Bicyclist struck, killed by car in Kirkland; driver arrested

KIRKLAND, Wash. - A driver who struck and killed a bicyclist at a Kirkland intersection early Thursday morning has been arrested for vehicular homicide. Investigators believe the 27-year-old Redmond man was under the influence of drugs and alcohol.

Police say at about 3 a.m. Thursday, Bradley Nakatani, 36, was riding his bicycle home from work/  We was going through the intersection of 132nd Avenue NE and 124th Street -- wearing reflective gear, flashing lights and a helmet -- when he was hit by a driver who was going nearly twice the speed limit.

Nakatani died at the scene.  His bike was cut in half by the impact.

Investigators say the suspect admitted to drinking and taking prescription drugs before getting into his SUV.

Praveen Arneja worked with Nakatani for about two years.

"He was young and aspiring and motivated to do a lot of things -- and he was good at heart,” she said.  "It's a very painful loss."

She says the talented software engineer typically rode his bicycle to work because he cared so deeply for the environment.

"The bicyclist was doing everything right and was well marked with lights and everything," said Lt. Mike Murray of the Kirkland Police Department. 

Friends and co-workers will hold a candlelight vigil for Nakatani on Friday from 4 p.m. to 4:30 p.m. at the intersection of 132nd Avenue NE and 124th Street.  They want to remember their friend while raising awareness about the dangers of drunk driving.

Just heard on the news that the car driver was not legally drunk. .078% bac. And the prosecutor was deciding whether to file charges. My guess is none will be filed because the prosecution can't prove whose fault it was. So for all you out there ready to confict for drunk driving, maybe wait another day. And we still have not definitely heard who was at fault here. Let's wait and see. Obviously too bad someone died. Obviously someone made a traffic mistake.

No matter who ran which light doesn't matter in light that the driver was under the influence at the time of the incident. The rules change when you are driving drunk. Oh, @siclmn, I do drive my car to the bar, but if I do, I do not drink, because it is a social function, I don't HAVE to drink, so I choose not to. If I do plan on having a drink, then my husband drives, and he doesn't drink. You seem to be generalizing bar patrons in your comment. I feel bad for this mans family, and I hope that more can be done for both sides to ensure safer transportation for both drivers and cyclists.

@cyclefoo - I have no problems with cyclists being on the roads however the cyclists are always ranting, "Same Rules, Same Rights". Well, when the cyclists can say they comply with the rules, I'll rant with them. Most of the time however, I see cyclists in blatant disregard for other cyclists and motorists on the road believing that the motorist will be blamed for the accident no matter what! I'm happy to accommodate cyclists as long as they stop at the 4 way stop signs AND the red lights, that they don't just turn because they've reached the intersection, and that they stay to the side of the road instead of riding 2 and 3 abreast! Also, use your hand signals!! Motorists are required to use their turn signals and if they aren't working, they are to use their hand signals just as a cyclist should!

When something like this happens I'm always disappointed by those who argue that this wouldn't happen if the cyclist hadn't been on the road in the first place. I've never heard a cyclist argue the opposite - that this wouldn't happen if there weren't any cars on the road. That's ridiculous, right? It's your right to be on the road. Well, cyclists have that same right. Get over it. And spare us the lesson about heavy-car-vs-light bicycle. We know that one. And stereotyping cyclists as reckless scofflaws doesn't help. Sure, there are plenty of cyclists who do stupid things - just like there are plenty of drivers who do stupid things - like drive drunk and kill cyclists, or other drivers and their passengers. The truth is some people are going to make bad choices that have terrible consequences; it's up to each of us to learn from these tragedies and make better decisions ourselves. That's how society works. If you make it someone else's problem to fix, that's how society fails.

Rotors, that is incorrect. If you are driving without insurance and someone blows a red light and t-bones you, the person at fault for the collision is responsible for all the damage, medical, and any other costs associated with the wreck. The person who was driving without insurance will likely be cited for not having insurance, but nothing beyond that.

