Family files police brutality suit against Seattle Police Dept.

Seventeen-year-old Joey Wilson called a neighbor for help soon after a police officer stopped him for jaywalking across a Queen Anne street.

When the neighbor arrived, he thought the situation was getting out of control, and quickly went back for his camera.

Joey explains what happened next.

"Two officers grabbed my arm. A third one started punching me. In the stomach, in the nose. My hands were being held I could not defend myself. I was thrown to the ground and I was kneed in the face. I felt my nose break," he said.

His mother, Mary Wilson, raced to the police station to pick him up.

"He was dazed, he couldn't move his neck. He was bloodied, his clothes were full of blood. And I put him in the car and drove him to the emergency room," he said.

Joey had a concussion and broken nose.

While any mother would be troubled to see their child like this, Mary explains that Joey is mentally disabled.  He was born three months early, weighing just one pound, and has been in special ed his entire life.

"Joey doesn't reason or process things the way that you might expect from a person," she said.

Joey's lawyers say the family has tried to get information from the police department and the city about this incident and the officers involved.

But they say after getting no feedback for more than a year, they've decided to move forward with a lawsuit.

"The police, who are here to protect and serve us, must also be subject to the law. In fact, if anything, I think the public expects them to perform at a higher standard," said attorney Charles Swift.

Joey's mother says she could understand if Joey had gotten a citation for jaywalking, but insists there is no justification for this.

"I can't believe the police would do this to me. I did not do anything wrong. Before this I trusted the police. Now I am afraid they will hurt me again," said Joey.

Lawyers for Wilson says they have not set a dollar amount yet, in terms of what they are seeking from this lawsuit.

The Seattle Police Department has released a statement which reads in part "…the suspect was noncompliant and resistive when contacted by the first officer; the back-up officers were responding to a "Help the Officer" call, which is the highest priority request for assistance; responding back-up officers had no knowledge about the incident, only that a fellow officer needed help. And the suspect continued to physically resist even after back-up officers arrived."

The statement also says "The specific force used by each involved officer was detailed in a Department Use of Force report.  A thorough OPA internal investigation was conducted and the four involved officers were exonerated on the allegation of 'Unnecessary Use of Force.'”

do any of you know anything about the law? first the is no special laws that make worst to assault an officer. they call it assaulting an officer because if you assault an officer then that's what you did. The punishment still carries the same range as a normal person. Will the judge be harsher on you? ya probably, if you got to choose how to punish some one for assault you would punish someone harsher for attacking a family member of over a total stranger. As for the d-bag who "got assaulted" maybe he shouldn't resisting arrest. Did any of you ever think maybe if the parents raised the people right and to respect the law rather then being hoodlums and always being aggressive towards the police; maybe the police wouldn't have to be such dicks back. I also love all the horrible videos of the police doing stuff always starts up half way through. like the recent one with the black girl who got popped in the mouth for jumping in a trying to help her friend not get arrested.

If this is an example of how the SPD "protects" the public, we don't want any of their protection. A severe beating is not reasonable "protection" for "J" walking.

There is a second video of another incident in Nov. involving one of the cops in this video that I have seen. All I can say is the SPD are in big trouble and we the taxpayerswill be paying out big bucks. Naming Diaz head of SPD will mean status quo. None of this will change. Police should be trained in de-escalation techniques. And OPA is just a branch of the police to justify this type of behavior. By the way, my son knows this boy, and he doesn't have a mental illness as some have written, he is developementally disabled. And as some have suggested that he was "off his drugs", you don't give drugs to DD people to correct their condition. There is no cure. Also, how do I walk to my neighbor's house across the street now. I guess I'll drive the 50 feet so I don't get ticketed. And Dede1978, you'd have fit in really well in Germany in 1938

sounds like the officer who made the call for help was inept at his or her job,why escalate to this degree of violence over jay walking? i don't understand. the men and women in law enforcement have my deepest respect, but this is troubling.

the law, why shouldn't a cop. Even when a cop is fired because they were wrong, they don't go to trial. WHY NOT. If I say you assualt me and i show a tape like that, I would be arrested and charged, but NOT a cop. But, I have one thing for you to think about...... YOU MAY BE NEXT!!!

