Investigators: Ferry system fails to hold cheating employee accountable

KINGSTON, Wash. - Jack Nannery is a committed baseball coach. He's so committed at times he skips out on his job with Washington State Ferries to take care of business at his other job. He’s a volunteer assistant baseball coach for the Kingston High School Buccaneers. Nannery has worked as a carpenter for the ferry system for 30 years. Most of the time his job is to make repairs at different ferry terminals around the sound.

But the KING 5 Investigators have obtained photos of Nannery at the field, not at the terminals, on state time during the 2008 baseball season.  On March 21, 2008, he put in for work completed at the Mukilteo ferry terminal. But there’s a photo showing him warming up with the team and coaching at an away game in Gig Harbor.

A week later his timesheet says he made repairs at the Keystone terminal. But a photograph shows him coaching first base at a game in Bremerton that day.

The next month, the state paid him to work at the Point Defiance terminal in Tacoma.  That doesn't add up. A photo shows him getting off the team bus for a match-up against the North Mason Bulldogs on Hood Canal.

The year those pictures were taken, Washington State Auditor Brian Sonntag assigned two investigators to look into Jack Nannery. The question: Was he cheating taxpayers by fudging on his timesheets?

Nannery argued he was perfectly legit. He said he routinely adjusted his schedule - used “flex time” - to make it to the games after an 8-hour day.

The auditors didn't buy it. In May 2009 the Auditor’s Office issued this report that stated, "We found reasonable cause to believe an improper governmental action occurred.” It also said that even if he did shift his schedule around, it "wouldn't account for the total time in question."

Sonntag says when his office issues this kind of report, it’s a serious matter.

"At least be on the job for the hours you're being paid. I don't think that's too much to ask. If you are fudging on timesheets, or equipment or vacation or use of computers, you are stealing from the public," said Sonntag.

The auditors found more. They confiscated Nannery’s laptop and found he was using his state computer, on state time, to check out all things baseball: scores, stats, schedules, rankings and rosters. The evidence showed he spent hours at work, working on baseball.

"I think individually you can look at any one of these things and say oh, not that big of a deal, but compounded it is a big deal. I think any time you are stealing from the public or abusing that trust that is indeed a big deal and I take that very seriously," said Sonntag.

We tried to arrange an interview with Jack Nannery. He declined. We caught up with him before a baseball practice last week and attempted to get answers. He told us he’s in the clear. 

"I've done nothing wrong," said Nannery.

When asked about the findings from the State Auditor’s Office he said that’s not relevant anymore. 

“That was all adjudicated by the state. I paid the penalty for it and I moved on. Thank you,” said Nannery.

The investigation by KING 5 revealed Nannery was in hot water at the ferry system well before the State Auditor’s report last year.  He was suspended for a week for yelling profanities at co-workers.  His state vehicle was yanked after he was seen driving it to sporting events.  And he was even fired at one point.

Paul Kressin, now retired from State Ferries, is the one who fired Nannery in the early 1990s for “falsification of time records.” He said Nannery was charging the state for work that didn’t happen.

“I felt strong enough that I wanted to terminate his employment. It’s not a good practice to have somebody doing that. It causes other people to look at that and say, ‘Gee, if he can get away with that then I can, too,” said Kressin.

Nannery grieved the termination through his union and won his job back. An arbitrator ruled the state didn't have “clear and convincing” evidence of wrongdoing. We asked the Secretary of Transportation, Paula Hammond, about the case last week.

"When we lose in those situations it frustrates all of us because we don't tolerate that kind of cheating," said Hammond.

But when Nannery was caught cheating by the State Auditor’s Office 15 years later, State Ferries Maintenance Manager Vern Day and Director of Vessel Maintenance Paul Brodeur gave him a one-week suspension and about a dollar-an-hour demotion in pay. Both of them declined to be interviewed for this report.

Director of Washington State Ferries David Moseley did answer questions posed by KING TV. When asked why the punishment wasn’t tougher after the auditor’s report, he said the findings didn’t support more severe discipline.