The driver was at fault 100% being drunk, high and doing probably 70mph in a 35mph zone. You are all idiots if you think it was the bikes fault. Its just the same if you're driving without insurance and someone hits you. It will be the driver w/o insurance who is at fault because they should not have even been on the road. This guy had no place behind the wheel speeding like that drunk and high off pills which he most likely does not have a script for. Some people and their messed up points of views. Just shocking. Either way a young, bright man with a wife and child is dead.

If the driver was drunk and speeding, but the bicyclist was running a red light, is it still vehicular homicide? I was kind of shocked to hear the police say yesterday that the cyclist was doing everything right. How did they jump to that conclusion so fast? Have they already obtained the traffic camera footage from that intersection and reviewed it? Seems to me like the police are contaminating the future jury pool for the upcoming trial by stating questionable "facts" so quickly before all the information is gathered properly.

Yes the driver may have been drinking and yes he should not have. But I will lay money of the fact that the bike rider turned left in front of the car without having a traffic turn light. Most bike riders think they have the right of way. We need a new law. Bike riders need to have a bike license the same as we who drive need a license. Also a license and insurance for the bike same as other vehicles. Until then they should stay off the streets designed and paid for by gas tax and license taxes. I have heard how intelligent this bike rider was. But not smart enough to watch out for a large vehicle.

I guess my question would be: Without witnesses or videotape how do the police know who ran the light? It could have been either. And as for those sticking up for the bicyclist, i have seen plenty of them break traffic laws, espcially not stoping at lights or stop signs.

It is a shame the cyclist didn't wrap himself in his car before he set out. Then he might still be alive. He had every right to be on the road - as do all cyclists, but a ton and a half of metal doesn't care how many safety lights and jackets you have on. It is interesting to see cyclists so voiciferously assert their rights, but that doesn't do you much good when you are dead. There are rights I would fight to the death for, but riding a bike isn't one of them. Condolences to the family.

We live in a country where 100% of the people in any bar have driven their cars to the bar. Going to a bar is a social function, it is what they do. When they leave the bar they will all say that they are just fine to drive. Then they get in their cars and drive away. What do you expect to happen? They majority of americans have not ridden a bicycle since they were children and us bicyclists are off their radar.

I am so saddened by this tragedy. I drove past the accident site twice today and my eyes welled up with tears. Drunk drivers need to be punished much more severely. This bicyclist was not to blame. Why are so many people assuming the biker did something wrong to get himself killed? The driver of the vehicle was DRUNK! He is clearly at fault here.

I understand and agree with many points all of you have made. While I truly appreciate bikers who ride smartly and safely using the rules, bikers need to also keep in mind that, even with the best gear, automobiles are a definite threat to them. Part of the reason for this is that our bike laws allow bikers to ride right next to auto lanes which can be dicey for them. Unless their is a definite bike lane clearly identified for all to see, bikers should be on the sidewalks for their own safety. Not sure about the bike lane in this sad accident but, if the driver was under the influence and on other drugs, he shouldn't have been behind the wheel to begin with. He should be tried and convicted of DUI at lesat.

TruthBTold (and this has nothing to do with this story). Don't sit there with your indignant outrage and lecture anyone on how they as drivers break the law every time they get behind the wheel. Why don't you reflect that mirror back on yourself? How many bike riders actually make a full stop at stop signs? God forbid they have to exert some energy to get going again! I've been passed on the right, the left and even the sidewalk by bicyclists who don't seem to think the same traffic laws apply to them. Riding with their earphones plugged in, darting in and out of traffic and generally breaking just as many laws. It works both ways. Take some responsibility yourself. And if you don't think drivers respect the fact that they're behind the wheel of a 2000 pound object, you better make sure you as a bike rider show a little EXTRA respect for the 2000 pound object. You'll lose EVERY time, regardless of who's at "fault".

