Washington same-sex marriage bill signed into law

OLYMPIA, Wash. -- Gov. Chris Gregoire handed gay rights advocates a major victory, signing into law a measure that legalizes same-sex marriage in Washington state, making it the seventh in the nation to allow gay and lesbian couples to wed.

Gregoire signed the bill in the state reception room in the Capitol, surrounded by gay rights supporters. "I'm proud our same-sex couples will no longer be treated as separate but equal," Gregoire said.

It's a historic moment, but same-sex couples can't walk down the aisle just yet.

The law takes effect June 7, but opponents are already mounting challenges on multiple fronts.

Opponents planned to file a challenge Monday that could put the law on hold pending the outcome of a November vote. Separately, an initiative was filed at the beginning of the session that opponents of gay marriage say could lead to the new law being overturned.

The state reception room at the Capitol was packed with gay rights supporters and at least 40 lawmakers from the House and Senate
Sen. Ed Murray, a Seattle Democrat who is gay and has sponsored gay rights legislation for years, told the cheering crowd: "My friends, welcome to the other side of the rainbow. No matter what the future holds, nothing will take this moment away from us."

As Gregoire signed the legislation, a man shouted "do not betray Christ!" However his voice was overwhelmed by gay-marriage supporters who cheered and spoke loudly during his outburst.

The Democratic governor signed the bill as Republican presidential candidate Rick Santorum, who opposes gay marriage, was in town speaking with conservative voters.

Santorum planned to meet with Republican lawmakers at the Capitol later Monday.

Gregoire's signature comes nearly a week after a federal appeals court declared California's ban on gay marriage unconstitutional, saying it was a violation of the civil rights of gay and lesbian couples.

A three-judge panel of the 9th Circuit Court of Appeals gave gay marriage opponents time to appeal the 2-1 decision against Proposition 8 before ordering the state to allow same-sex weddings to resume. The judges also said the decision only applies to California, even though the court has jurisdiction in nine Western states.

Washington state has had domestic partnership laws since 2007, and in 2009 passed an "everything but marriage" expansion of that law, which was ultimately upheld by voters after a referendum challenge.

Opponents said they would file a ballot challenge after Gregoire signed the measure that would require voters in November to either uphold or overturn the law. If the referendum gets enough signatures the law is put on hold pending the outcome of a November vote.

Separately, an anti-gay marriage initiative was filed at the beginning of the session, but the language is still being worked out so no signatures have been collected yet. An initiative alone would not pause the law.

Gay marriage is legal in New York, Connecticut, Iowa, Massachusetts, New Hampshire, Vermont and Washington, D.C.

Same-sex marriage also has the backing of several prominent Pacific Northwest businesses, including Microsoft Corp., Nike Inc. and Starbucks Corp.

Legislative committees in Maryland heard testimony on gay marriage last week. Lawmakers in New Jersey are expected to vote on gay marriage soon, with a vote in the state Senate on Monday and a vote in the Assembly on Thursday.

N.J. Gov. Chris Christie, who is pushing for a public vote on the issue, says he'll veto the bill if it comes to his desk. Maine could see a gay marriage proposal on the November ballot.

Proposed amendments to ban gay marriage will be on the ballots in North Carolina in May and in Minnesota in November.

The thing that gets me the most about this whole issue is we have put a label on it. Marriage is marriage wether it be same or opposite sex. I have many friends whom are in same sex relationships and let me tell you I do not judge them. Although I chose not to be in a same sex relationship. People who choose to be in a same sex relationship are just that "people" they are the same as those who choose to be in an opposing sex relationship. I do not label my friends who choose to be in a same sex relationship. I don't go around saying hey that's my friend so and so and he/she is gay/lesbian. I do not have to agree or want to be a part of a same sex relationship myself but that doens't change my feelings for people mainly those I call friends. I choose to have people be a part of my life because I like them for who and what they are with and without certain character defects, and I most definately don't define them by wether or not they are in a same sex relationship or not.

