Democrats blast McKenna over health care challenge

SEATTLE -- Democrats are blasting Republican Washington State Attorney General Rob McKenna over his decision to challenge the constitutionality of the health care overhaul bill.

State Democratic Party Chairman Dwight Pelz says McKenna "should be more concerned about the health of Washington's families than about the ideology of his right wing backers."

Gov. Chris Gregoire says McKenna did not consult her before his decision Monday to join at least nine other states challenging the bill passed by Congress. She says McKenna does not represent her and "totally disagrees" with his opinion, and she'll fight his lawsuit. 

McKenna says he has the authority to challenge the law without the governor's approval.

The House voted 219-212 late Sunday to approve the overhaul, which would extend coverage to 32 million uninsured Americans and make a host of other changes.

Members of Congress who voted for the health care overhaul bill are gathering Monday morning at the White House to see President Barack Obama sign the historic legislation.

Seattle 5th grader, Marcelas Owens, will stand on stage with Obama when he signs the historic health reform legislation into law. Marcelas received an invitation to attend the bill signing from the White House.  Marcelas has been advocating for health care in honor of his mother since she died in 2007.

For the first time, most Americans would be required to purchase insurance, and face penalties if they refused. Much of the money in the bill would be devoted to subsidies to help families at incomes of up to $88,000 a year pay their premiums.

"The individual insurance mandate is unprecedented in American history in requiring the American people to go out and buy a product in the private market," said McKenna.

Every House Republican and 34 House Democrats voted against the bill. All the attorneys general who have announced they are planning to sue, including McKenna, are Republicans.

Gregoire, a Democrat, supports the legislation and says she disagrees with the McKenna's opinion.

"He did not call and consult me," said Gregoire, "I don't know who he represents. He does not represent me."

McKenna said he does not need Gregoire's "blessing" to file a lawsuit on behalf of the state.

"My role is to defend the State Constitution and the people of the state," said McKenna, "That includes defending the state from inappropriate actions by the federal government."

McKenna says the 10th Amendment protects states from being forced to follow federal laws that are not covered by the U.S. Constitution.

"That's why the federal government has never imposed an auto insurance mandate, has never imposed a drinking age minimum, has never imposed a motorcycle helmet law," said McKenna.

Gregoire said she plans on filing a legal brief in opposition to the state's lawsuit.

Other states planning to challenge the bill are Alabama, Florida, South Carolina, Nebraska, North and South Dakota, Pennsylvania, Texas and Utah.

Governess Haywire and the Socialists can't balance their socialist budget now without robbing us for another billion dollars. Even that much doesn't fun all of their socialist programs. Now they are all in favor of another billion dollars in unfunded federal mandates. Have thy no clue at all about how hard people have to work for every dollar? I guess not. They are career politicians so spewing a few more lies is all the "work" they have ever had to do.

A few large companies stated obamacare will cost them billions (each) - wonder how many lay offs that translates to? Not to mention small businesses that will be forced to purchase health insurance for their employees - I know, they will get a "tax credit" for doing so - but when they can't even make payroll because of the increased health care cost, how will a "tax credit" help them stay in business???

Another news story - gregoire just appointed a health care panel and their main job is to grab as much money from the federal government for health care that they can get. The reason she is against the challenge on constitutional grounds is because she sees it as a money grabbing opportunity to fund her idiotic under capacity tunnel.

patty murray said she voted for obamacare because "my president needs my support" --- people should be OUTRAGED at that - she was elected to represent the people - not to be a sock puppet of the lunatic narcissistic idiot. Every person in the state of washington should be totally outraged at her comment - why even bother electing people if they are only going to do what "their" president wants and not represent the will of the people she is suppose to represent. patty murray needs to be recalled - and failing that, she needs to be voted out of office. It's obvious she represents the socialist party and no longer represents the people of the state of washington that elected her to represent them.

actually choosing not to live may be the only way to keep this law from breaking the bank. maybe we could borrow the pamphlet from the military that explains to old veterans that they should lay down and die before they become a drain on society. Old people aren't useful after all. They can't work and contribute any more, so why keep them around. Of course then you have to look at all levels of society and judge them on their contributions. I don't want to head down that road.

remainingreal Two problems with your comparing mandatory health and auto insurance. First, you can choose whether to drive or not. I suppose we could choose not to live or to live in another country, but for most of us that is really not an option. Second, auto insurance mandates come from the STATES not the federal government. This law must be defunded or repealed before it ruins America.

I didn't see your comment until recently so sorry. Now, before you do. It might help to think that Mitt Romney was a governor from a STATE! not a federal government. There are some good things in the current health care bill that just passed but that is the minority of things. Even if you still can't agree or understand people that know it's un-constitutional, sure fine, but how are you and I going to pay for it? I mean, realistically. Have you read any of the bill or did you just watch the debates? It's kind of hard to understand huh? And I replied to you and "noskills" unconstitutional argument under news story "Hundreds rally in support of McKenna" from the front page news story. Peace.