Read your handbook for the license test. It clearly states that bicycles are legal vehicles and they have the same rights as those of any other vehicles that use the roadways. We use the oil products and pay taxes for the establishment and maintenance of the roadways.

All you people trying to blame the victim are disgusting. Since the police already stated the cyclist was doing everything right and they arrested the driver, one should be able to figure out who was at fault. If the cyclist did violate the law then the driver would only be charge with a DUI, if in fact drunk. All of these holier than drivers who know no shame. Every single one of you knowingly and deliberately break multiple traffic laws everytime you get behind the wheel. How about all you stop drinking and driving or even stop for stop signs, yield to predestrians, obey the speed limit or even just pay attention while behind the wheel. Too many people die from drunk driving but even more die annually because people don't pay attention and respect the fact their mode of transport can also be a very dangerous, several thousand pound moving object.

This isn't the correct time to be biking or for others or it takes better gear ! Flashed / blinkers / lights and or extra equipment better off for all parties and any one at that hour on a bike not real concerned or walkways that all you can allow and add bikers rules!

Listen here bam206, it is my right...MY RIGHT to be on the road riding a bicycle. You MUST earn a license to operate a motor vehicle. I do not need one for a bike...again, it is my RIGHT to be on the road. Perhaps it is YOU that should be off the roads if you don't know the law. This is a case of murder and the driver...if found at fault, should go to prison for the rest of his life. Perhaps that will send a message to other oblivious drivers who refuse to understand who has the right of way on the streets.

Driver of the car definitely committed at least one crime, DUI. But that doesn't automatically mean he's responsible for the collision with the bike. Obviously the investigation will need to continue. Regardless of who is at fault, I'd question the decision to be out on a bicycle at 3am, lights and reflective gear or not. Dark, icy streets, and a good chance that cars out at that hour could very well contain intoxicated drivers. Why take that chance? I'd bet the bicycle rider also has a car. Too many things stacked against a bicycle rider in this instance. What a horrible loss. Prayers to the families involved.

Dear Rocket Scientists: Where the car was struck is not an indicator of who was at fault, unless the car was rear-ended. If the driver ran the red light a split second before the cyclist was about to cross that spot, the car gets t-boned. If the driver runs the red light at the moment the cyclist is crossing the lane, the car takes a hit to the grille. Just because the SUV has a dent on the side implies in no way that the cyclist was at fault. Think it through first, type later. (Yes, the cyclist could also be at fault in either scenario. I'm just saying that the side impact doesn't raise suspicion in and of itself.) In any case, if people would drive/ride sober and all use good judgement, incident rates should decrease.

I have a BIG problem with the police saying “The bicyclist was doing everything right and was well marked with lights and everything"! The only part of that statement that is factual is he “was well marked with lights and everything”. How do they know that he “was doing everything right”? No witness’s? I suspect the bicyclist ran the light as most do and ran into the side of the poor sole driving the SUV. The last few days I’ve had reason to be in the Seattle Denny Regrade and lower Queen Anne area I have been taken back by how many bicyclists ignore stop signs and traffic lights. I was on 5th Avenue where there is a bike lane on the left but I followed a bicyclist who felt it was his right to ride in the right lane because he was going to make a right turn a mile or so down the road. I feel sorry for the guy who died but I feel even sorrier for the poor guy he ran into and how it’s going to affect the rest of his life.

Lt. Mike Murray, I disagree with your statement that they said you made, about this being an unfortunate accident. If the driver of the SUV is in fact proven to be DUI I would say it is a serious crime. A criminal offense. At least vehicluar homicide, 31 to 177 months prison sentence. (I prefer Tennessee punishment which is from 8 to 30 years and $25,000 fine for vehicular homicide and 15 to 60 years, $50,000 fine for aggravated vehicle homicide.) I think it is criminal that our legislature in Washington state has such lenient laws for killing someone while DUI. Take a few minutes to write an email to your legislators in Olympia and tell them you will vote them out if they don't do their job and put some teeth in Washington States DUI laws. If a person has more than 1 DUI they should have their privilege to drive revoked forever. Killing someone while DUI, seriously criminal and deserves at least 8 years in prison, minimum.

