Frequent force by King County cop continues even after tragic case

SEATTLE -  Chris Harris had been wrongly identified as a suspect, yet when he ran from police they were the last steps he ever took. Harris was slammed into a wall by a King County deputy. The blow caused severe damage to his brain and spinal cord.

"They took away the greatest person I ever met in my life," said Harris’s wife, Sarah.
 
The Sheriff’s Office was quick to defend the deputy. “Preliminary conclusion is that our deputy didn’t break any laws from his use of force,” said King County Sheriff's Office spokesman John Urquhart.
           
Prosecutors agreed. And even after King County paid out $10 million to settle a lawsuit, Sheriff Sue Rahr defended her deputy’s tactics.

“There was no evidence of misconduct on the part of Deputy Paul," she told us.
 
But the Harris case was so traumatic we decided to take a closer look at the deputy. His name is Matt Paul. He’s 29-years-old and has been with the sheriff’s office for five and a half years.
 
KING 5 obtained Paul's file through public disclosure and analyzed 2,000 pages of documents spanning his entire career. We found a pattern of frequent force and questionable tactics that needlessly escalated some situations and caused injuries.
 
Red flags

We saw red flags early on. When Paul was a rookie his supervisors raised concerns-- about his tendency to rush, to “tunnel in,” to jump on incidents that were already covered.
 
But Paul liked to be where the action was.
 
By 2008, he was striking, tasing, and wrestling with suspects; using takedowns, foot sweeps, punches and pepper spray. His supervisors found all of it acceptable under department policy, but warned him to look for alternatives and to avoid arresting people simply because they challenged his authority or weren't respectful.
 
Paul was transferred to the Metro Transit Unit policing bus routes in April 2009. Buses travel through some high crime areas, so some force is to be expected. But we found Deputy Paul uses force far more often than the average transit deputy---six times more often.

The Chris Harris case in May, 2009 was so disturbing you’d expect it to be a wake-up call for the Sheriff’s Office to keep a close eye on Paul.
 
But we found a case a full year later, that made us wonder.

Another similar incident

Computer technology consultant Jeff Gold says he was walking home to his apartment in Seattle’s Queen Anne neighborhood when he saw something that made him stop.

"What I saw was two people on a bench in the bus shelter and two officers standing over them haranguing them,” said Gold, who decided to take some pictures. "Probably had taken three or four photos,” Gold said, “and this is the moment the officer became aware of my presence,” showing us a picture.  
              
Gold described the look on the officer’s face as “chilling.”

It was chilling because of what happened next. When Gold turned to go, he jaywalked. 
 
“When I got about halfway across the street I heard this gentleman yell ‘Stop!’ I turned to look at him, kind of 'You're kidding right?'”
 
That's when Gold admits he made a bad decision - he'd been drinking and he flipped off the deputy, and kept going.
 
"At which point he took off at a sprint and it looked like a rhinoceros bearing down on me. I was running away from him so he grabbed me from behind and thrust me to the ground and my face smashed into the pavement," Gold said.

The deputy who did the takedown was Matt Paul.
 
Paul took pictures at the scene showing Gold right after medics showed up and bandaged his nose. The next day, Gold took some pictures of his own.
 
"And you can't quite tell, but you can see my nose is a little out of kilter here because it's been broken," Gold said. He was arrested for obstructing an officer, but he was never charged. And he didn't learn the name of the deputy until we contacted him.
 
"It's always been burning in my heart that I haven't pursued this, and then when you called to say you'd been looking into this it was like, unbelievable,” Gold said.
                       
But we had one more surprise for Jeff Gold — tape he’d never seen. We showed him the tape of Deputy Paul slamming Chris Harris into the wall. 
 
"If I had seen this video before I had encountered this gentleman on the street, I'd have run like the blazes," Gold said.
           
Gold also didn't know that the force used on him was found to be reasonable and within policy.
 
"The policy for what? In the sense that he didn't break my neck? Within the policy that this is how you treat jaywalkers?” said Gold.
 
More use of force

After the Gold incident, Paul used force in at least two more cases that raised eyebrows -- and prompted complaints to the Internal Investigations Unit. 
 
We asked the Sheriff if he still belongs on the street.
 
“I agree with you. Deputy Paul has a lot of 'use of forces' and I am concerned about that,” said Sheriff Rahr. “His supervisors are very aware of how he performs his job and they're watching what he's doing. I can't turn around and fire a deputy because I have concerns. We are trying to work on it."
 
We hoped to hear Deputy Paul’s side of the story, and at first he said he would talk to us. But after conferring with his commanders, he changed his mind.

Our investigation continues here when we reveal how the Sheriff's Office broke promises and dropped the ball in aftermath of the Harris case -- and again a year later in the case of the jaywalker.

To all the people who say "you don't know what it is to be a cop", you are right, I don't. I made a choice to not be a cop. And the cops do. They are not above the citizens. I am not refuting that there are a few bad apples. However, I have a problem with what the other cops do to the bad apples. The answer is nothing. All the cops do is look the other way to maintain the "brotherhood". Since the cops look the other way, I think they are just as guilty as the "bad apples".

I find it astonishing that the force used on Mr. Gold is considered within the sheriff department policy. It states "Deputies shall not use physical or deadly force on any person, except that which is reasonably necessary to effect an arrest, to defend themselves or others from violence, or to otherwise accomplish police duties according to law." Gold's "crime" was jaywalking. If this justifies use of force, something is VERY wrong with the sheriff's policy.