I'm just curious why none of you are commenting on the Mitt Romney article where they are calling him out for being against Obama's Healthcare Plan, even thought it is so similar to Mit Romeny's Healthcare Plan? He is just arguing for argument's sake because he is trying to be an obstructionist. It's ridiculous the hypocrisy. And so blatantly obvious. And all you Obama bashers won't comment on that article. If it was unconstitutional to require people to get healthcare, why isn't it unconstitutional to required people to get car insurance? Huh. I don't see the unconstitutional difference, and I don't think it takes away anyone's rights as individuals. I don't think they have a case. As a democrat, I actually didn't mind McKenna until now. Now, I think it's being done just for the sake of being obstructionists as Republicans.

based on what you want to do. They don't account for current economic situations OR what it's going to be like down the road! Meaning, in the end, as the costs and taxes associated with it as it attempts to bring this nations economy down, you'll have a very watered down mandated LAW that tramples the constitution. Impulse - My boys will also thank you as they graduate from College that the VA paid for and the stipend they will receive from the VA, paid by your taxes. I almost forgot, I wish to thank the citizens of Massachusetts for the yearly VA bonus I receive, the property tax abatement and the truck tabs that they have paid for each year. impulse - Just to brief you on the pension that we Veterans receive. In 1776 the Continental Congress sought to encourage enlistments and curtail desertions with the nation's first pension law. It granted half pay for life in cases of loss of limb or other serious disability. This has been in place since our Nations birth. Unlike the Healthcare Reform Bill, that was signed by your President, in direct violation of our Constitution.

Impulse - I really doubt if you have any Veteran friends after you called them “deadbeats” and now “welfare leeches” in this blog. As for “portraying them” do not put words in my mouth as I never said anything as such. You’re the one that portrayed them as, again straight from your comments “deadbeats, welfare leeches”. It really saddens me that you find it necessary to show yourself as being so low as to result in calling our Veterans that. Why don’t you pry yourself away from your screen, and volunteer your time at the VA Hospital, and get a real education of our Veterans sacrifice. You will find out that our disability pension and retirement is clearly not enough to compensate for our sacrifice. You had a choice and only you are responsible for your life. Impulse - This move to close my doors started when your Medical Reform looked as if it was going thru back in January. You are responsible for this Health Care Reform Bill and you will be responsible for the millions of unemployed it creates. If you wanted to put more people to work, you do not put the squeeze on small business owners by forcing them and their employees to buy insurance they do not want and cannot afford. The unemployment you state is paid for by business owners such as myself. You really have no clue of business or finance, do you, just like you have no idea of our Armed Forces and Veterans. As for Veterans, I served my country, as per the oath I took, unlike you. I have never met a Veteran that turned down their pension after putting the time in. Yes, I did serve more than 1 tour, not just 4 years and I am out.

impulse – As an independent, I have never voted democrat and withdrew my Republican affiliation due to disagreements with policy. If my memory serves me right, your tax dollars, (assuming you work and pay taxes) are paying for private pensions. Remember the President you voted in, he bailed out our automotive companies, credit companies, and banks. Not only is your tax dollars paying for private pensions, but salaries, enormous bonuses, and large life styles. Much of our Military Machines come from Boeing, paid for by what, your tax dollars. Unlike you, my family comes first. I look out for their future, thus prior to joining the Armed Forces, I made sure that they would be taken care of in case of something happening to me. That is pretty simple, and basic. I am not like you, I take responsibility for myself and my family.

If the state legislature tries to block funding for this lawsuit, we may have to sue them for not letting the AG do his job. Gregiore is whining. It lets us know where she stands when she will put the Constitution aside if we get enough pork out of the bill. This bill is bad for America and Washington State. I hope Rob McKenna keeps up the good work. What happened to the America where people worked hard to get the good things in life? We have the right to PURSUE happiness, not have it handed to us. We are not children and the government is not our parent. We are responsible for ourselves.

dodge 1 you need to do your homework instead of the communist bit. Are you aware that the jobs bill that was just passed, contains an extension of the patriot act? Do you realize that McKenna, and most of the US congress and most of the governors, and most attorney generals in this country support the patriot act? Do you know that it is a communistic act? Instead of hating Dems, you should see that both major parties are very close on a lot of issues. I think the health bill is mostly bad, but the republicans did not want to create a joint bill, so the Dems just did it anyway. I guess under your ideal rules that those that are in favor of communism, at least 60 percent of the people in the US who support the patriot act should leave the country. More republicans support the government spying on you then Democrats. That means under your rules, McKenna himself would have to leave the country. What did you call them again?

Capegadgets my tax dollars aren't paying for pensions at Ford or Boeing. You and liberals like you and Nancy Pelosi can try and spin it however you like, but an entitlement program is an entitlement program. And the veterans I know don't serve their country for something in return, quid pro quo, they serve because they're true patriots so please don't denigrate them by trying to portray them all as welfare leeches. We need to end these entitlement programs that you seem to be so fond of, and put people to work so they can help themselves. Unfortunately it seems that you won't wait till 2014 when all employers with more than 50 employees will be required to provide insurance for them, so now we'll have more people out of work. But please convince them all to quit so they won't be eligible for unemployment (another liberal entitlement program).

If Attorney General Rob McKenna wastes tax dollars on his frivolous lawsuit to "challenge the constitutionality of the health care option," can we the taxpayers turn around and sue him for this gross misuse of public funds? This new health care reform bill gives a laundry list of hard-won benefits to thousands of Washingtonians AND it saves money in the long run. What would McKenna's lawsuit do? (1) Waste tax dollars. (2) Waste time. (3) In the unlikely event he'd actually win such a ridiculous lawsuit through some slippery legal maneuvering or loophole, force thousands of newly gratefull Washingtonians to lose newly-gained benefits. News for you - the AG was elected by a majority and Rossi was elected by the majority - only gregoire kept having them recount the votes until one recount was in her favor then she called to having the vote recounting stopped (never mind thousands of uncounted votes for Rossi showed up after that) If you think democrats will be in control come november, you will be in for a shock. I prefer voting independent and I am extremely independent although I will vote republican this november if it's the only way to get the anti-american party (democrats) out of office (if they do not uphold the constitution, they are anti american ---- obamacare is completely unconstitutional)

Impulse - I am not the only blogger that don’t understand you as shown in past comments by others. The Veterans pension is no different than the pension at Ford, or Boeing. Those workers have worked for a long period of time or were severely injured for their receipt of pension. Veterans provided a service of protection, which you have chosen not to do. As you have chosen not to work at Ford or Boeing, you will not receive a pension from them or the VA and DOD. As for attacks, you are the one attacking others and me on this site. The comments and calling disabled Veterans and the elderly “deadbeats” were totally uncalled for, from you.

