Prosecutors use conspiracy law in Tacoma gang case

TACOMA, Wash. - A 35-year-old state law is being used as a new weapon by Pierce County authorities in their battle against Tacoma's Hilltop Crips gang.

Earlier this month, criminal conspiracy charges were filed against 32 alleged gang members. County Prosecuting Attorney Mark Lindquist said it might be the first time that the law has been used "to go after gang crimes on this scale."

"What we're charging is that when you join a gang, you're joining a conspiracy to commit crimes and taking a substantial step in that direction," Lindquist told a news conference last week.

The law says it's conspiracy when someone agrees with at least one other person to commit a crime, and steps are then taken toward doing so. A person can be convicted even if he or she does not take part in the actual crime.

A conviction carries a sentence of up to 10 years in prison -- much longer than the sentence for a conviction on car theft or burglary charges that some of the alleged gang members also face.

Lindquist said the conspiracy prosecution is based on efforts in other states, including Florida, where a nearly three-year effort to stamp out gangs using state racketeering and conspiracy laws has seen some success.

"It's a hell of a hammer," said Thomas Smith, an assistant chief statewide prosecutor in Florida. "We've done it all over the state."

Smith told The News Tribune of Tacoma that Florida officials estimate more than 100 gang members there have convicted over the past three years by targeting them with such laws.

"They all commit crimes individually, so to take them out one at a time takes awhile," Smith said. "Under the racketeering and racketeering conspiracy laws, one of them deals cocaine, they're all impugned."

Public defenders who represented the 32 Tacoma men at their arraignments have filed motions that prosecutors turn over a detailed list of the facts supporting the alleged conspiracy and the role individual defendants are accused of having played.

Tacoma defense attorney Wayne Fricke, who has defended clients against federal conspiracy charges, said Washington state prosecutors likely haven't pursued similar cases up to now because they take a long time to put together.

It's often easier, faster and cheaper to prosecute for individual crimes rather than make a conspiracy case, Fricke said.

Most of the 32 men arrested are black, but local officials, including Lindquist and Tacoma Police Chief Don Ramsdell, have said the gang was targeted solely because it is one of the most violent and active in Tacoma.

Just like any large city Tacoma has its bad areas and its good areas. Tacoma wasn't on any list of the most dangerous cities I found. Yakima was on the list but not Tacoma. I also didn't see any Washington city on any of the lists of safest cities either.

tacomaroger - I appreciate your contribution. Please forgive my outburst of anger towards dog owners that constantly break the law in regards to noise ordinances. I'm in Belltown. My girlfriend (well, ex-girlfriend) lives in Tacoma and I absolutely refuse to visit her. It's absolutely pathetic. Seriously. Go to the corner of S. M Street just before it crosses 16 highway and you can hear dogs barking for 7 to 8 hours on any given night or day. There are people in the neighborhood that are struggling in relationships due to this problem. Cops came out 7 or 8 times because several couples were fighting due to frustration with the situation. This is a bad situation and I choose to stay in Belltown. If anyone breaks into my place in Belltown, they better make sure that I'm not at home. Otherwise I have a 357 Magnum that is very bored. Thanks for your observation tacomaroger. I was just venting. I studied hard for a law degree to avoid the need for violence. I'm going back to Tel Aviv soon.

It's getting to the point, here in Tacoma, that crime against law abiding citizens is coming to a boiling point. So much so that my wife and I are seriously considering arming ourselves. I hope this action helps, because I don't really want to use my military training to protect my family. Mr. Constantine; I am so proud of the fact that you are the most law abiding citizen in Tacoma, that you've never broken the law, never speed, always stop at crosswalks, or anything at all. Oh, I'm sorry, what's that saying "let he without sin cast the first stone". Well, Mr Constantine, allow me to tell you that my 2 shepards are keeping me and my family safe in our neighborhood. With the attitude that you have against dog owners and dogs, I'd say you are a prime candidate to be a victim of a home invasion. As for destroying Tacoma! Please feel free to leave anytime you like! I won't stop you!

Regardless to how many Crips that they lock up, Tacoma is still going to be a hell hole. Tacoma is by far the WORST place that I've ever been to in the US and overseas. I wish that a major earthquake would completely destroy Tacoma and kill all of the people that have dogs that constantly bark in Tacoma. I hope that Tacoma dog owners burn in HELL for eternity. Too bad that Maurice Clemmons didn't take his rage out on dog owners with dogs that constantly bark. He could have killed thousands of people that need to be dead anyway.
