Email reignites controversy surrounding a deputy's use of force

SEATTLE -- An e-mail uncovered by KING 5 reignites the controversy over a King County deputy who used so much force he left an innocent man brain damaged.  The e-mail shows red flags were raised years ago about the deputy's use of force.  But the victim's family didn't know it existed. 

 
The video of Chris Harris being slammed into a wall by King County Sheriff's deputy Matt Paul is deeply disturbing.
 
"They took away the greatest person I ever met in my life," said Chris' wife, Sarah.
 
Harris had been wrongly identified as a suspect in a crime.  The mistake was catastrophic. 
 
"He used to love to eat and cook and eat.  He can't do that.  He's on a feeding tube," said Chris' mother, Sharla Keeling. 
 
In January 2011, almost two years after the near fatal blow, King County paid the Harris family $10 million--money they say is going to care for Chris.   
  
Ten million dollars was a record settlement, yet the sheriff defended her deputy.   
 
"There was no evidence of misconduct on the part of Deputy Paul," said King County Sheriff Rahr.
 
But after we obtained Paul's file and discovered 19 use of force cases and 7 citizen complaints the sheriff ordered more training. 
 
"I do believe he can make some different decisions and I we want him to make some different decisions and we're going to do that," said Sheriff Rahr.
 
But the KING 5 Investigators uncovered more than a pattern of questionable force.  We found evidence the sheriff's office was warned years earlier that Paul was too aggressive. 
            
In 2007, while working at the Basic Law Enforcement Academy he was too rough.  The academy commander waved a red flag.  
 
In an internal e-mail obtained by the KING 5 Investigators, Commander Ron Griffin wrote to Paul's bosses at the sheriff's office warning Paul “exhibited behaviors that were a concern and we no longer wished to use him”.
 
The concerns included using force ”far above the norm” and showing a “macho type demeanor not acceptable to our goals.”   Paul's chief flagged it an early warning indicator that the deputy should be monitored. 
 
When questioned why he wasn't watched more closely, then King County Spokesperson Sgt. John Urquhart said he didn't have an answer.
            
It's not the only answer the Harris family is seeking.  They want to know why they had to learn about that e-mail on KING 5. 
 
They've filed new documents with the court, asking for an additional $3.3 million from King County. 
 
In a court motion filed in support of that request, Harris’s attorney Sim Osborn, argued the e-mail is evidence that the sheriff's office "showed deliberate indifference to Deputy Paul's use of excessive force."
 
The King County Sheriff's office told KING 5 that they did not deliberately conceal the email. 
   
King County has hired an outside attorney, Timothy Gosselin, to represent the Sheriff’s office in the new case. Gosselin told KING 5 “we believe there was a very clear and logical reason for why that document (the e-mail) wasn’t turned over.” The Harris family requested Paul's entire file, but Gosselin said “finding the e-mail was like finding a needle in a haystack.”
 
Now it's up to a judge to decide if King County should pay the additional $3.3 million the Harris family is asking for.  A hearing is set for March 8th in Pierce County Superior Court.

To 4america ... read the article before you spout off. An email stating 19 previous "excessive use of force" had been recorded against Deputy Paul in his file. This file was NEVER given to Mr. Harris' attorney to show further negligence of this nutso deputy. That qualifies as new evidence & by law must be considered by the courts. That this file was kept from Harris' attorney is disgusting & sloppy. This deputy should have been fired long ago. At the very least he should be taken off duty for more than a year & be retrained to follow department procedures.

Sue Rahr's disgraceful leadership has cost this entire county so much financially. two weeks after he put Christopher Harris in a coma (by the way he LIED to paramedics like a child in trouble saying that Christopher ran into the wall) he then slammed a jaywalkers face to the cement. Disgusting!!! When human filth gets a badge everyone pays. I hope Karma finds this pathetic man Matt Paul.

It is unrealistic to think that all of our officers are honorable men and women. While most have the interest of service and protection of it's citizens, there will always be a criminal element such as Matt Paul in the force. What I find so saddening is the unwillingness of the force to police and rid itself of this corrupt element. I take pride in my occupation (professional) and will not tolerate unethical/illegal acts as a matter of course. To me, it's unconscionable that a disgrace such as Mr Paul and countless others we are not aware of, reflect upon your honorable profession so poorly. I ask any officer who may read this why you continue to allow this element to tarnish the trust of our citizens...............

kanajune what is wrong with you. Was he mouthing off. And if he was big deal he doesn't deserve to be almost killed. If a cop can't take verbal abuse he doesn't belong on the force. Words are just that words and if your too thin skinned to ignore them you aren't suited to wear the uniform of a police officer.

Sheriff Rahr being fired and losing her retirement cause thats going to be paid out to all the families that got scewed by her not removing bad cops when the bad cops should have been fired.

So tell me something about the innocent victim please. Did he have a record? Was he mouthing off and threatening the cop? I hate the way the media portrays things so one-sided, when the truth usually lies in a grey area. So many of these "police brutality" stories end up with a lot of pertinent facts about the supposedly innocent victim being left out in order to sell a crisper story. I'd just like the whole story, please.

Why didn't the writer of the email come forward? I am just wondering. If you know you sent an email can't you come forward? If you see testimony being given that you knwo is a lie, that you as a Commander determined he was unfit and you sent an email stating this guy was too violent to be int he field can't you come forward and say so? As an officer of the law don't you have a DUTY to do so?

Sheriff Rahr has to go. She apparently has her own problems and is not fit to hold this office. How can she view the video, be aware of earlier concerns and complaints - and still maintain there is no evidence of misconduct? Please, Pierce County, vote her out!

This is pathetic. What else has been "misplaced" or "destroyed"? I'll never forget the video of Mr Harris being body slammed into that concrete wall. Harris had stopped running totally & facing the Deputy. I think the family should get another $10 million at least. I sincerely applaud the investigative journalists at King5 & KOMO4. They are doing an excellent job uncovering this evidence & police cam files. It's sickening to watch the smugness/smirks of the spokespeople for Sheriff Dept & SPD. And when they do admit that action was "excessive force" & against policy the officer gets to walk. (i.e. Officer Birk killing JohN Williams). If I managed my job like some of these public servants/protectors, I'd have been fired asap.

This is aweful and totally unneccessary. This "suspect" was running toward a concrete wall. He had nowhere to go. Why the push in the first place? I think the Sherrif can keep track of these records just fine. They didn't want this disclosed. What would we do without the media investigating this? We would never know. These are highly compensated individuals and WE are paying them. There is a cultural problem with law enforcement that is very apparent.

There was a time when "WE THE PEOPLE" had control over our goverment officials and those patroling out cities. When will we get back to that type of system so that cops LIke Matt Paul, who are just as much of a problem as those they are supposed to be protecting us from, are taken off the streets and held accountable for their actions

King County can't keep track of their emails and SPD can't find their videos. Let's have a full audit and see if there is anything these agencies can keep track of..
