Mother struggling with landlord over flooded apartment

KENT, Wash. – A mother of two is dealing with a Christmas nightmare. Her apartment was flooded more than a week ago after a pipe burst and she's still waiting on the landlord to address all the damage done.

Sarah Timmons and her two young children have been staying with family, even though the property manager at Chandler's Bay Apartments claims repairs have been made and the unit is livable. Fresh off a nasty divorce, Timmons says she's now fighting for a safe place to live, and it hasn't been easy.

The pipe burst in Timmons' third floor apartment on Dec. 11, flooding her unit and two more below her.

"We opened the door and there was enough water to be dumping out the door," said Timmons.

Timmons documented the damage. The ceiling collapsed in the closet. Fiberglass is everywhere. Outside, the roof is bowed over the doorway. And more problems are showing up.

"You can see holes in the wall. It's just getting worse. Dry rot, issues with mold and infrastructure," said Timmons.

There have been some repairs made. The carpet's been replaced in one bedroom and the collapsed ceiling in the closet is repaired. But Sarah says that's only the tip of the iceberg. Fiberglass still covers the floor and her belongings where 2-year-old Margot likes to play.

"It's an unhealthy environment especially for kids on carpets. They play on carpets. 2-year-olds are known for that," said Timmons.

Even Margot got to work trying to clean up the mess, which is more than Timmons can say for the landlord.

"I just don't want to deal with it anymore. I just want to get my kids back in a stable environment," she said.

We spoke with Equity Residential, which owns Chandler's Bay. They tell us they have offered to move Timmons to another unit, but only if she signs a waiver releasing the company of any further liability. Timmons doesn't want to sign it since she also hopes to be reimbursed for her damaged belongings and her rent pro-rated. Equity Residential says they weren't aware of other problems but promises to work directly with Timmons to reach a resolution.

Sarah is a kind and honest woman. I sincerely wish the best for her and her children. The place was a mess because it was flooded. It's obvious that she had picked up her belongings from the floors so that they were not water damaged. It's completely understandable that she was upset.

First of all, GET a FREAKING LIfe carlconstantine!!! Do you really think the poor girl piled her stuff up like that on purpose? She said in the interview she hasn't been there since the flooding, she's probably waiting for the Loser's insurance to reimburse all her damaged furniture. Her apt flooded Genius.... For those still remaining at Chandler's Bay, GET OUT NOW while you still can. It's only a matter of time until something like this happens to you. As for mr/ms constantine, what ever you are, sounds like you have personal issues, a little angry maybe? SEE A FREAKING Therapist!!!!

I sued them a year ago because they left my family without power for three months. The courts awarded me my rent back but they never paid.

What a freaking cry baby! The little girl was cleaning up while her mother did nothing but complain and cry... It appears that the mother was not a very good housekeeper BEFORE the flooding took place. So what does she want? The landlord to come in and do her housework already? The landlord is just the landlord. They can't do EVERYTHING freaking for you!!!

Here are some .gov resources if Sarah Timmons happens to be reading this or if anyone else in a similar situation: -- Contact the Building Services department from the City of Kent: www.ci.kent.wa.us/buildingservices and ask if they can do a structural investigation of the property. -- See list of 3rd party tenant unions from the City of Seattle's Web site that may be useful to communicate with landlords: www.seattle.gov/law/faq.htm#Landlord -- Read over rights and responsibilities of tenants and landlords by the State Attorney General's Office: www.atg.wa.gov/LandlordTenant -- See tips on how to clean up after a flood by the King County Health Dept.: www.kingcounty.gov/health/disaster Read over your signed rental/lease agreement including all the fineprint that may describe who is responsible for what. Ms. Timmons was wise to not sign the waiver releasing the rental company from liability. Contact a lawyer if they bring that up again.
