Amanda Knox facing slander trial; defense crying foul

PERUGIA, Italy – Amanda Knox, the University of Washington exchange student who is serving 26 years for murder in Italy, is about to go on trial on new charges that could extend her sentence.

Knox and her former boyfriend, Raffaele Sollecito, were convicted in December of killing Knox's British roommate Meredith Kercher in 2007.

Even though prosecutor Giuliano Mignini successfully won the murder conviction, he's not satisfied. He's already appealing Knox's sentence, saying she got off too easy and deserves life in prison.

On June 1, Mignini will again be leading the charge against Knox in the same courtroom, this time on slander charges. Mignini says Knox lied when she testified that police beat her during questioning at police headquarters the night of her arrest.

Knox's defense team is crying foul because it was Mignini who oversaw the investigation and interrogation of Knox. They will ask for a new prosecutor.

They are also challenging the judge who ruled against Knox in the pre-trial hearings. They say the judge is biased.

If convicted of slander, Knox could face an additional six years in prison and a hefty fine.

Perugia is also abuzz about a possible new witness surfacing in the case. He's a prisoner who claims to know who Kercher's real killer is and where the murder weapon was hidden. A similar claim was made recently by a convicted child killer. He said Rude Guede, the Ivory Coast man convicted in Kercher's slaying, confessed that he had acted alone and the Knox and Sollecito weren't even there.

Amanda didn't kill Meredith, and this is why her family wants desperately to bring her home. You'd want to do the same if your daughter/sister/friend was unjustly convicted. Find out all you can before you decide that the cops and prosecutor are the "good guys" who must have had reason beyond a shadow of a doubt to send this girl to prison. This is just some advice for anyone who visits a foreign country. Do not hang around shady people. Try not to use drugs. If you are on trial for murder, do not mock the system by doing cartwheels. Whether she is guilty or not, this stupid girl brought this upon herself. You have to be a complete idiot to behave that way in a foreign country. Remember, this is Italy, not the US. You cannot put yourself in stupid situations and expect to be treated by the US justice system. In Italy, that is the justice system. No matter how much ranting, raving, and pulling of hair you do, you will never change that fact. Were you the same people defending that guy who was caned in Singapore during the Clinton years? Are you people stupid? You need to get a life. Pick up a hobby that eliminates stress, not one that raises your blood pressure as you rave about reality.

Barbie Latza Nadeau (Angel Face p.27) “After she was arrested, the police set a trap for Amanda by telling her she had tested positive for HIV. This sort of psychological trickery is commonly used by investigators in Italy to illicit a confession.” So hitting her on the back of the head wasn't so bad -- maybe. But telling somebody they have AIDS as a tool to collect evidence really crosses the line. Look also at Doug Preston's first hand account of his interrogation by Mignini. He was calling Preston an accessory to murder. Preston was not interfering with a murder investigaion and any suggestion that he did was a joke. This was just a corrupt public official acting in his own interest. The Italian authorities in this case cannot be trusted.

I don't agree with the cops hitting anyone, but one smack on back of the head does not justify her falsely accusing an innocent men. Check out "the bathroom fallacy" 2:50 to 3:20 on YT. You will see the bathroom sink, where FOA say, the murderer washed his feet.

What she wrote the next day was a retraction of her statement to police- Asking them not to yell at her anymore and that she was "unsure of the verity of her statements". That is a fact and part of the court record. She couldn't identify the person who hit her because the woman was standing behind her but knew it was a woman because after giving her a whack on the head the woman said she was helping her to remember- So by the voice she could tell it was a woman who hit her. What is amazing is I wonder- how does one either win or lose a case like this- when there are no neutral parties- Just Amanda's word against the entire police dept. It;s another railroad job. Geez, I wonder who the judge is going to believe- what a joke. Mignini is a bully who needs to go to prison - and Amanda needs to be released from there. The Italian courts should take care not to lay it on so thick that even the U S State Dept begins to choke on it. The Italians should get Mignini out of there- but they don't