“Mr. Nannery had a clean record from 1997 until a SAO report in 2009 found that he had falsified timesheets and used government property for personal use.  Following this investigation we suspended and demoted Mr. Nannery. We did not believe the SAO report was strong enough to warrant termination,” said Moseley.

Recently the KING 5 Investigators have discovered that Nannery’s timesheets are still fishy. Payroll records obtained by KING show when the 2010 baseball season started, Nannery started calling in sick. The state paid him for sick time on days he was healthy enough to go to the ball field to work with the team.

Ferry system managers didn’t realize this until they were notified by KING. Director Moseley said they are now researching this issue.

“Recently, we reviewed Mr. Nannery’s timesheets, which raise concerns. We have begun an investigation and will take appropriate disciplinary action should it be determined that there is misconduct,” said Moseley.

"I'm disgusted. This is ridiculous that someone can come back, perpetuate the same thing he did and still work there,” said Kressin. “I can't believe the money that's wasted on deals like this. It's unbelievable."

Hope you will follow up on the progress of the promised changes. It's just so hard to believe that there were not more managers held accountable and more aggressive attempts to get restitution. Are Mr.'s Brodeur, Day and Mosley still in the same management positions ?

King 5 is guilty of deleting specific information posted, intended to provide transparency on this, and other issues. I have written several responses that paint the larger picture, while including specifics. In this instance, I posted that engineers work 7 nightshifts, have 7 days off, then 7 days dayshift-a very unhealthy arrangement, as Coast Guard is aware. Since these shifts are of at least 12 hours duration, at the end of each week, "Comp Time" is earned; because they work 84 hours in 7 days, 4 hours of "comp time". An engineer is allowed to take comp-time day, during a work week. This appears under different coding, but is a "part" of work week pay. "Comp Time" is for TIME ALREADY WORKED. It is difficult to believe King 5 does not have an "agenda in' scapegoating state and union employees regarding destruction of U.S. economy. All should know WSF employees had nothing to do with U.S. economic meltdown. It is a shame King 5 hasn't told the public that story...

two points to make. First FIRE these people and hire people who are unemployed. Second, IF and I say IF people who want to voice concern over this- stop using the Ferry system until they completely come clean and adhere to what is right. Most people do not have to use the ferry system. Why take a ferry from Seattle to Bainbridge, or anything like that. Seattle to Bremerton- go the long way around and stop using the ferry system. With more and more doing that, imagine the ferry system will loose money.. Hummm not enough cars to run a route? HINT HINT

The part of this all that saddens me the most is that this Country prides itself on the theory that every man & woman is innocent until proven guilty. Unfortuantley, when it comes to the media, especially Susannah Frame and those nieve enough to believe the media is telling you the whole story, this is not the case. Apparently the saying should be changed to every man & woman is guilty even when proven innocent!

The saddest part of this~~is that this Country prides itself on living by the theory that every man & woman is "innocent until proven guilty" but apperently when it comes to the media (espcieally Susannah Frame) and those nieve enough to beleive the media is the always telling you the truth & whole this is not the case. I just want to clear something up, because a similar comment was made earlier regarding this article that "union lawyers throw case out, because they're not worth fighting"...the union lawyers don't make the decisions regarding grievances! When a union employee files a grievance, because they feel they have been wrongly accused of something, fired unjustly etc the union lawyer acts as just that a lawyer and the employer gets their representative. Desicion are then made by an arbitator. Just like if a private industry an employee who feels they have been fired unjustly etc can hire a lawyer and a judge or arbitator makes the final decision. These issues in this story were arbitrated to the fullest! It's sad that we let "stereotypes" associated with "union" "state employee" influence our opinions on a man those jugding don't even know. There are still good union/state employees left, hard working men & women and this man is one of the few!

