Investigators: Edmonds rape suspect deported nine times

EDMONDS, Wash. – The KING 5 Investigators have learned that an illegal immigrant accused of raping a woman in Edmonds Sunday has been deported nine times. That's much more than previously reported.

Immigrations and Customs Enforcement won't comment on the case of Jose Lopez Madrigal. But KING 5 got the information through confidential sources and documents.

Larry Klein was the man who heard the alleged victim's cries for help. Police say the suspect pulled the woman off the street to a dumpster and raped her.

"I could see the back of his head. I could see his pants were down. I could see her lying on the ground. I could hear her crying, but I couldn't really see her face," said Klein.

Klein called police, who quickly arrested the suspect. But learning his identity took much longer because of some 30 aliases. It was only through fingerprints that they identified him as Madrigal, a Mexican citizen.

Madrigal's arrest and immigration record includes a staggering number of contacts with law enforcement since 1989. That's the year he was convicted of theft using a firearm in California. 

He was deported a couple of times after that. Then in 1999, he was arrested for drug sales in both San Diego and San Francisco. Records show that he was deported three times that year between April and August.

He was arrested for drugs again in Stockton, Calif. in 2000. In 2002, he pleaded to third degree sexual assault in Denver. Later that year, he was deported again. And in 2003, records show he was deported three more times.

People who live near the scene of Sunday's alleged rape wonder how it could keep happening.

"Makes you wonder, what are we doing wrong? How is he getting back in here?" said Kirby Aumick.

"It’s troubling. I mean, if this man should not have been in this country, he should have been behind bars then, really, this is a senseless tragedy," said Klein.

According to our sources, Madrigal's last contact before Sunday was around 2003. So, it's not clear how much of that time Madrigal was in this country.

Immigration and Customs Enforcement has refused to comment on the case which started making national headlines when it was learned that Madrigal had been deported several times prior to the Edmonds case.

In reviewing records and talking with confidential sources, the KING 5 Investigators learned just how extensive Madrigal’s immigration and arrest record is.

They found he was first deported in California in 1989 and since then he’s returned from his Mexican homeland and been arrested for drug crimes, a sex assault in Colorado and other offenses.
 
One criminal justice source says Madrigal is a "poster boy" for the federal governments ineffectiveness at keeping the most serious "criminal aliens" – illegals who commit crimes – out of the  United States.

Stop talking and take action! Go to "RespectWashington.us" and get petitions to sign for I-1056 with will stop all things you complain about illegals! This new law would demand the use of E-VERIFY for all employers, no driver licenses for illegals, etc., etc. Get involved now!!!

I still say that when we deport him, we need to charge his homeland how much it was for holding him. Then warn him that if we find him again, we will do worse before sending him back. This is really getting out of hand. I can understand once or twice, but NINE times? Come on, it is up to us to secure our borders and keep these people out!

Let’s not send any illegal’s to our jails, they are already overflowing with our own criminals. Not to mention that a criminals have it better then a lot of our own citizens. instead send them to a compound like Sheriff Joe’s tent city made up of two areas Compound A would house ANY illegal’s, with a gate open to the south with a sign the saids “Welcome to Mexico have a nice day“. After their fingerprinted and photograph they are free to go. If they are not a Mexican citizen that’s their problem. There is also a gate to the north side of the compound that reads “Welcome to the USA“. Please have your passport and papers ready. Now Compound B is for all who are illegal or has been caught a second time plus has committed a crime on top of being illegal. Sorry no open gates. THat is why the Arizona law was written and should be allowed to stay and enforced, our federal government and homeland security are doing nothing and now they want to give the illegals amenesty?? Stand up America and let your representatlive know that we want all illegals out of the country and then they can apply to legally come back. Please speak out about this issue, don't let the only ones protesting be the illegals themselves.

If this incident were the product of 10 or 100, or even a few thousands of illegals coming to this region each year, it could be attributed to chance and accident. But when the governmental groups pass so many ordinances/laws encouraging ever-more illegal immigration what results is that about 100,000 illegals come to this state each year. That is a major driver of our clearly unsustainable population growth, and it comes at great cost, educationally, medically, infrastructurally, along with housing and welfare costs plus exacerbated pollution and ecological degradation costs. At least this even is covered journalistically; it is too bad all the other costs are not equally reported. Then common sense politics might result.

