SEATTLE -- Seattle's self-proclaimed crime-fighting super hero is out of work Wednesday night.

He's still fighting crime, but Phoenix Jones is no longer working with kids with special needs and he says they are the ones who will suffer.
 
Most of us know Phoenix Jones on the street, fighting crime and in the dark.  But his day job shows a much different character.
 
"I teach basic life skills to autistic children," said Jones.  "Stuff like balancing a checkbook, if you want to go shopping at the mall, how to figure out how much money to spend, how to balance money for the entire month, how to survive with your autism that you have."
 
Phoenix Jones has worked for a company contracted by DSHS for the past five years, until last week, when he got a letter from the state.
 
"It basically just said that effectively immediately, I was no longer able to work with disabled or autistic children," said Jones.  'The reason is because I was put on a list of people who interject themselves into dangerous situations and some government agency put me on that list."
 
The 23-year-old says because he is being investigated in an assault case, that falls under the DSHS Secretary's List of Crimes and Negative Actions that disqualifies him from working with developmentally disabled children and adults.
 
It all stemmed from this incident last month when the masked superhero tried to break up a fight by dispersing a can of pepper spray on a crowd.  He was arrested for assault.  But no charges have been filed against him and Phoenix Jones says losing his job isn't fair.
 
"I feel like it's an unjust characterization of me. In five years I haven't had one complaint from any of the people I've worked with," said Jones.
   
Phoenix Jones says he'll be patrolling the streets as a superhero during the day, until he can find a new job.  And he hopes that will be soon because he says he has a family to support.

Thomas Shapley Public Affairs Senior Director Department of Social and Health Services said DSHS did not extend Fodor’s contract at that time. If he is not convicted of the assault, Fodor can request that his contract status be reinstated. Excuse me Mr.Shapley but he wasn't even charged with a crime. So you are saying that the officers decision to arrest him was all it took? Even if he is NOT charged? Officers in this city have made up reasons to arrest people all the time. They are called attitude arrests and they are illegal. Are you saying that every employee who is arrested but not charged will have their contracts cancelled?

Ben Fodor, also known as Phoenix Jones, is not and has never been employed by the Washington Department of Social and Health Services. Fodor worked as home-care provider. He contracted out to provide services to DSHS clients. His contract came up for renewal in October. A routine background check – a requirement for working with vulnerable clients -- showed Fodor had been arrested for assault. An assault conviction disqualifies people from working with vulnerable adults and children. Their safety and security are top priorities for DSHS. Because of the arrest, DSHS did not extend Fodor’s contract at that time. If he is not convicted of the assault, Fodor can request that his contract status be reinstated. @hewhoo: I resent that comment. I have several autistic relatives, all who express themselves JUST fine. They might do it a little differently than how you or I might do something, but the point gets across nonetheless and parents of autistic children tend to be very attentive and aware of how their children are treated. I don't think Mr. Jones should have lost his job either.

Being a mother of an autistic child, I know that two of the most important things needed to help these children is a charismatic carter and a real desire to help. It is possible that DSHS just got rid of one of there biggest assets in helping these kids. Its clear that Mr. Phoenix has some social abnormalities, he seems to real care, so it gives this man some common ground to work with children that suffer as social misfits.

where is daddy? i often hear that black children disproportionatly have no father or male role model in their life. instead of roaming the streets in the middle of the night to protect drunken fools from each other's childishness, why are you not at home protecting and being available for YOUR family Ben? You decided to sign up for adulthood at a young age, you need to now own up to the responsibility you commited to. Your selfish immature need for attention needs to be put in the backseat so you don't get yourself killed, and more importantly leave your little kid with no father. Time to grow up Ben.

What an idiot. I wouldn't let this whacko anywhere my children. Sorry, dressing up like batman and running around at night "fighting crime" doesn't instill a picture of sanity in my mind...I can't believe the seattle police let him operate, you cannot take the law into your own hands, especially dressed up like a fictonal character...

How do you blame DSHS for this? This guy is a ticking time bomb!! He has some major issues with self entitlement, in all honesty. How many other self-proclaimed martyrs do you see in this society?? Too many to count!!! how many dress up like BatMan and roam the streets looking for action?? Not many. Novelty is not public safety.

RightorWrong, you forgot that wonderful SPD officer who just plowed into some cars while smelling highly of intoxicants and six empty alcohol bottles in his POLICE vehicle who has not been fired. More than likely not even given a strong lecture because it would make his union rep really angry. What Mr. Phoenix does on his own time is his own business.

We have a Judge and the Schools Superintendent who get DUI and they keep their jobs. DSHS needs to be abolished and something new in their place. I forgot that we are innocent till proved guilty -- oops got to charge him first.

I think the question we need to ask is, If Phoenix was walking around in blue jeans and a T shirt with neighbor hood watch screen printed on it would he have gotten fired / arrested? I'm pretty sure we all know the answer to that. This has nothing to with maintain rule of law and preventing Vigilante justice. This is the government enforcing social policy on what is "normal". Any one bulling phoenix for looking / acting different should be ashamed.

I don't know about the whole wearing a suit thing, etc. but I know this...what you have here is a guy who seems to want to help people and goes above and beyond to do so then gets penalized for it. I dunno? It sounds like the state found a really good excuse to lay a guy off in a time when there is a budget crisis to me. They could say "this guy did it to himself" (essentially) then just not fill his job.

I believe Washington is an "at will" employment state...which means Mr Jones has no "right" to a job. He can be let go whenever and for any reason at all. Just like you are allowed to quit a job whenever and for any reason. Most employers would like their employees to exhibit normal behaviour when away from the job. Mr Jones certainly does not. Is he dangerous to kids? - mayby not. But it doesn't matter. Unless Paul Allen or somebody else want to pay him to fight crime, perhaps he should grow up and leave the crime fighting to the professionals.