For the uninformed -- bicycles have a stopping distance similar to that of cars. If some drunken idiot runs a light in front of you, you are going to broadside him, just as if you were driving a car. I don't know where people get the idea that they have some sort of God-given right to drive 3 ton metal monsters while drunk or without a care in the world, but as long as they do that they are going to kill people. It is the cars that are killing people, not the bicycles.

How do you people sleep at night with so much hate? Considering the bicyclist had all protective gear & was headed to work that early...99.9% he wasn't drunk. In the article they suspects the driver ran a read light it seems. Regardless....would you hit someone just because it was your turn? I would hope not! The issue at hand was the driver was DRUNK!

Lets see what the investigation confirms first. Was there a light, who ran into who, had the biker been drinking, how fast was the biker going. The main issue is, the survivor had alcohol, in his system, so by default he is in the wrong, but circumstancial has not been determined.

If you watch the video you can see the vehicle and the damage is to the FRONT DRIVERS SIDE CORNER. Not the drivers actual side implying the bike rammed the vehicle.

I have a question being not familiar with this intersection. What direction was the bicyclist going? Since the article states a "dent on the drivers side" did the cyclist actually crash into the drunk ? Is there a traffic light ?

There should be much tougher penalties on drunk drivers and the establishments who over-serve their customers. There should be no tolerance policies on enforcing DWI laws. With that said, bicycles don't belong on busy streets either; cars and bikes just don't mix, and we'll always see tragedies like this even when there isn't drunk driving involved. Some cyclists will even ride much faster than the flow of car traffic through busy intersections, and I cringe every time I see it. I always think, that young man isn't going to make past his 30th birthday if he keeps riding like that. Keep safe and have a nice day!

Two very distinct issues here. Firstly, who caused the accident? Could be either especially given that the damage to the vehicle was on the side of the car. Second issue is was the driver of the car drunk? Interesting legal point possibly. If the cyclist was the cause of the accident, and if the driver was legally drunk, can the driver be charged with anything more than drunk driving? I would think not. Without witnesses or other conclusive proof, it might be hard to know who caused the accident at the intersection because it would be impossible to show who ran the light or failed to properly yield.

I know lots of people do not like cyclists, but this person seems to have been doing everything correctly and yet he was murdered! There is no way you can protect yourself from stupid, drunk drivers. It appears from the story, the passenger may not have been drunk.........why didn't that person drive? These morons were either out very late on a bender, or began at home very early. This story makes me very angry about another senseless death caused by a drunk idiot. This cra* needs to stop and these morons should be in jail a very long time. This is nothing short of MURDER with a motor vehicle and should carry the death penalty. Prayers to this man's family and friends for they will suffer a very long time because of a fool. RIP!

dumm driver, weather he was durnk or not there should be a charges for invalentery manslater at the least. It's things like this that I think the state needs to have a law that says "if you go to have a drink at a bar, the bar is required to take you keays and make you get another ride home and you can come and get you car and keys in the morning affter you pass a bretheliser test." There are people who bye beer at a store and then go drinking and driving, but unless the people at the store see him/her drinking I don't see how the store can be responsable. If that driver go's to a bar on the other hand the bar tinder would and should knnow that thate dirver is drunk and should not drive, and there for should be reqired to take the persons keys.

I hope this isn't who I think it is.....I've workers in the area for 5 years. All of the riders take all the precautions. They aren't downtown riders who weave through traffic asking to get hit. This is so sad! I hope they get charged with murder. Driving drunk is a choice. They chose to kill this innocent & responsible guy. How sad to think our justice system is once again going to let us down on this one. RIP