I saw one posting saying they were ordering the kid to lay on his stomach and the boy didnt comply. BUT, at what point does a JWALKING turn into an arrest!(maybe if the JWALKER is a felon, not a boy.) You say what are the cops suppose to do. Well, I will remember the next time my children don't listen to me to have my wife hold them why I punch them in the face. Guess that would solve it. And I will tell my son that next his sister doesn't give him his toy to beat her up. COME ON!!!! And it doesn't matter what happened before the tape, you know why, because in the video they are infront of the cop car. WONDER what was on there fed. camera!!!???? Nothing to show they are not gulty. I was in a law enforcement trade school class, and they never taught us anything about punching 17 year olds that won't listen. What kind of cop can't set a 17 year old boy on the ground and cuff him. Amd YES people, they are sueing, because what other option do they have. The city wants maney when we break..

Is it me or has King 5 been editting their video story. I have been watching over and over again over the last few days, and I see they have slowed video to show the officer presumebly punch the guy. In last reports they used to show, where once the officers thought they had him compliant, he tries to get away, and it all starts again. With out seeing how it started, I know I can not take any side, but I see biased reporting here. I hope this gets posted, since everyone gets to comment.

I don't believe that it's actually jaywalking when you're crossing anywhere between 2 unsignaled intersections. Jaywalking is when there are 2 signaled intersections and you go against the signal or cross somewhere other than the crosswalk. I remember looking this up a couple of years ago when I saw how many jaywalking tickets are issued compared to failure to yield to a pedestrian in the crosswalk. The data says that the failure to yeild are where the fatalities and serious injuries are. Cops say it's more trouble to pull those drivers failing to yield. I imagine that's true when pedestrians are such low hanging fruit.

First off....ALLEN SCHAUFFLER from this video it looks to me like you are J-Walking and you had better turn yourself in! They have video proof! Next beating. I can see from the fast moving cars that about ran you over while you stood in the middle of the street that the police had good reason to stop this person. I can see how this person could take all of the police officers away from busting crack heads and murderers since there is no money in busting crack heads and murderers but there is money in busting J-Walkers! This is so stupid! COPS go and bust a meth dealer! DO some good for your pay rather than collect revenue from the people. Oh sorry that is your job! Your job is no longer "To Protect A Serv" you took that off all the police cars as that is not what the police are all about. You are paid to collect revenue for the city, county and state! This is not about safety but money! It will cost us!

The best solution is to eliminate all the special laws that make assaulting a police officer worse than assaulting a contributing member of soceity. Also, no police dept should ever conduct an investigation of an officer charged with misconduct.. A grand jury should be convened led by a non attorney. Lastly, there should be no police unions. If it was hammered into the heads of cops at police academy that they must always follow the US constitution and ignore all "laws" that are not in harmony with it and that cops are servants who must ALWAYS show the utmost concern and respect for their superiors, the taxpayers then I think we could go a long way towards minimizing the A-hole cop syndrome. You know what they say... 99.99% of cops give the rest a bad name.

Yes matthias, this will be my last comment but I do want to clarify in case you didn't get through all the comments. Never once did I say this was justified. I did quote the statement from SPD that the officers were exonerated based on both officer statements and the police car video, which I get the impression that the entire incident was recorded, for a reason. The only point that I was trying to get across to other posters is the bottom line. He was stopped for j-walking, which we all know is illegall, and he should have cooperated. There is nothing to convince me that he did that and nothing to convince me that the officer took the action he did without cause.

Yes, I usually ask if they would run the red light if they were driving, to me it's the same thing, or ask them if they can read. I've also called bicyclers on the same thing. Called one an idiot as he almost hit me crossing the street. He stopped and said "what?" and I continued to tell him that he was subject to the same traffic laws as a driver. I'm not shy. And no, I'm not saying that what happened is okay, only that there is more to it than the neighbors video. I would like to see the police car video, but the bottom line is, if he had cooperated, this would not be an issue. Why do children of this generation think they don't have to listen to a police officer? As I've said before, if he truly trusted police officers before this incident, why didn't he cooperate? Seems to me that would have been the best response.

