Wrong man's bank account cleared for child support money

Meet William L. Field, father of one and famed ukulele player from Enumclaw, but to the state of Arizona he's known as William J. Field, a dead-beat dad who owes his kids $46,000.

"It was a total shock, it was 'oh my God! What do we do now?" he said.

That's right. Arizona's chasing a delinquent father with bad information. Let's go over this again.

William L. Field - nice guy. William J. Field - a guy who doesn't pay his kids' child support.

The state of Arizona, didn't know the difference and wiped out William L. Field's bank account.

"It was complacency or total error, I don't know," William L. Field told me. Either way, it's not a good situation.

"It was a total disaster," he said.

Out some $3,500, William L. called the state of Arizona. They had his cash, but no real answers.

"At that point I had no money, there was no money," he said.

At that moment William L. Field had something in common with the state of Arizona: They're both broke.

So he called me and we got in contact with Steve Meissner, spokesman for Arizona's Child Support Enforcement Agency.

"So we have access to a lot of different databases, a lot of different information. We work with people in the federal level at various different state levels, banks, in trying to find people who owe money," said Meissner.

And not one of those investigative tools worked in this case. Not one. Steve did admit there was a mistake in William L. Field's case, but provided no details.

"In the case of Mr. Field, I believe we've worked with him to rectify any problems that may have occurred and I'm going to have him talk about anything else," he said.

William L. Field is pretty steamed.

"They were obviously being very zealous about thinking I am this guy, and there are a couple of accounts with money in them, so they have to act they had to pounce," said Field.

After we called the state, William L. Field got his cash, but he's still uneasy about the whole situation and he plans on checking that account every day.

"It feels good, but there are some doubts," he said. "Yeah, my bank is going to get sick of me."

The state of Arizona has refused to tell us how it mixed up the two gentlemen in the first place. William L. Field, the Enumclaw guy, had over $100 in overdraft fees because of this. His bank has dropped those charges so he's completely taken care of.

This happens all the time. If it's not the State or a State, it's the IRS. It is the old saying, " Kill them all, we can sort them out later. This was not a mistake, it was a failure in policy and procedure.

To Seattlelovemongr...I am the mother. And yes, if I was to get the money it would cover the hundred of dollars I spend a month on putting a roof over my childrens head, food in their bellys, and clothes on their backs. I do that already while working full time and paying for day care. All with out the help of welfare. So you tell me, are my kids getting anything out of this?? While the state pays for HIS medical and food because he won't work because they'd take the pay and give it to me to cover child support. And in yet they cannot find him.

batti4....It should be 10 grand he owes your child....not you!!!!!....thats the problem with the whole child support system....mothers think that the money belongs to them "The Vendiction Check" ...most of which never goes to the child or children.....

I'm with Bambianne~ Only in my case, they KNOW where he is but will not do anything about the almost 10 grand he owes me! Our system is truely messed up! All they did was take his driving privledges away...BUT HE STILL DRIVES!!!! I am happy the money was returned to Mr. Field and I do not blame him for checking his account every day! I would do the same thing!

The process to "drain" a bank account requires paper work being delivered from the courts to the bank. Then the documents are delivered to the banks legal department to make sure it is on the up and up before they put a lein on the funds and distribute them back to the correct agency. Looks like this whole thing didn't quite happen correctly - the first thing the bank should have noticed is the middle initial was different! If a customer comes into a bank to deposit to an account the tellers must compare the entire name to the computer records. If the names do not match, further investigating happens to insure the $$$ goes to the correct account. I admit there are mistakes do to human error but in my opinion if a teller can do this simple step with very little training then why can't a team of lawyers working in the leagal department? Not to mention the child support department and court who processed the garnishment? Thank your local teller today for all they do!!!! =)

The state of Washington cannot find my childs dead beat dad, and he lives within this state somewhere!! If Arizona can jump around bank accounts, why can't Washington do the same?

billvaughn-That's just how child support works. If you don't pay it willingly, the State takes it from you forcibly. But you're right, it scares the h$ll out of me that a State obviously has access to any American citizen's bank account at any time. Heck, that means if someone with my first and last name has court fines in, say, Kansas, the State of Kansas could empty out my bank account without even giving me a chance to inform them that they have the wrong person! That's just wrong. Wrong, wrong, wrong.

What's obviously very scary is how the State of Arizona - how ANYONE - could just reach into someone's bank account and empty it out. This is the part of the story that would really be interesting.

Wow. Way to Go Arizona. That would be awful, to just see that much is gone from your accoutn because you're being accused of being a dead-beat dad. This is just wrong. I'm glad he was able to get his money back.

Just having a name and pouncing on that persons assets is rediculous. How about some accountability on the State of Arizona's part. First and foremost should be a SS #. There are probably numerous William L. Fields in the USA. did they pounce on all of their accounts as well, just to make sure they got the right one?
