Social Security admits mistake

Social Security says they have been overpaying Helen Ballou for 19 years. The government made the mistake and she has 30 days to pay the money back. 

It took 19 years for the Social Security Administration to discover it had overpaid Helen Ballou some $21,794, but Uncle Sam wants all of its money back quickly or they will cut off the grandmother's monthly payments.

"Can you imagine if I sent you a bill saying, 'Whoops, we made a little mistake 20 years ago and now you owe me all this and get it over to me in 30 days,'" said Helen.

Now we'd all love to repair the mistakes we've made, but only the government could get someone else to pay for them in this case. They are asking the 84-year-old Bainbridge Island resident to do the impossible.

"It's an absurd way of handling it, it's totally absurd," she said.

Helen, a former college dean, has tried for months to educate the government about her case.

"I phone and the lines are all busy and then they say you can leave a message, so I leave a message asking them to call me, they never call me," said Helen.

Linda Slater, Helen's daughter, says they're taking on the wrong woman.

"My mom, she doesn't pick a fight, but by gosh, she won't back down from one," said Linda.

But the government wasn't listening or budging from its position. So the family called me and we spoke to the Social Security Administration, armed with a few questions from Helen:

"Who's running the show? Who's making these decisions?"

It took a month of calls, e-mails and prodding to get the Social Security Administration to own up they had made the mistake. The best news was this: Ms. Ballou doesn't owe Social Security any money. We rushed right over to let Helen know.

"Whew! That's a big thank you for your help! I wouldn't have gotten anything without you, I know it," said Helen.

Social Security says Helen had no way of knowing her payments were incorrect to start with and, like we said, it went on for 19 years.

We thank Social Security for stepping up. If this happens to you, appeal the decision, write the agency via certified mail and call as many times as it takes to get your case heard.

I am going through my own social security nightmare. The caseworker last week changed the award amount and when my back payments would be sent to me. My attorney told me that I have to write my own letter to appeal hardship. I have been on state help of only $339 a month, and have had to share an apartment with my daughter because I have been waiting for 8 years for a decision. The caseworker at the Kent office told me that because I did not contribute to the household more than I did, that my benefits were deducted, and the amount of $674 was taken down to $617, plus more than $6,000 is going back to the state and more than $5,000 to the attorney. The caseworker is holding up the majority of my back payment for another year. When I had my appt. on 19 April this year, she told me that if I had all my paperwork in by the 23rd, my back payments in total would be put in my account by May 1. Nothing is going as planned, and I feel like I am being pushed around with no one to help.

Who made the mistake at Social Security that made them have to send out 2 messages about when we will receive our first check in January. How much did that double mailing cost.?

I'm a widow since 1993 and was receiving benefits from Social Security for my two children. My benefits stopped in 2008 due to my youngest child graduating from High School. When Social Security went to close my file, they discovered they over paid me from 1999 $4400. I received notice of this "error" in June of 2009 and they were giving me 30 days to pay it back, after 10 years!. I requested a meeting and was granted one. I had to take in financials to prove that I clearly could not pay it back but yet they told me I had to. Then I requested a hearing in front of a judge in January 2010, I haven't heard from them as of today to give me a hearing date, but when I did my taxes this year, they withheld my refund. It's horrible what they do to people. I hadn't heard from them stating the overpayment at all until they went to close my file, 10 years later. Granted it's not $20K like Helen, but $4400 to a single parent raising two children might as well be! Thanks Jesse!

Big thanks to Jesse!!! Seattle-ites are lucky to have him as an advocate! It's time staff at the SSA remember that if it wasn't for the elderly and the infirm, they wouldn't have jobs. Sure they are overworked, underpaid and all - so am I -but I can't be an utter dink to my employers. For them to bully an 84 year old woman for a mistake they made 20 years ago is outrageous.

Many thanks to Jesse for covering this story. I have had similar dealings with Social Security. They do not communicate, have poorly trained personnel and hold no one accountable for their vast disorganization. In fact, it would be interesting to seen the news department do an expose of the horror that is Social Security. The public needs to know how poorly this government agency functions. In my dealings with them, they seem convinced they are a "secret society" rather than a service for the people. I have complained with no response to my Representative and both Senators. They seem content to bury their head in the sand as well.

Wouldn't it be nice if government, big business, etc. admit their mistake and not try to get the average joe to pay for it? She had no way of knowing she was overpaid - especially for 19 years. Coming on so heavy handed is just a case of doing it because we're bigger and stronger than you. thanks Jesse and King5 for going to bat for this woman!

As anyone who has ever dealt with the SSA knows, they are a complete and utter disgrace of an organization. Although their are good people employed, they are maxed out, ineffective because of policy, and unable to keep up. The whole admin needs to be torn down and rebuilt with an entirely different structure and philosophy.

We thank the Social Security administration for stepping up? Doesn't sound like they ever stepped up until the press got involved. The problem with government organizations like this is now that you CANNOT get a human being on the line, and when you do, its' all blah blah blah. You may was well be talking to a machine.

That's terrible they would do this to her....not to mention when Rebecca Anderson-Clements, who was convicted and sentenced in December 2009 of frauding the social security system for more than 20 years, they could only go back 7 years for the conviction. Law abiding citizens always get the reamed while the criminals get a time limit to their actions. I'm glad at least this incident ended well.
