Wash. medical marijuana activist shot robber in Kirkland home invasion

SEATTLE - A well-known Washington state medical marijuana activist traded gunfire with robbers who invaded his home early Monday, suffering minor shotgun pellet wounds and sending one intruder to the intensive care unit of a hospital.

Activist Steve Sarich, 59, runs CannaCare, an organization that provides patients with marijuana plants and advice about Washington's law.

"I don't want to shoot people, but God, this is our eighth home invasion since last May," he told The Associated Press.

Sarich said he was awakened at his Kirkland home by the barking of his dogs, then grabbed a .22-caliber handgun and headed down a hallway outside his bedroom.

A man with a shotgun confronted him in the living room and fired, he said. The main blast struck a wall a few inches from his head, Sarich said. One pellet struck his face while another hit his leg.

Sarich shot at the robber but missed. When his gun jammed, he darted back to his bedroom and grabbed another handgun. He spotted another robber standing outside the glass door to his bedroom and fired three times, hitting the robber multiple times.

Sarich's live-in girlfriend called 911, as did the wounded robber, a 19-year-old from Renton. King County sheriff's deputies found him in the backyard and took him to Harborview Medical Center in Seattle, where he underwent surgery for life-threatening wounds.

Sheriff's deputies arrested a second suspect, also 19, as he tried to flag down a ride nearby a few hours later. That suspect gave investigators the names of two others involved in the robbery attempt who had fled in a vehicle. They remained at large, sheriff's Sgt. John Urquhart said.

Neighbors living near the house on Juanita Drive NE watched in amazement this morning as a SWAT team descended on the secluded home.

They say most people in the area are aware of the medical marijuana being grown on the property and the frequent gatherings of medical marijuana supporters and users. It had bothered some.

"The other neighbor that lives right next door to me, she just moved a week ago, her and her husband, because they couldn't take it anymore," said neighbor Mark Stumpf.

But others say they weren't overly concerned - until Monday morning, when bullets started flying during the home invasion robbery.

"We do see a lot of traffic there. They've never bothered us, but we do realize with a marijuana clinic, I feel at least other things come along. And this obviously may have been a result of that. This may have been an 'other thing'," said Lauri Boritz.

The home invasion came just two days after a medical marijuana patient from Orting, Michael Howard, died of injuries sustained March 9 when robbers targeted his growing operation, according to Ben Livingston, of the Cannabis Defense Coalition.

Howard was struck in the head during the robbery, possibly with a crowbar, Thurston County sheriff's Detective Ed Troyer said Monday. Deputies found 150 marijuana plants in a shed on the property and are investigating the case as a homicide.

Sarich said he only grows starter plants and clones in his home that are provided to patients. He himself is a patient who suffers from painful back conditions including degenerative disc disorder, he said.

Sarich said he fired shots to scare robbers during a January break-in at his home when intruders escaped with seeds, a vaporizer and pipes.

Sarich said he typically doesn't call police when his house is broken into because he doesn't want to deal with the hassle of having his home searched by law enforcement checking his compliance with the state's medical marijuana law.

Investigators on Monday were waiting to obtain a search warrant for Sarich's home, but Urquhart said he didn't immediately know if the warrant pertained to the shooting investigation or the marijuana present.

Douglas Hiatt, a medical marijuana attorney in Seattle who has worked with Sarich and who knew Howard, said the cases show the dangers presented by marijuana prohibition.

Hiatt is gathering signatures for a ballot initiative that would remove all criminal penalties for adult use, possession and distribution of marijuana.

"This is directly related to prohibition," Hiatt said. "It's what happens when you make a house plant worth more than gold."

To answer "yessir" question, there should be NO government prohibition. FREEDOM is just that, the people's right to decide for themselves. Whatever harm drugs do it would not be worse than rampant crime and even wars being financed by the profits created by prohibition. Heroin prohibition finances the war in Afghanistan. It could be ended by getting the government off the backs of the people. Millions of Americans are killed or arrested and sent to hellhole prisons by the government's prohibition. The harm of prohibition is far worse than the harm done by freedom. Tobacco addiction is more addictive and kills more people than heroine or cocaine and the other prohibited drugs. But we don't have huge crime syndicates, wars in far off nations, and massive prisons full of tobacco addicts because its legal. Its time to stop the prohibition, end the massive prisons, stop the killing, end the drug wars, end the Afghanistan war, end the international drug cartels, etc.

