DNA experts highlight problems with Amanda Knox case

PERUGIA, Italy -- The investigators who collected the genetic evidence used to convict American student Amanda Knox of murder in Italy made a series of glaring errors, including using a dirty glove and not wearing caps, two independent forensic experts said Monday.
   
The experts had been appointed by an Italian appeals court to review the DNA evidence used in Knox's trial, including some found on a kitchen knife believed to be the murder weapon and some found on the clasp of the victim's bra.
   
That evidence played a crucial role in securing the convictions of Knox and her co-defendant Raffaele Sollecito in the 2007 murder of Meredith Kercher, a Briton who shared an apartment with Knox while they were both exchange students in the city of Perugia.
   
Knox, 24, and Sollecito, 27, have denied wrongdoing and have appealed. The evidence review was granted at the request of their defense teams.
   
In the first trial, prosecutors maintained that Knox's DNA was found on the handle of the kitchen knife and Kercher's DNA was found on the blade. They say Sollecito's DNA was found on the clasp of Kercher's bra.
   
But the independent experts told the appeals court that the collection of evidence fell below international standards and may have resulted in contamination. They used slides to refer to international protocols for the collection and sampling of evidence, including one from the U.S. Department of Justice and others from various U.S. states.
   
One of the two experts, Stefano Conti, cited several cases of forensic police entering the crime scene or coming into contacts with objects there not wearing protective equipment such as masks or hair caps. He said that while evidence should be wrapped in paper or kept in a paper bags, police often used plastic bags, heightening the risk of contamination.
   
"There are various circumstances do not adhere to protocols and procedures," the forensic expert told the court.
   
In footage and framegrabs shown to the court, two police officers collected the bra clasp, and the glove worn by one of the two appeared to be dirty on two fingers. Conti noted the bra clasp was collected 46 days after the Nov. 1, 2007 fatal stabbing of the 21-year-old Kercher.
   
"Over those 46 days several objects were moved, and in at the same time several people will have come in and out," he noted, again stressing the risk of contamination.
   
The other expert, Carla Vecchiotti, explained to the court that the genetic profile on the knife's blade that was attributed to Kercher is dubious and cannot be attributed with certainty. She said the original testing did not follow recommendations of the international scientific community for dealing with DNA testing.
   
Vecchiotti said the review concurred with the original testing in saying that the genetic profile on the knife's black plastic handle could be attributed to Knox. The knife was found at Sollecito's apartment.
   
The independent experts, both from La Sapienza University in Rome, will be questioned and cross-examined in the next hearing, scheduled for Saturday. That will be the last hearing before the summer break.
   
The full review, a 145-document obtained by The Associated Press, was filed to the Perugia court last month.

The national, media manufactured, "court of public opinion"(Italian, this time) wants justice and the obtained DNA by police investigators is adequate enough. As far as the Italian public is concerned, the contaminated DNA arguments are irrelevant just as they were in the American "court of public opinion" after the OJ Simpson murder trial. As far as the Italian public is concerned, DNA contamination or not, Amanda Knox is guilty. The prosecutor presented his motive of a ritual killing, and Europeans know that a lot of young Americans have shown a curiosity regarding voodoo, witch craft, satanism, vampirism, etc based on the popular movies out today. Amanda's naive American ambivalence and arrogant swagger at the onset didn't help her cause and also gave the Italian prosecutor adequate reason to charge her. Unlike the common law courts in America the judges are probably not going to go against the Italian public's opinion, after all they still have to eat lunch in downtown Perugia.

Knox might have been convicted here. (But if she wanted a US trial, she should have committed murder here, not in Italy.) Plenty of other evidence exists against Knox (less against Sollecito)--phone calls, lies, 31 pieces of unchallenged DNA (esp. Knox's and Kercher's mixed DNA in Filomena's room, and in the hallway and bathroom), the staged break-in (again in Filomena's room), and 10,000 pages of evidence in court. The so-called independent experts' report is to be challenged on next Saturday and Monday. There are a ton of problems. The article is wrong ("the independent experts told . . . that the collection of evidence fell below international standards . . ."); there are no such "standards" for LCN DNA, only "protocols" and "procedures"--a huge scientific difference. (One defense lawyer witnessed the original testing and saw Kercher's profile on the knife blade!) Fireworks are still to come. Were the independent experts truly independent? Based on their report, that seems unlikely.