I sympathize with the first line supervisors, in these cases. They have virtually no say in matters of this nature. They are the ones that probably know what's really going on. Their roll is to gather facts, accumulate records, research past performance, and the performance of others, to try and gather enough information, so they can pass it on to someone else, who probably passes it on to someone else, etc. etc. (the middle of the pear shaped government hierarchy) to finally reach someone with enough authority to take disciplinary action, only to be thrown out by some Union lawyer, or other employee advocate. Whats the point? Why should they do all the work, plus whatever they normally have to do, only to be wasted by little or no action, to improve the work place. I can tell you from experience it's a lot easier to take the offenders aside, explain the job expectations, tell them what corrective action is needed (but don't threaten them, because they know penalties don't happen

Ikeith, hate to burst your gullable bubble, but none of this support is from State Employees sticking together, it's from people who did there research & know this man is not capable of this accusations made by someone who didn't do her research (and chose to use just enough to to fool closed minded people like you). You've made stupid assumptions (which we all know what they say about those who make assumptions!) and your lack of knowledge about this story makes you just as uncreditable as her!

King 5 should be doing a story on his dedication to the community and his ability to balance the equivelant of two full time jobs rather than bashing him for being creative in his schedule and using sick time to coach. I am sure there are plenty of other people who change their schedule in order to spend more time at a bar, or call in sick because they are hung over, but you decide to go after the decent people and come up with petty stuff and try call it a story. There is fraud, waste, and abuse going on at way higher levels then this B.S. I wonder what Ms. Frame does in her spare time.....or on her sick days.....Learn to get ALL the facts on something first before you open your mouth again.

And once again KING 5 and Frame dissapoint me and another reason why I try to avoid this network. I mean, you really could'nt come up with anything better than to attack a man who has dedicated his life to his community. I have known Mr. Nannery for somewhere around 20 years, have been coached by him, and coached with him and have rarely met a finer, more dedicated person to his community. I am curious how Frame came up with him being at a game and at work at the same time. Last I checked games start at the earliest of 4pm, which is more than enough time for Mr. Nannery to work a full 8 hours and still make it to a game and coach. Mr. Nannery dedicates a lot of his personel time to the residents of the Kingston/North Kitsap area and has done so for the past two decades or more. He has done this while working for the state, caring for his family, and battling severel illnesses which have threatened to know him off his feet.

During the time of the alleged "sick time" scandal Jack was suffering from Lung Cancer. He used sick pay for Dr. appointments and treatments, and still managed to coach baseball later in the day. He sould be commended, not slandered. Furthermore, when he allegedly was supposed to be on the clock but was instead coaching baseball, he simply started his shift 1 or 2 hours early and left early by the same amount. Maybe not perfect, but definitely not "stealing". The report is full of inaccuracies, and I say an apology is in order---but I know it won't happen. The ferry system should be so lucky to have a legion of workers as good as Mr. Nannery and they wouldn't be having the problems they do have. Congratulations to Jack for holding his head high, and I say "thank you" for your commitment to your community!!!

Oh and by the way, I will never be watching KING 5 again. Those of you who wrote in should do the same. They are not a credible news source and this proves we can believe nothing they tell us. If they cared about waste they should have done a story about why our state legislature spent weeks at a cost of 10 thousand a day on extended session to decide how to raise our taxes with a one party majority in both the house and senate. I think we should flood Mr. Nannery with cards of appreciation and KING 5 with letters of distain.

I wonder if anyone who saw this story has coached before. Any of us that have know that games start in the evening and you run from work to make it in time. It is stressful and requires a great personal commitment. There is a reason that KING 5 did not print the times at which Mr. Nannery was "on the clock" and the times when he was at a game. They did not coincide. If there was any evidence that at noon he was clocked in and at noon there was a baseball game they would gladly have put that in the story. They are fishing for a story at the expense of a good man trying to help his community. Those of you at home complaining about this man should learn to look for facts before you judge someone who is sacrificing his personal life to help others. There are documents regarding this case with specific information which they could use. Instead they ran a story with broad accusations not specific facts. KING 5 should be ashamed of themselves and should pay for this slander and libel.

