SEATTLE, Wash. – A SeaTac, Wash. man who has been reported missing for nearly two years has been found alive, living under an assumed name.

Nicholas Francisco was last seen leaving his job at an ad agency in Seattle's Queen Anne neighborhood on Feb. 13, 2008. His car was found a few days later, abandoned outside a condominium complex in Federal Way, Wash.

Less than a month after his disappearance, detectives scaled back their investigation because they could not find any evidence of foul play. At the same time, Francisco's pregnant wife Christine said she believed her husband was murdered. Convinced Nicholas wouldn't abandon her or their two kids, Christine did numerous media interviews asking for the public's help.

Christine divorced him several months after his disappearance.

Tonight, Laura Collins, his former mother-in-law, called the new developments "disturbing" and said "his kids are the ones being hurt the most."

The King County Sheriff's Office says detectives uncovered information last week that Francisco is alive and living outside of Washington under a new name. Detectives won't say what state he is in.

Despite all the man hours police and volunteers put in to find him, the sheriff's office says Nicholas has not committed a crime in disappearing.

"Certainly there's a moral obligation. There's a moral obligation to not run out on your wife and your kids, much less the police department and the work we have to put in. But is there a legal obligation? No. People are free to run away, to disappear if they want to," said Sgt. John Urquhart, King County Sheriff's Office spokesman.

Urquhart says Nicholas also has the right to privacy, so detectives won't be disclosing any more information about him.

The case is now closed.

If he was in the Military then he would have broken a law though. Maybe he found out he's not straight?

you have to wait seven years before you can declare someone dead. Not a good way to make fast money. It is ridiculous to blame the wife.

shoreline, I think you are 100% correct. State should get info from police and make this guy pay child support, easy enough to find if wife involved but since it was not a crime doubt if there will be any police follow up.

bigdaddyof4, stop standing up for this creep, you sound like one too assuming the wife was at fault. He's the one who walked away, changed his name and left his children fatherless. I'm glad she found someone else and now hope she goes after back child support, it's the least he owes his children.

Geez King5 and you folks commenting! There is obviously more to this story than what has been reported! First she wants him declared dead, and a few months later divorces him? Guess she couldn't cash in on the Life Insurance or Social Security bene's afterall? Suppose the two kids and the one in the oven were from an extramarital relationship(s)? I don't know, and based on the given info, none of us do! King 5 put this story out with so little info it didn't justify even being reported unless they dig a little deeper. Must have needed a 15-30 second filler yesterday, huh? There is one accurate comment though! Grandma saying the kids are the ones who are being hurt the most.

He hasn't committed any crimes? What about abandoning his pregnant wife and two kids? Aren't there laws against abandoning your kids? And their protecting his right to privacy? Don't the kids have any rights? What about the pregnant wife he abandoned? Think of the incredible stress she suffered, which, btw, affects the unborn child. There's no accountability? What kind of a world are we living in?

His wife and and family have every right to know. In washington state there is a law against dead beat fathers that keeps them from leaving the state if they have not paid child support.

Maybe he and his wife were in on the scam so they could collect some life insurance once she had him declared dead?

This guy is a poor excuse for a human being. He has no right to treat his then wife that way or his two children. He has not seen child #3 but should be made to pay adequate child support for all three and spousal support for his ex-wife. She is lucky to be rid of him but it was a cruel way for him to disappear and bring fear to his family and friends. He sounds like he is a brick short of a load or crazy like a fox. It is too bad that law enforcement can't charge him with something. I hope the ex-wife continues to have solid support and is able to move on with her life. Perhaps there is a fund where donations can be sent if she needs help.

What a cretin. But why are they keeping his new location a secret? Are they afraid his former wife will track him down?