You have not asked a question that I would have the answer to Dede, and you have not answered my question. Why bother escalating the situation? But you go into what if's, well what if one of the officers had landed a punch to Joey's temple? Very possibly causing death. Or broke a rib which then punctured Joey's lung. All of the sudden the cop just killed the kid he was trying to save by approaching him for J-walking on a residential street. Then what????? Again, the officers involved had an opportunity to diffuse the situation and the did not. Rather they chose to turn a simple J-walking into a police inquiry, a law suit and public outcry which further diminishes the public opinion of the police. Now Dede tell me, was that the best decision? If you honestly believe it was then I shall choose to ignore you as you are clearly incapable of rational thinking.

And no, I'm not basing my entire opinion on what the cops say, I know people don't always tell the whole truth or any truth, I raised two children I know. They reference the police car video, so show me that and I'll change my mind. As I said before and so have others, you don't agree with what is happening, then you handle it in an appropriate manner. The officer decided to stop the kid, so he should have cooperated, then taken them to court for harrassment if he wasn't ticketed, and if he was, then fight the ticket in court. There are proper ways to deal with these things. Again I ask, if he was so trusting of police in general before this happened, why didn't he cooperate?

Actually matthias I would not call 911 for a jaywalking offense, I usually call the individual on it at the time I'm standing next to them and they do it. I was also stopped, as I mentioned in an earlier post, for jaywalking a little over 20 years ago. I stopped when the officer asked me to, I provided my ID when he asked for it, and I told the officer I would not do it again, which I haven't, and I walked away without a ticket, just a warning. Although I'm sure, had I not complied with the officer he would have had just cause to escalate the situation. Let's just say that he chose to ignore the jaywalker while he was strolling down the street chatting on his cell phone and not paying attention to traffic as he's walking across the street? A block later, he gets hit and killed, then what? People get hit on residential streets as much as on busy streets. But you haven't answered my questions. So?

Police have discretion on their side. They can choose to take action or to not take action. As well they can choose to back away from a situation. What cop who is not simply acting off of his or her ego would let a jay walking incident escalate to this point? Was it really in the best interest of the police, the city and the public to become involved in a physical altercation stemming from a J-walking incident on a residential street? If it were a busy street I could maybe see a reason for a focused intervention but that was not the case. Dede BE QUIET! Your statements are lacking in any substance what-so-ever. "The cops said this is what happened so this must be what happened" is a pathetic stance to take. There was no danger to any person at the time, nor danger to any property which is exactly what the police are assigned to protect. More info is need to comment on this situation. Yes it does appear that the police are over reacting to a simply jaywalking incident, but the video also shows no evidence of what was said or done by the "jaywalker".. Hard to make a conclusion, but these kind of things with the Seattle Police are happening way to often. And on Queen Anne? Please!

The bottom line matthias is, if he had not taken the time to call the neighbor and cooperated with the officer, I'm convinced that this would not even be an issue. I've said it myself before as well as others commenting, children now do not have any respect for law enforcement or any figure of authority. And please don't tell me to "be quiet", it will only provoke me to say more. I say, ask the SPD to release their video and prove that they didn't attack this kid. Again, all he had to do was cooperate. And if he had respect for the police before, why didn't he cooperate? Why wouldn't he give the officer his name? Why didn't he get off the street? mattais first of all I won't be quiet. From what I see on the video that the neighbor had time to run home and record, rather than take a moment to let the officer know that the kid is "mentally disabled" or "slow", that the kid was combative and uncooperative. Why instead of doing what he was asked did he feel the need to call a neighbor, why didn't he call his mother. Also, the statement that I did read completely reference the police car camera that showed the initial contact between the officer and the kid and that when he tried to get the kid out of the road, again he decided that he was going to stay in the street. I'll say this much, I'm am so tired of driving down a residential street and find idiots walking and running in the street rather than on the sidewalks, which are there for that purpose. And from what is in the "statement", that is exactly what the kid was doing, as well as crossing without looking......

Dede, the police statement said that the back up officers who arrived on scene had no idea what was going on. Did you not read the statement yourself or just choose to ignore that part? If you do not know what is going on then why would you suddenly jump in and start beating on someone? But yes, as mentioned, it was in fact the police making the statement who are the ones in question. I am sure that everyone believed O.J. when he made his statement of innocence right? For that matter most of the people locked up in jail who said they didn't do it must be innocent too. Set em free! There was something that was missing from the video. It was an officer writing a report. Why was that? Don't you usually see police officers writing reports after an incident? I do, at least the GOOD ones. No I do not hate the police, I just really do not like the bad cops. And FYI Dede I am a Law and Justice Major and through my work I am closely involved with SPD daily. So be quiet please.

