What is allowed under the new cell phone law?

REDMOND, Wash. – Washington state's new cell phone law goes into effect just after midnight on Thursday. That means you could be slapped with a $124 ticket if a cop merely sees you holding your cell phone to your ear while you are driving.

Sande English has been a traffic officer for the City of Redmond for more than six years. She was a patrol officer before that. She cites studies saying that talking on a cell phone is like drinking and driving.

Even with the current law where talking on a cell phone without a hands free device is considered a secondary offense, markers are there that somebody is thinking more about chatting than driving.

"It's similar to the DUI markers that you see. They'll be weaving in their lane of travel, crossing the center line or the fog line. They'll either be a few miles over the speed limit or, more often than not, they're under the speed limit," she says.

Then there's the classic "sitting at a green light." All are giveaways for the police to spot someone on the phone or someone under the influence.

As an officer who also works on the department's major accident investigations team, she sees the kind of carnage a bad accident and driver inattention can bring. English says her department will follow state guidelines allowing for no grace period come Thursday morning. She seems fine with that.

There are some exceptions, but for most of us adult drivers, this is now the new law plays out.

  • If you need to talk on a cell phone, the best way is with a hands free device, like a wireless Bluetooth, or an earpiece that connects to the phone with a cord.
  • If you insist on using an actual cell phone, the state patrol says it might be better to think of the new law as an "ears free" law. If you hold a phone up to your ear, you're a candidate for a ticket.
  • Holding your phone with your shoulder while keeping your hands free? Busted.
  • Putting the phone on speaker and laying it on your dashboard or console is OK.

But where the Washington State Patrol interprets the law as saying it's OK to hold a phone on speaker in front of your face, that will still get you a ticket in Redmond says English.

"It's not hands free," she says.

Texting is forbidden. The state patrol says texting at a stop light while not moving might pass muster by splitting legal hairs, but you're still responsible for operating the car. So, even if you're stuck at a light, you still need to be prepared to move out of the way of that emergency vehicle behind you. The patrol expects that kind of case to be hashed out by the courts.

It is legal to dial a phone number or call up or enter a name, even while moving. But texting or e-mailing will get you a big fat fine.

So, what if you're on the freeway and have to take that call? Pulling over for a non-emergency on the freeway or on another road where parking or stopping is illegal will get you an illegal parking ticket, although not a ticket for the phone.

We hear of some people who have interesting interpretations of the law. One is that it only applies to freeways. That's wrong. The new cell phone law applies to any public right of way in the state. If you're in an alley with a flip phone to your ear, you'll get busted.

All that said, the ticket won't count as a moving violation on your record and won't be reported to your insurance company.

cellphone users are tooo distracted making for an under the influence ticket . i agree . that said -- i am sick and tired of new law to fund the judicial system . i live in the county where burgularies etc are committed by criminals and gangs specifically because county police take forever to respond and rarely enforce exsisting laws and they know it . i will probably be given the next ticket for answering my cell , while a 'crash and bash ' burglery is occurring in my home . last time it was the middle of the night , the cop said it was just a deer . [ with tennis shoe feet and an empty storage room in his face ] . find another way to make money guys .

and redmond pd has allready decided to violate the state law and ban use of speakerphones which is written into law. they need a goddamm clue. more corrupt policing as usual

Read the RCW people!! Police, tow truck drivers, ambulance drivers (ANY emergency response vehicle) and those with hearing aids are exempt from the new law. We are ALL exempt if the call is in response to or reporting an emergency.

The law should read " it is ok to use a cell phone as long as the phone is not being held to your ear " point made simple. That would mean a blue tooth is OK as they are not phones. A speaker phone is ok- even those that can be heard through a car audio system. A hands free zone. Now, it should also be fine to dial a number. I do agree with those with disabilities, in that they need a phone. What would you then do needing to call the police because someone is stalking you or following you home? cant call anyone!! NOT! I will use my cell phone when needed- even if I am driving. It is my right. I pay for that phone for use in cases like that. By the way I enjoy the speaker phone- good invention.

repetivity..it's not about personal freedom. you don't have the freedom to drink and drive. you don't have the freedom to drive 100 miles an hour down a street and you don't have the freedom to endanger the rest of us when with your self-absorbed telephone call while you're driving. Although..I AM going to enjoy the newfound freedom of clowns like you getting cited for simply driving and yakking.

