Local windshield repair companies suspected of insurance fraud

BURIEN, Wash. - State agents raided a Burien home on Wednesday to search for evidence of criminal fraud and theft. The two-story house is the home office to Premier Auto Glass and Auto Glass Express. Both companies are mobile windshield repair firms.

The state Office of Insurance Commissioner is looking into whether the firms overbilled insurance companies and customers by tens of thousands of dollars.

According to court records obtained by KING 5, since February 2009, investigators for State Farm say they have examined 117 windshield repairs and found in 66 cases that cheaper aftermarket glass was installed while they were billed for the more expensive glass. State Farm states in court records that the alleged fraud cost the company more than $34,000.

State agents and Washington State Troopers collected years of business records and computer records from the Burien home.

"It will take several weeks to go through (the records) and figure out what we have got," said Mitch Barker, Director of the Special Investigations Unit.

The case hinges on whether the mobile windshield repair companies used Original Equipment Manufactured glass, which is the same glass that comes from car factory, or if they used a third-party aftermarket glass.

Acccording to state investigators, the aftermarket glass is generally a less expensive and cheaper grade of glass. Insurance companies typically pay for the more expensive glass to protect their customers.

Barker says his office is looking at 1800 potential cases stretching back four years. If the companies are billing for one glass and using the other, then Barker says "it's a crime , it's theft in essense."

It may take several months before any charges could be filed.

KING 5 spoke to one of the owners of the company by phone. We asked if she or her husband were breaking the law.

"I don't know. He knows all the ins and outs. I only did what he asked me to do," she said.

State Farm says insurance fraud is a $30 billion a year problem in America.

An average household can pay up to $300 a year in additional premiums due to fraud.

I love the way we convict people over a news story, these are the nicest people you would ever want to meet. They are active in their community, and always there for all four of their children - one of which was in the hospital while they were riffling through the house. They just wouldn't do this. Why is it ok for my hospital to charge $6 for two generic Tylenol, I can buy an entire bottle at Walgreen's for that. I have had two windshields repaired by them, they didn't try to replace they fixed the chips. They also told us that the previous repairs we had by someone else where not good but they couldn't in good conscience replace the windshield - for that we would have had to pay all out of pocket if we wanted it replaced, they wouldn't bill our insurance. Get the facts straight people. Insurance won't pay for OEM either. Anyone look at this State Farm agent? OH no!

I don't think these people could do this, I have met them on numerous accounts. They love there children and they would never do anything to jeopardize going to jail to leave them behind. I have seen there windsheild repairs and they look just fine to me. So next time you put this stuff on the news consider all of the possible factors.

The most disturbing part of this story is the absolute lack of facts by the reporter. Did they talk to ANYBODY else from the glass replacement industry before running this story? Anybody from the industry will tell anybody asking that most of the insurance companies ALWAYS PREFER aftermarket parts as opposed to your report stating the opposite. Duh, it saves them money. Just you try to get an OEM for your BMW or Mercedes and see what your policy says it will approve. The other issue is that the origin of the so called dealer parts are not always from the same glass plant as the assembly line but from an aftermarket plant of the same company. Now for the Chinese imports. They are providing OEM for just about every auto manufacturer in the world with licensing agreements to put the same GM,Chrysler,Ford , BMW,etc. logos on the glass as any North American glass manufacturer. Get it right before making idiotic claims of low grade products being installed. Its simply false.

thank you wanttoplay for letting everyone know about State Farm. In fact, all insurance company will not pay for the OEM glass unless the vehical under two years old from the manufacturer's date of when the vehical was built. if a customer request for OEM glass and the vehical is older than two years the insurance company will only pay for the aftermarket glass. So the insured have to pay for the remaining balance. But it doesn't make any since to get OEM when the aftermarket glass has the same quality. Unless you don't like to save money. Also, for a glass shop to get pay for OEM, the shop must provide a proof of purchase. By the way, State Farm does not provide their insured with a free rock chip repair. unless you got a big fat $0.00 on your deductible.

I work for an auto glass company and find these kind of stories disturbing. It makes me very upset when I hear about how companies are putting thier needs before the customers. It's a good story, but has some discrepencies. First off, 9 out of ten times, when a customer asks for Original Equipment (OEM), the insurance companies require a proof of purchase that the OEM glass was purchased for the customer. Secondly, aftermarket glass is of the SAME QUALITY as OEM. It has to be by law. ALL AUTO GLASS IS INSPECTED BY THE DEPARTMENT OF TRASPORTATION. If even one piece of glass is shown to be defective on a pallet, the whole thing goes back. For an insurance company or even a glass shop to say that there is a difference between the two shows one of two things: They are liars and are only interested in money, OR they don't know what they are doing. And furthermore, if your vehicle is more than two years old, insurance companies won't approve OEM glass unless that is all that's available.

Last year in 2009 State Farm let all autoglass companies know they would no longer pay for dealer glass for their clustomers and that the customer would be responsible for the payment of their dealer glass and it was autoglass peoples job to advise state farms customers of this and IF state farm customers did not agree to contact their agents! and by the way guess what windshileds are made of glass soooo if you all didnt know this glass cracks and breaks especialley when rocks hit it or bad weather strikes and you have a rockchip!

You want fraud? Fraud is when your insurance company pays $750 to the glass company to get your windshield replaced, and I can go into a local glass company hand have my windshield replaced- out of pocket no insurance involved- for about $200.

organdonor b/c of what you said.--> i hope your organs rot. news media stay out of it. they dont need the extra b.s. on their back. dont sit outside their home waiting for them to leave and come back. go sit at your home with your family and spend a day learning a little bit more about your kids or wife or husband or for that matter yourself. if they wanted the world to know dont you think they would tell everyone themselves. not by being broad casted all over the internet and television. sure its a big deal and wrong of these people, but like others said statefarm wanted the more expencive glass, and maybe it wasnt from the dealership but hey it was what statefarm asked for isnt it. theres been more then one? then why not get them all instead of just this couple or family? the house is big for just a couple they must have kids?

This means effective April 16, 2009, State Farm will only pay for the most competitively priced piece of glass available that will return the damaged vehicle to pre-loss condition regardless of what piece of glass is actually installed.

Mr. Wallace Please follow my advice. OEM is nothing more than a logo of the car manufacturer. They did not make the part; they farmed it out, put a logo on it, and raised the price. If your car is more than 2 years old your insurance company will not pay for "OEM" parts period. Your car is used and they are putting it back to pre loss condition. BTW look up the AS-1 designation there is no difference in the quality of the glass.

All the windshields these guys install crack really easily. Many of them have distortions. Don't waste your money on their prop glasses! Always ask for the OEM product!

Had a place try to pull that on me years ago. Called for an appt, gave insurance/vehicle info, and specifically told them I wanted OEM glass for the install. They assured me that's what they would order.. well thats not what was waiting for my car when I got there. Tried telling me I would have to pay the difference for an OEM part which is B.S. Called my agent and had the right one installed next day.

I guess the web editors have not passed puberty yet, or English 101. I use to work for another ins. company and they had bad results and similar billing problems with some of the Kitsap County "winshield" repair companies. I wish they could catch them all, but most people don't want to be bothered by a fight with an auto repair vendor when they are having to deal with a claim. They expect the Insurance Company to do it for them. It is better if you have a problem that is not easily resolved, to at least call the Ins. Commissioner’s office and see if there are any steps you can take to report any suspected fraud by either the vendor...or if need be, the insurance company. (The later being far more rare an occurrence).