Hey bobknows, bobknows, wow what a handle, anyways what do you think a good police by your standard should be like?? Should they sit around and watched people jaywalked cross the streets and possibly get stuck in the tread of a tire? Don't know the full detail to this story, but before you unload that bobknowledge on full automatic you should take a trip to some of those other countries, like central America or the southeast Asian countries. I think you should, if you have issues here with the way the cops do their job than you'll love it there in those countries. It give you the opportunity to come up with new words that is worst than goons and blue gun thugs. So increase that bobknowledge, take a trip down in those wonderful countries and experience their law enforcement.

Hey Yogi: When seconds count, the police are minutes away. I would much rather keep my tax money and do away with the police and rely upon defending myself. I have never encountered a cop who I thought was worth a cup of warm spit. I have seen them commit perjury. As a matter of fact every cop I have ever seen on the stand was a liar. I'm going to ask my state representatives and senator to sponsor legislation that will make ANY police brutality a mandatory death penalty for the police. I also want legislation so that anytime a police officer commits perjury, he/she is executed. If a cop sprays a person with mace and it is not called for, kill the cop. If a cop tases a person without good cause, death. The problem is that police are made to feel that they are somehow better than the working elements of society. There is special legislation making it a more severe crime to assault a cop or to kill a cop. This has lead to cops thinking that they are superior when in fact they are inferior and are really just servants, not too inelegant servants at that. I urge all of you to also write to your elected state legislators asking for support of the "Police Accountability Act." Be sure to tell your reps that it is "For the Children.

Combine that with knowledge that Gun Thugs from all across America proved to SCOTUS a few years ago that LYING is part of "good" police work every day. SCOTUS accepted their briefs and warned American citizens NEVER to believe anything the blue gun thugs ever say. They are sworn liars who willingly lie to the public. The kid was wrong not to cooperate. The officers were wrong to use excessive force. Not sure if all officers used excessive force. The third officer running in and throwing a punch seems to have. Two officers have his arms and the third runs up and throws a punch to the face. Seems excessive to go in throwing punches is all.

washingtonian, blackhand, matthias and others with the same opinion... With attitudes like yours, it's no wonder that the children of this generation have no respect for law enforcement. If you would please read the statement from SPD, you'd see that the kid did not cooperate from the beginning. Even the simple request to identify himself. He refused to get out of the street and became combative, rather than comply. Now even the most simple minded out there know how to provide at least their names. Your comments only lead me to believe that you're part of the problem and would find yourselves in the same situation as this kid did, because obviously you would not comply either.

first of all, if this person is mentally disabled teenage boy, what is he doing out by himself? if he can't reason or process things like others wouldn't it be dangerous from him and maybe even others if he wasn't with someone who can reason and process like others. how were the police to know that he was mentally disabled. all they had was a man who was resisting even when backup came so they took necessary force to subdue him. Last of all, if the man with the video camera was so concerned why did he not explain to the officers about the boy's handicap, that could of easily explained why he was acting in such a manner and then the police could of handled the situation differently. Instead the man rushed to get a camera to film the end results of this situation... maybe to make sure he got his cut of the lawsuit?

I love how some of you can make threats against the police. Your comments about "shooting pigs", and "blowing their heads off" needs to stop. Would you walk a day in their shoes? I didn't think so. So unless your willing to step up and do this shut up. The Seattle Police Department does have a civilian board which reveiws cases like this. So both the departments Internal Affairs, and this civilian board looks at the case. Yes its a jay walking violation but this kid made the choose to take it to the next level by not listening to what he was being told. If he had shown some very simple respect to the police, and complied with their directives he probably gotten a warning and sent home. But instead he decided to fight the police. I agree with a previous comment if he had mental issues that bad why wasn't he supervised? Stop using his mental disorder as a crutch. During is interview he sounded, and acted just fine.

Agreed (somewhat) I think the list of people who are for out local police agencies is shrinking and the list of people who are against them is growing. I do not think there are a lot who would actually consider shooting a cop but there are plenty who or dissatisfied with the police.

