Nursing home staff accused of taking nude photos of patients

BREMERTON, Wash. - A Bremerton nursing home is under investigation, after the staff was caught allegedly taking nude photos of some of the patients. A nurse and two nursing aids have already been fired.

Susan Dreyfus, Secretary of the Department of Social and Health Services, says they are now investigating three nursing staff members at the Kitsap Health and Rehabilitation Center in Bremerton. They were fired after allegedly taking inappropriate photos of patients on their cell phones, and sharing them as entertainment.

"It just can't be tolerated," says Dreyfus. "If this was my parent or your parent, we would be incensed by this."

According to the police report, one photo was of "a resident nude in their room." That particular photo was of the patient "bent over, naked, buttocks."

Bremerton Police is investigating it as a case of voyeurism, but a spokesperson for the department says since the photos apparently were not sexually motivated, the staffers may not be charged.

Some patients' family members heard about the allegations and came to see what was going on. Jeff Shelly of Poulsbo says he was appalled.

"It's very inappropriate behavior for a staff member to be doing that," Shelly said.

The police report said the victimized patients were not aware of the photos. Some had "severe dementia and would not understand what had occurred." According to the report, one woman who was self-conscious of her weight would be "emotionally crushed" if she knew about them.

"We would take all appropriate enforcement actions including revocation of license if it goes that far," says Dreyfus. 

The nursing home, which is managed by Evergreen Healthcare, issued a short statement saying they notified the proper authorities and they're conducting their own investigation.

The case has been handed over to the prosecutor's office to decide whether to press charges.

So, how does that work? If the pictures are of naked people, old or young, as long as they are not sexual motivated, they are not illegal? What constitutes sexual motivated?

I hope they press charges. As the article mentions, we'd be furious if this happened to our parents; but we'd also like to know that down the road, we don't have to worry this sort of thing might happen to us.

I am absolutely apauld at this behavior! How dare anyone in the nursing profession, use their profession to take advantage of ANY situation to exploit a patient in ANY manor! I am sure I’m not alone in this thought. As far as I’m concerned, the staffs who were involved in this inappropriate conduct should be prosecuted to the tenth degree. This isn’t just a matter of voyeurism, I’m sure it goes against HIPPA & Civil Law. Families of patients unite and take these persons to court, prosocute and make precedence that this is INTOLERABLE behavior and make people accountable for their actions. This is what is lacking in our judicial system. As for the corporation who owns/manages this facility and others…be accountable also. We entrust our family members in your care. CARE FOR THEM….NOT EXPLOIT THEM…instead of worrying how much money you can take in….you’d best be looking into who you are staffing…you are not above the law.

So...it's not sexually motivated when it's old people but it is sexually motivated if it's 17 year olds?! Forget that - nude pictures are SEXUAL EXPLOITATION regardless of age! Especially because these individuals are not able to take care of themselves and are in a vulnerable position. These individuals should be charged with a SEX crime and required to be registered as SEX OFFENDERS for the rest of their lives. Disgusting, worthless excuses for human beings. I hope they get what's coming to them.

I don't care if the photos were not sexually motivated, these people should be prosecuted just the same as the guy taking pictures up women's skirts on the escalator. Their names should also be made public so that when they apply for a job somewhere else this offense will show up if someone googles them!

Probably costs too much money to charge them with anything other than a sexually motivated crime. I think it is sick, but are we really shocked and surprised? Of course something should be done. Anything.

It's amazing to hear such discrepancies in how prosecutors decide who to prosecute and who to just call stupid. Recently, when some students circulated pictures on their phones of photos of questionable content involving nudity, they were being charged in court, in Lacey, I believe. This follows these young people all their lives, one stupid act. Now, we have people (nurse and nursing assistants) that we the public entrusted with the care of our elderly citizens, and the prosecutor just says it was STUPID and not CRIMINAL?!! If it were me, and it was my parent, or grandparent who had been VIOLATED by this NURSE and NURSING ASSISTANTS, I would be seeking a civil suit against the NURSE, the NURSING ASSISTANTS, and the NURSING HOME in Bremerton. This was a violation of their personal rights and personal dignities that were perpetrated by so-called professionals. If the prosecutor turns a blind-eye to these people, hopefully it will not be his or her family that is violated next.

To emptynestr they are care givers not care takers and as far as punishment their livelyhood is gone and chances are they''ll lose there license to work in that or any simular job for life which should be the case.