Part 3 has been submitted twice to no avail so here we go again--short version-Remember folks, since the last computer-gate scandal, Jack has worked and lived under glass. All his time recordings and accounting's were surly picked over as they came in--just plain CYA by Management. Does it make any sense that NOW we have a problem? Me and my family are proud to count Jack and his family as true friends. I hope that King 5 News purges its ranks as a show of real support for truth and reporting honesty. ...AND just before the incident Nannery had just caught theses two men falsifying their OT records. AND with Nannery at the helm his shop turned in the least OT of any shop at the facility. It’s all there in black and white…Yet here is Ms. Frame and King5 spinning it into something it’s not. Seems evil to me to try to ruin the reputation a guy that is willing to drive from Mukilteo to Bremerton after work, as a VOLUNTEER, for ratings and Ms. Frames own personal gain.

....As far as his “past crimes” Frame must have just mailed it in on this one. A simple Google search pulls up the past records. If she had actually read the documents from WSF she would have seen that there was no crime. Anyone of us who has been the boss knows there is constantly a target on your back. And wouldn’t you know it, two employees who were next inline for Nannery’s position and pay grade conspired with Paul Kressin to make it happen. Kressin never even interviewed Nannery to get his side of the story. The AG’s office found no evidence of wrong doing and Nannery was reinstated to Foreman, all record of the incident were supposed to be removed as well....

I don’t have the flow, fancy words or legal-eze of some of the ladies and gentleman who have posted before me but I also see the gaping hole in the Ms. Frames tabloid style report from last Monday. Who is to say if Mr. Nannery wasn’t sick on the days in question? Ever woke up in the morning not feeling well and been better by noon? Imagine now you’re in your 50s or 60s, as Mr. Nannery must be with 30 plus years of service under his belt. Last I played ball we played in the afternoon and evening often under the lights. Not during the work day. Being in the construction industry myself I can confirm that we love to start early and will often times flex our schedule to as early as possible in the morning. Before 6am if there is light. Know why? We do it so we can spend quality time with our family, coaching baseball, playing softball working on cars heck even to get the lawn knocked out before dinner......

Part1 The above story which is exactly that a story truly saddens me and has caused me to lose any faith I had left in King5 creditability. Mrs. Frame has twisted a good mans life to fit her own agenda. Course who am I kidding why wouldnt she report anything other then what benifits her image with the taxpayers. Her article states that Nannery grieved the termination in 93 through his union and won his job back. An arbitrator ruled the state didnt have clear and convincing evidence of wrongdoing. But she failed to mention is the part where the marine employee commission state Jack Nannery explanations of his own overtime claims were objective truthful and very credible. Under cross examination Nannery responded w/conviction. It wasnt just that the state didn't have clear and convincing evidence its that it didnt happen. Maybe Mrs. Frame should investigate the fact that Paul Kressin one of her sources unjustly fired Jack and denied his right as an

I'm heartened to see the more recent comments posted about this article. Yes, King5, sensationalism is lucrative. However, it sounds like your viewers aren't buying. Perhaps you will read what your viewers have to say and quit this pointless attack on ferry employees. Give Ms. Frame something truly newsworthy to chase after and leave the good people of our community alone to live their lives.

The story that should have been done on Jack Nannery, known most commonly as “Coach,” is on his dedication to his community and to the 100s of kids he has coached over many years. Jack has changed lives, set kids on the right path that were headed down the wrong one, he is the Coach that makes sure every kid gets to play regardless of their personal situations. He is not just a member of this wonderful community, which has stood behind him through this attack on his character & integrity, but he is a friend and a family member to them! Those of you who sit on here and judge a man you even don’t know, go ahead. Those that matter know the truth. Jack has always volunteered his time (by every means of the definition) and has refused paid positions coaching, because for him it has always been about the kids & the passion & love for game!!!

