Wash. lawmakers toughen cell phone driving law

OLYMPIA, Wash. -  The Washington state Legislature has approved a measure that makes it easier for police to ticket people who are driving while either texting or talking on a cell phone without a headset.

On a 60-37 vote Thursday, the House passed a bill that makes it a primary offense to be caught holding a cell phone to your ear while driving, or to be reading, writing or sending text messages. That strengthens the state's current secondary offense law for both, which only slaps drivers with an extra fine if they are pulled over for another infraction, such as speeding.

"Maybe now people will pay attention to their driving instead of their conversations," Sen. Tracey Eide, D-Federal Way, and sponsor of the bill, said in a prepared statement after the vote.

"Our roads will be safer and I believe lives will be saved as a result of this law."

The House initially had watered down the bill to make only texting a primary offense. But they receded from that position on Thursday and passed the bill in the form it had passed out of the Senate last month.

The measure now goes to Gov. Chris Gregoire for her signature.

"Distracted driving is a very serious, real deal problem," said Rep. Reuven Carlyle, D-Seattle. "There's a public safety element to this that is very real."

Under the bill, police could immediately pull over someone for texting or talking without a headset and give them a $124 ticket.

A ticket will not become part of a driver's record and dialing a phone is not considered text messaging. The measure exempts transit and emergency vehicle personnel, as well as anyone who is text messaging or calling and not using a headset to report illegal activity or summon emergency help. People who are using a hearing aid or operating a tow truck are also exempt.

The bill also outlaws any cell phone use by a driver with a learner's permit or an intermediate license, which is given to drivers under 18 years old.

The National Conference of State Legislatures has said that Washington is one of six states and the District of Columbia that have passed laws regulating cell phone use by drivers, but is the only one that considers the use of a phone without a handsfree device a secondary offense.

I would like to be there when and if you ever got in a situation where you needed help from the cops.I'll bet you would be crying a different tune real quick. What a load of malarkey. Talking on your cell phone while driving is no different than steering your car with one hand(you're all guilty, don't deny it!) and talking to the person in the passenger seat next to you. When you're talking to someone next to you, do you turn your head in their direction once in a while? Of course you do. Seriously, if you can't handle driving and talking at the same time, you shouldn't be on the road in the first place.

If it is too dangerous for us "simpleton taxpayers", then it is too dangerous for the po-po as well. I personally responded to an MVA in Clark County in 2004 where a deputy sheriff ran into a bicyclist because he was texting on his MDT. Not en route to a call. Not busy "saving lives". Did anyone else know about this? Nope. Covered up. The bicyclist survived. A badge does not make one infallible. Treat people equally and stop making excuses.

Crooked politicians and their blue shirt highway robbers want to take it. Not so long ago armed highwaymen were caught and hung by the good people. Now they work for the government.

Bobknows.........nothing. Riddle me this Bobby: Who are the people being "robbed" on the highways? If you're talking about people being stopped for traffic violations and cited for them......you are talking about people breaking the law. As much as I can gather from history, law breakers (not enforcers) were the people hung from the trees. I'm just guessing you don't think traffic violations are that big of a deal......maybe you think drunk drivers should be allowed to roam the highways unchecked. Here is a little history for you. Traffic fatalities kill more people in the US than any other non-natural death......more than murders, more than natural disasters, more than people being hung from trees! As a matter of fact, they account for more than all of these combined. Maybe these so called robbers are risking their lives to save people like you from themselves and from hurting others. I imagine you never put your life in danger for a stranger......Bobknows.....nothing!

The blue shirt gun thugs are "trained" to rob drivers on highways. About 1/3 of the city budget comes from armed highway robbery. This new excuse for armed robbery is being done because revenues are down. It has nothing at all to do with safety. Not so long ago armed highwaymen were caught and hung by the good people. Now they work for the government.

Maybe everything has become a 'cop bashing thread' because the police here are totally corrupt and a lot of people are fed up with it. It's just become a part of life. I was at work once and a cop not only pressed this young girl for her number, but he started texting with her and making lewd comments as well, while we're talking about cops texting, but that's all I got on cops texting. Cell phones should be illegal to use while driving, and people with no brakelights working should be sentenced to a month in prison for causing horrible accidents and getting people cases that they don't need or deserve even though they avoided hitting everything on the road other than a bus sign... Not that there's any personal reason for me bringing all that up, I'm just bored. This is a great outlet for people to vent their frustrations with the legal system, that's for sure. We need more forums like this that are tied in with news. Kudos King5!

My comment was deleted. Looks like someone at King 5 doesn't like people pointing out that we are slowly turning into a nanny state. Maybe they like that agenda. So why do we need this law? The feds just released stats that our highways are the safest they have been in 60 years! That's right six zero years. "The Transportation Department said Thursday that its projections show total traffic deaths declined nearly 9 percent in 2009 — to 33,963. That's the lowest toll since 1954. In 2008, an estimated 37,261 people died on the highway" (You can find it on the MSNBC site but not King5 for some reason.) Just because you don't like someone reading, talking, texting, putting on make-up, picking there nose or whatever it apparently is not causing chaos on the roads. So why the law? Revenue maybe? Maybe the state can stop micromanaging us?

