Mercer Island's underage drinking law goes into effect Friday

MERCER ISLAND, Wash. -- Starting on Friday, Mercer Island parents and homeowners will be held responsible for underage drinking at their homes, even if they are out of town and unaware it is happening.

The recently passed "social host" ordinance is believed to be the first of its kind in the state and some are hoping the idea will spread across Washington. Starting on Jan. 13, people who own, rent or lease property where teenage drinking happens can be fined $250.

"This ordinance sends a message that our parents too need to be responsible," said Derek Franklin with Communities that Care Coalition on Mercer Island.

The coalition helped spearhead the new ordinance. Franklin believes the vast majority of parents on Mercer Island are responsible, but they're targeting the 5% percent who allow underage drinking and parties at their homes. But Franklin said underage drinking is a real problem. He points to a survey on Mercer Island that found 44% of high school seniors admitted they drank in the past 30 days.

Some parents have complained the new law is too heavy handed, but supporters disagree.

"I think it comes back to the fact that 44% of our kids are still drinking. It's not safe. We know from a public health perspective that kids drinking alcohol can have permanent damage. It's the number one killer associated with deaths among kids in the United States," said Franklin.

Under the new law, the person who's house is being used for underage drinking could be a cited by police and have to pay a fine of $250, regardless of whether or not that person permitted drinking in their home.

But some parents feel the $250 is too expensive.

"It's pretty high. Someone would have to call the cops for that to happen. I could see people maybe taking chances," said Rebecca Lane, a parent.

"I think the sooner the better, because maybe a few parents will say we can't do that because we don't want that fine," said Kathi Coski, a grandparent who lost a child to a drunk driver.

Mercer Island police say the citation would be a civil infraction equivalent to a speeding ticket. On a scale, it's a penalty that's below a misdemeanor.

Simple if you do not want drinking of alcohol don't ever start!!!!!!!!!!! The people of Washington should have said no to I-1183 in order for this law to work effectively. We are going to pay dearly come Summer - more deaths than ever before is coming. The reaper is coming. Ravanah the Devil is coming. Rape, murder, more auto deaths, high crime, all on account of our beloved govenor believing that drinking alcoholic beverages and same sex marriages should always be socially accepted at all costs! She claims she's Christian --> I think not! Jesus nor God would have accepted these laws because they all break the laws of nature. When you break the laws of nature --> You pay dearly in the end. I feel sorry for our state and I am already crying for those who will die and for those who will be hurt and those who will lose all on account of one persons own selfish decision to get her own way --> Ms. Christine Gregiore. As a teen myself, I know how prevalent teen drinking is and how dangerous it can be. I just want to say I appreciate someone trying to make a difference in such a difficult issue to tackle. I know that to a parent or home owner this might appear unfair or even ridiculous, but please keep in mind this legislation is not put in place to persecute you. It is intended to encourage parents to take all possible precautions against teen drinking. I hope that parents will see this as an opportunity to discuss drinking with their kids (whether to forbid it or explain safe ways of doing it, it is not my place to say) and to take the extra step of locking up alcohol and asking a neighbor to keep an eye on the house while they are away. If you know you have taken every precaution and are still worried, perhaps let your child know they will have to pay you back if they host a party at your house, this will act as a discouragement to unwanted behavior. Please keep an open mind to this law! Thanks.

When my daughter was 16, she attended a party at the home of a wealthy family where the parent was present and turned a blind eye. When Amy ended up with alcohol poisoning, 25 kids fled the scene under the influence while the mother chose not to seek medical attention or notify me of my daughter's condition. Two years later, a classmate was killed in a racing accident while riding in a car driven by her best friend. They had just left a party hosted by a popular football player who had led others in denying their involvement in my daughter's incident. So Wolves50, you need to realize that when parents supply my child with a "safe" place to drink without my consent, they are the ones imposing their values and dipping their beaks in our family business. A responsible parent would use this as an opportunity to engage in dialogue, get help if necessary, and teach the teen accountability by making him/her pay. Consider the fine a donation to offset the high costs of underage drinking.

I think that's a great idea...but I will say that the fine isn't enough. Even if my kids when they grew up and stuff did that I would expect a more hefty fine then a slap on the wrist. I mean come on.

Great idea - it's about time that politicians follow proven prevention practices and take underage drinking seriously. When drinking happens in homes - parents give it a wink. I'm tired of kids getting in cars after they've had too much to drink and then hitting other drivers and hurting someone. More infuriating is having parents come to the door drunk when officers show up a house where underage drinking is going on. The number of parents that allow drinking in their homes is low - they are not victims - they know their kids drink at home......Get real people - we need to figure out how to stop kids hurting their brains, getting in accidents, and causing injuries. The social and economic costs of underage drinking are in the billions - we won't even see some of the damage until the end of someone's lifelong struggle with alcohol. If you are a parent - figure out how to make this work: for your kids sake and the sake of others on the roads and elsewhere.

One legal challenge by a Mercer Island parent with legal connections and the law will probably not be around very long... alternatively, the parents can just vote out the jokers who passed this law and put someone else in who will repeal it and, maybe, invest resources into things that DO make a difference, like education and public outreach efforts to the parents and kids. Otherwise, we might as well start just having parents fined or arrested on Mercer Island for any other of their kids' indiscretions that they may or (most likely) may not know about.

If they think this law will decrease teen drinking they should think again. It's not the parents' responsibility if they don't know about it. The teens know what they are doing with their actions. And more than 44% of teens drink. Instead of thinking that teens will stop drinking, perhaps people can actually teach their kids of responsible drinking (such as having a DD, or staying the night). DERP!!!!

this is just another red light law, you rent out a house and while the renters are out of town the kid next door drinks a beer in there back yard ...they get fined $250.00...its the city councel that is responceable for any law violated inside the city and they should be the ones to pay the fine.....