(cont) an American to due process and therefore cost the tax payers a year of investigation and arbitration to reinstate Jack to the job he deserved as a hard working honest American to provide for his family. I could also go on about the two State Employees who are so bitter about being found not creditable in their allegations against Jack, which they did/would have benefited from his termination that they have spent the last 20 years wasting tax payer money on a personal vendetta. As for the current allegations of using sick leave to coach baseball, even Mrs. Frame’s own report doesn’t support this! Those who judge should read & listen more carefully, what was that someone wrote earlier, you can’t fix stupid! Those who believe it because “the news said so” are just that, stupid! Long story short, no tax payer money was ever spent by this state employee to coach baseball, and that’s the truth, doesn’t matter how you look at it.

While we're speaking of wasted taxpayer funding...WHO DO YOU ALL THINK IS FOOTING THE BILL for King 5's BIG INVESTIGATION? YOU ARE! The TAXPAYERS of this great state are absorbing the cost to administer and process the breadbasket of public disclosures that King 5 News is using, in lieu of actual investigation. Perhaps they've canned the real investigators and they just have this one little (unknown?) reporter grinding out public disclosure requests. King 5 has now resorted to a business model that appears to have devolved into a practice of spamming government offices with disclosure requests as a sort of esoteric fishing expedition. I would further assume that it is easier and more fragrant than sifting through everyone's trash cans. Although, it would seem appropriate for this series of articles to have spawned from that source.

Part 2 - You have accused, condemned, tried, and perform the execution. I was taught that everyone will make mistakes and that there was only one pure person. They crucified him by the way. I could go on and say many things about Jack Nannery but much has been already said. I will say he is forthright and his contributions to our community have always been positive. Has he made mistakes yes as we all have and as we all have we have learned from them. Before you start attempting to wreck lives or damage reputations you need to make sure your little world is clean.

This was a hatchet tabloid article. The details of the accusations did not state when they happen. As an example when he was fired, used profanity, etc... Did this happen 5, 10, 15, or 20 years ago? Many of the pertinent details were not included in this poor display of journalism. This shows a real poor display of professionalism. Lack of integrity. Susannah Frame and Paul Kressin really have little value. They pose a higher than mighty approach to this subject. My questions to each is at anytime in your life did you call in sick and weren't. Maybe you called it a mental health day. But you were out with friends and family doing something "fun". Never cheated on your timecard? Never took paper, pen, pencil, paper clip from work? I venture to say each of you at one time did these things and also lied to someone to ensure you stayed out of trouble. Part 1

"The Truth", is an absolute defense against a charge of libel or slander. If the allegations of wrongdoing, lodged by King 5 and Dori Monson, are true there is no claim. However, they have INDEED slandered and libeled United States Coast Guard licensed Merchant Marine Officers. King 5 and Dori Monson have implied, nay broadcast and testified, that they have; padded paychecks, received perquisites ("perks"), thieved taxpayer funds, etc. All the while they leave out crucial details such as the labor contracts. Yes folks, none of the previous employees were disciplined because they were receiving all of the alleged perks under the contract. A "perk" is not a contractual obligation. By reference they are stating that the employees were taking something they weren't entitled to. Slander and libel. Read the Contract! Furthermore, they have left out how the maritime unions deferred their contractual raises to help out the state during this budget crisis.

This is the way allegations, innuendo, and lies become fact. After all, the technique worked well for Yasser Arafat, Josef Goebbels, etc. This is similar to the Jean Enersen "shop lifting" stories. Are they true? Who knows? Who cares? But, once they're out there they take on a life of their own and they acquire an assumed authenticity. This can irreparably damage the target. They are mocked, vilified, tried, and convicted in the Court of Ignorant Public Opinion. Once this has occurred, this "genie" cannot be returned to his bottle. The assertions of King 5, and Dori Monson, constitute "defamation per se." Perhaps the honest employees, of this great state, may wish to litigate. Washington State supports action against "defamation per se". (Defined): Generally, per se indicates that a statement is defamatory on its face (from Latin, "for itself" or "of itself"). For example, a former employer wrongly tells someone that you extorted or stole money from the company.