Why does it NOT SURPRISE me that the Democrats are blasting Rob McKenna for filing a law suit against the Obama health care bill? BIrds of a feather flock together they say. I fully support Rob McKenna and I hope he wins this lawsuit. Others here have said it better than I could so I won't elaborate any further. But this health care bill is NOT the way to go for this country. It falls into the entitlement mentality rather than the work ethic mentality. And it is unsustainable and punishes those who work hard to sustain those who won't. I understand that some people are in a position where they can 't work and I understand that but then how did they get there? If by accident and no fault of their own that is understandable and I am not throwing them under the bus for the ones who won't. But this country needs to get back to respecting the Constitution of this country and abide by it and quit trashing it by their disregard for it.

I am extremely distressed with how many support this unconstitutional health care legislation. Those who do not support the constitution are anti american - and that goes for obama as well as gregoire and everyone who supports / voted for this garbage. .... It is telling when the liberals gripe about the state attorneys general who are fighting this as being "partisan" when the democratic party was extremely partisan in cramming this down our throats. Interesting how they say nothing about the illegal back room deals and promises the narcissistic idiot had to make in order to get this passed (a promise by him is as good as a lie) Funny how this "honest and open presidency" he refuses to show us his REAL birth certificate.

Rob McKenna doesn't need Gregroir's approval to do the job he was elected to do. He is also NOT her employee! I, for one, am delighted and hopeful that McKenna and the others are successful with their lawsuit. This bill/law was crammed down the American taxpayers throat and if it is such a 'great healthcare' law, why aren't the President and members of Congress forced to have this same insurance?! Ah but no, they will continue to enjoy their 'cadillac insurance' at no expense to them while we poor schmucks pay even more for even less! It's high time we took our country back from those idiots in both Washingtons! As for Gregroire, she is about the most incompetent governor this state has ever had! McKenna is totally on the right track. This health plan is truly unconstitutional, and his position requires that he protect the people of this state. Nice to know that SOMEONE in the state government feels that way, rather than trying to protect their personal interests by not challenging the Regime in Washington DC. Besides, if it is such a good thing, why are the Democrats so afraid of it being subject to scrutiny by the courts?

Well here comes the true colors of the democrats, They are mad someone is disagreeing with them,The health bill is unconstitutional. and the system will prove it, If the Democrats do not believe in the constitution and its processes, that makes them communist. There is no room in this country for people who do not allow the process to work and inflict their personal views and opinions on others. If you do not like our system and the laws that govern it then move the hell out. That includes the Governor. She is a elected official not a Queen or a god.

The people of our state voted by majority to elect representatives to Congress who voted for this bill, enacting our will by doing so. That the AGs opposed to this bill are all Republicans signifies the same ridiculous bias that the POTUS and Congress have been fighting for a year on this bill. The health care bill passed because Americans resent the fear-mongering and lies coming from the health insurance industry and Republicans AND because it's needed. Our health care is NOT the best in the world and it costs a fortune as well as being responsible for unnecessary deaths, illnesses, and families destroyed in their fights to save loved ones. Health care decisions belong in the hands of the patients and their health care teams, not in insurance boardrooms. That the insurance companies hunt for ways to reject care for sick people is the lowest of the low and that anyone would justify it is appalling. Ron McKenna is out of order wasting WA's time and $$.

Impulse - It is not my responsibility for the financial responsibility of you or others. Yes, this includes my employee, who will get a severance and a placement service. I have paid them extremely well, and each one of them would have their paycheck at what it was, then having a pay cut and overpriced insurance. The extra benefits they have received while working far exceeds any employer I know. You need to establish your facts prior to making false statements. Your comments are so very hard to understand as you flip flop each issue.

So much here to comment about McKenna's choice: First, it's pure partisan politics and straight out part of the 'slash and burn' mandate of the Republicans leading to the attempt to repeal health care reform. This strategy is to put a legal challenge back-up plan in place just in case the Republican-stuffed US Supreme Court is the only avenue left at some point to gain the repeal (just remember the 2000 election stolen from Gore by the Court.) Second, it's perpetuation of the politics of elitist right-wing Republicans who must keep the "have" and "have not" status quo in our society, i.e. why we have at least 32 million uninsured Americans (which is way under estimated to begin with!) Third, it was a clear attempt by McKenna to embarrass the Washington state Democratic majority, from the Governor downward. Anyone who previously thought that McKenna was a liberal Republican in touch with the majority electorate was a fool. Now he is showing signs that he can be compared to Tim Eyman.

AG Rob McKenna is my hero! Yaaa! You go man! Here is the kind of leadership we need running this state not just the AG's office. The governor and democratic party leaders in this state are shocked that he doesn't just run and hide in the corner with his knees knocking together because they are in bed with the President and the national democratic party leaders? Give me a break! This is yet more evidence that the Governor and her democratic crony friends are more concerned with politics on a national level that they are about running this state in a fiscally responsible way. She lied her way into office and claimed the state was in great financial shape, rainy day fund and all, and that she wouldn't raise taxes. She has no credibility left at all. Rob McKenna for governor!