Hey emptynestr, how can you be so sure of that Holy book when not one single word was written by the chief himself, Jesus. Was he illiterate? All there is about him was written by others many years after he was gone and not one word of what they wrote indicates that he spoke out against homosexuality. He was a man of peace who healed the ear of a soldier injured in the act leading to his own death. The Apostle Paul however was very different. Paul was militant abut everything and hated homosexuality. Interestingly, this Apostle Paul was NOT one of Jesus twelve disciples, did not learn at Jesus feet, didn’t become a Christian nor an apostle until Jesus was long gone, and his alleged apostleship is entirely based on his own accounts. Recent discoveries reveal there were gospels of Judas, Mary Magdalene, and just about every James, John or Steven who wanted to express an opinion--not much different from these comments. Think about that.

@backinmyday, as a Mormon, I can tell you if you tell the missionaries, "No thank you, I'm not interested," they will respect you and not bother you about their religion. And if they ask you if there's anything they can do to help you, they'll do ANYTHING you need to help you, if you need your yard cut, or your bushes trimmed, or you're laid up with a broken foot and can't clean your house or wash your dog...they'll help you and expect nothing in return. I'm sorry you've had bad experiences, but I know that before I became a member, they never bothered me if I told them I wasn't interested.

And no, I don't push my beliefs on people here or anywhere. It's people like you that go door to door always during dinner time by the way, to ask people like me to join their religion, and no, it doesn't matter what other religion that I could be a part of, that doesn't matter to them. I could be a Buddhist and they would still try to get me to join their religion, instead of respecting my beliefs and leaving it on the door step, it doesn't matter if I believed in Buddha or Allah, they use the high pressure sales tactics "used car salesman", it's annoying, and people like you annoy me to no end. I don't go door to door telling people not to believe in their religion, I am too busy avoinding the other nuts like the Jehovahs Witnesses, the Mormons, and the Fundamentalist Christians.

@mr_conservative, actually that is exactly what you're doing. You're telling two people who love each other that they cannot or should not be together because they're both the same sex. How is that NOT telling someone what to do? How does that hurt YOU in any way, shape or form? It's just fine if that's not what you believe, but to tell other people that what you say is right, and they're completely wrong is beyond hypocritical. Two people love each other, they want to show that in the biggest way possible. You're not God, you shouldn't judge them. Let them do what they feel they need to, and if God is against it, they can deal with that when their time comes.

@backinmyday: What that means is that through legislation you just pushed your beliefs uninvited on a bunch of people who believe something different than you. Nobody here is trying to tell you that you should believe what they believe. They're only trying to shape the world according to their beliefs just as you are. Even if you don't believe in "that fairy tale stuff", that doesn't mean you have no beliefs. You believe there is no god who affects your life. You have just as much faith in that belief as any Bible-believing Christian or Koran-believing Muslim. It doesn't somehow make you neutral in a debate. Hammering away at the people who disagree with you and your world view doesn't make you any less preachy. Everybody has an opinion based on something. Everybody will make an argument based on that opinion. Everybody will resist what they think is wrong. Sometimes you will win, and sometimes they will win. That's how our country works. You don't have to like it.

@mr_conservative, enjoying sex (with a husband or wife) isn't deviant, no matter what they choose to do in the bedroom. *shrugs* You're the one making a big deal out of what people do in the bedroom. It's up to God to sort it out. Don't have "perverse" sex if you don't want to. Worry about YOU. It's all great that you're Mr. Born Again, but with that you have to think about the fact that not everyone is like you, and you should learn to clean your own closet out before trying to tell someone else how to clean theirs.

