TACOMA, Wash. - The people on East 34th Street in Tacoma have quite the collection of war stories. Last night was just another notch on the belt.

"I came out to cover my boat last night and look across the street see someone prowling around Dave’s car, trying to jimmy it,” said Brandon VanBrocklin. “My wife called Dave.”

“I have a taser, grabbed it on the way out of the door just in case, i didn't know what i was running into,” said Dave Sanderson.

Neighbors chased the man behind Sanderson's home to the alley.

"I warned him three or four or five times, to let me see his hands, and he started to come out with his hands, like he had a gun, and I tased him,” said Sanderson.

What the man was reaching for was a hatchet.  The taser didn't get him, he took off running, but only made it about 50 feet.

"He went head-over-heels, hit the ground and we were on top of him like that, he kept trying to fight and flail, basically where he was until cops got here,” said VanBrocklin.

Sanderson says with the amount of crime that goes on here, they have to rely on each other.

“We cover each other’s back all the time, you gotta, you ain't got close neighbors like that who ya got,” said VanBrocklin.

Dave says he's not a vigilante, just a citizen, who’s frustrated.

The incident is under investigation. Police took Sanderson’s taser and the prosecutor's office will decide if he will be charged for deploying it.

I have had the taser since 1999. They gave it back 2/27/2012 Almost a month later..No Charges on me. They have brought charges against the crook. All misdemeanors??? The event happened 2/3/2012 Crook got out 2/6/2012 NO CHARGES. They kept my nonlethal weapon for almost a month?? The US Courts say that a Taser is an "ARM" and is protected by US Constitution and Article 1 Sec 24 Wa State Constitution.. They spent more time looking at charging me than getting on with charging the crook that was gonna split me open with a hatchet, had .2 witnesses...We shall see.. Victims and Witnesses do have rights.... Tacoma doesn't seem to think so...No protection order??? Wonder if they gave him the hatchet back when they released him? They won't tell me...??? Been in Tacoma since 1994... Have had many many problems, Cars stolen, House burlarized, atempted home invasions...etc etc Always the same nothing??? Getting sick and tired...

The police will bring ridicule upon themselves if they charge this man for using a taser on the thief. I hope they drop that scenario and get on with the business of charging the thief. Chances are if a police officer had cornered the man and he started reaching for a hatchet they would have used something stronger on him than a taser anyway.

Police took this man's taser, what about the guy trying to break into car. He had a hatchet! That hatchet would have killed somebody. This man should Not be charged!!!!!!

@ Kinky. He will never get the taser back. Once the police steal your weapon they never give it back. They probably won't charge him because they know that a jury would never convict him in Tacoma. If they thought they could get a conviction, they would charge him.

josefina, you hit the nail on the head. Too bad there isn't an understanding with the cops that the victim basically goes free, even if the thief got his head bashed in.

Come on folks, King5 is just spinning words to get more attention for a story. There is no way this guy gets charged. They know this will fire people up, so they include the little undecided line in the end of the story so we keep checking back for an update...it drives traffic back to the site. It's marketing, full stop. The taser will be held for some amount of time, then given back. There's really no story here, except for the part where neighbors do a fantastic job of watching out for each other and having the courage to act against the bad, dark, illegal element of society. Kudos to all those who got involved.

Washington needs the Castle Law. Considering charges for the VICTIM? You have got to be kidding! I'm from Texas and if the bumbling thief tried to steal a car there, he would have been shot dead. It's what I miss most about my former state. The ability to protect your own darn property. Too many do-gooders here. Sad.

Unfortunately, this could lead to situations where captured criminals simply disappear. It will be too dangerous to call the police--as in many nations.

This is neighborhood watch in full implementation. I guess if taser is not appropriate then German Shepherd is. This is EXACTLY what needs to happen sans the protection of the thief via the "justice system".

Whenever the innocent victim defends himself, the police come and steal your taser, gun or knife, or whatever you use to defend yourself. They many times arrest you for defending yourself as well. The police position seems to be that only they have a right to protect themselves. Victims have no rights to self defense. They want you to just call the police so they can show up an hour later after the thief and aggressor has gotten away.

The police took the taser...what were they doing while this was going down? Donuts? Incompetence, yeah that's the word. I wasn't there; I didn't get to use my magic badge, you citizens caught the bad guy so my job now is to arrest you. Nice.

This is why we need castle domain law in Washington.

I agree, tasers are overrated; OC is a better nonlethal weapon, IMO...just watch for sprayback, etc. But an Axe/hatchet vs taser, I'd ideally rather just grab a shotgun w/ rotating rounds of buckshot and slugs, then a pistol, them baseball bat....in that order, whatever I can grab the quickest... So to the victim of the crime the moral of the story is to just grab a gun because you could have gotten killed.

Sounds like these neighborhood watch folks need to be drawing the wages of the Tacoma Police Department.

If he had used a gun, the idiots would be asking why he couldn't have used a tazer.

"The taser didn't get him." Tasers FREQUENTLY won't "get" the perp and are legendary for their ineffectiveness for a wide variety of reasons under all conditions. Criminals and thugs know this, so if you corner a burglar and attempt to hold him for the cops with a drawn taser, the perp sees what you've got and knows that he has an excellent chance of getting away, and beating you bloody with the taser as well. Now the perp is in custody, thanks to him tripping over his own feet and having numerous neighbors sit on him, not because of the taser. If he serves any time at all it will be a short sentence and he'll be out again soon, and he and his homies will be wanting to exact their revenge upon the neighborhood that thinks a taser is adequate protection. He failed to obey commands, made threatening movements and presented himself as an immediate danger to the community. If one or more of the neighbors had shot him dead they would have been entirely justified.

Sounds like the liberal cops need to be beaten with the weapon, the criminal deserved it. As a homeowner and taxpayer I am against anyone except the prowler being charged. Ill be checking up on this story to sway my votes in the near future. I am sure a lot of people feel that way. So think long and hard Mr Prosecutors.

Wow, your cops over there are absolute morons for disarming law abiding citizens. Maybe the next time a Tacoma cop uses a taser on a criminal, the public should have the authority to take it from them, and bar them from it's posession until a grand jury selected by the public decides if the cop did the right thing. In such cases, the cop does not get to go out on "paid reward" for his questionable behavior (labor union for gov't peeps = job protection for people with bad behaviors), he get to go to work with no taser or he get's time off with NO pay. The world is getting pretty goofy, it's even worse when good people are forced to fear prosecution for defending themselves and/or their property themselves.

When are people going to learn that u can't defend your property, u just have to hand over the keys to the thief or just leave your home open so that the thief doesn't get hurt..... Bet the prosecutor's office makes an example out of Dave and makes him the criminal...... good luck Dave......