I would like to know why Richard Owen of the Times of London on 11/07/07 reported that a signal from a cell phone belonging to Mr. Lumumba was traced to the vicinity of the murder scene at 8:38PM on the evening of Ms. Kercher's murder. We know now that Mr. Lumumba was at his bar that evening. Mr. Owen must have been sourcing someone with inside knowledge of the case. What was the story there? Thank you.

saint michael, well first of al she was n't even a suspect that nite, her boyfriend was called for interrogation, so she wasnt taken into that room of interrogation where taping and survelllance was set up. she was asked question casually as a non suspect, ecause her boyfriendwas giving a differt version in the other room.secondly the supreme court threw out the untaped part of thetrestimony by itself, HOWEVER THEY LATER CALLED IT "ADMISSABLE EVIDENCE BECUSE OF HER 2 ALIBIS AND ACCUSATION OF AN INNOCENT MAN". Lastly,the chief police officer did say that interrogation was rough but she was nt hit or forced. Even in USA FBI is rough to murder suspects and terrorists. sHE WROTE HER CONFESSION NEXT DAY ON PAPER AND GAVE TO THE COPS. Also during the trial judge asked her to point out which cop or cops maltreated her. All of them who were in the police station were in the court room with their badges, BUT AMANDA COULDN'T POINT THEM OUT. Well thats what this slander trial is about.

I was there and I saw the Italian police beat Knox. That is the only reason why she accidentally accused P. Lamumba. Two weeks later when Lamumba's alibi check out & he was released Knox said that Sollecito murdered Meredith & was trying to frame her. Sorry can't explain that one, I wasn't there.

jimkim- are you serious? Wake up, why do you think the Italian police did not tape what went on in that room- they were suppose to by law and yet they did not. Take a wild guess. I'll give you a hint- Because they didn't want anyone else to know what went on in that room. And why would that be- geez what could possibly have gone on in that room that the police wanted to hide? Well personally since it is clear that they didn't want to document what went on it looks like what happened in there was not too cool- legally speaking- and that Amanda was probably given a very rough time. Now if you don't agree with that- I would LOVE to hear why you think they didn't record when they were required by law to record. Even the high court said her rights were violated.

And folks after reading this article titled as , 'how 3 of them subtly and surly pushed each other to the fire", then as one commenter remarked that, how can people say that amanda and Raff are innocent1. it talks in detail about their not one , numerous lies which they did in order to fit their versions to the changing accounts each of them were giving to the investigators. At one point, amanda even accused Raff of doing the murder alone and in the other instance Raff distanced himself from her by stating to the judge that amanda may not be with him all nite except in the early evening. He even told the Prelim hearing judge that 'I DONT WANT TO SEE AMANDA ANY MORE". Innocent people dont lie myraid times like these 3 have done.Innocent people can make a wrong statement once by mistake , but here we see a cascade of changing and contradicting stories really: A PLETHORA OF LIES. I GUESS THIS GOES WITH THEIR BOTTOMLESS CONSCIENCE OF MURDERERS. I PITY THEIR SYMPATHICIZERS

To a lot of the Knox haters it's not a matter of guilt or innocence-not a matter of proof or dna- It's simply a mater of....they don't like her. It's a personality thing I bet. Yeah some people are like that. That's what Mignini does all the time- if he doesn't like someone or thinks they are against him, he says those people are guilty of a crime and indicts them-Just like a lot of the Knox haters. You guys have a lot in common with Mignini. Mignini has had a lot of people throw in jail on a whim. Do you guys actually like Mignini? Do you think he is a good guy and just doing his job? If you do then you also have something in common with Boo Radley. It doesn't matter what she said or did. People accused of murder should be PROVEN guilty or acquitted. But not in Mignini's Italy- Just like the Knox haters, he doesn't go with proof either. Mignini is a convited criminal he's a bully, and he doesn't care who he hurts so long as he gets his way- its personal, just like some of you.