@mr_conservative, not only homosexuals do sexual acts that are historically homosexual. A lot of women love having their men have sex with them "back door", and female oral sex and using toys isn't just for lesbians. Women also go down on their men, and a lot of straight men like a little "play" with that, back door style. Heterosexual sex can be a public health problem if not done monogamously and/or with condoms. Gay men and lesbians are NOT defined by their sexual orientation (i.e., who they have sex with), any more than I'm defined by my sexual orientation (right now, no sex at all, although I am straight). I'm not a prude, and they are not disgusting pigs that have sex with everyone they can lay their hands on, spreading AIDS and forcing our children into immoral acts (which, btw, has absolutely nothing to do with whether someone is gay or straight, just using an example).

@tsunami - Homosexuals are not people who are just a little different. They are defined by the manner in which they have sexual relations. Doesn't that seem a little shallow - your identity revolves around the manner in which you have intimate relations? And it's not just a little different - it's a LOT different - to the point of being a public health issue? Don't go comparing this to race. That's a slap in the face of every black person who'd had to sit in the back of the bus. It's about a psychological disorder that is revolting to normal, sane individuals.

The fact of the matter is, our laws are supposed to NOT be based on any religion. There really are no arguments against a secular marriage between two consenting adults without bringing religion into it. You don't believe gay marriage is right or proper, great, fantastic, don't marry someone of the same sex, don't support friends and family members who DO marry someone of the same sex, don't patronize a church that chooses to perform gay marriages. It's really that simple.

While you go off spouting about the evils of homosexuality, the rest of us just shake our heads and dismiss you as the hateful, ignorant waste of people you are. We know that this is a battle that you can't win. You won't ever be able to get rid of homosexuality. Just like your ilk couldn't ever get rid of all the African Americans in the civil rights era, and now we look back on that time and think, "How could people have ever been so ignorant and cruel?" One day our children will look back at our time and be astounded that there were people around that were so hateful and so stupid that they dedicated actual time and effort to deny rights from another human being who just happened to be a little different from them. Homosexuals getting married has little to no effect on your personal life, so why do you guys care so much?

It doesn't mean jack what christians believe, it doesn't matter to the rest of us who are not christians one way of the other, it would be just the same that it doesn't matter what a muslim thinks of another christian, it doesn't matter one way or another to that christian or even an atheist, it doesn't matter to that atheist what that christian and that muslim thinks of him or her. They can quote the koran, the bible, or the talmud all day, bottom line, it's just a piece of papers to that atheist with no legal basis in fact. We are only obligated to follow constitutional law, that's it and nothing else. So stop quoting the bible as if it's law, it's not, besides some of the analogys from the bible pertaining to homosexuals that I have read on here are inaccurate anyway, like I said, it doesn't matter to non-christians, so save it. I'm sure you christians would be up in arms if someone were trying to shove the koran down your throats.

There is a lot of misinformation about what Christians believe - that they're supposed to love everybody (true) and tolerate everything (false). People on the "tolerance" side of the argument like to point out that when a crowd was ready to stone a woman caught in adultery, He said, "Let he who is without sin cast the first stone." That's all well and good. But people tend to leave out the part where He told the woman, "Go and sin no more." Jesus loved the woman and did not condemn her, but neither did He "tolerate" her "lifestyle". In the same way, many Christians do not condemn homosexuals and those on the "tolerance" side of this argument. But neither can they sit in silence and simply allow it to happen. It has nothing to do with equality. It has everything to do with morality and a conviction that it is their responsibility to stand for what is right and against what is wrong.

Wow, I had no idea there were so many angry hateful people up in Washington until I started to read this comment thread. It sounds like they're going to try and Prop 8 you. Hopefully it doesn't have the same effect there as it did in CA. I see so many people quoting a bunch of lines from some old mythology book. Do they think that is somehow relevant to any discussion? Talking snakes, bushes, and donkeys? How do people actually believe in that stuff?

