DSHS squandered taxpayer money, ignored rampant fraud says report

SEATTLE -- For many years crooks have had an easy time cheating the state's largest agency.  That's the finding of a new report ordered after a series of KING 5 investigations.

The report’s author says taxpayers lost at least tens of millions of dollars each year because of an extreme lack of oversight by the Department of Social and Health Services.

How bad is it?

Former United States Attorney Jim McDevitt says DSHS left fraud unchecked for years if not decades. 

"As a taxpayer I was incensed. As a former prosecutor I was disappointed," said McDevitt, who just completed a two-month independent investigation of the agency.

The Department of Social and Health Services has its own fraud unit but McDevitt says investigators were hampered by DSHS upper management.

“Even when a criminal case or a fraud case looked to be obvious there were those in the department who were trying to figure out how not to prosecute the case," said McDevitt.

McDevitt says that’s discouraging given DSHS’s size and the commitment from taxpayers. The agency has an approximately $2 billion yearly budget and it screens social services programs for the elderly and disabled, food stamps, cash assistance for the poor and daycare. The report singles out DSHS manager’s “caregiver mentality.”

"I'm not demeaning that at all. That is, they want to take care of people,” said McDevitt. “But you have to realize, even the caregivers have to realize, that in any program like this, when benefits are so easy to get, with a lack of enforcement, there is going to be fraud."

According to McDevitt, managers cut back the fraud unit’s staff and funding over the course of many years and led by “fear, intimidation, a culture of disrespect."

This explains why the KING 5 Investigators have documented so much fraud over the past year in their series Their Crime, Your Dime.

  • They found DSHS clients selling food stamps openly for cash, even on Craigslist.
  • They found merchants buying them for half price and doubling their money when the stamps are redeemed.

They reported on 13,000 clients who withdrew their welfare cash last year at ATM’s inside casinos, something one DSHS official initially shrugged off.

"I don't know if someone who is withdrawing money at a casino is actually using it to gamble," said Assistant DSHS Secretary Troy Hutson to KING 5 in September of last year.

Big changes

Hutson, who headed DSHS economic services division, resigned as the stories continued.

DSHS Secretary Susan Dreyfus ordered an overhaul of the fraud unit, including the review by McDevitt.

McDevitt believes taxpayers paid dearly for DSHS’s lack of oversight.

"I will tell you it's way north of tens of millions of dollars per year, probably," he said of the yearly losses from fraud.

Former Franklin County prosecutor Steve Lowe has been hired to lead DSHS’s new Office of Fraud and Accountability.

"I've got some work to do," Lowe said. He’s hiring more investigators and ordering new equipment.

During the new unit’s first sting operation last month, Lowe found out that investigators didn’t even have a video camera to tape a transaction with a woman who was trying to sell her food stamps on Facebook.

Lowe was stunned that the fraud unit didn’t have the most basic equipment needed for law enforcement, including cameras. 

“The best evidence is video evidence. It is really strong and compelling to a jury," said Lowe.

McDevitt’s report also includes some recommendations he acknowledges are controversial. He recommends drug tests for all welfare recipients and benefit providers, like daycare providers, who are paid by the state. He also recommends increasing efforts to find illegal immigrants who are receiving benefits and kicking them off taxpayer-funded programs.

The Office of Fraud and Accountability (OFA) investigates Welfare Fraud in the state of Washington. The word Welfare is used to include: Public Assistance programs and benefits; food stamps; Temporary Assistance for Needy Families (TANF); Quest card, which is used for Electronic Benefits Transfer (EBT); and Childcare benefits.

This will work guaranteed. It'll take some "new" money but they wasted tens of millions without seeing any return. Problem number 1 would be no jobs or lack of skill to keep a job. Solution #1 Build day care centers above which would be homeless/transitiona/section 8 housing. Some of the people drawing a welfare check would work in them doing daycare,house keeping, food prep. We could train them and rotate them out on an on going basis. The people that hire them would get a tax break that would lessen over a 12 month period. This gives the person enough time to gain skills and contribute to the company. On the weekends, or after their shift, they would be expected to take courses to learn how to manage money and other life skills. Also getting a G.E.D. if needed. Over, not to many, years they become contributing members of society.