It's so sad to see a small business owner close up shop, rather than provide his employees with health insurance, especially when he not only gets free healthcare from a government entitlement program but apparently pays himself enough to get private insurance too. That really sticks it to his employees. "I have two healthcare plans and you have zero, ha ha ha!!" I miss the days when employers actually cared about the well being of their employees. I just hope that his employees don't use all their vacation time, and sick days all at once before the store closes. I hope he'll help them rollover their 401k's he provides them. It's too bad we're losing more family wage benefited jobs (benefits exclude health insurance). C'mon people we have to stop this before we end up like Massachusetts. After Romneycare every last one of the small businesses closed rather provide health insurance. Not a single owner was savvy enough to be able to run a business and take care of their workers.

Does anyone remember the story about a year ago that some members of the Republican party were going to kick him out for validing the election of Gov. Chris? He is the most moderate/independant Republican in the party. He stands up for what is right and true regardless of which party is barking at his door. He is not doing this because he is a Republican, he is doing this because some of the provisions of this bill are unconstitutional. Congress really should have come up with a better bipartisan plan.

McKennas participation seems to be based on fact and law. That's his job. That's why we put him there. It is what it is. Forcing people to pay for insurance IS NOT a National health care plan. A comprehensive plan for controlling costs and providing equal care for CITIZENS is. This plan must be funded through other methods as well as increased taxes. Forcing people to write a big check every month is hard to swallow. There isn't even a cost estimate or porposed, fixed plan, but merely forcing us to buy what is already out there, which isn't much.

perspective I would say I feel your pain. This has happen to me in Mass. I had to close as I could not eat the $200,000.00 it would cost me to insure. This went up from $65,000.00 in two years after the Mass. Health Care Reform went into effect in 2006. This reform is the one that the National Plan is patterned after. This is reality, that has already happened.

Of course there are good and bad things about this new bill, I hope more good than bad and think that is the case, but at least it's a start. The cost of this plan to my business will determine if i keep my 4 employees or not. If it raises my payroll cost more than 5% the will be unemployed, I will downsize and run it myself. Thats the reality of this to millions of small business owners.

I have addressed this with my employees. Even with the tax credit which would help defray the cost 10% - 15%, it would still be $85,000.00 per my insurance company and that is the very minimum. I am sure that this price will be more then double in two years as it was in Massachusetts. I am in business to not only create employment, but to be profitable. I will be closing my doors, and my employees fully understand. Obama may run this Nation in the red, then go and print more money to spend more. Unfortunately I do not have that money tree to stay in business. As per the Small Business Owners Blog, it seems that I will not be the only one in this Country. The closure of these businesses will have a drastic impact again on our families and Country. I wish to thank President Obama for making the decision of my retirement. Although a dozen south King County families will have another opinion to say to the President.

I'm thinking that it’s possible some of the anti-health care people own some of those, oh, restaurants who hire a bunch of part-time help so that they can pay them less (training) and, in some cases, “assuming" that tips make up the rest of it", and not provide health care. And then there's Wal-Mart. It's refreshing to know that there are business owners who can do very well without having to stooping so low. I tend to patronize those and always will, because I believe in people - in general.

Ok, so requiring people to have car insurance is to protect the other guy, right? Is that anything like requiring people to have health insurance so the other guy doesn't have to pay increased health costs? By george, it is the same thing. I fail to see how mandatory health insurance will hurt. Sure, people will go to the doctor more if they have insurance. If they make 5 more $1000 trips to the doctor each year, but it saves them from a preventable $50K surgery a year down the road, have we lost $5K or gained $45K? Right now, the uninsured are giving zero, zilch, notta, to their health care. If they are required to atleast pay a fine for not having insurance, they will be giving SOMETHING for the care they are going to get anyway.

Amazing, I have friends whom I tried to warn regarding this bill and they would not look into it because they didn’t think it would affect them. The news last night sure got their attention and fast. I really took no joy in telling them “I told you so”. They said, “What could we do about it if we had looked into it”? I said you could have told others as I had tried to tell you that this bill has little to do with healthcare and more to do with control over the populace and that it is not a constitutional endeavor for the United States government to do. I do not see how McKenna is going to be stopped by Gregoire but it would not surprise me if she tries to do so against what his job is all about and that is protecting us against the throes cast upon us by the Federal government. Gregoire is a sellout. I am still shocked that she got the office considering how she did as this state’s Attorney General in losing over 22 million of our dollars in a lawsuit because of her failure as AP.

Thank you Rob, we need more people fighting this bill. Nobody wants tax credits for small businesses to get health insurance for their employees, or drug help for senior citizens to close the "donut hole", or stopping insurance companies from dropping people when they get sick, or stopping insurance companies from imposing lifetime limits on people's health care, or giving free preventive care to people on medicare, or stopping insurance companies from denying coverage for pre-existing conditions. Thank you Rob from protecting us from all of these terrible ideas that nobody wants.

The fact that McKenna, a person I voted for and previously respected, has joined this lawsuit is offensive to me. I have friends from other countries that laugh at Americans for being opposed to this. If you are opposed you need to do your research on the overall benefits, including monetary (because that is ALL you care about). I employ 28 people because I care about providing a living wage AND benefits to quality employees, NOT because I want to eak every last dollar out of my business so I can drive a newer, better car every year. Further, listening to the various parts that will need later consideration, like the doughnut that needs to be filled to really effect prescription costs with Medicare, it has been portrayed wrong and instead of saving $2500 annually it MAY help me save $500. There has not been truth in regard to the bill. I think we do need health care available for all but no one should be fined for not purchasing insurance. Stick to your beliefs, AG McKenna. The governor just wants to push the bill through like so many democrats. We all need to review the bill, work out the legitimate kinks and then send it through for approval. Seeing the governor so angry makes me begin to think we need new leadership. I have a choice what type of car insurance, I can choose what type of car I want to insure to save money, and I can chose not to buy a car at all and pay no car insurance. This program, I have no choice. ** The Governor states the Attorney General does not speak for her so she may use the option to sue him. And YES, he does represent the views of the people of Washington State. (and probably every state in the country for that matter if you take any stock in the polls and the Mass. senate race). So. Is this health insurance that I will now be forced to purchase actually going to cover anything? As a self-employed individual for the last 5 years I was paying hundreds a month for a policy but still had to pay every time I went to the doctor due to the high deductible. So 2 years ago I canceled it. I mean why pay more than $3000 a year for insurance then still pay the doctor? Being healthy I decided to self-insure until another better option became available. Is this it? Or am I back to paying for nothing again?