Direct copy and paste from the US Constitution "Amendment 1 - Freedom of Religion, Press, Expression. Ratified 12/15/1791. Congress shall make no law respecting an establishment of religion" I do not have to recognize this law made by these people and neither do you; I don't care how much you complain and whine that you don't have EVERY special privilege possible; guess what? SOME things don't get ALL the same things as another thing learn to live with it. Complaining so much that you can't get married... try helping society instead of complaining you can't USE A WORD good god... I'm going to go cry for this state we are going down the drain - the Governor doesn't have enough votes to stay in office so she does this to get gays to vote for her, that's right, walk right into her trap...

Why are Christians being seen as the one on the offensive side instead of defensive(I'm not talking about those religious people who don't have personal relationship with Jesus who put up signs "God hates gay")? Can you gay people assure us that you won't make it mandatory for my nieces and nephews to study a text book where a father marries a father in elementary school? We have to defend ourselves because if we don't we'll be forced to follow you just like we were forced to study evolution in school just because of so called "consensus" agreed by so called scientists (who twisted the data and jump into conclusion to fit their bias)

To those who are asking "why is the legislature spending time on this when there are more pressing issues?" Realize that the legislature is a GROUP of people who are perfectly capable of working on multiple bills and projects at the same time... like any organization... and then they address bills on the floor in a serial manner... like any organization... really. People. They ARE working on MORE than just this! This, however, as a civil rights issue is BIG NEWS at least with respect to garnering an audience for the news outlets (like this one) so it is getting lots of coverage.

Also you can't tell me about "I need to move" or "I need to learn to live with it" - YOU need to take your own advice, I HAVE moved and I HAVE lived with the laws so far; why can't you live up to your own expectations? Why does everyone have to conform around YOU? The selfishness and hypocrisy the gays have shown here is repulsing. Everywhere you look they want equal rights, but ONLY FOR THEM, and everywhere you look they want people to conform TO THEM; they immigrate here and ask US to MOVE because they think they are entitled to it. I admit I'm hypocritical, I admit I'm selfish, but I dont go into someones house naked and when they complain say "you need to leave" because they don't like it...

When are people going to get it... marriage, from the perspective of the State, is a secular institution embodied in law for the purpose of establishing rights of inheritance, familial obligations with respect to children (including custody issues), joint property ownership and survivorship, etc. Marriage, from a religious perspective is different... the whole "sanctity of marriage" with its definition of "one man and one woman" has nothing to do with the secular interests of the State. If you base the secular laws on the religious definition, then you are, de facto, institutionalizing a State sponsorship of a religious doctrine -- one that not all religions follow -- breaking the constitutional wall between "church" and "state." Look up the definition of "sanctity" and then think about the rhetoric of a politician pushing the "sanctity of marriage" position as the law of the land: s/he is pushing a religious doctrine to apply to everyone regardless.

@emptynestr, regarding the polygamy and concubines in the Bible...in Genesis, there is TONS of non-monogamous behavior, which is what Heavenly Father put in place (with Jacob, Isaac, etc.). He even "closed the wombs" of Jacob's (who became Israel) wife and allowed his concubine to get pregnant to help spread the Sons of Israel all over the world. Like you said in the same post, it's up to Heavenly Father to judge us. worry about YOURSELF and YOUR sin, not what others do with their sins. As long as they aren't hurting you, it shouldn't matter if they want to be married to someone of the same gender.

The reason all that "polygamy, concubinage, deception and deceit." is iun the Bible is to show that human nature is sinful and God doesn't condone any of that. Sin is sin and God HATES SIN. That is the total reason Jesus came to save us because otherwise we would all be so lost without any way to be saved from our sinful natures. The REAL message of the Bible is that God came down to us through His Son, Jesus to PROVIDE A WAY for us to be made clean and holy and acceptable before Him. It means humbling ourselves and anknowledging our sins. But since most of you on here won't accept that provision for forgiveness by faith in His Son there IS NO forgiveness otherwise. @musikpal - read the law, it says that religious leaders such as preachers, priests, rabis, imams, and can't have legal actions taken against them for refusing to perform a marriage ceremony because of their beliefs. So we don't even have to assume that a separation of church and state would protect churches from litigation, it's written into the law that these organizations are protected.

