BREMERTON, Wash. -  Kitsap County prosecutors will not charge three employees of a Bremerton nursing home accused of taking nude cell phone photos of residents.

Deputy Prosecutor Chris Casad told the Kitsap Sun while it appears the employees behaved stupidly it doesn't appear they committed a crime.

Three nursing staff members at the Kitsap Health and Rehabilitation Center in Bremerton were under investigation. They were fired after allegedly taking inappropriate photos of patients on their cell phones, and sharing them as entertainment.

According to the police report, one photo was of "a resident nude in their room." That particular photo was of the patient "bent over, naked, buttocks."

The police report said the victimized patients were not aware of the photos. Some had "severe dementia and would not understand what had occurred." According to the report, one woman who was self-conscious of her weight would be "emotionally crushed" if she knew about them.

One licensed practical nurse told police he and the two others had sent funny pictures to each other but denied taking inappropriate photos of residents.

Bremerton Police investigated it as a case of voyeurism, but a spokesperson for the department said since the photos apparently were not sexually motivated, the staffers may not be charged. Prosecutors apparently agreed.

The state Department of Social and Health Services is still investigating.

The nursing home, which is managed by Evergreen Healthcare, issued a short statement saying they notified the proper authorities and they're conducting their own investigation.

it looks like our leaders, police, and prosecutors are too busy picking on the baristas up in everett. what would any of us expect but utter silliness from the people we pay to and are supposed to uphold the laws.

Note the name: Kitsap Health and Rehabilitation Center in Bremerton Do not place anyone under their care. If someone you know is already a resident of this shameful place then do what is right for your loved ones and move them to another facility.

I think the consenses here is every one is shaking their heads at this horror story. These people should have been charged with a crime. As some have said: Voyerism. Exploiting innocent people with out their consent or knowledge and even if they can't give that consent or have knowledge it is still JUST PLAIN WRONG and if it isn't a crime it SHOULD BE. A pox on the prosecuter. For shame. Everyone here who has commented is appauled.

No charges being filed! That is outragous. These victums had their privacy violated. If these pictures had been taken from outside a window,peeping tom style, there would be charges. What's the difference here? I am sure the picture takers have not heard the last of this,however. If it was someone in my family, I would be talking to an attorney for sure. These 3 should never be allowed to work in the health industry ever again. Good Lord, if you can't trust an LPN,RN,CNA's or any of the rest of the alphabet soup of care takers, who can you trust!

I agree with you bigdaddyof4, they should have a tattoo on their forehead saying how stupid they are!! I also, hope the families do report these creeps. Just imagine if it was YOUR Mom, Dad, Grandma, Grandpa, etc.. I would be on the war path!!!!!

Actually everyone, there is something the families can do about this , they can call and turn them in for abuse to seniors with disabilities, and assault also because they have different laws, they investigate you for any type of charge or acusation toward a senior and find you guilty you lose you license and it shows up on a background check weather you are charged or not, keeping them from getting another job in this field or others like it so can not do this to another helpless person, just cause they didn't understand what happen to them does mean the accused shouldn't have been charged.

Are you kidding me!!! This is voyeurism, what in the h.. is the difference between taking photos of people like this and taking photos naked photos of other people w/o permission or knowledge. Prosecutors can be fired and should be fired over this

RCW 9A .44.115 (2) A person commits the crime of voyeurism if, for the purpose of arousing or gratifying the sexual desire of any person, he or she knowingly views, photographs, or films: (a) Another person without that person's knowledge and consent while the person being viewed, photographed, or filmed is in a place where he or she would have a reasonable expectation of privacy; or (b) The intimate areas of another person without that person's knowledge and consent and under circumstances where the person has a reasonable expectation of privacy, whether in a public or private place. OK so I guess we need to change the law to protect the innocent victims yet again! Becuase these employees that are trusted with these clients didn't take the pictuers for "the purpose of arousing or gratifying the sexual desire of any person" they can't be charged with voyeurism! WOW!

ok so i know from experience that if it was anywhere else they would have pressed charges. But since it is this one nursing home they are not going to press charges this is stupid. This nursing home has done so much wrong in the last few years i do not see how they can still even be in business. Also i think that they should not only have charges brought against them but have there licenses taken away and never be able to work ever again as anything that deals with people. What would they have done if it was pictures of them that people were using for enterainment they would be like i want to press charges and so on and so forth. I think kitsap county needs to be investigated to know what is going through there heads and why arent they pressing charges, If it was my family that this happened to i would be like i want to press charges or i would pull my family out of that nursing home. Need less to say they should be shut down and never open again!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

So... let me get this straight? These guys intentionally took pictures of nude people, some who are not all there... and it's not a crime. A 14 year old recieves a picture from a girl (of herself), and forwards it... and he potentially has to register as a sex offender for the rest of his life? This is one stupid judicial system we have.

Let me get this straight....Their behavior was "stupid" but "not a crime"????? How so? Even if the patients had no memory or knew of the incident it is still just common decency to treat people with dignity. If that were a relative of mine I would be outraged that they would have been treated in such a degrading and humiliating manner. These are human beings, not just some animal they did this to. All for fun and games. Shame on them. Shame on the police dept. and shame on the County Prosecutor. The perpetrators deserved to be fired. People need to be treated in a more humane way even if they do have dementia or Alzheimers and aren't aware of the way others are treating them. That could be the perpetrators someday. How would they feel if someone did that to them and was laughing at their expense??? I am horrified that this was taken so lightly by the Prosecutor like this. Am I the only one who thinks like this????

Thats just wrong. The patients didnt know! Its just wrong . So your telling people that they can just go to anyone and get them naked and take photos of there buttocks and share that with anone they want? What is this world coming to.
