Court: Seattle police OK to Taser pregnant woman

SEATTLE (AP) — A federal appeals court says three Seattle police officers were justified when they used a stun gun on a pregnant mother who refused to sign a traffic ticket.

Malaika Brooks was driving her son to school in 2004 when she was stopped for doing 32 mph in a school zone. Rather than give her the ticket and let her go on her way, the officers arrested her. They used a Taser three times when she refused to get out of her car.

A panel of the 9th U.S. Circuit Court of Appeals ruled 2-1 Friday that the officers were justified in using force because of the threat that Brooks could have picked up her car keys off the floor, started the car and driven away erratically.

The dissenting judge called the ruling "off-the-wall," and said the police officers had no authority to arrest Brooks — let alone the authority to use a Taser on a nonthreatening woman who was seven months pregnant.

We have that perfect combination: Power hungry cops and "victim" looking for an excuse for a lawsuit. Warned several times before tasered? Perfect!

If the courts rule its ok to tase a pregnant mother who refused to sign a traffic ticket then I'm ok with crazies shooting cops at coffee shops.

Rather than give her the ticket and let her go on her way, the officers arrested her. They used a Taser three times when she refused to get out of her car. <--- okay I am 8 months pregnant and I just have to say I really think that instead of possibly harming a baby we should think of another way to punish women who are pregnant.

Recently, we in the Emerald City heard of, witnessed, or read a story about a man with a fake bomb taped to his arm, walking about saying that he was a vampire. For this person, a bomb squad was mobilized, a few city blocks were shut down, and he ended up being ushered into jail minus the use of a taser gun. Today I read a story about a woman who was tasered for refusing to sign her name. I'm really confused. How is it that THREE police officers feel so threatened that they think themselves justified to use the serious, dangerous, and painful force of a taser gun on any person who simply refuses to sign their name? The fact that this person happened to be 7 months pregnant makes this even more beyond the pale shocking. That a judge could then find in his or her conscious to arrive at the decision that this was OK is frightening, sickening, and truly confusing. A song comes to mind. It's by David Bowie. The song is, "This is Not America."

She is not setting a good example for her son. Signing the ticket does not admit guilt. How would she feel is someone going 32 in a 20 hit her kid?

Even if she was in the right, why would she jepordize her baby? I'm sure she was warned 20 times. She bet she was already counting her lawsuit money!

My question to the assenting judge, "so if a woman is pregnant, no laws are applicable to her?" I am glad the Court got this one right... People need to learn that there are consequences to not following the orders of a police officer...