How does the statement exonerate the police? The statement says the back up officers did not know what was going on so they started beating the kid. Bottom line though, the SPD needs to go back to the community policing model otherwise they are just going to continue to see millions of dollars go out the window each year with lawsuits. Whether or not the officers are exonerated, it still costs the city a lot of money for the investigation and the time in court.

If he had cooperated, I'm certain he probably would have gotten a warning rather than a ticket, as I'm sure he hasn't had any previous run ins with the police. But how would they know that when he would not tell them who he is. The bottom line, teach your children to cooperate with law enforcement and this kind of thing won't happen. I was stopped over 20 years ago for jaywalking, I cooperated, gave the officer my ID and all I got was a warning. And for the record, I've never jaywalked since.

Maybe all of you running to the defense of the kid should read the statement from the SPD. It very clearly exonerates the officers. There was video running on the police car cam and very clearly shows what happened prior to the neighbors video tape. The officer was concerned about the kids safety. He was walking out into the road without looking for oncoming traffic and talking on his cell phone. Then he would not cooperate when the officer tried to lead him off the street, would not identify himself and became combative. As others have stated, if he is that mentally incapable of understanding simple directions from an officer, then maybe he should be supervised, and seeing the video interview with the kid, you can't really tell that he is "slow", so I understand why an officer would not recognize it either. I think mommy is after the money and nothing else. This was her failure for not teaching him to cooperate with the cops.

First off, gotta say this is pretty wild for a jaywalking beef. And the street it occurred on looks very residential, quiet and suburban-like. Seattle cops don't fool around! This would NEVER happen where I live in Boston LOL! People for better or worse jaywalk everywhere...it's a way of life. The 'Kid' (A.K.A. 'Joey'; reporters might try and be a little less biased and refer to him by his full name...'Joey' makes him sound more innocent and child-like) is physically impressive....he looks like he could cause serious damage if he wanted to, so I understand why the cops had a hard time dealing with an un-compliant 'Kid'. WOW what you have here is a family trying to reach into the deep pockets of the City of Seattle. First of all blame the parents in this situation. If you know your son suffers from a mental disorder ensure he is getting the proper care from a doctor which includes medication. I have worked with people with mental disorders for over 12 years, and its been my experience that when they off their meds they can be very violent. On their meds they are just fine. This kid openly admits "they had my hands and I couldnt defend myself". You hear the officer in the video shouting oders to the kid to get on his stomach but he is to complying with their directives. What are the police supposed to do when they encounter a person who is being defiant, and not following directives just walk away? Also kids now days have no respect for law enforcement. They run around like they own the world, and everything has to be given to them. There is no sense of personal accountability.

I can't understand how any crime as small as j-walking could end up with force such as this. Not to mention that it is a 17 year-old. Now i am from Ohio, but here children don't get arrested for j-walking, the cops call the parents to come get the child. The report says that the neighbor got the video camera after the whole thing started. But, I ask you, how many cops do you know can't take a 17year old, yet the video shows 2 cops holding the 17 year old boy, and another cop punching him in the face?! If that is police policy, then I am teaching my kids to run from the police. Thank GOD, they didn't have teasers. If that boy would have got a brain injury and died, how would you respond? Let's think back to the transit tunnel beatdown incident in Seattle. Look at the more recent incident of the video of the cop punching the girl after her friend got involved. What do they have in common? Dirt. Special needs or not he resisted. He resisted to the extent that he used a cell phone to call a neighbor while an officer was attempting to cite him for jay walking. A long long long time passed from the intial stop to the taping that you see. Long enough for the LAWBREAKER to call a neighbor, for a neighbot to go to the scene, for the neighbor to then go back to his home to get a video camera, for that neighbor to then return to the scene and then start taping only the very end of a long drawn out confrontation where the LAWBREAKER refused to comply with lawful orders issued by the police. BRAVO to the police for the restraint they showed, so the LAWBREAKER got a little hurt. Boo Hoo. Could have been worse. Can we all stand in line to sue his family for not properly supervising this special needs LAWBREAKER. What law will break next? Why do so many people always think that the beginning of some video is going to show that the police were in the right for killing or injuring someone? Maybe they did not show the first part of the video because it showed one of the officers smoking weed while the other performed unmentionable acts on yet another officer before they all stared beating down some kid for j-walking. I have not seen the entire video, but Joey appears perfectly capable to manage his behavior. We all know improper uses of force take place. However, just because force is used does not make it excessive. Using force is ugly and shocking to the average person, but it's often necessary. It doesn't matter what the crime, cops can't walk away when someone is not obeying lawful commands. Often, citizens do not think commands given by police are lawful, right, fair, simple, nice or easy, but that doesn't mean they can act w/o repercussions. If a cop wants to arrest you, let him. Sort it out in court. Hire a lawyer. If one resists or fights, he should expect to get hurt. Also, realize that MORE officers often = LESS force. If a single officer has to escalate force to win a fight, the result will nearly always be worse for the suspect. also note, in the eyes of an officer, when you fight, prior events do not matter; you become a "bad guy" and will be treated accordingly.

