Innocent man may be labeled a sex offender for 'rest of his life'

PORT ORCHARD, Wash. -- It has been a nightmare for Dan Wheeler for 15 years. It started with his wallet being stolen from his truck, and his identity stolen. Usually the trouble that follows has to do with bank or credit fraud, but Wheeler says his identity was stolen by a sex offender who was arrested and used Wheeler's name as an alias. 

"It's been absolutely miserable," said Wheeler.

About five years ago the Port Orchard man was stopped for making an illegal left turn.

"The officer told me to get out of the car and I was under arrest," said Wheeler.  "I asked why and he said I was a wanted sex offender. I couldn't believe it." 

Since then, Wheeler has been fighting desperately to get his identity back.  He has a difficult timing getting any kind of job that involves a background check, and was recently rejected as a foster parent -- all because of a case of stolen identity. 

"I've been to police and prosecutors and they all tell me there's nothing that can be done," said Wheeler. 

He may be right. A spokesman for the Washington State Patrol, which handles the State Sex Offenders Database, says when someone is arrested and uses an alias, that alias is kept on file forever.  The concern is that if authorities delete the alias, the criminal could go back to using it again.

Wheeler doesn't know where to turn.  For now, he just hopes he gets the job he recently applied for, as a maintenence worker at an assisted living facility. 

"But they require a background check," he said.  "Who knows if they'll believe me?"

There is seriously something wrong in this country if something like this can not be cleared. I have had a freind that had identy theft and was given a REALLY hard time, and her credit was ruined. Again the registery is a useless piece of time and money. The people KNOW this man is not an offender yet because of an unfortunate incident his life as he sees it is ruined. He may very well be right. However until you walk in ones shoes you can never really know the devastation that these laws cause for hundreds of thousands of families. I understand that the parents want to protect their children, but rallying for these laws is a waste of time. Too many people are walking around with a scarlet letter, that have done their time, are not dangerous, and deserve the rights that everyone else takes for granted. The registry, and zoning laws are only a ploy for news and political votes. If we want our children safe, then we need to keep them safe ouselves.

As horrible as it is, maybe this is what it will take for the public to wake up to what "life on the registry" is like for hundreds of thousands of our citizens. This man is totally innocent and everyone believes in his innocence, so they will listen to him, and eventually, something will be done if he continues pushing. Well guess what? Some of the 700,000 other people on the registry are also innocent and suffering through this nightmare, and no one believes them or cares. Many who are not innocent are guilty of offenses that were misdemeanor, consensual, non-violent, non-contact, and are no risk to the community. It's like the 7 circles of Hell; they committed offenses that are labeled sex offenses, but do they deserve to suffer the full ostracism of the registry along with those who are violent, predatory, and dangerous?

There is really absolutely NOTHING anyone can do?? That sounds like bull to me. You can't just call it cased closed... There HAS to something that can be done... It just seems like there has to be something about this that violates his rights as an American. Keep fighting buddy!!!

Even if he gets another SS #, he can still be arrested until he proves to a judge who he is. So why doesn't the dmv do this. My left side was paralyzed and I have a limp, so I told the dmv I would just use an automatic and use the right leg only and they have paperwork from the doctor saying nothing is wrong wit the right leg. So if a cop calls because he sees it says there is a medical record on file, as soon as they are told so long as I drive a automatic, it is okay. So once this guy proves he is not a sex offender, the dmv could put on his license, legal papers on file and the dmv would have records that he is not the one that is a sex offender. If they can do it for different medical reasons they should be able to do it for that and they will not have to worry about a lawsuit. Now when the dmv is closed ,the affected party should make sure a local police agency has that on file, so another police agency can call and ckeck it out.

Dan Wheeler sounds like a very common name, how can he be accused? What every John Smith sex offender puts everyone with that name in jeopardy in background checks? That does not make sense. Is it tied to his SSN?

You'd think they could code names in the system that were used as aliases by criminals that would suggest further checking the identity of the individual you're doing the search on. But the sad truth is that this type of background check is necessary. Maybe this guy should also inform any place that he applies to of the situation up front so it doesn't come as a surprise to the potential employer. Just a thought.....

I've done backgroung cks and used the State Patrols base. It states without a finger print it can may not be accurate. I bet a healthy lawsuit, could get a foot note, for this guys name.

Yogi? I beg to differ, when you go for a job that requires a background FBI and WSP check- they take your fingerprints. Teachers, school personnel, caregivers for the elderly, etc...

They can fly people to the moon.... and they can't take care of this? Oh come on! There could be an option on his background check for a fingerprint. Say.. if this person goes down for a fingerprint check and it comes back that he's the REAL Dan Wheeler then it's all good. They should take his fingerprint and add that to his "record". Or...... he can have his name changed. But it does suck that this fricken criminals can alter a innocent persons life like that!!!

It is a sad commentary on American society when the innocent are punished while the guilty(even convicted) are allowed to celebrate their freedom. Certainly we govern ourselves in a manner in which we can fix a serious problem like this instantly. We are that socially responsible, right? Unfortunately, probably not. I say, until this innocent man's name is cleared, he should get to live tax free.

So are all "Dan Wheelers" now registered sex offenders or just this one? Quite honestly, it sounds like he has a multi-million dollar defamation case against the State Patrol. How can the state claim that the database is accurate when clearly it is not? If the database has no value, then why maintain it at all?

Hard to believe that this story is true.If the term Identity theft is really to be considered a "theft", Law Enforcement agencies should then be legally accountable to return the "stolen property " to the rightful owner. Law enforcement agencies seem to be part of the identity theft problem.There is definately serious Constitutional Issues at stake. If this story is true he should take it to the highest court in the land. Hard to believe this one.

Unfortunately you are incorrect, 'theykilledkenny'. Background check and sex offender records are tied to a person’s name and birth date, not to their SSN. It's quite unbelievable (and believable at the same time with regard to our govt) that this guy's life can be effectively ruined forever because of govt bureaucracy. If it doesn't fit neatly into a box then the Gov't can’t do anything about. Life is complicated and exceptions NEED to be made, this is a shining example of that. I certainly hope WSP makes an exception for this gentleman.

Why can't they use fingerprints? How about the fingerprints that were taken by the sex offender? Wasn't he processed? And when they do an FBI Washington State Patrol background check, they use finger prints. Why can't they compare the two?

One would think the DAs office should have some information out there for ID theft victims. People don't want to take time to help the common people. I had a problem with my nephews SS# a few years back when I was trying to get medical for him. When the state ran his SS# services were refused because his income was to high to be qualified (80,000 dollars too much). He was onl51/2 yrs old. He father and some of his illegal friends were using the SS#. I couldn't even get the SS department to help with, it wasn't their domain.

Yes Dan, there is a way to fix this. Go to your local social security office. If you can prove you are the victim of an identity theft crime, you can have your social security records and funds transfered to a new social security number. This way when you apply for a job or background check your old number will tied to the perpatrator and your new number will be tied to you. You can finally get your life back in order.