Why do I need the FDA keeping me "safe" from contaminated food? Why should the government decide I need to drink "clean" water? Why should the government use MY tax dollars to pay fire departments to put out fires at my neighbors house (or on government owned forestland). Why should the government tell me what time it is? Why should MY tax dollars support "public" schools? If parents want their kids to learn, send them to private school. impulse - no where did I say anything about changing our Constitution or any Amendment. As for my Veteran Benefits, these were promised me prior to my commitment to my Country. It is the exact same thing as if your employer promised you benefits before hiring you. You would expect that those benefits be given to you after your hired. As for my disability, it has taken years of surgery, and years of rehab to get where I am. I cannot do the things I did before, and have missed much of my kids growing up because of it. My recovery and where I am is the result of determination and hard work (which will continue the rest of my life). My wife and I try to help other disabled Veterans less fortunate (over half my employees are disabled Veterans) with transportation to the VA hospital when we are able.

impulse again no where did I say anything about denying health care to anyone. As for my employees, when they were hired, they knew up front before they were hired that there was no health insurance as I could not afford it. I did not "deny" them any health care. As for being my employees, this will change as I will close my doors, as I did in Massachusetts, because of the cost of the insurance. You can ask any of my employees the same question as I fully informed them that when I get the letter that forces me to pay the insurance, that I will be laying them off. I cannot operate a business in the red, like our government is being run.

But capegadget since you're able to afford private insurance in addition to your free "socialist" healthcare, why shouldn't we force everyone on government healthcare to get off of it? You were able to do it. Some of them could get jobs at your store, oh wait, I forgot that you deny your employees healthcare. I'm sorry but paying off the national debt is more important than helping the citizens of our country. While we're at it, let's change the 6th amendment and take out the right to legal representation. How much is it costing our government to defend these poor people? Again we'd be paying off the debt (which must come before everything else). And the founding fathers that came up with the whole "free lawyers" thing were probably socialists anyway. We must pay off the debt!!!!! (except if we want to start another multi-billion dollar war, or create another tax cut that adds 1trillion dollars to the debt like we did in 2001.)

These things we know, people need affordable health insurance. Medical bills -especially for catastrophic illness/ injury can become considerably huge and people are unable to pay their bills. People cannot use the ER as their regular care. One thing I don't want is to have to cover for those who don't have insurance and who don't pay their bills. And that is what we are doing now! I didn't agree with all parts of this bill, but it is better than nothing-

I'm behind Rob McKenna, hope he considers funning for Governor when the time comes. I hope something good comes from his law suit, from what I hear there are quite a few states suing as well. Good for them!!! This Health bill is wrong, we were not privy to the bill at all, they just crammed this bill down our throats so to speak. I think the American public has a right to vote for this bill. This is not something the Federal Government should put in place for us citizens. As a Retired Disabled Veteran that honorably served his country, I do not appreciate being called a "deadbeat". Nor do other Disabled Veterans who paid for their "insurance" with real blood, sweat, and tears. The Veterans families of those who were injured or gave their lives, would not appreciate your comments. I highly suggest you curb your comments on disabled Veterans and the elderly as it was highly inappropriate For your information, I pay for and have paid for private insurance, as I get better care outside the VA system. Again the VA is a government run agency and clearly cannot give the quality of health care as the private sector. The nerve stimulator implant I have for my severe back injury was only obtained by my insurance company as the VA would not do it. This is what each American can look forward to.

What I find so hard to understand is how so many people do not care about the millions of uninsured... there is so much selfishness in this country - don't you realize that we end up paying anyway when they go to emergency because they could not afford a doctor early on in an illness? You're right capegadgets, bringing down the debt is the most important thing, which is why Bill Clinton was one of our greatest presidents. If we stop all forms of government healthcare like medicaid and medicare and health care for veterans, and all other "socialist" programs think of how much we'd save on the debt. Plus if we get all of these "deadbeats" that think they've earned a free ride just because they're old or because they've served our country, to buy private insurance it would really help out our economy. If they're really patriots, they'll be proud to give it up and help with the national debt.

McKenna is wrong when he says the Federal government hasn't imposed federal laws that aren't covered by the constitution. The Feds, and the Republicans in particular did impose a 21 year old drinking law on all states by threatening to withhold federal highway funds. it imposed similar financial threats that has led to wide spread drug testing in the work place. The Republicans have always been at the forefront of such impositions, and have always found a way around the constitution to do so, such as blackmailing states with federal funds.