I was wondering as I kept reading responses to 402lrac if that post could have actually been that bad, well it is, my god are you being serious? You can't actually think that. Several people have responded to your insane post, perhaps you could grace us with a rebuttal? I would love to drop a few more IQ points today. You should run for City Council or for mayor, as it certainly seems there are others who think like you, though, and thankfully, not intelligent enough to speak their mind on here.

I heard Governor Gregoire on the radio the other day trashing talking the AZ immigration law 1070, saying the State of Washington would Never pass a law like that and we need illegal immigrant 2 pick Washington cherries & apples then this happens. I have also heard about the Seattle City Council (Sally Clark) approving, and Tacoma City Council planning and Boycotts of Arizona, I feel that any government Official, whether Elected or Appointed, that decides that a LAW is just "not worth enforcing" is not worth having in office. But when they take it upon themselves to decide NOT to enforce a Law and Puts Its Citizens In Imminent Danger, as this decision has done Those decision makers and policy makers should be held responsible and accountable in a Court Of Law. The Leadership of the State of Washington owes this poor woman an unspeakable debt that can never be paid. And in my opinion our Governor is responsible. We the People need Leadership

This is really sad... I feel so bad for the people this man has hurt.... If I was this woman, I would sue ICE, and the US as an accessory to the crime (Criminal Facilitation under the RICO ACT) If is good enough for the Mobsters...then it is good enough for the Government... If the government can't protect us from these criminals... then they need to make reparations for their crimes, that they Allow and Facilitate...Many have been saying for years that the Mexican government is emptying out the prisons and jails and sending them here because they don't want them back when we deport them.... He probably has and even greater arrest record in Mexico....Not that we will ever find out, because the Mexican Government has no interest in having these people's crimes come to light and the Government being FORCED by us to DO SOMETHING TO STOP THIS!!! So here is a guy that has been deported so much yet nothing is done to keep him out of the country. He has done crimes in multiple states. Yet He keeps comming back. I agree this is a poster boy for Federal government failures. Yet any immigration plan would give him citizenship. We are a country of laws. He broke the law entering this county illegally. He broke our laws by doing crimes. This is the type of person I do not want in our country. Send him back. And if he comes back into the country strike three you our out. Never allowed citizenship. Can not marry anyone to get citzenship. He is also a person that we should get DNA and check unsolved crimes to see if he was involved. Maybe we can get lucky and get him on three strikes you are out. Since the federal government will not keep him out. Maybe the only way is putting him into prison for life. He appears to be a danger for society. any society.

Didn't Seatlle city council boycott Arizona? Good to know who's side your elected officials are on. Maybe they would feel differently about illegal immigrants if this happened to their daughter,sister or wife. Wake up Seattle & America. This type of stuff is happening every single day in Arizona and Border states. It's time to stand up for the American Citizen. Visit Governor Brewer's site & sign the petition. Fortunately for you, you aren't subjected to it much, but unlike what the MSM wants you to believe about these "hardworking immigrants," they broke the law to begin with (they are all criminals). California & AZ prisons are filled with hardcore illegal alien criminals. LA county murders are committed mostly by illegals. Our schools are overrun. Why do you think the leaders of this country are allowing this to happen? It is destroying our nation and setting us up for fall. The Mexicans think they will take control - 20-38 million of them, minus women and children, against our 1.3 million man military. Naw. Correcting this problem requires a PUBLIC OUTCRY. In just the time it takes to write a comment, a telephone call could be made. Everybody who reads this article is sympathetic to the victim. But we are faced with politicians who refuse to do their jobs and secure the border. That must change, NOW. The next victim could be a friend, family member, or relative. A joint session of Congress just gave Calderon a standing ovation when Calderon criticized Arizona's immigration law. Arizona is taking a stand and the rest of America must ACTIVELY SUPPORT Arizona. John Morton, head of ICE, has gone on the record as being unwilling to uphold Arizona's immigration law. This is an OUTRAGE. When can public officials tell us "they will not uphold the law?" PLEASE, PLEASE, EXPRESS YOUR OUTRAGE by telephoning tomorrow. The next victim could be a loved one.

