Judges say Knox killed without 'planning or resentment'

ROME -  The brutal murder of a British college student in Italy by American Amanda Knox and her former Italian boyfriend was not premeditated, the judges who convicted them said in a document released Thursday.

Instead, the killing occurred spontaneously after what began as a sexual assault on Meredith Kercher, a 21-year-old Briton, the judges said.

In fact, Knox -- Kercher's roommate -- and Raffaele Sollecito had felt no resentment toward the victim. After the murder, they showed a "sort of repentance" for their crime when they covered Kercher's naked dead body with a duvet.

The judges also said they found no holes or inconsistencies in the prosecution's case against Knox and Sollecito, largely supporting forensic evidence that had been disputed by defense lawyers. Therefore, the guilty murder verdict was a "necessary and strictly consequential outcome" of the trial, the document said.

Knox and Sollecito were convicted in December by a court in Perugia, the central Italian town where the slaying took place in 2007. The Seattle woman was sentenced to 26 years in jail, while Sollecito received a 25-year sentence. The two, who were dating at the time of the killing, have insisted they are innocent.

They remain in jail.

On Thursday, the judges released the reasons behind their ruling in a 427-page document that reconstructed the night of the murder and detailed evidence and testimony heard during the roughly year-long trial. Once the document -- required in Italian trials -- is released, defense lawyers can launch their planned appeals.

Amanda's father, Curt Knox, says the family has been waiting for the document to be released.

"We've been waiting for this document ever since the wrongful conviction that Amanda experienced," he told KING 5 News in Seattle. "This really allows us to put together the appeal document and what the basis will be of our appeal."

Kercher's body was found in a pool of blood on Nov. 2, 2007, in the apartment she shared with Knox. The judges said she was murdered the night before by Knox, Sollecito and another man, Rudy Hermann Guede, an Ivory Coast citizen who also has been convicted of murder in a separate trial. Guede sexually assaulted Kercher with the help of Sollecito and Knox, the document said.

The judges said the murder was carried out due to "merely random circumstances": Knox and Sollecito were free that evening, they "ran into" Guede in town and they "found themselves" at the house where Kercher happened to be alone.

"The murder therefore came to be carried out without any planning, without any animosity or rancorous feelings toward the victim," the document read.

But despite the lack of any premeditation, the document said, Knox and Sollecito assisted Guede's sexual desire for Kercher, becoming her brutal assailants together with the Ivorian man and ultimately killing the 21-year-old from England when she resisted the sexual approach.

The pair might have found Guede's sexual drive toward Kercher "exciting" or might have been under the influence of drugs, the document said.

Knox, now 22, has said that she and Sollecito, 25, smoked pot the night of the murder. However, she maintains she spent the night at Sollecito's house and was shocked and saddened to learn of her roommate's slaying the following morning.

David Marriott, a spokesman for the Knox family,  e-mailed a statement from the Knox family to KING5 News. In the statement, the family said in their opinion "there is a lot of conjecture in these motivations, a number of discrepancies as well as a number of inconsistencies and contradictions as well as conclusion not supported by evidence....Based on our initial review of the motivations, we feel there is a substantial basis for the appeal and are confident that the appeal will result in a reversal of the wrongful conviction." the family's statement said.

Anne Bremner, Seattle attorney and former prosecutor who has been a Knox supporter, said "What they're basically saying is, we found her guilty but there was no evidence, at least what we see from some of these first excerpts to support that and in fact it wasn't pre meditated."

"The key thing was the fact, was that she knows that she did not murder Meredith Kercher and that Meredith was her friend," said Amanda's father.

Luca Maori, one of Sollecito's lawyers, said he will reject the ruling "point by point," according to the ANSA news agency.

This is sounding like the OJ simpsom trial mybey someone else had the same d.n.a as amanda, could the bloody( bare) foot prints have been left there by a cop with the same size foot and d.n.a as amanda.could the prosacuter of planted the blood at the scene. Donald Trumps words on TV interview was pretty stupid,sorry trump but your fired.

I wish that Curt Knox would shut the hell up. He has no right to make such a statement that Amanda and Meredith were friends. He doesn't know that and he certainly didn't know Meredith or anything about her and now he can read her mind; "I know that wherever she is, Meredith knows that Amanda is innocent". How delusional and insane is that? He spat in the face of Meredith's real friends from England when he basically called them all liars with rehearsed unified testimony over a year ago. Are Meredith's family liars too, Curt? The only people who have lied are your daughter, her boyfriend and Rudy Guede. I am glad that the judges and jury recognized this. I honestly hope that the Kercher family never have to be in the same room, let alone country, as you or your ex-wife and her current husband. Do Anne Bremner, George Marriott or Ted Simon even care about what happened to Meredith? I seriously doubt that. She seems to be an inconvenience to all of them.

Collegeguy-Amanda et. al DID cover it up! What do YOU call it when you ransack an adjacent bedroom next to the scene of a killing and then break a window in same adjacent bedroom BUT forget to note that a real burglar would have to break the window first to ransack the bedroom for valuable goodies to steal. It matters not whether Foxxy Knoxxy was sober as a judge or high as a kite when she cut Meredith's throat open, she still did it and as a college educated woman she had ample opportunity to know better.

Yes, all you know-it-alls are are so certain this actually means anything, considering she was tried as if it she actually killed Meredith on purpose and then tried to cover it up. Lets consider all the evidence not allowed, like the taped conversation between Rudy Guade telling a friend that Amanda had nothing to do with it and that Amanda was not even near when he killed Meredith that was not allowed in court. And not to mention the "DNA" evidence that ties her to the scene... considering Amanda lived in the apartment, NO DUH, her DNA was going to be all over the place. Just because people are so quick to judge and make rude and unnecessarily comments doesn't make them right. Considering she had nothing to actually do with the murder, it is still a travesty and that is why it is still news. However, like others have said, if you are living in another country, you need to be above reproach and not hang with the wrong people. Amanda was guilty by association only.

I am so tired of hearing about this. She obviously was not blameless. Perhaps she should get a reduced sentence, but she shouldn't go free. I'm not sure why this stays in the news except that she is an attractive young woman.

I don't know why the Amanda Knox story keeps getting dredged up on here. I am tired of hearing about it. Its tragic yes on several levels, but there is more to Seattle than Amanda Knox in jail in Italy.

The 'shocked look' on her face that we've all come to know is likely due to the fact that so many drugs were involved that she probably DOESN'T clearly remember the event...Unfortunately, DNA doesn't lie. Sweet-pea..you WERE involved. Accept it--and quit whining.

When in a foreign country, your conduct must be above board. Whether she is guilty or not, the Italian courts decided and her parents didn't help one bit by going over there and criticizing their system.

With all these locals claiming her innocence, I am baffled by the account of the shop owner saying that Knox was waiting outside her shop the next morning to buy cleaning supplies. Why would an innocent clean up someone else's bloody mess if they were not involved?

The only one that knows whether she is innocent or guilty is Amanda. The Italian justice system has done it's job, fair or not. If you don't like their courts, don't go there.