Seriously, what in the world would make you think that cops learn to drive while talking on the cell phone? It doesn't happen. Ask a cop he or she will tell you. There is NO talk on the phone while I am driving training for cops.

What about the police? The police (WSP) make up 1 out of 2000 cars on the road... I mean, that means in rush hour traffic, out of the 42,000 cars on the roads between Renton and Everett... there's 21 cops out there who are on their phones, getting in accidents and driving recklessly...

Police are exempt from the law. I'd much rather have a cop who has been trained to multi-task using his/her phone in an emergency, that some idiot talking to his/her buddies/mommies/kiddies while driving. I've never had a cop cut me off, drift into my lane, etc. while talking on the phone. I think the fine should be at least double what they're charging, and get caught more than once - lose your license for 6 months!

The real problem to any law in Washington is that the one at is ALWAYS on their cell phones and driving is the POLICE! What, good for the goose and not the gander? Remove cell phones from the cops hands as well. So cops think they are not driving worse than a DRUNK, cause they are. NO CELL PHONES FOR ALL, NOT JUST CIVILIANS.

And what's the difference if you're HOLDING a cell phone to your head and talking on a bluetooth? TALKING is the distraction - this rule is stupid

If you and the car in front of you are driving at 60 MPH, with 50 feet between you. You look at your phone for 2 second, at the same time the car in front of you slows down to 50 MPH, in that same 2 second period, you will have traveled 176 feet, where as the car in front of you would have traveled 146 feet. You will now be 20 feet behind the car... If it takes you .5 seconds to hit the breaks, you will have traveled another 44 feet, or, effectively, you would be int the back seat of the car in front of you....

What's amazing is that this legislation was passed quite fast..but we still coddle our DUI drivers..and no one seems to want to change it. You'd think that upping the penalties for DUI would be a no-brainer breeze to pass into law..

All im saying is i dont understand why everytime this comes up its an immediate cop bashing session. So basically what your saying is that they shouldnt talk on their cell phones which i guess in turn means they shouldnt talk on the radio to respond to calls. Mabye everytime they get an emergency call they should pull over and then answer it.

I agree with the_commando. It's much harder for me to dig through my glove box to find my hands free set, put it in my ear and then make sure it is properly plugged in. Much easier to pick up the phone and just answer it. Don't care so much about the cop issue, that will never change. I honestly don't think this law will change anything. People didn't care about it before and I can bet they won't now either. People will just put it on speaker and still hold the phone just below the window. I do that now and probably won't stop doing it just because this is passed. You can also text that way too, hold it below the car window. Good work government! Now focus on more pressing issues.

I don't understand why everyone thinks this is the polices problem, they are doing their job as the lawmakers tell them to. You don't hear about them getting into accidents because they are on cell phones, my sixteen year old is going to start driving and I'm glad that she can't be on her cell phone. Get a headset, start worrying about what the politicians are doing in Olympia to raise your taxes, if you use a headset you won't get a ticket but you will pay higher taxes even if you don't want to.

They have proven that it's the conversation that distracts people more than the holding of the cell phone. If it was just a one-hand on the steering wheel issue you'd have to ban everything else that causes a driver to take one hand off the steering wheel. This is just another way to bring in revenue. If they were truly concerned about safety they would ban cell phone use (except for emergencies) while driving all together.

Chevelle70ss is right. Cops are trained to do multiple things. Shoot unarmed citizens, put innocent people in comas, run over bicyclists and crash their cruisers while texting. There is some cop bashing for you! Okay honestly though, they are not trained to talk on their cell phones or text while driving. I mean if they started training for that, they would have to also train for getting jelly donut stains off of uniforms while racing to crime scenes.

There is nothing so important in your meeger little lives that can't wait until you reach your destination, that warents you calling someone while you are driving. Phones with GPS trackers should dissable the key pad, except for 9-1-1 calls, when the phone is moving faster than 5 MPH. That would solve all these driving while talking on the phone issues. NEXT!

Talking on a cell phone while driving has obviously been a major distraction for Sen. Tracey Eide, D-Federal Way. Maybe now she can focus on the issues effecting our local economy and the lunacy of raising taxes.

BS....cops are not "trained" to do multiple things...it's merely what they do. If it's deemed unsafe for us, it should be deemed unsafe for anyone. There is no reason the cops can't have a hands free device as well.

The police are exempt.---------- I sure am glad our elected officials spent time passing this bill as opposed to trying to work out a reasonable solution to the budget problems. After all we don't already have a law against this type of thing, unless you count the law regarding distracted driving.

WTF stop bringing up the police, everytime this story comes up it becomes a cop bashing thread. I have yet to be stuck behind a cop on the freeway doing 40mph because they were on their cell phone. They are trained to do multiple things while paying attention to the road and driving fast, as alot other people on the road can barely breath without getting distracted.