part 2. The article goes on to show Jack coaching at Kingston High School and worse than that, getting off a school bus. We are led to believe he is logging hours to someplace else with the use of pretty pictures and diagrams to confuse us. As a member of society that lets people think for themselves, if the only would, we must see this for what it realy is, just another shot at a state-run ferry system. The story is built on conjecture, assumptions and outright lies fed to a stair-climbing excuse of a reporter whose only talent is shoving a microphone in someone's face "surprise" and wanting rational responses to assinine questions. Nowhere in Frame (ups) article were the words alleged, presumed, or might have used to describe Jack's so-called new transgressions. The words thief, liar, and cheat, etc. were used. Today I have finally calmed down enough to vent my anger at what King 5 news lets pass as journalism. The article by your "investigative reporter" is at best slanderous if not libelous. It is more than obvious that assumptions, innuendos, and outright lies were spoonfed this reporter by people with personal axes to grind. I have known the Nannery family for well oer 20 years. I also had the privilege to work with Jack via the NK youth sports program for nearly 10 of those years. In that amount of time, I really got to know the kind of person Jack is. His work ethic is and has always been beyond reproach. Knowing him as I do, I am sure the state received far more work hours "free gratis" than any personal keyboard time logged. This is old news unless you are an investigative reporter needing to justify yourself always at somebody else's expense. end part 1

Geez....some of you are so quick to judge. You cant beleive everything the news says. Maybe if they had actually looked into why he was really taking sick days they would understand. I know this guy very well and all of you writing negative things would feel like dumba** if you only knew the whole truth! Yes he has taught these boys great morals and no not how to cheat and steal. Because he has done none of that. And to however thinks he has relative in upper managment the answer is no! No relatives work for the state ferries or politic offices. many might choose not to believe he is a good person but all of us in this community know different! One more point! If KING 5 wanted to do a story on abuse, they could have done it without smearing an individuals name and face.Mr Nannery is being judged in public opinion prior to having his day at trial. Is this really a story about the system or was it simply sensationalism by a news station that could ruin an innocent persons reputation.

You know, maybe this guy is abusing the system, maybe not. I agree with another user, enough about employees who abuse the system. How about if King 5 does a news story on bosses that abuse their employees? Hostile work environments in Washington state. Anyone know of any? I do. I would really like to know how these employers get away with having leaders that create an atmosphere of fear, and that is apparently okay? Maybe all the workers should unite again...sound familiar? I see a definite tone in the comments to the story. I wonder why. It certainly seems to me, even though we are all taxpayers and it costs us money, as employees, we all feel....mmmm....what's the word I'm looking for, oh yes, taken advantage of by employers? There are some good leaders out there, but the bad ones, they can ruin you, for no just cause.

I hate it when I see TV news and it show only part of the story! KING 5 acts as if the person being "approached" is a bad person for not talking to them! The news reporters have the pure advantage of showing the parts that they want on the report. DO NOT BELIEVE EVERYTHING YOU SEE AND HEAR! Mr Nannery was found innocent on every account in previous years. He's a great coach and a wonderful mentor to many high school kids. Go pick apart someone who really deserves it.......maybe there is someone at KING 5 that took a sick leave day and spent it with their son...OH WAIT...THAT could NEVER happen!!!

The story sounds alot worse than it really is. Ya, he was using sick days that he is entitled to for baseball. If one guy spends 10 days in the hospital, and this guys spends 10 days at the ballpark, we pay both of them for 10 days work we did not get. Is it really fraud if he works 4am to noon, but punches the clock for 8-4? No one questioned if he worked the hours he was paid for, just when he punched the clock. I see inaccurate punches every day. The state requires that people go to lunch before 5 1/2 hours, but if the workload is heavy around someone's lunch, they will clock out and go back to work. When the worklaod slows down, they go eat on the clock. Show me video of this guy going to and from work with the times and then we can decide if he is stealing. Maybe he is. If so, give him the boot.