The Attorney General is clearly executing the duties of his job. Unless they can dig up some more dead voters in King County in November, maybe we can see some fiscal restraint return to this state and some common sense too. The only person that seems to be "over the line politically" in this matter is the Governor....who emphatically told us that the budget problem Dino Rossi spelled out quite clearly would not lead to tax increases. I wish every citizen to have access to health care. STOP. I want everyone to pay something for it. STOP. I don't want the government doling out the money. STOP. When Jeans Emerson's reported about our new health care legislation today 3/22/10 on the 5PM news she deliberately made it look like the mass of the public is AGAINST a health care bill. She deliberately neglected to point out the the amount of people who didn't think the bill went far enough added to the people in favor of the bill as it is adds up to be more then those against the bill. Bottom line IS that the majority of Americans are FOR health care reform, even if Ms. Enerson ISN'T. Nice SPIN Jean. Why don't you start reporting the truth and report the FACTS of you survey instead of what YOU want the facts to be. Your survey proves that the majority is FOR Health Care Reform. Don`t you realize that forcing businesses to supply yet more heathcare drives up your costs of goods and services? You don`t really believe that business will simply absorb these costs, do you? That means that any savings that you might have realized getting healthcare ( which you will likely pay higher premiums for), will be disapated by increased costs to you. Wake up, people. This is NOT the way to reduce costs of healthcare, or to make insurance companies accountable!

sjean would you give up your job so that 2 to 3 of your employees would get health care? It would cost the jobs of 20 to 25 employees out of 50 to provide health care. That same employer would close his doors if forced to provide health care. Those unemployed workers would then be forced to provide health insurance for themselves/family or face a fine for not doing so. I am not making this up. It is happening now and I am providing you the information about it. I would not wish any person to be without health care but to force each person to buy health insurance or face a fine is wrong. If you were unemployed and recieved a fine in your Federal Taxes because you could not afford to pay for it, how would you feel?

I get so tired of reading about everyone blaming INSURANCE companies for jacking up prices for health insurance. You all are pointing your fingers in the wrong places. You first have to examine why medical proceedure costs are skyrocketing. Insurance companies only respond to the rise in costs from medical providers. And for everyone sniveling about the high cost of insurance - get a grip. You go in for heart surgery and the bill comes out to well over 100k. In most instances, if you have insurance (EVEN A HIGH DEDUCTIBLE PLAN) you're not paying too much out of pocket by comparrison. Still think you're paying too much? Talk to the medical facility that's doing the billing.

Real strange - I was for health care for everyone before it got mixed with big business. Does any other country in world force private citizens to give money for private companies? For government (people?) yes but for some stock holders? I think they tried it in Europe long ago - didn't work too well, or? This doesn't count - "The state requires people to buy car insurance; what is so strange about requiring citizens to have health insurance?" - except if you classify people and cars to same category! A car is not necessity, health is! Of course there are other issues like paying for water to private enterprises, try to live without, but it's paying old mistakes - just hope the air is not next!

I commend Mr. Mckenna and am excited to see what he and the other states that have the courage and see it is as their responsibility to stand up for the rights of the people. I read the comments above and am amzed at how many uneducated, silly people we have in this state. Most all of you have no clue what this bill will do to further degrade our rights and bankrupt our country. We continue to spend spend spend and this bill goes right along with that philosphy. Of course our lousy Governer is for the bill, it gives reason to raise more taxes and make government bigger. She presides over a state that it's biggest employer is the state, with close to 50% of working people are employed/funded by our tax dollars. I would encourage all of you to please read up on this and find out not only how it goes against everything our founding forefathers prescribed in the constitution, but also puts OUR HEALTH IN GOVERNMENT HANDS!!!

loquaciouse so you would rather fine the people who cannot afford health insurance and force them to pay for insurance at a fixed rate (it is not cheap), or incarcerate them as this reform clearly states. I am a father of three and a wife who also works. I am a disabled Veteran who volunteers his time and money to transport disabled Veterans to another state so the can receive health care. This health care by the VA is very much sub par. Please note that the VA is a goverment run agency. Please visit your local VA hospital and ask the VA Doctors and Nurses what is preventing them to give our Veterans the health care they deserve. I promise you they will say funding. I would not want to imagine that any of my children would not get the health care they deserve because of inadequate funding. I would think you would feel the same way. You can look on the internet to the physical condition of our VA Hospitals. Some so bad that they contract to local hospitals for services.

Then take away the law that says I MUST have car insurance. You want to play that game then so be it. I really don't understand how people can be so upset by a plan that offers people who otherwise can't afford health care an option to do have it. The only way it would hurt small business is if they failed to get their employees health care in the first place. I'm sorry but a business of over 50 employees should provide health care for its employees, and if you can't afford to do so, then you can't afford 50 employees. Read the bill people. Stop listening to what the media or FOX news tells you. Use your brain and think for yourself. I know, its a tough concept.

I have a family and both my husband and I work our butts off while raising our family. However, I recognize that I am extremely lucky to have the gifts that I was born with. I don’t qualify people’s worth based on their rank in the food chain. Someone who works in fast food standing on their feet all day works just as hard as I do crunching numbers. Oh and a little finance education… People who can’t afford health insurance end up in hospital emergency rooms because they get last minute care where ever they can and it is against the law to turn people away. If you were in their place and were sick and you didn’t have health care insurance, wouldn’t you do everything within your power to save yourself? People who can’t afford health insurance also can’t afford emergency room visits. These unrecouped costs are being passed along to premium payers. You are already paying for the uninsured and underinsured, so don’t kid yourself. Get a clue.

I am so sick and tired of hearing the standard Republican adage that people are poor because they either deserve it or they are lazy. Equality doesn't guarantee equal opportunities. Everyone does not have equal access to certain privileges or innate talents. If you were born to parents who care about you and your success then you have an edge over someone who wasn’t as fortunate. This wasn’t a result of your hard work but simply luck of the draw. How about demonstrating a little thankfulness for the gifts you possess by giving to someone who doesn't have the fortune that you have.