I appreciate the legitimate debate over legalization of marijuana.... however... to those who imply it's a necessary freedom, or it will do so much to eliminate crime... where does that end? Do we legalize heroin, because then we could tax it and it would eliminate crime? Cocaine? Meth? Where does this line of debate cease? I do appreciate there's a grand difference between marijuana and heroin... my point is the argument regarding crime versus legalizing drugs.

@baz - I agree with your posts on so many other subjects. You obviously are a very inteligent man. However, we disagree on this particular point. I know you are a big believer in the Bill of Rights. Please consider that everyone's "pursuit of happiness" is different. You know that I am not a drug user. Drug and Alcohol abuse are a medical problems. Taking the criminal stigma out of the equation will make this type of crimal enterprise unprofitable except to the state who would tax it. Please reconsider.

Unbelievable some of the posts I've seen posted here. A man who is trying to help dieing cancer patients and people are posting he got what he deserved? Its times like this that makes me ashamed to even admit I'm an American. Thank god for the 2nd Amendment is all I've got to say. And some of you need to pay attention to the story of Michael Howard who died last week from a somilar act. Did he deserve to die?

I believe in days you all will find out that Pierce County Sheriff's have criminals on the force who broke the law. Failing to investigate a murder? Not even taking the weapon that killed a man for 2 days! Helping this criminal get a head start getting away for two days! JAIL TIME for Sheriffs in Pierce County, now round those criminals with badges and get them off the streets. Reckless Endangerment, those cops allowing this criminal to get away with a 2 day head start has placed everyone in the area at risk. They have endangered the public. Arrest those criminals...

This situation is unfortunate, the people who committed this crime were after cancer patients medicine.. if you have a legal growing / DISTRIBUTION operation, you should be required to have adequate security, to deter these kinds of actions. nobody is going to break into your pad with a shot gun if you have one or two plants. but if you are supplying an entire community, maybe its best not to grow and keep "product" in your home. the fact is that the people selling drugs illegally will always sell drugs illegally. most weed dealers that are the problem aren't selling it because they think it should be legal, they are selling it because there is an under the table market for it that requires little work to make income off of. although i believe that marijuana should eventually be legalized I'm not convinced that legalization is a permanent solution to these kinds of people. Specific regulations should be in place to protect people who grow and supply those in need.

This does not appear to be a case where some pothead decided to try and jack a stash. Rather, this appears to be a case where an armed individual planned a potentially violent home invasion with the intent of stealing potentially valuable merchandise. The fact this the merchandise happens to be marijuana plants is not really relevant. It could have been gold, diamonds, or works of art. This was about money, pure and simple. It's almost always about money. During alcohol prohibition, it was about money from alcohol. Now, during drug prohibition, it's about drug money. Same stuff, different day. Legalization and regulation fixed the majority of the issues surrounding alcohol, and can do the same for drugs. Using a single example as a strawmis should be nothing new. That these individuals are dangerous is also nothing new. Unless you plan to argue that DUI justifies blanket prohibition, your argument is invalid.

With nut cases like "bazwest" voting for Big Brother, government tyranny will not end. We don't have people killing each other over growing tobacco because it is legal to produce on farms and market at a reasonable price. We do have people killing each other over "illegal' drugs because the drugs are illegal. That is the inevitable result of government prohibition. It creates faux "crime" while it takes away freedom. Prohibition destroys the lives of millions of people and destroys freedom for everyone. How many people will die before we demand that the government stop its war against the people? A long time ago in a land far, far away, there once were free men.

Hmmm... I think people should get a clue. Yes, medical pot should be grown at home since it is NOT available other than through illegal channels. But how could this been pot related? DUH, maybe because some pothead knew there was a grown operationa and maybe his stoner mind thought it might be easy to steal some! Some of you really need to use the brain God gave you.