I'm getting really tired of these reports on the employees and management of the WA State Ferries. These are hard working, honest people who are running a transportation system vital to the Puget Sound economy and community. Surely Ms. Frame can find more newsworthy topics than to denounce valuable members or our community. Look around Madam. There's plenty of real crime to boost your ratings.

Volunteer, a paid one if the story is correct. The focus perhaps should not be on the employee but the ruling body who decided his termination should be overturned. Who was that? Perhaps it is them that give little value to how tax payers money is spent. In today's world, sick leave for many is just another 12 days of vacation a year. It is not considered a pre-paid insurance policy to be used when sick. Instead it is a I earned it so I can use it anyway I see fit type of leave. If I remember correctly, the state has a shared leave program. So how the use as I see fit employee sees it, if I run out, I can just get others to give me their leave to use should I get sick. I know there are many responsible employees who truly need shared leave, a well intended program, but those that abuse their sick leave can get on the program, its easy. I say follow up KING 5, to see if the pesent alleged abuse is dealt with, if found to have merit.

This story is not credible, the records are not accurate, his previous boss is a disgruntled jealous old man, and the media has made a quality man look like a criminal. This man has spent more energy developing young adults then most fathers do for their own kids. He paid for his wrong doings in the past and this is just bringing up the same story that was dismissed once before. Stealing from the community??? Give me a break. 1 in 3 adults dont even pay their fair share if any of their state and federal tax obligations annually. Stop making him look like the bad guy. Afterall, if you spent more time giving back to your local kids programs maybe he wouldn't have to cover your fair share.

Please keep in mind there are always 2 sides to every story. I have known Jack for over 20 years and he is a great father, grandfather, husband and coach. Hundreds if not thousands of kids have benefited from his coaching at all levels of baseball. Yes, this story makes him look very guilty. We know the Ferry system is faulty and Management oversight has been poor. But I've known Jack to be upstanding and honest and I believe there is more to this story. A lot of people in this community support him.

I would like to know who this guy thinks he is that he can constantly cost the Washington taxpayers money. I use to work for the State myself and I have seen employees fired for a lot less including false accusations. I don't care that he has gotten away with it for so long now he has been exposed to the people of the state. We need to look into who his union rep was and see about having him and everyone who helped cover this up for so many years fired on the spot. It is people like these who are constantly re-elected to political offices and find new ways to rip all of us off. I think every politician who helped cover this up and let this thief keep his job and allow this practice going should be fined and fired. This guy and every state employee who have stolen from the taxpayers should have to pay every penny stolen back with interest. Everyone involved should have to do the same or go to prison for a year for every $1000 that every employee took from us.

We the taxpayers voted to have a state auditor to ensure our tax money was spent wisely. Is it the biggest bang for the buck to go after a ferry carpenter, or would it be more cost effective to start at the state capitol and investigate many who work there for (I would assume) much higher pay? What this worker did is wrong, no doubt, but I would like to see the state auditor go after the true criminals who are in charge of how our money is spent. I think the current financial crisis, and the track record of those who are in positions of power, would say we need to focus those energies in a more productive manner. My 2 cents worth? No. Just my $3200 in property taxes worth.

Brodeur and other mis-managers have the power to stop this abuse, but remain aloof to the problems, Moseley must make the mis-managers accountable for their inaction or things being revealed by King 5 will cease for awhile then will start anew with different employees. Sick leave is a joke anyway. Consider person A, and person B get 12 days vacation, and 12 days sick leave. Person A does not get sick and is a good employee takes his 12 days vacation. Gets 12 paid days off. Person B does not get sick is a good employee, takes his 12 days vacation, and uses sick days as time off, gets 24 paid days off. Both people took the "risk" of not being sick, employee A got 12 days off, employee B got 24. What's the incentive here? Reward for not being sick? No. Reward for taking a low risk? Yes! Chances are if you do use all your time off due to illness, you just go on leave of absence, with no penalty. You already got your money.

Mickey0 - I agree with you. There is no law in this state requiring employers to give sick leave. It is not even earned - it is GIVEN to the employees. Unions negotiate vacation and sick time, but any employer at any time can decide next contract, we will not offer sick leave. So, those that abuse it ruin it for those that don't.