Let's face it people- nobody know exactly what happed in that room in the police station except those who were present. A lot of people think that the changing stories of Amanda and her accusing the wrong man makes her guilty. Well- sorry- it doesn't. But it tends to make her look guilty. Do you all suppose that the police and company were really nice to Knox and that she just came out of nowhere and started making up things and pointing a finger at the wrong guy- just like that? She was alone in that room with a bunch of people yelling at her in a language she barely understood at that time. They were getting very aggressive with her- yelling at her and making threats Yeah that would rattle some people. And if you badger them long enough and don't let them sleep after awhile you begin to lose it. The police knew this. It was probably pretty brutal and that is why there it wasn't recorded like it was suppose to have been- no lawyer-no sleep-constant aggression- and now they what to sue

Mary h, u again, if everything is false in ur refernce to the timing of police arrival and Raff calling the police after they showed up, then where do u get ur info from? BBC has reported this and other italian newspapers. why shud esp BBC be discredited? they are major world media and actually are more accurate than american media! There are some basic facts in this case that one cannot ignore: amanda's changing versions and lies. even her lawyer in the beggining had stated " i dont know which story to believe there are 2 many of them". There 's enough evidence against her, controversial and solid both. Its just tat ignorant and arrogant folks like u dont want to admit it. U will see that she will lose this appeal and u probably shuld do something else with ur life than to sypmathicize and advocate for a canniving, lying, convicted beast

Well before I get on with the slander trial I would just like to say I seriously wonder about the intelligence or attention-span of the Knox haters. It seems that the same type were sitting on the jury in Perugia. You know, half awake and full of preconcieved ideas. They miss the forrest because of the trees. It just about defies common sense to for anyone to seriously believe that Knox commited this crime. No one has shed any light on how could she have been in that room with all that violence going on without leaving any traces of herself- But if they ever do find that space-suit she was wearing that night well then they will really have a case. As far as the slander trial- oh what a joke- only in Mignini's Italy. Think about this- How are they going to prove they didn't hit her? Answer: They don't have too- She has to prove that they did which is ridiculous. Now you know none of those involved are going to say she was hit- nope- they would be looking for another job-This is nuts.

"That they had called Italian emergency (US-911). Phone records show they called after the police arrived." FALSE. "they said that they had spent the entire night at RS's, CCTV shows Knox at her apartment, even RS says that Knox did not spend the entire night." FALSE. "By RS own admissions he lied about that night because Knox had asked him to." FALSE. "I know you have heard all this before. Do you really need to hear it again?" No, I certainly do not need to hear any more false allegations. If you have any citations to support any of the claims you just made, then it would strengthen your argument to provide them.

The evidence that the police got rough with Amanda is contained in her statement to them wherein she asks them to stop yelling at her.

Moveon101: What's your point? Are you saying the police didn't know what they were doing because Amanda's DNA must have been in Meredith's room and they couldn't find it? If you were right that would just reinforce my point that the Perugian police didn't have the faintest idea what they were doing. Doesn't it register that Guede's DNA was everywhere in that room. Even if AK and RS wanted to remove any trace of themselves in Meredith's room, they wouldn't have known how to do it. And if they had bleached it, the whole place would have looked like a blue ocean when sprayed with luminol. Does anyone really think that AK and RS were holding down Meredith while Rudy performed? This case is so simple it isn't even funny. Guede did it. His DNA was found in areas indicating sexual penetration of the victim. The American girl didn't put it there.

