Investigators: Older brother sues state in starvation case

Two years ago the near-death starvation of a four-year-old boy, Shayne Abegg, shook up DSHS and changed state policies.

Now his older brother, Joey, is suing the state, claiming he was a victim as well; but no one talked about it.

Shayne was rescued by firefighters two years ago after getting a call that the child was starved and abused. The emergency response workers were horrified: Shayne weighed fewer than 25 pounds, half the weight of a child of his age should weigh, and had a body temperature which put him in peril.

The case caused public outcry. The top official at DSHS at the time, Robin Arnold-Williams, said in March of 2007, “No child should go through what apparently this child has gone through and resulted in his, having to be hospitalized for this. So we start with that, and then we have to look at every step, every decision that was made and say, what happened?"

The boys’ father and his girlfriend are in prison now, convicted of criminal mistreatment of Shayne. But both are suspected of starving both boys as a form of punishment.

A neighbor, Melissa Stonehouse, called CPS four times to say the brothers were desperate for food.

"They're starving, you can tell, you can tell by the way they ate," said Stonehouse.

So why all the attention on Shayne, and not Joey?

Unlike Shayne, Joey was old enough to go to school. He attended Odyssey Elementary School in Mukilteo.

The principal there suspected Joey was a victim of neglect and abuse.  Like the neighbor, the principal called CPS with her concerns.

By phone, the principal, Cheryl Boze, told KING 5 Joey was "unusually skinny" yet "ate voraciously" -anything he could get his hands on-at school.

Three days after that call to CPS, Joey’s dad yanked him out of school and moved him to another state. After that, no one from DSHS ever checked on Joey again.

Joey's attorney, David P. Moody, of Hagens Berman Sobol Shapiro law firm says the parents were desperate to hide the child who was old enough to be in public and speak. They quickly shipped him off to a relative two states away.

"As soon as the parents understood that Joey was a walking piece of evidence and was going to lead back to the horrific things that were happening in the house, they shipped Joey to California," said Moody.

But before Joey was moved, the school principal reported additional concerns about Joey; detailed in a state record:  “(Joey) had "excessive bruising" all over his head and ears which did not match the explanation of the injuries given”; reported the principal.

A DSHS social worker came to the school to investigate. She took pictures of the injuries. But to date, no one can find that evidence. DSHS says the photos are lost.

"This ‘story’ about the missing photos is unbelievable,” said Moody. “These are supposed to be professional investigators. They weren't professional in any sense of the word. And to have lost the most important, critical evidence of the case I think speaks to how grossly negligent and incompetent these investigators were."

Joey and Shayne have now been adopted together by a couple in Washington State.

KING 5 recently spoke to their new dad, who says Joey remembers his past in great detail: how he was beaten, scavenged for food, and fought for his survival.

Joey’s lawsuit comes after his brother Shayne was awarded 5-million dollars by DSHS to settle a lawsuit against the state last year.

State officials say they can't talk about Joey's suit.  But in a written statement to KING 5, they point out that since the Abegg case came to light, they've increased training on how to recognize malnutrition.

Poor kids, that is just sickening. DSHS wastes so much time and money on red tape and harrassing people that aren't doing anything, and then they just make things harder for people who actually need help. They lost the photos, isn't that convenient. I'm sure they wouldn't lose documentation that your family is making .50 a month too much at your grunt job to qualify for help, but they lose something that could have saved this child from years of suffering. I can't believe that things are run this way.

Just goes to show what a waste of taxpayers money CPS really is. They take and adopt out children to strangers(profit) that should have never been taken. They leave children they shouldn't. and they place children in some really bad places like with people like Carole D'leon who by the way only spent three measly years for killing her adopted son. It is doubtful that they have really saved many children. Considering the 80 percent failure rate of children placed in foster care compared to children left with family even a neglectful situation.

Training on how to recognize malnutrition? No one should be working in that department if they can't recognize malnutrition. I'm sure most of us on the street could spot it as easily as the school officials.

Jenasal, I completely agree. Start holding the CPS investigators liable for their actions. It is negligence and endangerment for them not to do their job.