I have worked with individuals who have Autism as well as being involved with helping to implement a DDD program at an institution, and have a degree in Psychology. I am sympathetic to all individuals who have a developmental disabilities that is if they truly do have a developmental disability. Dakota, police do have extensive training in mental disabilities and how do deal with each one. However, in a fast and volatile encounter like this, there is no time to diagnose the subject and play psychiatrist. The cops didn't know what they had and took care of the situation. Better for the kid to have a few bruises than have a dead cop. If the kid is unstable, DON'T SEND HIM OUT ALONE! What would have happened if he encountered some street thugs?

Yes they may "seem perfectly fine" when people are talking to them, but their thought process differs from "normal". They may be fine when in a normal social situation but totally freak out in higher stress situations, such as interacting with a police officer. I have an autistic child and in most situations he is just fine, but there are certain situations where his thought process gets so confused that he panics. Parents and professionals who are around the developmentally disabled on a regular basis can recognize the subtleties of a developmentally disabled person usually before any major behavior differences happen. I wish that Police Officers would get more training on this. I feel that our Police do a great job in general, but they are not being educated enough on how to recognize developmental disabilities.

Yes, the initial contact may have been for jaywalking but...what occurred between that initial contact and the time the "helpful" neighbor arrived with his camera? Was the subject calm and cooperative? Somehow I doubt it. According to his mother, "Joey doesn't reason or process things the way that you might expect from a person" If the officers weren't personally familiar with the individual, how are they to know this? If the subject became argumentative or aggressive, the amount of force may escalate in response. It's pretty simple, people. If you fight a police officer, he/she will fight back. If you attempt to flee from a lawful contact, you will be chased and apprehended with whatever force is NECESSARY to get the situation (you) under control. Is the family right to sue the department? Maybe..without the officer's statement or report, WE DO NOT KNOW THE WHOLE STORY!

Thank your lucky starts you are not in Spokane. The police here tasered and hogtied a young developmentally disabled man - he suffocated while he was hog-tied. As to resisting arrest - when you KNOW you haven't done anything wrong, and the cops start manhandling you - it's disbelief, confusion, frustration and anger that causes you to twist and turn, trying to explain they are making a mistake - that is hardly "resisting arrest" , but self-defense. Second, I'm not convinced that the kid completely cooperated with the officers when he was initially stopped. I'm sorry if some of you don't agree with me, but I don't believe that the officers would have done these things if he had cooperated fully at the beginning. I've said it before and I'll say it again, and I've raised my daughters with the same instructions, if you are stopped by a police officer, regardless if you agree or not, you cooperate and fight it out in court, period. And this kid looks like he is fighting it all the way to the car. Don't get me wrong, I'm not saying there is not excessive use of force, but even after they got the handcuffs on him and is escorting him to the car, he is still resisting.

But I understand how the people base cops, they're are only bad people when they cite us for going 50mph in a 25mph zone. But when they save you from a sex predator, they're considered heroes.

After seeing this video my opinion is that there is a serious disconnect between SPD officers and the public. I think both sides have strayed away from the level of respect we should all be giving each other. When I was young I was taught that you never resist arrest or put your hands on a police officer. Now, with that said, I can't recall officers ever breaking peoples noses or giving them concusions. Maybe things like this happened but back in the day the level of news the public had access to was limited. We all know that today everyone has a camera or access to news. Bottom line is I think we as citizens need to remember the level of respect we need to have for officers and vice versa.

