An Edmonds police officer has been arrested for allegedly having sex on duty with a woman who was in his temporary custody for jaywalking.
Officer Daniel Lavely, 46, was arrested and booked at the Snohomish County Jail on one count of Custodial Sexual Misconduct. Formal charges are expected to be filed by the Snohomish County Prosecutor's Office.
Everett police were asked to investigate the May 7 incident involving the 28-year-old Seattle woman. They determined there was probable cause that criminal conduct occurred.
Everett police said Lavely released the woman after the jaywalking stop but contacted her again later, put her in his patrol car and drove to a remote location where they had sex.
The woman reported it a few days later, and Lavely was placed on paid leave and his law enforcement authority was suspended.
Lavely has been with the Edmonds Police Department for seven and a half years.