I am talking about the crime scene photos of the apartment that shows one every sparkling clean bathroom sink. The same sink FOA site says the murderer washed his feet. The photos of the hall leading into Meredith room that shows no blood trail and yet there was bloody footprints in the bathroom and outside the cottage. Living in a dormitory/house you are going to get other peoples hair and DNA on you. Regularly I found hair on my clothes or in my room, picked up from the sofa, clothes dry, by my slippers. My hair is black so when I found blond hair on my sweater I knew that it was not mine. Knoxs hair was in Merediths room even before the murder. I don't want Knox to be guilty, she is guilty. Raffaele says he lied about the night because Knox asked him to. It is on the net in his own words.

Moveon101: The forensic "evidence" was indeed weak and can in all cases be explained in ways unrelated to the crime. Amanda lived there; her DNA would be all over the place, especially in her bathroom. Go to Wikipedia and you will find that they say the same thing that Steve Moore says about luminol -- it reacts with bleach. If anything was cleaned up with bleach the luminol results would have shown the large curved swaths indicative of a cleanup effort. Please post your source for the claim that the duvet on Meredith was Amanda's. "No way that Amanda's DNA was not in Meredith's room?" You have got to be kidding. This is how Mignini works. Don't listen to the evidence, just dream up what you would like to think happened and don't listen to anything else. And how would you know that Guede didn't cover the body? You weren't there. A veteran FBI agent with 25 years of homicide investigation is more credible than you are.

You think that Amanda went though Meredith's room and picked up all of her hairs that you think should have been there? What? What crime photo are you referring to when you say that you can tell by looking at the crime photos that the bathroom was cleaned? What in the world are you talking about when you say that you found "hair from roommates that I never met" in your dorm room? What?!?!?!? Why people like you want so badly for her to be guilty baffles me!

So the Italian Police are suing Amanda because they don't like being criticized? Try this. The Italian police are incompetent in Amanda's case because:1) They failed to detain Rudy Guede after the Milan nursery school break-in. Even though they had direct knowledge of his involvement in two seperate break-ins, they simply put him back on a train to Perugia. Meredith Kercher would still be alive if they had done their job and taken him out of circulation;2) They failed to measure the body temperature of the victim leading to difficulties in establishing the time of death;3) Patrizia Stephanoni did not understand that luminol reacts with bleach. If she had she would have told the prosecutor that her luminol tests proved that no cleanup occurred.4) They failed to recover the bra-clasp until 47 days after the crime. 5) They failed to go to local medical clinics to see if anyone had come in with defensive wounds. 6) They destroyed hard drives with important evidence.

There is no doubt in my mind that Knox was involved in this crime. Just looking at the crime scene photos I can tell that bathroom was cleaned. However, I do believe these latest changes are an overkill. If the prosecution loses the slender claim he will loss credibility, he should have just left it at the 26 years. Insufficient for rape and murder, but better than giving the Knox clan ammunition.

I lived in a dormitory I was always find hair in my room from roommates that I had never even met. There is no way that Knox hair & DNA was not in Meredith's room. Meredith was covered with Knoxs comforter. Guede did not waste time covering a body, he ran. S Moore does not know what he is talking about. That bathroom was cleaned and it was not cleaned by Guede.

Phanuelb, Amanda Knox and Raffaele Sollecito lied before 5 November 2007. These lies are explored in depth in the judges’ sentencing report, which you clearly haven’t read. Raffaele Sollecito admitted that he and Knox had lied to the police and claimed that Knox had asked him to lie for her. On 5 November, they were given another opportunity to tell the truth. However, they both chose to tell the police even more lies. You have no evidence that the police officers started to get tough with Knox. There was nothing illegal about her questioning. All the witnesses who were actually present when she was questioned, including Knox’s interpreter, testified under oath that she was treated well.

The Italian government needs to grow up and get a thicker skin, and besides, if you're charging her, maybe her statements (if any) aren't slanderous at all, but true, and you're just worried that, American citizens (or anyone else) may actually find out what those statements are to begin with, and boycott the hell out of your country, your entire industry, and all of your products. The whole trial against her, was a farce with circumstantial evidence, to begin with. Did you try to read the pattern of tea leaves in a cup, to convict her, or something. Relying on statements of old women as evidence alone, is exactly like having those girls, during the witch trials in Salem, say she's guilty or not, you guys are total idiots.

