Mom charged in sons' deaths after monster truck show

TACOMA, Wash. - Pierce County prosecutors have charged a 41-year-old mother whose sons were killed in a collision after a monster truck show with vehicular homicide.

The accident happened back in January in Tacoma.

Prosecutors say Jayme Lynn Davis had been drinking when she took a corner too wide, went over a concrete lane divider and headed into oncoming traffic on Bay Street.

Her sons, ages 8 and 11, were taken to area hospitals and died shortly after the accident.

Davis reportedly told police she'd had a few beers at the monster truck show.  

Toxicology lab results revealed David had a blood alcohol level of .07 at the time of the accident.

you people don't know. She only had the boys she gave birth to every other weekend. She was not in their lives at all. She only did what the courts ordered her to do. SHE HAD A BLOOD ALCOHOL LEVEL OF .O7 3 HOURS AFTER THE MURDER OF HER FIRST BOY. There is a reason the Prosecutor put in the charges of HOMICIDE. If it was an "accident" then he would not be prosecuting. DUH! Do not feel sorry for Jayme... She has not taken responsibilty for her actions... she has blamed everything and everybody else for this horrible event. Do you people even know how many people/lives she has destroyed? She is not living with anything. What has she had to deal with. Nothing. Does she have kids come to her door crying? Does she run into families at the store/restuarants/every day life that have been impacted by her? Did she sign paper at the hospital. Is she dealing with the $150,000.00 hospital bill. Did she deal with the funeral home, the arrrangements? Does she even know where the boys are?

You people can make all your judgements. You do not know the facts. You were not there. .07 blood alcholol was 3 hrs after she murdered her first boy."They" were not her children. She only gave birth to them. That does not make you a "MOM" Just because you are divorced does not mean you are divorced from your children, unless you choose to be. There is a reason the father had "Full" custody. She signed her rights away. There are reasons why she had monitored visitations. She was not a good mother. How many times did she play Melinda against Kylee? How many times did she drop Melinda off because she didn't want to deal with the drama that "she"(Jayme) created. What about the times she didn't want to deal with Kylee? How about the times the "boys Jordan and Jared would beg not to have to go to the birth mother. Why didn't she envolve herslelf with the children she gave birth to. She just walked away. She did not follow the court ordered rules. Action speak louder than words Jayme

I have known Jayme since the day she was born. Her children were her life. She would not put them at risk. Jayme is suffering a horrible loss as well as her mom, sister, brother, aunts, uncles, cousins and friends. We support her, not judge her .

i do not know all the decimal points for driving after drinking vs the legal system definition . i do know that a whole lot of suffering is going on due to this tragedy . perhaps no alcohol should be allowed where children are --just like in a bar . on second thought how do you really moniter under the influence ? drugs , sleep deprivation , stress ?? in this case i see room for compassion .

I would like to just state that yes .07 is not over the legal limit but you got to also think .07 can have different effects on different people. She may of had only two or three beers but that can either make her really buzzed or not effect her at all. Also it says shes being charged with vehicular homicide. The crappy part about that is even if it is just a car accident no alcohol or anything involved just simply a car accident happened you can be charged with vehicular homicide. I am sure the mother of the two boys didn't mean for it to happen.

Please disregard my previous posting regarding this issue. I was half sleep at the time of posting. I don't know what I was thinking... I'm just saying that this is the 3rd or 4th incident that ended with kids being hurt or killed after leaving or while attending a monster truck rally. Is monster truck shows still a RedNeck sport for RedNecks only? Not sure...

Yeah, I agree mentioning "Monster Truck Show" in the headlines was just to grab attention. Would the headline ever read " Mom charged in sons' deaths after sexual affair with neighbor who lived across town" or "Mom charged in sons' deaths after viewing images of driving fast at local theater"? Nope! OOOOHHHHHHH! Monster truck shows are dangerous to our children! We gotta do something, for the children! It's for the children! Last time I checked, the Catholic Church (and all those fine child abusing priests) has done more damage to children than "Monster Truck" shows.....

rainydave - Duh! She tore out of the parking lot of the Tacoma Dome after watching monster trucks do so... Drinking alcohol made her think that she could do what the monster trucks do. Boy was she wrong.... Crash!

Hmmm, so since .07 is pretty much .08, why not just make the limit .07, but since that is pretty much the same as .06, why not make that the limit? Or .05, or.01, why not make it illegal to drive a car with 2 weeks of passing in front of a bar or 2 months of drinking a beer... .08 is very low, it used to be .1...

Bottom line, when you are a parent, it is your responsibility to make sure your children are safe. If it is rainy and foggy, you slow down. Just because a speed limit is posted, doesn't mean it is safe to drive that limit. You stay off the cell phone. No phone call is more important than your children. If you are the chauffer, you don't drink. Are a few beers more important than a childs life? No. Unfortunately, some people become over-confident about their abilites and in this case, two innocent little boys paid the price.