So because she is not a wrongly accused poor minority, then we should leave her in jail? Did your parents ever teach you that two wrongs do not make a right? There is absolutely no evidence against her. None. If you think she is guilty, what evidence makes you think she is guilty? I don't want to hear anything about how she was buying underwear, or doing cartwheels, because that is not any kind of evidence of murder.

charleylechein... You are way off base.. I don't think anyone really cares if your grand kids don't eat a certain kind of food. My goodness since when did everyone start bashing everyone else.. It is still news because she never would have been convicted over here.. There is enough reasonable doubt.. It is still news because she is from here, and went there for schooling.. Grow up people and post comments that pertain to this subject and stop being rude.. If you wanna be mean or don't care about the case why even read it or comment on it.

Its still news locally BECAUSE mommy, daddy, step mommy, step daddy can all combine their money and resources and the only one that wins is the lawyers defending her, and the hotels, and the fancy restaurants they dine at. Lets see if her combined family can eat what she east every day, dady after day, And take mommy and step mommy and place them in a small room with burly Italian wimin (wimen !!) for a "rastling match" Italian style, no rules. Im sure Ms Knox may have met some wimin that think she is a real cutie. I only wish that those that make appeals get their sentence doubled if they lose.... Ms Knox will be in there for over 50 years, such is life.

shan79marie ..... My kids, and grand kids hate Italian food, they dont travel overseas and do anything against the laws of the host country. Cause they dont travel overseas. People coming from the US often think they dont have to follow the laws of the country they are visiting. There are some exceptions, but since Ms Knox was NOT in the military they dont apply to her. Need more ? "Status Of Forces Agreements", it spells out which crimes the US military will try the case and which crimes the local government will try the case. Ms Knox could have stayed home, used CRAIGS LIST... but no, she wanted to go to ITALY. Ive spent 8 years in Europe, seen some people break a law and got arrested, got sentenced. So she is getting what the average Italian gets from their legal system. Maybe if she stayed in WA state she wouldnt have these problems, or would she?

if her parents weren't rich but come from a tailor park, and were brown or blacc the world would not even know who she is, how many millions of dollars wasted behind this dumb girl, i don want to see anyone in prison, death or free is how i see it, but come on lets quit wasting time and money, shes convicted and all the suburban whining about it is just wasting time and money. there are a million questionable convictions of minorities that never make the news, well now she knows what it feels like to be brow/ blacc

Well hammonda, I can honestly say that is the most ridiculous line of reasoning I have ever heard. You are clearly uniformed about the case. Did you know that the prosecutor who tried the case has a tendency to blame satanic cults and witches for crimes? Lovers, huh? In this case, he came up with some crazy "sex games" as the reason for the murder. Not to say that it is impossible, but he has a history of drumming up huge conspiracies. This evidence was tainted from the beginning, and anyone who read about the case knows that. They have videos of the police offices stepping all over the crime scene. And a tiny amount of her DNA was found on a knife in her boyfriend's apartment, and they cannot say with certainty that DNA found on the blade belonged to the victim. It is not unreasonable that she would have used a knife in his apartment. You think she is guilty because you believe her to have a "spoiled rotten brat look"? I hope you are never asked to serve on a jury.

by now, after all the original testing, yes the DNA would be compromised. However, after the defense hired their own experts to examine the DNA; of course, it would wind up compromised, that way, they can challenge the courts. The Italians are not a blood thirsty people. They are more lovers than fiighters. So, in my opinion, there was more overwhelming evidence that showed she was a part of it. Here is a theory: Maybe she found out that her boyfriend was having a relationship with her roommate?? Jealous, she demanded that he help herf get rid of her rooommate?? Sorry, folks, but, she has never had an innocent look on her face at all throughout this thing. She has always had the spoiled rotten brat look who cannot understand why she would be in trouble for doing something wrong that she did. I lived in Italy for 3 years, I understand the Iatalian people somewhat. I feel that they were right on! Sorry folks; that is just the way many of us do see it!

This case fits nicely the definition of a “Black Swan,” as Nassim Taleb described in his book, “The Impact of the Highly Improbable.” He wrote on page 144, “The problem is that our ideas are sticky; once we produce a theory, we are not likely to change our minds ..so those who delay developing theories are better off. When you develop opinions based on weak evidence, you will have difficulty interpreting subsequent information that contradicts your opinions, even if this new information is obviously more accurate. ....... Remember that we treat ideas like possessions, and it will be hard to part with them.” The Purgian authorities and especially Prosecutor Magnini have invested so much of themselves on a theory that they cannot do the honorable thing and ask the court to dismiss these charges.