JFYI.....according to the RCW of the new law, if you use a hearing aid you CAN STILL use your cell phone, no hands free device is required.!!!

I can't use bluetooth, I'm missing both my ear flaps. You can't text, but it's ok to dial the number and switch the phone to bluetooth while driving? I agree we shouldn't drive and text/use the phone, but I can see someone challenging this law in court

The title of this news article is: "What is allowed under the new cell phone law???" Simple Answer: You are allowed to get a $124 Ticket. This new cell phone law is the ONLY thing Governor Gargoyle has done right in her entire time in office. Dino Rossi would have had this done within the first 30-days in office. This new cell phone law has an added benefit as it will severely reduce Road-Rage incidents. Nothing infuriates me more than someone driving with a cell phone held up to their ear. Hang-Up or Pay-Up!!!

IN reply to rodeogirl73---with a hearing impairment-even more reason that you not be on your phone while driving. Your focus should be 100% on the road. No offense to your disability, but you seriously increase chance of accident if your doing both at the same time.

i am 110% for this law, and i will tell you why. 10 years ago, cell phone penetration was 12% (multiple sources), now it's 83% (multiple sources) while only 73% (US 2000 census) of the population is 18 or older. Technology has always moved faster than the law, or more appropriately, faster than common courtesy. If it's true that using a cell phone, or eating a hamburger, putting on makeup, or whatever distraction you allow while you operate automobile is the same as drinking and driving, then it is your responsibility to have the common courtesy not to do so. But what about the commuting diners and such? Cell phone usage while driving is low hanging fruit, but in the end, it's still your responsibility no matter what the distraction.

The city of Redmond is asking for a host of legal troubles. In court, there will be one question to ask the officer. "Was I holding the phone to my ear while driving?" When the officer says, "No, but..", all you have to do is cut him/her off mid sentence, and say "Thank you. No further questions. Your honor, I motion for dismissal with prejudice due to the state's primary witness just confirming that I did not break the law by holding the phone up to my ear while driving." Simple stuff. They are asking for a walloping in court if they ticket you for simply holding the phone in front of your face.

I'm all for the new laws, but they did not mention anything about people who CAN NOT use blue tooth like me for one, which I'm hearing impaired. This is pretty much asking for Discrimination against disability act.

also if you wear hearing aids you are exempt from this law as i wear them which i think is still wrong but i am getting tired of hearing this cell phone law. what about eating while driving or drinking a pepsi or coke while driving or car pooling and talking to a person in the back seat or even next to you. i see this all the time and even i do it, looking at the person next to you as you talk to them or in the mirror at the person or child in the back seat. i have a bottle of pepsi and need to open it what bdo i do? one hand on the steering wheel holding the pepsi and opening it with the other one or eating fries and a burger from somewhere. ok ok you get the picture what are they going to do start ticketing us for eating and drinking and talking where does this stop. holding a phone to my ear is no diffrent then opening a pepsi or eating or talking to the passenger which we all do and is a distraction. sorry everyone but i think it is bull and with my hearing aids i will still talk

THE NEW CELL LAW IS JUST ANOTHER WAY FOR BIG GOVERNMENT TO TAKE PEOPLE'S FREEMDOM'S AWAY FROM US.THIS LAW IS ONE OF MANY LAWS THAT GOVERNMENT HAS OBTAINED BY EXCUSSES AND SO CALLED SURVEY'S TO CONTROL THE PEOPLE OF THE UNITED STATES.ALSO IT SHOULD BE THE SAME FOR POLICE TO OBEY THIS LAW AT IT IS FOR REGULAR CITIZENS.IF WE THE PEOPLE CANNOT PULL OVER ON THE SIDE OR SHOULDER OF A ROAD OR HIGHWAY WITHOUT BREAKING A NO PARKING LAW TO MAKE OR RECEIVE A PHONE CALL, NEITHER SHOULD THE POLICE OR ANY OTHER GOVERNMENT VEHICLES BE ALLOWED TO DO THIS EITHER.THANK YOU, A VERY CONCERNED CITIZEN.
