recorded two-way radio transmission that sparked an investigation into whether a Snohomish County sheriff's deputy had sexual relations while on duty.

It happened in the early morning hours of September 19. Dispatch was communicating with one Snohomish County deputy when another male deputy accidentally keyed the mic on his radio. It was about a ten second transmission that sounded like a woman moaning repeatedly.

KING 5 News has learned that deputy is now under investigation for having an inappropriate romantic relationship on duty. It is not being investigated as a crime, but could be a case of police misconduct.

In the recording, a second similar radio transmission can be heard a few seconds later. About a minute passes, then dispatch asks the deputy to check his mic.

"41 sam radio check" said the dispatcher.

"Code 4," said the deputy.

"Copy code 4," the dispatcher answered.

The deputy is a 45-year-old sergeant, who has been with the office for 20 years. According to his internal personnel file, the sheriff promoted him to sergeant in December 2009. He's now on paid administrative leave pending an internal investigation.

The Snohomish County Sheriff's Office says since this is not an alleged crime, the investigation is a personnel issue, which the department can't comment on. The sheriff's office says the internal investigation into the sergeant's conduct won't be made public for 2-3 weeks.

Some Q's: Was this activity with his "Patrol Partner"? His wife?, Girlfriend?, mistress? a citizen? What about his partner? Was it her? Was she single, married, separated, divorced? Was this a "Roadside Interview"? or was he at his/her residence,in private?, in the patrol vehicle? Too many unanswered questions, not enough information. Everyone is jumping to conclusions, but if it isn't being investigated as a crime, then it was consensual. Maybe a bit tacky on the Sergeant's part, but no crime. He should not lose his job because he got "a little", sounds to me like too many hypersensitive coffee drinkers out there, not getting ANY.

Could just as easily have been a depressed woman leaning on his shoulder mike while being consoled and the sounds were her crying. Anyone looking inside the front seat of a police car can see that sex would be very difficult with all that equipment mounted between the front seats. If so the sounds would be from the pain of the console on the seat. Was there a dash cam in the car so they can at least review the full audio of the incident? Were there any traces of body fluids in the front seat? Did the officer volunteer to take a polygraph exam to determine the truth about what happened?? (most cops will refuse to take a polygraph for fear that they would lose their jobs if they were asked if they had ever made a false report or broken any laws which would have caused a criminal charge on them or loss of their job).

Speaking of Police misconduct, what about this clown down in Lakewood? Lakewood Police Officer Victor Celis was placed on administrative leave pending an investigation for conduct unbecoming an officer. Celis is accused of starting a bar fight and then attempting to use his police credentials and authority with responding officers in order to leave the scene with no charges being filed. Responding officers detained Celis and notified Lakewood PD.

And sex is only for the procreation of the species….yea right, I feel sorry for those of you who think that way.. People have sex all the time, last time I knew, cops were people also. So what if they have sex while on their break, or lunch, who really cares… I don’t as long as it does not impair the performance of their duties. And you wonder why we don’t want gays in the military..but that’s another column to write about.

PAGE # 1: Too many cops getting away with things that other " Private Sector Businesses would not put up with. I think Police Departments should make very sure to keep, an Eye on all their activities. I also think that when a cop crosses the line of what is considered unbecoming conduct they MUST soon loose their jobs, and never be able to work in Law Enforcement ever again. Further, we as thier Employers MUST be able to keep our Employees in line on every aspect, and every level. Not just limited to willful acts of Adultery, & Fornication. YES, Adultery, and Fornication are considered UN-becoming. NO MATTER WHAT !!! NO MATTER WHERE YOU ARE !!!! NOTE: Please excuse the spelling errors.

Let's see. having sex in a squad car while on duty. hmmm..what should we do? I know, put him on paid admin leave like the murderer cop in everett for say...a year or so. That ought to teach him a lesson. And King County cries it has no money. Now THAT is funny.

This is not big news, although I think King 5's point is its our tax money that is paying these officers to work. He should be able to just resign, and hopefully learn from this mistake. However, the truth lies here. Clinton got away with the same activity, and he wasnt fired.

Remember folks,,, these types of stories are like roaches. If you see 3 or 4 you can bet your last penny there are dozens more we can't see or don't know about. I'm sure on duty sex by bored patrol officers is a common occurrence and hopefully one that will not be tolerated by us. We don't pay officers to have sex while on duty, if they have down time between calls they need to be patrolling not trolling. If our officers are this bored at work maybe we have too many officers.

I have to agree that this is not news worthy. I do believe that he should be terminated due to misconduct, but really, does the public need to know this. If this happened to me, no one would know about it and I'd be sent home immediately without additional pay. So fire him and hire someone who wants to do the job. In fact I know someone who just received his notice at the Lynnwood police department who could use a job at the end of the year. Sure beats the option he's looking at....

What difference does it make? Even if caught in the act the union will make sure the punishment is nothing more than a slap on the wrist. On Mercer Island a police officer was drunk while on duty and hit a pedestrian with his patrol car. Nothing happened.