No one will ever really know what happened with her interrogation. She was almost certainly asked to imagine what might have happened; she was lectured on false memory syndrome. Italian police were recording the conversations at the police station between Raffaele and Amanda. Why then were they careful not to record any conversations where the police were speaking? The answer is that they didn't want public scrutiny of their actions at a later date. A day or so after the murder, Amanda wrote a six page email to her family and friends which is part of the trial record. That letter appears truthful in all respects and is presumed to be what she told investigators at least until they started getting tough with her. Coerced confessions are common in cases of people wrongly convicted. Look at the big picture. Forensic evidence against her is weak (even Barbie says this) why then become convinced that she did something that would have no parallel in the history or crime?

Rag: Outside experts have discredited the testing of the knife. The sample was so small that the results would not have been admissible in US Courts and they could not be reproduced. It tested negative for blood so it wasn't used in a stabbing incident. The scars on Rudy Guede's fingers photographed 20 days after the crime are consistent with the kind of small thin knife with no hilt that must have made certain of the fatal wounds. There was no bloody footprint of AK in the murder room. Patrizia Stefanoni is not qualified to do forensic testing because she was not properly trained in the use of luminol and LCN DNA testing. This is the opinion of veteran FBI agent Steve Moore. Your statement about bloody footprints of Knox are completely and categorically false. No tests confirming the presence of blood were ever done on the luminol prints. They almost certainly came from household bleach in the shower stall. If there was any cleanup the luminol would have showed it.

Like I said - make sure you get hold of the 400 page summary of findings that outlines, in often painful detail, the logic and thinking behind the guilty verdict that the judge and jury handed down to Amanda Knox and Raffaele Sollecito for their parts in the horrific murder of Meredith Kercher. Actually, the guilty verdict had nothing to do with prosecutor Mignini - it was the sole product of a judge and jury who carefully weighed all of the evidence, along with the arguments of both the prosecution and defense teams. The judge and jury clearly downplayed arguments by both the defense teams and the prosecution team that they did not agree with. This is precisely how a well run court should work. If you have any doubts about the process used to convict Knox and Sollecito you owe it to yourself to read the full translation of that final court document. The double DNA knife not only places Amanda Knox in Meredith's room, but also indicates that she inflicted the fatal wound. The woman's bloody shoeprint on the pillow under Meredith's body matched Knox's foot size, but was incompatible with Meredith's foot size. According to Dr. Stefanoni and Professor Vinci, Knox's DNA was on Meredith's bra. Knox's reading lamp was found in Meredith's room. Knox's footprints were set in Meredith's blood in different parts of the cottage, which indicates that she had stepped in Meredith's blood in Meredith's room and tracked it around the house. Knox's DNA was mixed with Meredith's blood in the bathroom, which indicates that her hands had come into contact with Meredith's blood and then touched different fittings and the box of cotton swabs in the bathroom. Knox voluntarily admitted that she was involved in Meredith's murder in her handwritten note to the police on 6 November 2007. She even asked for a pen and paper to write this confession.

This case is one of the great travesties of justice of our time. For those not familiar with the case, Rudy Guede is guilty as sin; Amanda and Raffaele are totally innocent. Vast evidence links Guede to the crime. His DNA was everywhere at the crime scene including in areas indicating sexual penetration; his palm print was there in the victim's blood; he flees; he had defensive wounds to his hands; his footprints were there, and on and on. No DNA of Amanda Knox was in the room where the murder occurred, none. She had no motive, did not flee, and did not have defensive wounds. Incompetent Italian investigators have misinterpreted forensic evidence, particularly with regard to the use of luminol. Jurors were observed sleeping through much of the trial and openly stated that they were insulted by newspaper editorials in the US that they were reading during the trial. The Nation of Italy has an obligation to rise up and reverse this judicial outrage.