I hope everybody who is judging us up in Seattle and calling us a bunch of racists for attempting to enforce immigration law here will read this story and realize that we deal with these kinds of things daily and maybe cut us a little slack please. Rapes, kidnappings, murders, high-speed chases, drugs, gangs, drop houses, tresspassing- it's an everyday thing here. Not to mention our bankrupted schools, jails, social services and healthcare system. We NEED to secure the border. We are not interested in "comprehensive immigration reform", because we have seen already what that gets us- another 20 million illegals. Secure the border. Cut illegal entry by 95%- SHOW US with real actions that you people who want a path to citizenship for illegals actually will address the border security problem, and THEN we will be happy to talk about the folks who are already here. The problem cannot be fixed without the border being secured! PLEASE PRESIDENT OBAMA DO YOUR JOB!

In Mexico an illegal alien who is caught the second time is imprisoned for 10 years. Mexico's immigration laws are the only thing about Mexico that we should copy, and we should do it now. Illegal entry ten times is ten times too many. In Mexico even the first time can result in five years in prison. We should enforce the same immigration laws against illegals as are in effect in their country. That would be a good beginning as to a cure for this invasion. Maybe throw in the non-enforcers and enablers along with them.

If the alien rapist had his pants down and the good samaritan could see the whole event, why didn't he settle this by kicking the guy in the balls and breaking his head open with any convenient object? Let's make an impact on illegal immigration. (BTW this wasn't an undocumented worker, this was a well documented criminal.) Here in the border states we were never supported in protecting the border. We are overrun with criminals, organized narcotraficantes and people with no ambition at all or interest in US society. Next you know there will be an MS 13 gang in Vancouver. This happens all of the time in Arizona, the Border Patrol routinely arrests illegal alien sex offenders entering the US. ::::::::::::::::::::::::::::::::::::: Report: Border agents arrest 3 sex offenders in southern AZ TUCSON, AZ -- Five people who reportedly entered the U.S. illegally were apprehended by Tucson Border Patrol agents over the weekend. Border Patrol agents used the Integrated Automated Fingerprint Identification System to determine that all five suspects had previous criminal records. The agents report that two of the individuals have reported gang ties with criminal offenses, and two had been arrested for sex crimes that include sexual exploitation of a minor and sexual battery. The fifth individual has been charged twice for DUI and been convicted for lewd acts with a child less than 14 years of age. All subjects were held for further processing. VIVA SB1070

This is an excellent job of investigative reporting by KING5. Taking this one case into account knowing that John Morton the head of ICE has gone on record stating that he will not uphold the immigration law that's on the books in protest of Arizona’s law is unconscionable. John Morton should be impeached from his post for this one case alone, as it is one of many. This is a tragic example of the risk this administration is willing to place on the citizens of this great Country for their own political gain. I am disgusted and outraged by these fools. This innocent women should not have had to face this captured and released criminal.

This is an armed and violent invasion. We are getting the drug runners, and many individual illegals acting as mules for a few bucks coming across the border, criminals who enjoy the fruits of violent crimes here while protected under the Obama umbrella with liberals such as Napolitano who will not deport these criminals until they are actually caught raping, robing, or injuring someone , and if they are discovered they hotfoot back over the border to slither back at a later date for more crimes. The invasion that Arizona, and the nation has been experiencing is much like when Castro emptied his prison of his counties worst felons, and sent them to the USA, we excepted them. Arizona spends over a billion dollars a year just for legal expenses, and incarceration of illegals for other mainly violent crimes, such as murder, rape, home invasions, pedophilia, armed car jacking, drive by shootings, armed robberies, the vast number of DUIs and i think you get the idea. That does not include the crimes such as shoplifting, ID thefts, fraud to obtain benefits meant for citizens, and legal immigrants, driving without insurance or license, etc.. The estimated cost to just Arizona to provide, health, education, and welfare benefits for illegals, and their litters is over one billion also, Arizona can not get the exact costs from the federal government , and it is illegal to even ask. We have not even addresses the jobs stolen from 15 million citizens by illegals throughout the nation.