Beg to differ seen52. We all know that a drunk is a problem on the road but so is a person high on marijuana. Combining alcohol and smoking marijuana makes the problem even worse. The data shows that people high on marijuana exhibit the same lack of coordination on standard "drunk driver" tests as do people who have had too much to drink. Here is one of the studies: Liguori, A.; Gatto, C. P.; and Robinson, J. H. Effects of marijuana on equilibrium, psychomotor performance, and simulated driving. Behavioral Pharmacology, 9: 599-609, 1998. The earth remained round despite the nay sayers who claimed it was flat. Likewise claiming that smoking dope has no ill effects "don't make it so".

You guys are funny! There is really no point in trying to enlighten the "talking points". People are going to believe what they want to believe and many people out there will never believe the truth no matter how many studies and statistics you present them. @bazwest- I think your post is more "wacky and flawed" than bobknows' was. Yes, he used some harsh words which I personally would not have used, but at least he has opened a history book! Didn't the same type of violence occur when alcohol was prohibited? It's not about cheap and legal drugs here, it's about the way we as a society treat this problem. Instead of spending billions incarcerating drug users, wouldn't it be much better for everyone if we spent those billions of dollars on getting treatment for addicts and into anti-drug programs? Judging from your post, I'll bet you will say no and that you have never done anything remotely wrong in your life! @treeclimber- wasn't it "we the people" who voted for medical mj?

I concur with some of you and am flabbergasted by others. Blaming medical marijuana (or the grower) for a home invasion robbery?! Let's blame McDonald's because somebody was stupid and ate the wrapper and choked. You need to blame the "bad guy"! I personally know the home owner who was shot and you will not find a better human being. He is one of the nicest people I have ever met and he is growing within the law (gray as the law is currently) for cancer patients and other people who are sick and cannot grow for themselves. He is putting his life/future on the line to help them and others. Bringing up some drunk lady who evidently also had marijuana in her system (assuming this is true as I didn't look up the story) to prove your point in a home invasion robbery situation is silly. She was a DRUNK DRIVER! Happens every single weekend in every single state. Bad judgment to smoke and drive for sure, but let's be realistic...it was the alcohol!!!

I think bobknows should be a bit more selective about which adjectives he uses but I agree with his assessment of the overall situation. It is because drugs have been made illegal that brings about these situations. It is a win win situation for the Bad Guys and the Government who are both making huge profits out of the so called "war on drugs". It is society that is paying the cost for this war (as with any other). Illegal Drugs , like alcohol , should be managed not illegal.

A nutcase me thinks bobknows is. It is not the government's fault that a perp with a gun went into this home to steal drugs or anything else and shot the homeowner. The fact that he went in armed and prepared to commit robbery and murder is the thug's personal responsibility...period. Bobknows "wacky and flawed" notion that it's perfectly understandable that these things will happen because of our repressive drug laws is pure hog wash. Too many drug users live in an imaginary world where they believe that unlimited access to cheap and legal drugs will help them be happy and responsible citizens. "My choice to use drugs will not affect anyone else" they say. Try explaining that to the families of the two victims killed in Everett two weeks ago by a woman who was high on marijuana and alcohol. She didn't have enough command of her faculties to know she was driving on the wrong side of the road when she slammed head on to these innocent victims.

Once again prohibition causes violence. Prohibition ALWAYS causes massive crime, organized crime, individual crime and a huge increase in violence. The crime and violence caused by prohibition is far worse than whatever damage the prohibited substance would otherwise cause. Millions of men have been killed or sent to hellhole concentration camps by the anti-drug prohibition enforcement. Prohibition is creating a crime for the purpose of "fighting" it. The underlying responsibility for this crime and the violence against both of these victims is government scum who destroy freedom and lives.

Medical drug dealers are going to be a huge problem, theres no control,they can grow, sell and buy anytime they want to. the laws govern them do not work. to ask a drug dealer to comply buy a written law,is about the dumbest thing the lawmakers have ever came up with.We need to WEED out the Lawyers,Senaters ,and Judges,,who have given these drug dealers an open market for drug Dealing.

I don't think marijuana even for medical purposes should be grown in your home. It is prescribed to you therefore I think you should have to get it from a pharmacy.