If anyone needed proof that Mignini is a vindictive freak, here it is. One man's DNA was found inside Meredith Kercher's body. One man's bloody fingerprints were found next to her body. Mignini did not complain when the court of Perugia cut that man's sentence in half because he was willing to accuse Amanda and Raffaele. That's how much Mignini cares about justice for the innocent young woman who was raped and killed. Amanda Knox and Raffaele Sollecito had nothing to do with Meredith's tragic death. @lundgren, yes there is some seriously wrong stuff with the Italian judicial system. This prosecutor was and is allowed to practice, despite his own legal troubles that proved that he has purposely misused his office. Now, out of vengence because Amanda did not get the sentence he wanted and because she spoke out about how she was treated, he is going after her again. He already won the first case and now is going for more. He has nothing to gain from it by doing so and is again misusing his power to pursue his own personal agenda and not justice.

If someone has something to say either way, it would behoove that person to spend some time dealing with court records rather than anything the media has to say one way or the other. After all, don't we all know OJ did it??? But alas the jury said he didn't. All courts and juries should be subject to review. Sometimes in a fit of passion (the gloves don't fit, you must aquit) or (she is a satanic devil worshipper.. convict!).... the jury doesn't really look at the facts. I truly hope a new set of eyes in the Italian justice system gets to judge the case anew. Then, one way or another, it will seem more fair.

It seems impossible for this to be continuing but here it is again. Giuliano Mignini was involved in the interrogation. He was there for several hours that night. He has also been convicted of Abuse of Office. It is incredulous that he would be allowed to prosecute Amanda Knox for slander for what she said happened during the interrogation that he was a PART of. It is a CONFLICT OF INTEREST to the extreme. If the Perugian justice system does not at least change the prosecutor in this case we will all know they have no interest in justice or fairness in law. I'm already convinced of that. The police taped almost everything in this case. It is not believable that they did not tape EITHER Amanda Knox's or Raffaele Sollecito's interrogations. They have purposely buried these tapes that would show the truth about how the police handled these interrogations. Yet they sue her for slander. If those tapes were available she could them as proof.

It's amazing...this Italian legal system farce keeps going so far over the line. The interrogation was illegal -- it was thrown out of court. It was NOT recorded, as it was legally required to be done. Amanda has no ability to prove what happened. Mignini himself supervised the interrogation. How a witness can possiblly be the prosecutor is beyond explanation.

The police said they arrived at the apartment at 12:35 and Raffaele called the police at 12:50 after their arrival. According to witness testimony, the police had with them both of Meredith's phones and were asking who owned the phones. The family testified they delivered the second phone found to the police station at 12:46, so how did they arrive at 12:35 with the phone that they did not have possession of until 12:46??????????????????????????????????????? Also in judge Micheli's report he referred to a phone call made at 11:50 am and reasoned the police knew about the second phone found around noon. The second phone was ringing when it was found because Amanda was calling Meredith at 12:07. The phone records show the phone did not receive a call for 12 hours prior to Amanda calling at 12:07. So how would a call at 11:50 cause the police to be aware of a second phone that had not been found at this time???????????????????????????????????????????????????????

Giuliano Mignini, the prosecutor in the case against Amanda Knox, has already been found by an Italian Court to have abused his power. He, and the Perugia investigators, screwed up their own handling of the forensic evidence. Is Amanda Knox guilty? We will probably never really know, partly as a result of the poorly run investigation and prosecutorial misconduct; we do know that the jury was not sequestered, were allowed to read local papers and news reports about the trial, were allowed to discuss the case with family and friends, and that none of this would have been allowed in a judicial system that values true objectiveness in the trying of a murder. It is a black mark against the Italian system of Jurisprudence, that such a vengeful prosecutor is being allowed to continue to bring charges against an already questionably "guilty" person simply to satisfy his own warped desire to wreak vengeance.