You will not only get Massachusetts Health Reform bill, but the current Federal Health Reform Bill that was based on Senator Kennadys Massachusetts Health Reform Bill (2006). It will not work across the nation (plus it is loaded with extras like you will be fined if not insured, Nebraska residents get Federal subsidies, Washington State will not). I find it amusing that the governor said she doesn't know who McKenna represents, but he's not representing her. She's right, he's not supposed to, he's supposed to represent the state of Washington and he's doing so. This health care reform bill is unconstitutional, it totally undermines states' rights. No where in the Constitution does it say that the federal government has control over our health care, what it does say in the 10th amendment is: "The powers not delegated to the United States, by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people." It is clear in my mind that health care is not a delegation of the federal government, but since when has our government cared about the Constitution?

The drug companies charge a premium and they SHOULD it takes many man hours and expensive equipment and trials to produce a drug. The clinics and hospitals charge a premium and they SHOULD the equipment, staff, and liabilty insurance are expensive. The medical equipment manufacturers charge a large sum for their equipment and they SHOULD the materials, research, engineering, and production cost are all expensive. The medical professionals charge a premium for their services and they SHOULD. The educational cost, liability insurance, and responsibilty they burden are all high. We are privledged enough to have the best medical equipment, drugs, doctors, and yet we complain that the cost is high. Listen people suck it up and pay for it. If it is important enough to save your life then it is going to cost you. Heaven forbid you may have to go without your cell phone, 300 channels of cable, new car, fancy shoes. This feeling of entitlment everyone has now days is sad.

Credit that came in the form of home mortgages, over extended credit cards, and basic theives in the financial/banking sector. I did not see President Bush force credit onto any American Citizen. As for the thieves in wall street, they started their work in the Clinton "Error". People need to take responsiblity for themselves when they buy their home, or put that LCD TV on a credit card they signed for. That is just basic financial fundamentals. This whole thing illuminates what is wrong with the two party system. It always ends up being an "Us vs Them" scenario regardless of what the issue is. While we have been predominantly a blue state somehow this red bozo got elected to a post that he shouldn't have been. I am sick and tired of paying over $900 a month for insurance that doesn't even cover anything. It was less than 15 years ago I could cover my family of three for less than $60 a month and I didn't have insane deductibles. I'm not saying that this bill is going to fix anything but I surely cannot see how it could get much worse. Doing something or anything has got to be better than to continue to do nothing.

So person A will pay more then person B, and person C in Nebraska will pay less then A and B because of Federal subsidies that are in the Reform Bill for Nebraska citizens. There are those who like to compare this insidious bill with vehical insurance. There is no comparison : States require vehicle insurance not the Federal government. So you are comparing boats and airplanes, they are both transportation but they don't exactly work the same way. Greenspan warned congress in 05 of the looming financial crisis, thus s.190 was introduced but Democrats opposed it on a party-line vote in the committee, which then killed it before it could hit the floor and be debated. If that bill had become law, then the world today would be different. In 2005-2007, a blizzard of terrible mortgage paper fluttered out of the Fannie and Freddie clouds, burying many of our oldest and most venerable institutions. The Community Reinvestment Act started this in the 70's under Carter and was never solved. Clinton then turbo charged it further by pressuring banks into making these loans in the name of helping the lower classes. Reform was pushed aside due to some liberals who were certain they held the moral ground by doing this and ignoring the potential collapse. While I may agree reform is needed, this is not the way.

If the individual does not acquire the insurance, you will be fined and forced to accept a group insurance plan at a preset price and you will pay for it outright or thru yours and mine favorite Government Agency, the IRS. This has happened in Massachusetts. I invite you to investigate this as that State is the only one that has mandated Health Insurance for each citizen.

For those on this blog, if you want more information on the future outcome of this reform, please look at the citizens of Massachusetts who has had to endure this same reform for the last 2 years. This Democratic State had this Health Reform" passed for the last 2 years. Now due to loss of jobs, increased health insurance premiums, and health care that has deteriorated, 75% of Massachusetts does not want their Health Reform. This is in two years and that State is changing their elected officials who voted it in. You do not need to take my word, feel free and investigate yourself, as that will be our future!

I am self employed, my insurance is about 250.00 per month. I have had one MRI in 32 years. my MRI would cost those without insurance 1,746.52 my insurance only allows the hospital to charge 648.00. If the insurance companies can get away with only paying 648.00 why does it cost 3 times the amount for an uninsured person? If I only had to pay 648.00 for an MRI, once in my life. I wouldn't pay $3,000 a year to my insurance company. Here is health care everybody should support. Freeze all costs, at the lowest figure billed. If 648.00 is the cost for person "A" it should be the same for person "B".

This legislation was all about control, it has next to nothing to do with real health care. If they really want to have healthcare then it should start with the FDA and AMA getting it right, and getting off the backs of those who really desire to help people, not seeking great profits. Next, sue Montesano, better yet distroy them, for the failing health and deaths of many from eating genetically modified foods. Teach people to eat healthier foods and move on from there. If you ask people questions like "Should the government take-over health care?" or "Would you be in favor of the government raising taxes to support health care?" then 74% of people are going to be against it. If you ask questions like, "Are you in favor of prohibiting insurance companies from denying coverage of preexisting conditions?" or "Should insurance companies have to justify rate hikes before they take effect?" then many more people claim to be in favor of reform. Check the poll questions first.

This bill is not going to FORCE employers to provide medical insurace to their employees, it will however offer incentives to businesses to do so. Maybe you all should actually read whats in this bill before you start complaining. And you people claiming that this is not the will of people, how the hell do you know? There haven't been any votes to see who was for or against this. There haven't been any nationwide polls. So HOW do you know? hmmmmm? You'll say anything to try and make your point. This bill will help people like me. I am disabled and require medications every single month. My meds cost roughly $600-$700 a month. Heaven forbid if the goverment asks you to help low income or disabled people get and continue to be able to receive their healthcare.