DSHS is never going to change. They don't care about children. My step-son who is 8 yrs old is suppose to weigh 52lbs, he weighs 37lbs! He's below the 5th percentile!!! He eats less than my 2 yr old who weighs 27lbs and is healthy. My step-son is so malnurished he gets sick when he eats, he constantly shakes and is always exhausted. CPS knows this and they also know his step-father abused his children and went to jail for it but do they care?? Nope. Instead they told his mother its okay to stalk me and obtain proof that I am harrassing her since I reported her to CPS. WTH? We tried to get custody more than once and the male judge we had only granted her supervised visits, she appealed and the female judge we had threw out the case without looking at any of the evidence we gave her. Way to go DSHS, I hope nothing happens to my step-son or I will make sure you are held responsible.

"recognize malnutrition?" How about ALL signs of abuse starting with what was called into CPS by legit sources (neighbor, school principal) Can you say 'guilt' hence moving the child aka: evidence out of state? The story does not elaborate on the length of sentences for the birth father & live in GF but I imagine it won't be long enough considering the facts involved. I pray for these boys and am happy they were adopted by a loving family/home so they don't have to endure the insanity. Any award from this new lawsuit should go toward the kids future such as college in lieu of attorneys.

They need to have a system in place to track these children/parents across state line. The children we have with us have been reported to CPS for 10 years, but mom kept moving every time CPS showed up. She did this for 10 years until they were finally taken by the police in our state (yes, police, not CPS). Once a person moves from the state they were being investigated in, CPS will just drop the case. There needs to be a national database, which follows these families in EVERY state. If someone moves, then they need to keep investigating/following in the next state. These poor children get moved around by their parents to hide from the system, but the children suffer years of abuse due to this.

This is Disgusting.What a Cesspool of Idiots,Scum,and other waste. I believe what is needed here is a Nelly Bly.Someone to infiltrate DSHS and expose them for the worthless pile of taxpayer waste they are. How sad that those who are supposedly protected By DSHS are harmed by them. What we are to believe is they are too STUPID to recognize signs of starvation. Too STUPID to look for signs of abuse in other siblings.Too STUPID to keep photo's of evidence. I think DSHS should change their name to DUH! ..

The state has renewed it's claim on it's favorite old cash cow--"the taxpayers". I'm sure you have heard about all the cool new taxes the state house and senate are stumbling all over themselves to enact? Gregoire will quickly sign them into law and then she and her DSHS lackeys can relax a little. They can afford to shrug off a few measley little lawsuits like this one. No need to run responsible government when you can just throw money at a problem and claim you are fixing it.

Once the boy moved out of state, what legal obligations should WA. State have?The boy was nolonger a ward of the State.They were reported and investigated.You guys are a hard crowd. One minute you argue about parental rights and then the next you want the Govt to step in.Some of you are the same ones that argue, Govt. is too big. The schools job, is just like the securty guards at the bus tunnel. They report, they dont have the legal authority to hold a child based off of assumed abuse.I also hate to break the news to you, but for a large percentage of kids, the school lunch and breakfast programs is the only guarenteed food intake for them.This is another program that big brother supplies that some of you Teabaggers forget about.

YOu have any idea how many complaints DHSH gets? Most of which are bogus complaints. There is no way they can investigate every complaint. Principals and teachers need to have the authority to not release a child to his or her parents if they suspect abuse. They should take custody of the child until the police show up.

Inept social workers do not lose their jobs, they are promoted to supervisors! God Bless these little guys and their adoptive family. May you be surrounded by love. It is time to restructure DSHS. DSHS has too much power and no accountability. Children will continure to die and suffer until something is done.

DHSH SUCKS as a so called professional institution. No mention of anyone losing their jobs. The very definition of bureaucracy "converting energy to a solid waste"--------- The other crime here is that no one was held accountable and that something like this will happen again, maybe not this week or this year, but DSHS will fail again it is in the nature of the department. No one held accountable it’s “The buck passers dance”

Of course CPS lost the photos!!!! I feel CPS supervisors should be held responsible and serve as much time as the dad, when are crimal charges going to be brought against them for child ENDANGERMENT???????????????