Jose Lopez Madrigal isn't a bad man. He is simply a victim of a cruel racist society. He needs Amnesty. Sorry make that "Comprehensive Immigration Reform". Obama (El Presidente de Mexico) wants to make this man an U.S. citizen. Don't believe me? Don't think Madrigal will get Amnesty from Obama? Every Amnesty proposal I have seen so far allows the illegals to use any (fake) identity they want. All Madrigal has to do is change his name and he is home free. Sure ICE could check his fingerprints. However, do you really think Obama is going to check the 12-20 million new voters (and welfare recipients) his Amnesty will turn in loyal Democrats. Note that all prior Amnesties have included massive and overtly tolerated fraud. One example, Mahmud Abouhalima got Amnesty by claiming to be a farm worker... In New York City. He actually drove a cab before he blew up the World Trade Center.

Since so many lib cities (like my own, Seattle) are calling for Arizona boycotts, I say we boycott Seattle, LA,(and other "pro illegal" cities) and Mexico as well. I was infuriated by Mexican President Felipe Calderon and his scolding Arizona and our immigration policy while a guest in OUR house (the White House). And Obama just stood by....... I make it a point now, when grocery shopping, to buy US grown produce/fruit, If anything has a made or grown in Mexico label and I can buy US instead, I will. And while Mexico has some of the loveliest scenery and wildlife anywhere (been there 3x), I am not planning on spending my money there in the future as long as THEIR president disrespects our country's immigration laws.

California DOES have a law very mcuh like AZ 1070 (look it up: California Penal Code Section 834(b)). The problem is ENFORCEMENT. For some reason TOLERANCE has become a vertue. In the EU and surrounds, you have German, English, French, Spanish, Portuguese, Italian, Greek, etc. etc. You also have Flemish, Rumantsch, Basque, Romani, Magyarul, 3 basic groups of Slavic languages, Turkish, Hebrew, Maltese and so on. You also have foreign travelers from places like China, Thailand, Myanmar, Japan, the Pacific Islands, and so on. With today's mobility, it makes sense to use a universal "pidgin" traffic language for the sake of transient travelers and for general public safety. The Swiss have 4 major languages, but they don't legislate or contracts in all 4. Only 2 represent the majority of commercial discourse. we do not legislate in Spanish, Norwegian, or Afghan. We use English. Not necessarily better or worse than some other tongue, but good enough to meet our needs. Learn it or be marginalized.

This is our Federal Govt not doing the one thing they're supposed to, keeping criminals out of our country. I live in AZ and that is why we passed and support SB1070. We don't profile, we don't discriminate but when someone is stopped or arrested for a legitimate reason the police can now ask for id and if they don't have a valid drivers' license or some sort of id (Fed Law requires that guest workers carry their green cards with them at all times) they can be arrested and turned over to ICE. Unfortunately our Fed Govt doesn't care. They don't have the will to do something about this horrible situation. And, because of that criminals, drug dealers and other ne'er do wells are welcome to come to America and commit crimes. After their time has been served in a cushy jail they get sent home only to sneak back in through our porous border. Wonder what would happen to an American illegally in Mexico who raped a woman? Would the jail be nice? Would they see daylight again?

The AZ law was not the first. King Williams county in VA enacted this law three years ago and have enforced it. The savings to the county have been astrinomical. Crime is down 38%, saving to social services has grown and the number of births by undocumented aliens is is almost nil. The surrounding counties have done the same. The other day when I was at the DOL the two Hispanic men in line before me asked (in English) for a driving booklet. The clerk behind the counter asked if they wanted the English or Spanish version. GIVE ME A FREAKIN BREAK!! How much do you think that cost?! I'm so sick of this s***. I never use to be racist but I am now. Oh yeah, they asked for the Spanish version. I'm not against immigration - I'm against doing it illegally and the benefits that comes with it. When my ancestors immigrated from Sicily no one asked them if they wanted Italian versions of anything. My great grandfather became successful and wealthy in the pasta business and gave back to our country by donating pasta to our troops during WWII. There were many other causes he contributed to as well. How much of that do we see from the Mexicans - NONE that I'm aware of.