Oh yes, they DO do these things! My brother was at a peace demonstration in Seattle back in the 70's. Just a bystander and not into violence at all. He got pushed out from a crowd and the cops grabbed him and starting beating him. We saw it on TV on the news (my mom and me). We saw him laying in the street in his own pool of blood while the tac squad were kicking him. He was totally unarmed and in court they even said he had no weapons. He ended up with broken ribs, and a deflated lung 90%. His head was split open and needed stitches. When it came time to going to court, the news reel was spliced and that part was taken out. You cannot sue the city. They are as corrupt as the mafia is. Have respect for the law? Not really!

Wow thanks for your genius insight @kameha, you know what all you gun thugs are missing is that if you watch the video both the street the kid is on and the street behind is a RESIDENTIAL street. Where I'm from, Hawaii by the way, there is no such thing as jaywalking on a residential street. SPD again for the umpteenth time in 3 months show exactly how they treat citizens, right or wrong, with obvious excessive force. I hope the kid wins a million bucks from these chumps so the police budget is forced to fire 10 officers and maybe they rethink their civil duty and responsibilities.

I really hope that there is more to this that we don't know (i.e. he robbed a store and was THEN jay walking). Don't you just love how our military now does the policing and the police now do the combat?

Please tell me why this kid does not know that resisting arrest is illegal and can get him hurt so long if resists? Why doesn't he know enough to comply peacefully? That's all it takes -- comply peacefully and explain yourself later. He is a big, full grown kid as can be seen in the video, and it took several cops to subdue him. No wonder he has bumps and bruises and a broken nose. I hope the "brutality "suit against the police is found unjustified and the kid is charged with resisting arrest. Maybe a judge can get through to him and his parents that next time he should comply peacefully and he won't get hurt.

you can clearly see in the video that this kid is resisting arrest, he is lucky they didn't shoot him. when the police tell you to do something, you do it, otherwise you are subject to compliance by force. this looks like it was planned all along by the family to make money, pathetic. you want safe neigborhoods, first kill all the lawyers.

I'm all for listening to cops, and always have, a disproportionate number of my relatives are police officer or in law enforcement, but I'm just saying what I see from this granted abbreviated video.

I really hate it when they use 'developmentally disabled' term for a pretty well physically developed teenager who is capable of aggression and other crimes. Instead, look at the children genuinely raped, and otherwise abused by their own parents or marketing companies, eg. NE/SE 82nd st. in Portland.

Just based on the video, I see a suspect resisting arrest even after he has been handcuffed and still resisting while trying to be secured in a patrol vehicle. Whe people don't realize is that if an officer tells you to do something...YOU DO IT! Even if the suspect is developmentally delayed that doesn't give him the right to resist what he is being told by an officer who has taken an oath to protect people from harm....this includes the officers too. I tip my hat to the SPD crew who responded on this incident. I don't see how they acted inappropriate for this situation. As to why this is just now comming to light when this happened almost a year ago......I can only speculate it is to get the public sympathy behind this famly who was "abused" by SPD.

As I stated on the other website, it is highly convenient that the video starts after an obvious struggle has ensued. This kid has enough intelligence to read, obey the command to read, so therefore I can deduce that he has enough intelilgence to obey an officer. "Stop talking on the phone." "Come here." ETC.

The video is very telling. As usual the cops are completely out of control but perhaps even more troubling is the way the video displays how fitness standards have become extremely lax. Look at the chick cop, she has a perfect pear figure skinny(relatively) on top and huge on the bottom. The dude cop probably typed on his resume that he served as the Michelin man prior to applying to the police force. Honestly the rise in violence caused by the police is probably due to training. They are trained that they are too fat and slow to pursue a suspect so you gotta beat em down or shoot them before they have a chance to get away.

Police should be responsible for their brutality. Officers abusing citizens is happening all too often and it really needs to stop. I hope this family wins the lawsuit and cops learn not to always go overboard with their brutality. I've never been in trouble with the law, but I'm terrified of ever getting pulled over for a traffic stop since cops might attack me the same way they do to so many other people. I'm very small boned and I break easy.

Sorry, just saw the video. I apologize to the neighbor for my previos comment. The video looks bad. I do see a few punches and kicks that probally are execive, but I also see a suspect not going down, and constantly tring to get away. I still have to respect that there is an ongoing investigation. Ongoing litigation, now being shown as news, to win public support.