I am a small business owner, in Auburn, and on the Cape in Massachusetts. I closed my business in Massachusetts a year ago, because of the cost of insurance (it was suppose to go down, but it increased due to lack of competition of insurance companies). Now 11 hardworking Auburn employees will loose their jobs as I will not afford their insurance. I know exactly what I am talking about. You can tell those 11 employees and their families how great this reform is and I promise you, each and every one of them will tell you where to put your "Change"! By the way, I am not a Republican, I am however a Disabled Veteran, Small Business Owner, that experienced this first hand, and just informing you what is going to happen. This Bill is not a good thing and you cannot argue, validly anyway, that this Bill is the will of the people. It is not. @ Kingster, the State requires it, not the Government. If you don't have it, the IRS doesnt garnish your wages are make you pay more in taxes. If you do not have auto insurance you are running a risk of getting caught without it and recieving a ticket issued thats it. with this "health care reform" they track you down and make you pay regardless. Its a right of mine to choose if i have health insurance or not, Not the governments.

I'm hoping a public option will be available by the time the mandate kicks in. When I was 50, I might have objected to mandated health care, as my medical expenses were minimal. By 55, I had a ton of medical problems, and was glad I had employer-provided health insurance. At 62, my health forced me to retire on disability. With pre-existing conditions, my only option was to keep my employer's plan which cost me over half of my retirement income. Boy, was I glad when I became 65 and was able to enroll in "socialist" medicare. I pay for Medicare coverage each month, and also pay for supplemental insurance. This is costing me about half what the previous plan did, but I'm covered for almost everything, and have no deductible. No one in government has made any medical decisions for me, or denied care. My only complaint is the Part D donut hole, which is addressed by this bill. A public option would make the mandate much more acceptable.

No one has a problem with spending tax dollars to give each citizen access to a lawyer to defend them in court, but then people "raise hell" if you try to give poor people access to a doctor. I forgot that only rich people deserve to be healthy in America. We'd much rather see our government spend billions on fighting two wars. We want to vote for "fiscally conservative" politicians who care about our national debt. The same "fiscally conservative" politicians who voted for tax cuts in 2001 that added a trillion dollars to our national debt. The same "fiscally conservative" politicians who voted to go to war twice, and instead of paying for it, did the opposite and voted for more tax cuts! The truth is you will only be required to pay for the insurace if you make over 133% of the poverty level. For those who make over 133% you will receive subsidy to help cover the cost unless of course you make over $200,000 a year when you will be required to pay in full for the plan, but who cares cause god knows if you make more than $200,000 a year you can certainly afford it. Odds are you complainers are republicans and your only sore because a democrat passed this bill. I bet anything if it had been a republican who passed this bill you would be all for it. You complain about how this bill will cost us money yet you fully support sueing the government, which I might add will probably cost a helluva lot more money. The point that the suit falls on is that the FEDERAL government is mandating this purchase. The constitution says the federal government can't do this - only the state can mandate this. The STATE government is what mandates the purchase of car insurance (if you drive a vehicle). No matter which side you fall on, this is the typcial absurdity that comes with too much government. Waste money, waste more money, then go into debt so far that there's no getting out of it. Ha!!

Perhaps next they'll find the science shows that each of us should have a colonoscopy annually--"lets make a law requiring it!" Maybe they will decide that citizens have no right to own private property. After all, Its not fair that some people should own a home when others are homeless---Right? Could be they'll pass a law, like communist China, to limit families to one child in order to control population growth. Some people don't have jobs right? Perhaps congress will rule that private businesses are required to hire them even if they don't need them. Maybe one day we will each be given a state approved menu complete with penalties for eating anything else. Sounds crazy?! We may be required to purchase car insurance but the state doesn't go around fining you for not having unless you are pulled over or get into an accident. The government will have access to all our medical records and will know if we have insurance or not. Why should they be allowed to fine me because I couldn't afford one of their "affordable" plans? This is not Heathcare reform but a healthcare insurance mandate. All they are doing is forcing those 32 million people to purchase healthcare insurance thats how they are insurring them.

Please do not use car insurance requirements with this health care mandate. HUGE difference. You do not HAVE to buy car insurance if you do not drive a vehicle on the roadways. Driving on the public roads is a privelage that the State bestows upon you. If you want to drive on them, then you must buy car insurance. Don't drive, don't buy. Here we have the federal government mandating that you go buy something on the private market or get fined and or taxed for not doing so. Not even close the same thing. Hopefully there will be more than just ten states filing suit on these grounds.

Without reform it never will be "optional and affordable". The insurance companies will continue to jack up rates and deny people coverage for any preexisting condition. While I agree health coverage should be optional (as long as individuals opting out accept they will have to pay for their medical bills and not expect the hospital or state to cover them), there definitely needs to be more regulation of insurance companies. They have proven that without it they will continue to operate under more and more unscrupulous business practices.

Forcing the citizens to purchase a product or service is not reform. We need to actually provide this service for free not force Americans to go out and purchase insurance. How is forcing someone to purchase something reforming health care? Its not all it is doing is making sure everyone has some sort of coverage. Also I don't want my government rationing out my healthcare. I don't want them making the decisions on what kind of care I get when I die or what kind of coverage I get if I have cancer. When a government starts MANDATING something like health care or pay a fine, then what is next? I fully agree with health care for kids and those diagnosed with a horrible, life threatening condtion. Yes, the govt should step in. Why don't they regulate the important issues such as pre existing condition limitations and SUPER RIDICULOUSLY high deductibles, instead of attacking an issue that obviously is going to take more than Obamas term to figure out. Be prepared to fork over more of your money to Uncle Sam....and also be prepared to wait A LOT longer to see a provider!!!