The apologists for illegal immigration do a great job of twisting the debate away from logic to emotion. This is not about race. Mexico also has a diverse citizenry, as do other countries to the south of our borders. It is not about Immigration. I see few, if any, who say no one should be allowed to enter the U.S. under legal circumstances. It is about "illegal". I have recently seen articles by folks arguing that, since we all break the law by speeding or whatever, we should throw open our borders to these scumbags and welcome them as fellow evil-doers. Such an argument is beneath contempt. Given the reactionary rantings of folks like Ran Paul versus the defenders of rapists like this guy, I despair for our country. Has our modern society outlived it's ability to function?

Now i cant walk into any store without someone in there speaking Spanish, the kids speaking Spanish. And most jobs now require you to speak Spanish. My 8 year old son had a hard time in school, because the teachers gave the non speaking kids more attention then the kids who spoke English. We took him out of that school and put him in one that has very little Mexican population, and hes getting straight A's. Not only is these illegals and non English speaking people taking up our resources, they are makeing it hard for our children to learn, because our teachers have to give most of there attention to the kids that cant speak English. I am sorry but if you cant speak English you shouldn't be in school. Learn before you put your kids in school.

I am so sick of people thinking that its OK not to speak English. This is America and people should have to know English. Look at Australia the prime minister. He made it a law that English is the primary language and it must be spoke, his words are if you cant speak it get out. They do not make there products in English, and Spanish or any other language. This country needs to stop having products in Spanish, needs to stop airing things in Spanish. If these people come to my country they need to understand what we say. Why should we spend millions of extra dollars to make it easier on them to enjoy our comforts when they pay no taxes or help this country in any way. When this country was young and the Irish, the Scottish and other countries came to America, they were proud to be American, they learned English they took English names to fit in. There was no Mexican/American no German/American. They made there children learn English and spoke nothing but.

I'd be willing to bet you that the time between 2003 and now when there is no police record it's because he was arrested elsewhere (maybe Mexico?) and held there for those years. Or he was using an alternate ID somewhere. He should just be legally 'euthanized' so the world can go on with one less 'bad seed'. Lock him up and he'll get out and next time he may kill someone (if he hasn't already added that to his growing list of crimes) Or doesn't the 'three strikes' law apply here somewhere....entering the country illegally NINE times?

Well that was 10 years ago. We were on assistance for about 6 months. I recovered from the injury and surgery and went back to work. But since then every time I look at my paystub and see the taxes I pay I think back to that lady and all her kids that she had on public assistance receiving cash and food stamps and medical.( Medical really gets to me because of how much I pay for medical insurance for my kids) She is getting all that money and she had all that cash in her purse. And I just wonder how many more are out there just like her.

@tapper, have you read the AZ law? It DOES NOT STOP racial profiling. In fact it clearly states that skin/nationality can't be the ONLY factor, but does NOT prevent it from being a factor at all. Read the MF law before you say it makes provisions to prevent targeting minorities when it DOES NOT. Take the recent article about the sex offender who was deported 9 times! It shows that deportation does not work to prevent these people from coming back. Instead of forceful deportation, why don't we actually work at finding a solution that works instead of becoming like all the countries we hate. @maynard, english is actually not manitory to be here other than people should understand it to be able to communicate. However, the traffic signs used around the world are fairly universal in color and shape so that people understand the meaning without having to actually read them without understanding the words.