I am very much against drunk driving, but there are really no facts here. "She took a corner too wide", driving fast, distracted by her kids, tired, on the cell phone, etc. There are no conclusions other than she is charged, was responsible, and is being prosecuted. Being a poor driver might be the reason here kids are dead but charged with vehicular homicide? She is not a threat to society, she should not be charged.

This lady got what she deserved. Drinking any amount of alcohol and then driving is stupid. Be smart designate a driver or call a cab and save a life.

Mom's "Job" is to keep her kids alive. But really, I don't think she understands "no drinking on the job." That goes for everybody. The courts give a curve on the test results, also, the amount of time till the breathalizer test is taken. so she is getting a big break as it is.

I wouldn't let my kids near a Monster Truck rally after hearing about all the incidents at those shows. Anyone remember that little boy that had part of his head taken off last year.

Apparently some of you are not thinking very well. Yes, a person's impairment can be subjective but many studies have shown that a BAC of 0.08 makes a person a threat to everyone when driving. Since 0.07 is only 0.01 below the limit she was impaired. None of you would be so cavalier about it if one of your own had been injured or killed.

Blankingout, a BAC 0.07 may be just under the 0.08 limit but for all practical purposes it is at the point of being impaired in judgement, reaction time and coordination. She should not have been behind the wheel. Would your attitude be quite so cavalier if it had been someone in your family that died because of her driving? I think not.

The tragedy of 2 beautiful innocent little boys' lives can never be brought to justice. You people need to pay attention, the mother is NOT being charged with DUI, she is being charged with vehicular homicide, meaning the manner in which she was driving caused the deaths. My heart aches for Jared and Jordan and the family who lost them too soon.

There is zero chance that they got a blood sample "at the time of the accident". There is less than a 50% chance that it was within an hour. .07 could be on the downside from .10 or more at the time of the accident, or it could be peaking from a .04 at the time of the accident. Doesn't really matter anyway. Drinking and driving statistics are a joke. They say that alcohol related accidents increase at night. Duh, more people drink at night. Non alcohol related accidents increase at the same rate after dark. Also, a sober driver that crashes his car with a drunk person in the car is also an alcohol related accident because they would not have been on the road if not for the party. Hey, if it helps with your numbers!

.07 may not meet the legal level for drunk driving, but it is driving impaired. No matter the weather, if she was driving impaired, she took a chance with her kids' lives and lost. Too sad - not something she'll ever get over, whether she serves any time or not.

People, the story never said the prosecutors is charging her with drunk driving, but stated she had been drinking before the accident. I believe just careless and/or reckless driving resulting in accidents causing deaths could be reason enough for the prosecutors to level a vehicular homicide charge against this lady; drunk or otherwise. Like it or not, I think they (prosecutors and media) like to include the alcohol factor whenever it comes up in these cases.

I agree with not being okay to drive around drunk with kids, but parents should have the right to have a beer or two over the course of what I am guessing was a several-hours-long Monster truck thingy (how else would you be able to tolerate it?)... .07 is not drunk, its not even buzzed...

She didn't 'loose' her children.. she slaughtered them herself. This piece of drunk filth needs to suffer every moment for the rest of her life. I wouldn't shed a tear if they found her swinging from the ceiling fan. Those poor children didn't deserve such a horrible death at the hands of someone that is supposed to take care of them. I hope she hears the screams in her head till the day she finally dies...and the first one to come and say what a kind and loving person she is and 'she didn't really have that much to drink' can bite me ..her actions have proven that she's nothing but a selfish, self-centered cow that has no right to the air that we breathe. .. but lucky her.. she lives in WA state.. where we pamper our drunk drivers. She'll be out on the road in no time..punched license or not.

The legal limit is interruptive so one cop can charge you where another might not. The .08 limit is the DUI limit for Driving while intoxicated. Driving under the influence can be one beer. there is BWI which is driving while intoxicated and DUI driving under the influence, and since people died it is homicide becuase she had some alcohol in her system, I dont think anyone should drink a beer then drive espcially in front of their childern

It does not matter if you have had 1 beer or 20! One beer impares your ability to drive. People who dont agree with that are dumb. Also the people who think they drive better while drunk... not smart. People here don't care about the kids who lost there lives, they care about how many beers you should have to be drunk. It is selfish and stupid. Hopefully its not your kids next in the backseat of your car.

Why does Mr. or Mrs. make any difference. Is it ok to to drink and drive with children in your car. NO. It is not ok to drink and drive period but with adults they can make their own decision to be in the car with you or not.

I agree with blanking out... .07 is not drunk, not at all... This is a calous move by the Tacoma Police... I say throw the book at drunk drivers, but the limit is .08, and even that is pretty low...

0.07, that's not drunk! Besides she has lost two kids... isn't punishment enough for Ms. David? Weather that day was foggy and rain, it's easy to miss a turn. Course I am being forgiving because we are talking about Ms. David... if MR. David were driving, I'd be with the state bias against men and say lock that scumbag up for 20 years!