Common who else are you going to report on for calling in sick the Ups driver who calls in to take his kids waterskiing? I ride on the boats to go to work every day and your just trashing all the decent ferry workers that I see every day. You make a point that a few are doing something wrong. Let's not judge everyoneof them for the few that are wrong. As for the 140 a hour bit you did, I'm wondering how many people out there if ther boss offered them $5000 to come back and work on there vacation how many would turn that down? Really can you blame them? I'd blame the State not the worker.

State employees receive Annual leave for time off for activities such as those Mr. Nannery engages in. Because of his seniority he receives over 30 days a year of this vacation time, plus at least one "personal holiday". He receives generous holiday pay. Since he has his 30 years in why doesn't he just retire, draw his (un)earned pension & get on w/ his life. He's a moocher!

What you people are complaining about it's a "government" problem... it's a problem with human nature. And before you start railing about how private enterprise "fires" such deadbeats... Not true at all. Almost every company has plenty... you know them... you work with them... you complain about them... and there they remain. A person very close to me works for the state in a department that manages employees and I hear complaints all the time of people on state time wasting away the day leaving for hours on end with no accountability, using the internet for hours shopping for gifts, etc.... King5 makes it sound like they've really uncovered something unique. This type of activity is par for the course with state and federal workers. WAKE UP !!

I have a son who coaches also. He goes to his job earlier in the morning, during the season, coaches from 2:30 til 5:00, then goes back to his job and finishes his hours. He doesn't cheat his boss. He' s honest, and has integrity. What kind of message does this send to his athletes? And why is he not accountable to us , as taxpayers? I go to work everyday, and do my job, so that I can pay taxes, so that he can be paid. I personally want an explanation as to why he thinks this is alright. If I don't do my work, I would expect to be fired. And the union should not have recourse to "save" his job. No work, no pay.

exballplayer - how has he taught young men to be productive members of society when he himself was not one. He maybe has taught them to be productive liars and cheats. I hate when people do this. I've worked for government, and for private industries. There are people in both sectors who cheat, and people who work more than their 40 hours without overtime, to get the job done. Usually, it has been my experience that the vast majority that cheat are union members, and the union protects their ineptitude. I hate being part of a union, but am forced to join to do the job I currently do. Not a good member however, as I work more than 40 hrs when needed and don't charge overtime, rarely take a full hour for lunch, voluntarily come in on weekends to help someone. The Union HATES me because I won't toe their line!

Unions make me so angry when they fight to keep someone like this working! This guy is a thief. No wonder the State ferry system is in such financial trouble! Many people volunteer their time to coach youth sports, without bilking their employer. This is taxpayer money involved and I, for one, insist that this guy be terminated and never be allowed to work for the State again. After following the reports about ferry workers 'padding their hours' and getting huge overtime pay, and now this guy getting paid when he's not even on the job - WOW!

But a photograph shows him coaching first base at a game in Bremerton that day. The next month, the state paid him to work at the Point Defiance terminal in Tacoma. That doesn't add up. A photo shows him getting off the team bus for a match-up against the North Mason Bulldogs on Hood Canal.....exbbplayer...you are misguided....his timesheet showed him working, but he was at a game....what it appears he is showing is how to cheat a flawed system...you said have you never taken a sick day when you weren't sick...who f'n cares...the rub with him was he didn't use his sick leave, so he was double dipping...if one of us stayed home we TOOK our sick day, whether sick or not we lost those hours of sick leave...if you can't see that, well Ron White says it best...."you can't fix stupid."

This man has devoted countless hours to help young men develop and hone their baseball skills. He has taught these boys to be productive members of a team and society. And this is how we repay him? By literally throwing him under the bus?!? He took a few sick days when the team he VOLUNTEER coaches was in the state playoffs. I am sure none of you have taken a sick day when you weren’t really sick. Give him a break. The real question is: How many hours were wasted by the state to investigate this?