Hey Stonetrails..Conseula here..I am presently watching a program about Pologomists and again supporting what I recently told you..The Pologimist husband has on legal wife that he is responsible for. His " group wives" and all the children they have conceived by the Pologomist head of household receive Welfare and food stamps because they are considered single mother's without any to support them..With five or six wives and 25/30 children, (the more kids they have) bring in lots and lots of money to them, (TAX PAYER MONEY..YOU/ME/EVERYONE ! go figure

Stonetrails..Thank you for your response. I have watched Dateline ABC as well as Primetime NBC who both have programs and investigated Pologomists. Each station stated that because the Pologomist wasn't legally married to these "extra women" they did in fact QUALIFY FOR WELFARE/FOOD STAMPS. How else would the man of the Pologomist household and sometimes don't work, support 20/25 children and five to six wives? I Check it out on Google..If I am wrong I apologize.

I agree with the idea of saving taxpayers money by investigating fraud, yet the stipulations and rules in order to get help from DSHS are so old fashioned that it is unrealistic to receive help. Fifty years have gone by, and not a thing was done to actually help people who really need help. The price of living increase should have reflected benefits increase, and allow individuals to have made more than $542.00 a month to still be able to receive benefits. It is so drastic to even have a program considered to be called "help", when people become a product of their environment, and the less fortunate have to live in bad neighborhoods. A lot of people turn to drugs and achohol because that their situation seems hopeless. Why not try to stop the fraud, and at the same time, try to find a solution to help those that are really in need.

Yeah, like we haven't been talking about this for the last 10 years. I will bet there are many people out there that have tried to turn in someone for fraud to get no results. The end result as usual, we the tax payer pays for this. Not only should the person that was in charge be charged with a criminal felony suit, but the intire department should be fined and refunds to the tax payers should be made. On top of that, I don't begrudge someone that is in real need to use this program but there definetly needs to be heavy screening and applications put forward to insure that the people that are receiving these benefits are really qualified.

@Conseula, - No, not being married does not let him off the hook for child support. One needs not be married to be deemed financially responsible for their children. All that needs to be done is the state needs to allege is that this person is the father, that allows them to take what they want.

management needs to go - all of them and the programs restructured for people who *really* need help and a hardy pink slip and fine to those abusing it. kudos to king5 on the stories they've done and to McDevitt but it is very hard to swallow that people who get paid to monitor programs don't give a rip (and continue to collect a check). and for the record, with a statement like that Troy Hutson, you should not be assistant dshs secretary - seriously? wow seems you are a huge part of the problem! you need demoted to restroom attendant!

What a joke... giving out a phone number when we know the person on the other end probably isn't writing down a thing that is said. I reported a woman, living in a friends foreclosed unit receiving housing benefits from DSHS that were NOT paid to anyone cuz the friend walked away from the home. So she kept the money... and she partied and partied for 6 months. WE finally shut her power off for not paying the homeowners dues since she was living there. The bank could care less... And did DSHS do anything... I was told they don't have time for this kind of stuff. So don't come crying fraud, cuz the state does nothing to prevent it even when it's delivered on a silver platter!!!!

I honestly believe that King 5 started this whole expose' and I congradulate them! Now, if they just follow up and make sure that SOMETHING is done to get the $$$$$$$ to those who really need it. Saw the lady buying food stamps on TV. Why isn't she and her co-horts in the slammer?

I applaud all those involved in this investigation!!! Most of the public have no idea how this culture mentioned has gone through all DSHS departments (CPS & DEL) According to McDevitt, "managers cut back the fraud unit’s staff and funding over the course of many years and led by “fear, intimidation, a culture of disrespect." I know of many that have tried to hold DSHS accountable and the retaliation is incredible. Many of good folks that provide service to DSHS clients have had their lives & livelihoods destroyed as a result. Then they litigate and get nothing for their compensatory losses, perhaps it should be investigated as to why is this the highest sued department. I would like to see this investigation taken further. I agree with a previous comment that DSHS needs to be dismantled, as we know it today. In addition, all DSHS/CPS/DEL case workers should be drug tested and held to uniform standards in there conduct. Their Code of ethics should be upheld.

