King County settles with family of man injured by deputies for $10 million

SEATTLE -- King County has settled with the family of a man who was severely injured by sheriff's deputies in 2009 for $10 million.

Christopher Sean Harris, from Edmonds, suffered permanent brain damage when he was tackled by deputies in May 2009.  Harris' family filed a civil lawsuit against King County, claiming deputies used unnecessary force when they arrested him after a chase, knocking his head into a wall.

John Cobb, the senior prosecutor on the case for the county, confirmed the settlement five days after the civil trial began on January 20.  The settlement is believed to be the largest of its type against King County.

Harris' wife said the settlement will help care for her husband, but it can't change the fact that he is still paralyzed and can't speak.

"I feel like, for the King County Sheriff's Department to agree to pay this amount of money, it should say that a investigation should be done into what happened," said Sarah Harris. "I don't know how they would agree to pay that amount and not feel like something was wrong."

Jurors said it was an emotional, tense day for them.

"I really believe that they should have got what they were asking for, especially Sarah Harris, she has to deal with a lot every day, 24 hour care. It's traumatizing," said juror Bailey Puryear.

"Everybody in the county really feels like this is a just resolution in this matter," said Cobb. "It's a tragic accident, but that's what it was, it was an accident."

Harris was a passer-by when Metro transit deputies responded to an assault at a convenience store in Seattle's Belltown neighborhood in the early hours of Mother's Day 2009. A witness wrongly identified Harris as a suspect.

Harris ran, and deputies followed. Harris then stopped a few blocks away at the Cinerama Theater, and one of the deputies tackled him, knocking him into a concrete wall. The impact caused Harris to hit the back of his head against the wall and he suffered a severe brain injury.  Harris is now unable to walk, talk or take care of himself.

Witnesses who testified in the trial said they didn't recognize the deputies as law-enforcement officers because they were wearing all-black uniforms. Many thought the deputies were either security guards or bouncers.

The deputies were not criminally charged. King County says Harris was responsible for his injury because he ran, instead of letting them determine he was not a suspect.

King County Sheriff Sue Rahr released the following statement about the Harris settlement:

"We realize that the incident where Christopher Harris was injured by one of our deputies was a tragedy for Mr. Harris, his wife Sarah, and his entire family. We hope the settlement will at least bring financial peace, while understanding nothing we can do or say can make that night 'go away'. My sincerest condolences and apologies to Chris and his family."

10 Million!! Wow that should take care of the medical bills for a few years. What about the pain and suffering, loss of income, and basically loss of normal life? Yeah, I think King County got off real cheap. I agree with other posts that our police are in desperate need of some training and using better judgment during arrests.

Okay nolibkoolaid4me, How do you live with yourself? You should be ashamed of yourself!! How can you be so cruel? The court new they had to settle this case because if it went to trial they would have been awarded alot more money, this man and his family should have all medical expenses paid for him for the rest of his life. The officer Burk comment was so sick. Hopefully you never run into him. Actually you have someone higher to answer to when your time comes!! You owe the Harris family an apology!!

This is such a tragedy!! It should have never happened. I heard Chris's mom on the radio today and I cannot imagine what she is going through and how awful it must be. I think this police officer (I shouldn't even give him the respect calling him an officer) should be fired and let the other cops see that they will have consequences for the actions that they take. This young mans life was taken away from him as he new it, because of one more over zealous cop. I feel so bad for this family his brother who adored him, his beautiful wife that should never have to go through something like this. This is a mothers worst nightmare. Thank God they won this settlement so he can get everything that can help him. I really hope the jerk who did this never does anything like this to anyone ever again. Way to many cops are so arrogant! I will be praying for Chris's family and Chris, just know that through Christ all things are possible.

What would be happening to me if I was a citizen at the scene with no cops around and had made the decision to make a citizens arrest.? A witness makes a wrong ID on the suspect and I smash his head into a wall when he has obviously stopped running. Oh just a mistake, sorry???

Did it come out in the trial why Mr. Harris ran from the police? If the police are called to respond to an assault in a Belltown convenience store you know they are going to be on high adrenaline alert, it's the most crime ridden area of Seattle. Anyone who runs from the cops in that situation is automatically going to become the prime suspect and cops know those kind of perps carry guns and knives. It is so easy for everyone to criticize the police, but they have never had someone point a gun or knife at them by surprise and have to deal with it. Cops know this can happen and they have seen their fellow officers get killed when they were not either careful or aggressive enough. I am sure they were fearful of what Harris might have done to them if indeed he had been the assailant at the store. Harris put his own life in danger by running. I feel bad for his wife, she has to deal with all the fallout from this for the rest of her life.

Not a soul here likely has enough actual info on this to put blame on one side or the other. This moron ruined his entire life because he chose to run, and there's another camp of folks that apparently are just going to be anti-cop regardless of the facts or situation... of course until they need one. Either way, this should have gone to trial if anyone had the stones tor realize that a few of us aren't going to freely throw money at someone because we actually understand where that money came from to begin with. Sadly the city would have been better off if Ofc. Birk made this arrest.

Since they settled, it appears that the Police knew that any jury would have found the police at fault. Wait till they try and find a jury for this officer Birk shooting. I would suspect that they will try and settle out of court too. King County is going to go bankrupt paying for the mistakes of their police force. Instead of trying to learn from their mistakes, they are too busy complaining about the corrective training that they brought upon themselves.