As a high school kid who drank occasionally, I think this is pure comedy. It just goes to show how far some people will go to dip their beaks into other people's business. It's a pointless law that will in many cases punish people who are completely unaware. Someone just wasted part of their own life in helping craft this law, but also wasted a bunch of other folks time as well. This just goes to show how boring and pathetic some of our lives are becoming.

charleychein, I take responsibility for what my child does, thanks. However, my parents didn't know that when I was 16, I went to a party and had two coolers (and was so afraid my mom would find out, that's the only time I did it). It's kind of something kids do, especially in THIS country where the drinking laws are so strict. You don't see the same problems in countries where parents give their kids a beer or a glass of wine with dinner from the time they're small, because it's *not that big of a deal*. We make it far too big of a deal in this country...which makes it more enticing. I don't drink at all now, and haven't for almost 3 years. But if my kid wants to have a drink, I'm not going to kick him out. I've told him, he can call me any time day or night to come get him if he or his friends drink...just not to EVER get behind the wheel drunk or ride with someone drunk (or high).

That may be but it is also plank #1 in any civil suit filed because of damage or injury that results. It's one thing if the parents knowingly provide alcohol (that's already illegal BTW, its called contributing to the delinquency of a minor) but if the little vermin steal the booze I don't see how you can hold the parents responsible any more than you would if the kid took one of their cars without permission and causes injury or mayhem. This is typical legislation by politicians who want to be seen as "doing something" about crime...never mind if it doesn't actually address the problem, so long as it sounds good in a campaign ad. Just enforce the laws that already exist instead of creating new ones where the ramifications are at best unclear.

franklin you should recheck your facts. car accidents are the number 1 cause of teenage death, and of thoses death only 23 to 30% are alcohol related. you can double check me if you want.

I do not condone underage drinking but I also tell my children if they do decide to drink, do not drive and I will pick u and your friends up. State law says its ok to allow your own children to have a drink at your home just not people outside your family. Also, if I am not home and these kids decide to have a party at my house, then they are responsible and should pay the fine and any damage incurred. I had to pay a $76 dollar jaywalking ticket when I was 12 in 1983. I had to pay for a minor in possession charge when I was 17 in High School, not my parents. Kids need to take responsibility for their own actions and parents need to be 100% engaged with their children to have open communication so when (not if) they make bad choices, they know how to handle them.

I admit I cringed when I first seen that the penilty can be levies against absent home owners, but realy this is the first step to making parents more responsable for their adolesent teenagers. now from 18-19 and even 20 where youare under age, if they host a party their are laws aredy, but a stiff fine helps drive the point home. Being a former party goer starting at 18 I was one of those under age drinkers, but I partied at homes that were rented out. THe landlord could not be punished but the rentrer could. A copy of the citation should be sent to the landord so they know this is going on at their property so they have the option if stated in their agreement to evict for braeking laws. I do hope this law is intended to stop the parents who help sponser these parties beliving they did it too. I have seen the parties held for the college kids, but the grapevine is vast and HS age kids will not be too far behind.

musicfreak... you had the child, accept responsibility for him or give him the boot out the door. if he is no a drinker and follows the rules, no problem then. i didnt drink alcohol until i was in the army. that was at 19, where it was legal in az, and in many other states until the age limit was raised to 21.

its ok to let your pot head kids smoke dope, take take morphine,oxycotton, snort glue at home but not to drink alcohol. this new anti alcohol law is the same as the red light law you loan your car to the judge next door because his is broke down and he runs a red light and you get a ticket. it goes on your record not his,,its its unconstitutional to make some one pay for a crime they did not commit....and the cases will get thrown out of court.

This is ridiculous. I dont understand why people spend so much time and effort to get there children to not do things we all did when we were younger. Drinking is a normal part of teenage life. It is more important for parents to emphasize responsible drinking. When parents act like it is a horrible thing and dont talk to there teenagers about it they have a larger chance of binge drinking or becoming an alcoholic in college or later in life.

It's only January, but we have a clear cut winner for the dumbest new law of the year for 2012. What is it about these "if it saves one child" type laws that cause people to absolutely lose their freaking minds? Even the most responsible parents cannot be responsible for everything that their kids do 24 hours a day. I have no alcohol in my house. So what this law is saying is that one of my kids' friends could steal liquor from his parent's liquor cabinet, bring it to my house, pop it open in my kid's bedroom, and I'm the one that stands to get in trouble? This is just more ridiculous overkill by a group that is carrying their good intentions way too far.

You know, I have a 15 year old. There is no alcohol in my house because I don't drink. If my 15 year old invites some friends over when I'm at work (which he's not supposed to do, but hello, he's 15 years old) and those friends bring alcohol, how in the world would it be fair for me to be fined, as a mother, at work, with a kid whose friends bring alcohol into my house? This is a complete hypothetical, because as far as I know my child doesn't drink, but it's kind of a dumb law.

I would rather have them drinking in the security of a home, instead of out on the streets or in the woods somewhere. They are going to drink anyway, they are teenagers, thats what they do. Its a part of becoming an adult, especially here in america where alcohol is so mainstream. Teach them, supervise them, encourage them to make good decisions, don't pretend there is this alcohol free world out there. Alcohol is everywhere in america, its advertisments are attached to every sporting event and concert, by the time a child is a teen he or she knows the big brands as they are proudly displayed next to our countries' flag. Honesty is the best tool here, not some silly citation. I would gladly pay the 250$ fine, and know my kid and all his friends were safe...

what kind of morons would pass that kind of law you own property and lease it to someone that has a kid, and you get fined??? I guess it would be really nice to live in a place that kids can't be around - hey mabe we could pass a law making it illegal to be under the age of 21 and be on Mercer Is.