Of course gay people are people and my sins are probably much greater than many gay. In fact I've met many lovely gay people. 3 of my friends are gay and one of them I grew up with and we hung out in my teenage years. One gay man at the store near my house are actually my favorite clerk and I joke with him every time. For us BORN-AGAIN Christians who knows God, we know we can't tell gay what to do, it's their business and their life style, yet I oppose the law because I'm now a Christian and the reason we have to oppose it is this; Just like among black, white yellow, fat or skinny , tall or short, there are good and bad, gay have good and bad among them as well. So if let's say if one out of 1000 gays is bad then that one can, for example, show up at a church and demand the church to do a wedding ceremony for him/her. So what will happened to the church if it denies? It'll likely be sued for discrimination against gay marriage.

They would have no legal binding in the eyes of the government and however the respective religions chose to dissipate them, is up to them, but again, it would have no legal binding. Civil unions would be law, divorces would break up civil unions, and both would only be mediated by the government and only by the government. How religions chose to treat/honor them is up to their respective religions.

It is only the United States who first stopped this practice. In a large section of the world, the established religion is the only marrying and divorcing authority. stonetrails...short, sweet, and well said. This state is bankrupt, taxed up the ying yang, and now this. Gregoire obviously isn't worried about reputation, morals, or the huge debt she has us in. Instead, she sticks her nose where it doesn't need to be and throws morality to the wind. One more note...I also noticed that the other handful of states that already passed it are all on the east coast. Maybe the folks that want that life style should all go there together and leave our one man & one woman society here in peace.

If it comes to a vote, the Conservatives and bigots will loose. This is a very blue state and lets not forget the marijunia initative will be on the same ballot also.Every young, college aged, liberal, gay, Democrate, dope smoker will vote. That will put 70% of Pierce, Thurston, and King in the FOR group. Plus might even add Pullman. The numbers just dont add up in their favor. Plus the Morman Church which bankrolled Prop 8 in California will be sitting on their hands this round, so that Bishop Romney doesnt have to explain his flip flopping views.

@Coug9 Then why is the government handing out marriages if they are a religious practice only? This is an argument that people bring up time and time again. The government should just hand out civil unions to couples, whether straight or gay, you file taxes with your spouse as a civil union and you get divorces from a civil union. Then let religious institutions hand out marriages as they please to whomever they want. However, these marriages will have no sway according to the government, taxes, divorce or anything. It makes perfect sense.

If your straight you are entitled to benefits but not if your gay? Last I checked they were TAX PAYING citizens too! I surely don't see anyone saying "we aren't going to accept gay money". @Coug9, You just made the point I have been trying to make. This whole issue really boils down to $$$'s. It is not really an issue of being able to use the term "Marriage" so much as the financial issues associated with the term. If done properly Civil Unions can accomplish the same thing, without offending and violating the US Constitution. The part of the "law" that will eventually cause it to be over turned is the stipulation that a business "can not refuse" to provide services to a gay couple based upon the religious convictions of the business owner. This violate the 1st amendment. "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof". Specifically, "... prohibiting the free exercise thereof ..." Ok, where do I go to sign the referendum?

There is lot of stuff that does not affect me in my daily life, but Ir doesn't make it right. Ripping fetuses out one leg at a time doesn't affect me. Someone blowing up their kids and themself does not affect my life. A hooked walking down the street does not affect me. Why worry about any of it?

The U.S. Constitution says "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof". "Marriage" is a religous practice: "What God has brought together, let no man part." So, unless you have a religous right to gay marriage, it is up to the Government to "DECIDE" what qualifies as a "marriage" as defined by your "free exercise" of religion clause. What religous freedom is the government preventing by allowing homosexual marriage?