Maybe next they can investigate people abusing low-income housing and HUD housing! I live right down the street from this little housing community for low income people and their familys and the waiting list is 5 years ! Everyday I drive by there and wonder how somebody that is supposively low income on DSHS can afford brand new Chrysler convertables and brand new minivans, brand new patio sets, BBQ's ect when they on assistance! WEIRD! I can't even afford those things having a pretty good job and everything! :( The system needs alot of work and like another person said they need to investigate the Children's Administration too thats another money drainer!

Wow, not surprised, but sickened. 2 Billion! I agree with a few comments that it is not the ground level DSHS workers fault, but 100% DSHS Management! Had friends in the field tell me that their superiors looked at the budget more of a use it or lose fund than taxpayers hard earned money. Management should get completely cleaned out.

Funny that the Gov isn't as combative/angry with King 5 on this story as she was with the Ferry scandal. Maybe she is learning that the electorate actually wants our money well managed (or at least her PR team has). We need to keep squeezing the budget clearly there is more to give.

Hey WASHINGTON LADY..you are smart!! you hit the nail on the head in all you wrote. You might want to research students who get financial aid for college??? Better not make $1.00 over requirements to qualify..and in turn check who gets priority and financial aid??? How about States with Pologomists? Five, six wives, some times twenty plus children given birth all living under the same roof..The male bounching from bedroom to bedroom.. I don't know if people realize that the Poligimist does marry the first wife. Cannot marry the rest of the wives legally..this procedure lets him off the hook for supporting all the wives and his/their children and allows wives to get welfare, food stamps, every benefit available to women without a husband to support them! Our hard earned money we pay taxes on AT WORK!!

Unbelievable that the "State" finally has done its job and discovered the DSHS fraud..Upper management absolutely the blame..The very one's who were paid the 6 digit salaries to protect tax payers! Sadly, fraud, dishonesty is in everywhere in the working arena.. and all because those responsible were not doing their job..Depending on their low paid employees to do their job! I worked in a "field airline marketing" office for many year's and the bosses weekly expense reports were right out theft/fraud. How do I know? They were given to me/the secretary to put in envelope for mailing.. Dinners, lunches, after hour drinking/happy hour with friends...Three day week end golfing trips (Friday through Sunday) and using the customers/company names to justify their reimbursement for these expenses when if fact, many times it was family entertainment! Accounting doesn't question the reports, just cut the check Only secretary in the office, single parent, you don't blow the whistle.

I'm impressed that DSHS hired an auditor who was allowed to tell the truth about their shortcomings. Refreshing change! I hope Mr. McDevitt will also investigate other DSHS branches, particularly Children's Administration.

The problem is that DSHS spends over $2 billion per year (1/3 of the entire state budget) plus much more in federal funds which are allocated to it and they have weak internal controls, poor contract oversight, and extensive payroll problems potentially resulting in millions of dollars in errors. Read the latest WA State Auditor's accountability report for DSHS (#1005061) for a little light reading some night and you will be enlightened. Brian Sonntag's report focuses on internal problems without addressing the potentially much larger issue of misuse of taxpayer funds by the recipients of those funds. The culture of non-accountability originates with the governor's office who should set the tone for operations and with her political appointees who head the DSHS. Of course the problem goes way back before Gregoire, but she clearly does not have the political backbone to properly address it. It there any wonder there is a taxpayer revolt going on in our state and nation?

DSHS has had these problems for years. I can not blame the staff of the agency for most of the issues. The real issue is that when fraud was reported- the agency did NOT follow up on each issue presented. HOWEVER, with the cutbacks Our state made to DSHS-laying off employees it just made it easier for people to get on DSHS that do not need it. THAT is the problem. Remember our state budget? On who's backs was it ballanced on? the rich? NO! the Poor yep. So having said that- the ultimate blame here is on our govenor Christen sorry for the spelling haha, but under HER watch- this could have been prevented. yes I am a democrat but I do not agree with what she did. DSHS now is in shambles here and NOW people are asking "how did this happen", well look no further than Olympia.. THAT is how it happened

It's worth noting that the majority of people commenting here are participating in name-calling, generalization and demonization. I was recently laid off from DSHS and contrary to public opinion, employees in my unit worked diligently to the best of our ability. In my data-entry position we were required to meet a 99.9% accuracy standard which was verified by daily quality assurance measures and discussed in weekly meetings with our supervisor... It's easy to make broad sweeping statements about government being "evil' and DSHS employee's being "rats" but unfortunately these statements are inaccurate and perpetuate passive aggressiveness. I applaud the agency for seeking out those who abuse the system and creating a solution.