Would someone please tell our police and Sheriff's to wear there readily identifiable uniforms. Geez It might be fun to wear all black and look like SWAT but it isn't in the best interest of the community. Grow up and be professional.

Saltydog, I'm not in the business of paying $100 million of my taxpayer money for an accident. if you want to be so loose with the public treasury, you pay the extra amounts out of your own pocket. He shouldn't have run. Everybody knows it but since the injury was so catastrophic it's easy to place all the blame on the deputy. What would you do if a potential suspect was running from you and it was your duty to catch him? That's the reason loud mouths like you aren't cops. I'm fine with some government money going to pay for his care, but you shouldn't squawk too loud about awarding massive punitive penalties to everyone who feels wronged by the government.

King County good off cheap. Ten million dollars is not very much when you consider the high cost of medical care and 24 hour nurses. The original $25 M may have been a closer estimate to the long term care he will need for the rest of his life. I can see the family taking the offered settlement to avoid a lengthy court process with possible appeals dragging it out for years. I'm sure a jury would have awarded more than $10M..

King County got off easy. !0 mil for a up front settlement wouild be ok but they should pay for the ongoing care this man is going to need for the rest of his life. Caring for someone 24/7 is the most stressful job anyone can have, and is the most demanding. King County consider yourself extreemly lucky.

Personally, I think I would rather be dead than encased in a body this damaged. You know he can't even commit suicide. The money means nothing, I thought it was real stupidity the way he was injured. I am so sorry for him. As a kicker, who gets to pay. Thats a whole lot of tax dollars. Its a really sad case, the police of late really need to tone it down, and that is why the Fed are stepping in to investigate the Seattle police procedures.

If you see two large men , dressed in all black running at you, at night, in downtown Seattle. RRUUUNNN.

These cops need martial arts training. Most of these civilian deaths are due to the police being scared on the job. The guy was innocent. He stopped running. At that time an officer will ask him to put his hands behind his back and cuff him. If that was me (an athlete) that video would have looked comical as the police officer hurled HIMSELF into the wall with ME helping him. Same as the wood carver. The guys is 20 feet away, the cop runs AT him with weapon drawn. Then claims he was scared for his life (smirk). Give that poor wood carver another 2 seconds to figure out who was yelling at him...and he drops the knife. Sure some of our citizens do not know how to act when confronted by anyone, let alone a police officer. Give them one more second or 2 of life before deciding to execute them on our streets? You might findout your related to them. Then what?

Don't accept the figure. It makes good headlines. The young man and family have a long road ahead of them. To insure others don't get into his money, you can bet the Court appoints people to get into his money! A paradox to be learned through experience. I have. I am inside. Local papers were using $16,000,000 as the figure for my daughter, many years ago. (Out of Court settlement against a local government.) The amount was actually under $500,000! Allow for atty. fees and other expenses... About $300,000. Properly, an annuity was bought. Over the next 80 years of projected lifetime, $16,000,000 will be paid out...nowhere near worth the pain caused.

Why do people run from the police? Because they don't want to be handcuffed "for their own protection" during questioning. Far too many police officers are bullies with badges. Try asserting your fourth amendment rights when a cop says"do you mind if I search your car?" Tell him, " yes I mind!." and see if he lets you go. that's when he thinks you must be hiding something instead of asserting your rights as to search and seizure. I'll tell you what irritates a bully. He hates to be ignored. Give the officer who stops you your license, reg. and proof of insurance and don't answer ANY questions. Not even "How are ya?" Anything you say can AND WILL be used against you. If he's gonna write a ticket,let him. Argue with the judge or the D.A. but not the cop. He just might be in a bad mood and want to shoot somebody.

Once again the Kingcounty legal staff screws up. The officer was clearly justified in tackling the runner. The fact that he fell awkwardly into that wall was NOT the officers fault. Wonder what kind of connection there is between the plaintiffs attorneys and King County. The best I would have thought of would be health care costs but 10 Million? King County doesnt HA VE 10 million.

First off, knowone knows now why the young man ran, and likely will never now. Seattle and Tacoma and surounding Police have a history of corruption dating over one hundred years, and the many cases of it are a part of record, including hurting inocents following directions. The young man stopped and was giving himself up, but was still unnessarely tackled in force that took away his life. King Co. should have had to pay that to the family alone and then pay Med. Ex. for the rest of the young mans life, remove the officer from the force, and agree to reforms in their thinking and start being public servants instead of arrogant criminals wearing badges.

Why do people immediately go against the police? You want to change something, you go do their job wondering if the next person wants your help or wants to kill you. I am sorry for the family that this occurred but why did Christopher run? I am glad I don't live in King County because of the liberal thinking and blaming the cops for the stupidity of the suspects. The MOST the county should have done was pay medical but I don't even think they should do that. If a cop says freeze, stop what you are doing and give them your full attention. When have you ever heard (and believe) that a suspect was treated bad when they are doing what the officer said? This is as brilliant as McDonalds paying a person because they ordered hot coffee and then burned themselves. I am sorry for the injuries but should we really reward stupidity?

Its a sad story and sometimes settling is the right thing to do. Settling means that a court doesn't get the chance to declare one side or the other to be at fault. In my view Harris and the county share responsibility for this tragedy. Its not cut and dried one way or the other.

Figured this would happen. This settlement was just to keep a jury from awarding more since it would have been hard to find a jury that would have favored King County, even though they were in the right.