Tapper I am in the same boat. I have been out work for 2 years, I got jumped by some Mexicans (not sure if legal or not) but they didn't speak English at all. I got most of my teeth knocked out, and having no insurance i went to dshs to try to get medical. they refused me , I am a male man 40 years old and not able to get medical, but there were at least 10 women in there that didnt speak a word of english with new babies and getting medical and welfare. How is this fair that i pay taxes for over 24 years at least and can not get help when i really need it. I have never had assistance before and these people can come into my country and soak up all the resources needed by Americans. So basically it is hard to get a job as it is, now with a messed up mouth, it makes it even more hard to get a job, because i look like a meth head with my messed up teeth and my own state wont help me. God bless this country!!

Continued...Anyway I saw this same woman at store the very next day. She was in line in front of me at the money center. I was there to get a money order to pay rent. She was getting 6 $500 wire transfers to Mexico. She had a roll of cash in her purse that was friggin HUGE!! My best guess is that there was 10 to 15 thousand dollars in there. On my mother's grave I swear this is true. So W.T.F. was she doing at the welfare office!!! Yes I agree that I am profiling here but I am assuming that she is an illegal, she is recieving public assitance and she has a roll of cash that I think came from drug deals. Now could I be wrong... YES. But what would you think? Wouldnt you want to know? Since you are funding the public assitance don't you have the right to know?

The only people that have to fear this law are illegal immigrants. The fact is and I believe it has been proven here in this forum, that the majority of Americans support Arizona. @tapper: The problem lies in that it's so easy to find something someone is "doing wrong" to necessitate the IDing of someone. Be it, swerving in your lane (a favorite to nail secondary offenses), "suspicious" behavior, etc, they will find something. Sounds to me like it's not too far from outright stopping of people and demanding "papers please!" Seems like the government overstepping their boundaries and interfering with civil liberties to me. In the State of WAHTF L&I makes rules that if you are under 18 you cannot operate or work around machinery. Thus making it so our youth can't go to work in E.WAHTF to work in the orchards or fields. Allowing the youth to do this would build a work ethic,give them some spending money,teaching fiscal discipline and the value of money and a job. Instead the youth are told sit around ,play video games,be bored and do drugs,or join a gang . Youth can mow their own parents lawn ,but not their neighbors ? Look in grocery stores. The reason the under 18 group can't work there stocking shelves is ??? Buellur ,anyone ??? Because when the box is empty they can't put it in a cardboard baler. ,which is classified as machinery. I don't have any problem proving my citizenship. I provide proof of it when I get hired for a job, buy a house change my driver's license. In fact because I have a hazardous materials endorsement on my driver license I have to go through a FBI background check and had to be fingerprinted as well. So what! I have nothing to hide about where I was born!! Walla Walla, WA!! Reform is simple. Proof of citizenship for drivers license, employment, buying property.( I would also include licensing a vehicle and opening a bank account in this.) Also proof of citizenship for ANY public assistance. Enforceable laws that punish employers for hiring illegal immigrants. Don't take offence to that because there are LEGAL immigrants and seasonal workers with proper documentation that CAN be hired. I have no problems with Hispanics, I work with them 5 days a week. I also know an immigrant from England..Nice chap :)

My home was burlgarized by an illegal from Santiago Chile. It took forever to get him deported. Though he was picked up numerous times for other offences he always managed bail. Even immigration had him under their wraps and he made bail again. Yeah, let him make bail cuz we all know he will show up for his deportation hearing! Finally he was deported which in my case he was physcially escorted back to Chile and turned over there. Am sure he'll be back.. big money and drugs to be made in the US.

As the result, the border control is miserably weakened. But this rape repeater is a product of our law being tender and kind to all rapists. Maybe the Seattle City Council - after their vote to boycott Arizona - maybe they should read this article. They are out of touch with the problems of immigration. There is a recent story where 12 Mexican citizens are suing an AZ rancher for keeping them from crossing his property to gain entry into the US - and a judge is letting the case go to jury. They aren't US citizens! How can they sue that rancher. It's a mixed up world. I think the Seattle Council who voted unanimously to boycott AZ, would spend their time fixing the problems of Seattle and not try to control Arizona! They are out of touch and so are the Feds on immigration issues. They think they are so cute with their little boycott - this is why the incumbents are in trouble - they are too arrogant. Simply put it allows an officer to question the legal status of someone who has already commited another offense. Let's say an officer pulls over a vehicle for speeding or having a tail light out and the driver cannot produce a drivers license or any other form of ID. At this point the officer now has a person who cannot be properly ID'ed. Most states will arrest a subject that cannot be ID'ed so that they can see just who they do have. Even if your a redneck hillbilly like me!

