Marysville man gets 13 years for killing 6-year-old daughter

EVERETT, Wash. - A Marysville father, convicted of first-degree manslaughter in the shooting death of his six-year-old daughter, has been sentenced to 13 years in prison.

Richard Peters, 43, was convicted last week of recklessly causing the death of his daughter, Stormy, when she was shot in the face while he was cleaning a gun. The shooting death happened on November 16, 2008.

At the time, The Snohomish County Sheriff's Office said Peters had been drinking and then asked his daughter to get one of his guns. Police say during an interview with investigators, Peters told them when his daughter handed him the gun, he pulled out the magazine and pulled the trigger.

The gun fired, and Peters' daughter dropped to the ground. She had been shot between the eyes. She died the following morning at a Seattle hospital.

Investigators say Peters told them that while cleaning his guns, he was drinking vodka, pouring himself multiple double drinks. He told them he was probably too drunk to drive.

"He abused that position of trust by drinking and asking her to carry what he knew to be a loaded gun," said deputy prosecutor Mona Clarkson at sentencing "Daddies are supposed to protect their children and not leave them lying in a pool of blood on the family room floor."

During the trial, prosecutors argued that Peters had, in fact, intentionally pointed the gun at his daughters head and charged him with second-degree murder.

The jury, after deliberating less than four hours, acquitted him of that offense, opting instead to convict him of the lesser charge of first-degree manslaughter. The jurors said they weren't convinced that Peters acted intentionally. They said he was reckless and deliberately ignored the risk of handling a firearm around his child.

At sentencing, Peters' mother and wife asked for mercy.

"I don't want to lose my son, too. And he's a good man. He's not a threat to society," said Peters' mother, Crystal.

"No matter how much time you give Rich will never amount to the amount of punishment this family is going through and how much we have lost in the last year," said Peters' wife, Kristina.

His family said it was all just an accident, but the judge didn't buy it.

"This is no accident. This is first degree manslaughter," said Judge Michael Downes. "Mr. Peters failed miserably in his parental obligation to keep this child safe."

Peters' defense attorney plans to file an appeal.

Who would ever let a 6yo handle a gun loaded or not. Thats extremely irresponsible parenting. My mom and I have firearms and we keep them locked away, and never loaded. Though we keep the magazines somewhere close by. If you have a gun of any sort, don't let children handle them. Don't handle them drunk. Be responsible.

This poor child...NONE of her family had regard for her life. If my husband or son-in-law ever 'accidently' killed my granddaughter with a handgun while he was drunk-I would NEVER forgive him. If he was a normal parent, he shouldn't care how long he sits in prison because a mistake like that should be reprehensible in his mind. Imagine it. I have zero tolerance for this kind of recklessness-there's obviously a wide spread and predominate genetic flaw going on in this family; they're probably mistaking self pity and actual grief for this trusting innocent.

I also believe that a 13 year sentence is too light for this selfish father. I hope that the next 13 years gives him some time to get his act together. Booze and parenting don't mix and adding a weapon is just foolish. Unfortunately the gun wasn't aimed at his own head.

There is no difference between someone handling a gun or driving a car while drunk. Both are extremely dangerous. You don't let a 6 year-old have access to loaded guns (If it was properly locked up he would have had to get it himself). This is the same as if someone was in a wreck and their child is not properly restrained, or if someone leaves a small child or infant in a hot car and they die. All are irresponsible, and all are punishable. I hope that while he is in prison that he gets treatment for his obvious drinking problem. Most likely he has not touched a drop since this horrible incident. If people keep doing things like driving drunk, handling firearms while drunk, and just doing other stupid things all the do-gooders will try to force prohibition on us again. Think before you drink. Don't be stupid

are you serious dakotanative? A responsible human being does not ask his 6 year old daughter to retrieve a loaded gun so he could clean it (while drunk,no less). You see nothing wrong with this scenario? You must be delusional. How do you compare him with someone who gets into a car while drinking? He could have done that too but instead killed someone in his own home instead of a stranger on the street. What's the difference? An innocent life was still taken from his irresponsible actions. Probation and a lifelong gun ban? Get real! I am all for right to bear arms when you ARE A RESPONSIBLE HUMAN BEING. Drunk fools with loaded guns and children just don't mix. He should have been sentenced for way longer than 13 years. I have no sympathy for him at all. I hope he rots in prison.

Get frickin real. There was no intent on this guys part. Jail is for cop killers, not accidental shootings. There is guy is far less dangerous than the guy that gets in a car drunk. Probation and lifelong ban from weapons is far more reasonable. The people that complain about this are the same ones that get drunk and bang their head on the toilet in a far away hotel room.

A sad affair. Booze and guns just do not mix. I own guns but youhave to be responsible when owning them. This man was so errant in his ways that it is hard to understand how someone could be so stupid.He should be locked up much longer.