Let's get rid of the entire DSHS, and start over. No food stamps, medical coupons, etc until you can prove the following: You (not your children) are legal US citizens; you are actively seeking employment unless proven disability won't let you be gainfully employed; you volunteer at least 10 hrs a week - picking up litter, driving seniors, etc. Food stamps can only be used for basics, milk, cheese, meat, vegis. Oh, and no high end steaks. If I have to eat hot dogs and hamburger, so can you. Anyone found selling their food stamps are IMMEDIATELY cut off, and cannot get back onto the program for at least 1 year. The Fraud dept of DSHS needs to have basic tools, and be at least double in size - get rid of the fat cats at the top who are so obviously standing in the way of getting the job done correctly.

What does anyone expect? The whole government is run like this. This is a primary example of why this state is in such a dire condition. These people in government will spend more time and effort trying to find a way to not do their job than they would have had to put into it along with leftyism. As someone already posted "The whole system is CORRUPT!!!". Keep voting for Democrats.

I agree 100%. There definitely should be mandatory drug testing and really Troy? you dont know if they are using the money to gamble? yeah because i know when i need to use an ATM i find the closest casino and get it there. I just hope this isnt a one off story and someone actually puts words into actions and does something about it.

To qualify for government assistance, proof of US citizenship is required. All the time I see immigrants using EBT cards at the grocery store. I finally was told by someone how this is done. The benefits are not given to the adults but their minor children who are born in the US. Basically, both parents can be illegal and have 5 kids and then apply for benefits using the children as citizens and qualify. Theoretically, the food bought with those food stamps should only be used for the children. I think this should be changed. I think at least one custodial parent should be required to prove US citizenship for the children to qualify. Two years ago, my daughter moved back home with my granddaughter. Since she was only 20 at the time, she was cut off from her food stamps due to the fact that she was living with her parent and cannot qualify be herself until she turned 22. I was the responsible parent/grandparent required to support my adult daughter and my granddaughter. Interesting!

The DSHS Division of Children and Family Services is one of the most corrupt, dishonest, evil sections I have ever seen. I am a former Foster Parent and adoptive mother. I have been appalled to see the extreme dishonesty, blatent lying, and corruption come from social workers there.... They are untrained, unprofessional, and in some cases complete idiots~ Outright lies are the norm there.... with CASA's sitting in the Social Workers "pockets" doing and saying whatever the Social Worker wants...The whole system is CORRUPT!!!

If recipients not only had to pass a drug test but also do public service to get their benefits I think you would see big changes.They should have to go get food supplies at a distribution center of some sort and also have to work that distribution center.This system is to easy so why should they care.School of hard knocks-don't just dump it in their laps and walk away.

I am behind you Mr, Mcdevitt. How come whenever we get a story like this no one ever is happy at the fact that at least someone from DSHS is taking the lead and weaning these idiots that are milking the system out. I for one am glad that they are now doing something... As far as the drug testing I think it should be required I have two kids that are severly disabled and they are on SSI and I think their should be drug testing for that also the people that help with the checks received. Just like at a job you get a drug test why should the state be any different if they show they are using you turn them away. Not to mention why is it a debate if people should be checked more thoroughly to see if they are a citizen of course if they are an illegal immigrant they should be tossed out of it... They should be sent back to their own country for cheating our government and not allowed in until they can pay back what they took illegally... It is time for our government to step up.

If someone robs a bank for a few thousand dollars they get prison time..... we are talking billions stolen here. There is no excuse for these criminals robbing every single taxpayer in Washington State....not to mention what was stolen from the Federal Government. Where is justice?

If they find fraud or interference with investigations in the executive ranks, they should be investigated, prosecuted if appropriate, and barred from any retirement pensions or medical/dental plans. Fraud is a criminal activity and this should not be rewarded. There are many people who need this assistance, and some of these activities prevent our using funds effectively.