They will come out, or come in, whatever, after living in their hotel for a while. But, once we reform the moderate death penalty against the rapists, don't deport the foreign rapists. All rapists must be enforced to pay the exact equivalence of the victims' devastated lives on the soil of the US. Then we would recover true liberty with responsibility in our society, that we have been missing.

In our throw away society we seem to throw away everything we don't want or disgusts us except people like this who cause unspeakable harm to so many others. It is too bad that most of us have this streak of decency that won't allow us to simply throw away people like this man who has caused so much damage and will probably continue to do harm until the day he dies. So we retain our decency by not putting him to death. At the same time many other people's lives are destroyed by this man. Which is worse? A tough question. When will the process of law become more than just a process and actually begin producing results that will take people like this off the streets immediately when it becomes obvious what type of human being they are - which is to say the FIRST time they deliberately and with malice commit a terrible crime against another human being? On top of everything else, we don't need to additionally endure the hurt caused by a failed legal system that supports this man.

A drivers license is questionable at best due to the fact that there are states that don't require a birth certificate to obtain one? New Mexico for one. We should all be nervous about this- I agree. The one point I take issue with is that sexual assault is not prosecuted in most other countries. Therefore its unlikely he would have been prosecuted or served time in Mexico for this.

Those of you who are touting the Mexican form of government are usually the first ones to say we have too much government. Which is it? You use immigration laws of other countries as pillars for the US to model but would you want to live there? Don't get me wrong, I'm all for a reconstruction of our immigration laws. But we've been down this road many times before by 'profiling' suspected illegal immigrants/ citizens and people. Native American relocation? Japanese Internment? Mexican Repatriation? Yes, citizens who had birth certificates on them were tossed on the train to Mexico anyway! Round up the brown people or the people with funny eyes- hey lets bring in slaves! And what about those Irish Immigrants? As soon as they got off the boat during the civil war- and before they could grab their luggage- they were forced on the battle field. Then discriminated against AFTER the war. Sure this guy is a criminal and needs to be jailed and deported permanently.

This has been what's going on in Arizona times 10,000. And that is why they passed a perfectly reasonable law, a law that does nothing more than mirror federal law (which isn't being enforced), a law that is less onerous than the illegal immigration laws that exist in virtually every other country in the world. This never would have happened with an American Citizen in Mexico due to the fact an American Citizen would never have deported 9 times. An American Citizen who is found to be in Mexico illegaly would be thrown in jail for quite some time after the second incident, and for many, many years after the third. Every state should follow Arizona's example.

If he was put in prison for past crimes instead of released / deported he would have been still in prison and would not have committed the rape. he was a three strike felon who should have been in prison. There are lots of countries that have some illegal citizens and I suppose that would be no big deal here but 20 million illegals is a bit much. It is really inviting the third world in to colonize and change the culture of our country. I blame many of the people in this country who use them as cheap labor. Many of the jobs I or locals did back in the 70's and 80's (construction,factory restaurants...) are now being done by these people. Sure we Americans won't do them now, We cannot afford to live off these slave wage jobs. The jobs we have now are threatening to disappear by offshore or H1 workers as it is. I blame the open border problem that was created as much by the Republicans as by the Democrats. I do agree that our immigration laws need to be enforced by strengthening our borders and our laws. We need to enforce our labor laws and make a American job worth something again. We either keep our middle class strong or we slowly slip into the third world.

Let's hope the victim can sue the appropriate government agencies for failing to protect her and the public at large. Yes, I know that sovereign immunity may protect the feds and any monetary award from a state or locality is just taxpayers' dollars/pesos and thus won't hurt as it would an individual or a corporation, but this and no doubt other crimes likely wouldn't have happened if the alleged individual had been tracked with the same vigilance most of us are when we have a few outstanding parking tickets.