@Slinky_McGhe7a8, so you think rushing at and aggressively pushing an old lady onto the concrete would be okay if she jaywalked? Let's admit this was a case of unreasonable and unnecessary force by a cop with a history of violence. The police officers are supposed to enforce laws, but not to have an *attitude* about it that causes them to do violence against citizens, even if taunted. They can't be thin-skinned. If a 200-lb man came sprinting full speed at me, I would move to avoid being hurt, whether he was a police officer or not. It was unprofessional behavior on his part. 100%

I have tried to post another comment on the brutality I deal with every day in Stevens county. I only named one persons name today but was not allowed to post it I am wondering if King 5 is blocking me from saying more about the corrupt cops in Stevens county. I lived in King county most of my life they are not half as bad as the ones out here. I will try to post again but I am being censored at this point so I dont know what will be allowed. This is why I cant get help!

Gee about time the head of the sheriff would get it thru here thick head. I would have gotten that paul investigated along time ago, With Diop Kamau on u tube a great police misconduct expert, who takes his clinets to court who were either mistreated by cops or had the snot beaten out of them flat out. Diop Kamau would knock down paul and the rest of the king county police down a couple of notches. In some cases like these ive heard on u tube by Diop kamau if the police dont really do anything about this dirty cop, Diop kamau willl get the FBI involved in cases like these. That is my attorney by the way he wont do you all wrong my advice for the people of washington state and anywhere else in the usa that includes Candada as well.

As someone who has performed law enforcement duties in the military, I tend to be a bit biased in favor of other law enforcement professionals, but reading all of this about Deputy Matt Paul raised far too many red flags for me to side with the King County Sheriff in this matter. Someone with Deputy Paul's record of using such a high level of physical force as a first response to a situation should not be on the street, but behind a desk in a support capacity where he will do no further harm. The role of law enforcement professionals is to protect the public and to deal with any situation utilizing the minimum force necessary, not to terrorize and maim people who offered no physical threat to anyone. There are most definitely times when deadly force will be necessary, but none of these situations covered called for the levels of force Deputy Paul used.

further, i find it even more disturbing that so many are quick to jump on a cop, again without having ALL the facts, and to DEMAND that cops are held accountable for their actions, yet, not quite so quick to demand the SAME degree of accountability for criminals, even WITH all the facts. I keep hearing these same people (reporters included) saying things like "bad cop" "out of control" "rogue cop" and so on, yet criminals found GUILTY of hineous crimes are regularly characterized as "misguided", "ignored", "good kid who just made a mistake", "a product of a bad environment" how about holding the media responsible for things, i've seen situations on LIVE tv, where the cameras are rolling and the "suspect" would only need to turn the tv on, to know exactly where the cops are at!! how about having an "outside agency" review Mrs Byron's report to ensure its accuracy... cos personally i only saw ONE side of this story in said report here is a novel idea, how about objectivity for ALL?

I am a Retired Police Officer from NV (Over 12 years on the job). When I first moved to this State so my wife could be with her parents. I had been advised and saw the reports on "What NOT Agencies" to apply for moving here. WA. State Patrol had one of the worst records for there attitude and the way they treated the Citizens in this State. Two years ago I actually found this warning to be true. I was Not Only verbally assaulted by a state trooper but actually had an Assault Committed on my person, (Threw me onto a vehicles tires). He DID NOT know I was an ex-cop and played Mr. Macho Man and literally threatened to shoot me with his hand unlocking his weapon. I wrote to the Governor pleading with her to appoint an independent authority to investigate. Well she gave it to the Commander of the Patrol who gave it to his minions. Trooper was having committed no violations. Wrote Lewis County Prosecutor for assault charge and "NEVER" Heard a thing. You want justice In WA STATE? FORGET IT

to me it is sickening to see, how yall are so quick to jump on those out there who for a relatively average salary, place themselves in situations (willingly) that most people would RUN from. And if you dont know what im saying, just pay attention to what happens next time a major incident takes place. You'll see most of yall running AWAY while cops, soldiers, etc will be running TOWARDS. yet, knowing NOTHING as to what that's like, yall will chastize all of them in a second just on a small GLIMPSE of an event, one which has already been dissected, analized, judged, and sometimes, like here, EDITED to offer only ONE possible conclusion, that being, that the cop was in the wrong! I wasnt there when Harris got slammed. I wasnt there when the other dude flipped the cop off and then RAN from him, but Im no sheep, and wont let some reporter (with questionable motives) dictate what my opinion is about any one subject. obviously, most around here rather be sheep and let others think for them

Wow, I am really impressed with this investigative reporting--many thanks for continuing to perform an important role of the press even in these days of declining funds. This is an excellent segment, worthy of prime time national news in my opinion. The video of him shoving that young man into the wall and his body going limp from his brain being crushed sickens me every time I see it. If that isn't unreasonable force, I don't know what is. Imagine losing the love of your life, completely innocent of anything but instinctual fear of a large man running at him who is not identifiable as police, and then find out the officer has a history of physical violence against citizens. Your body reacts before your conscious mind can even consider alternatives in such a situation and neuroscience proves it. It's why we have something called adrenaline. I can't see how there won't be consequences now that you have investigated this. Good job. Sad that you had to actually do it.

I was in Seattle in Feb for the Ridgeway arraignment some people asked why are just now trying to tell your story. That is not the case I have been trying for years and because the cops refuse to give me the time of day is one of the reasons I wont give up. Rhiechert who has just decided to run for governor wouldnt even return my call. Sgt Urquhart who loves to see himself on T.V insinuated in front of Helen a Seattle Times photographer that it was my fault I was raped because I was hitchhiking. Then he said "Idont know what you think I will do with this report Im just going to throw it away". He didnt know I had a tape recorder in my knitting bag and the Seattle Times now has that tape. He later told Christine Clarridge (Seattle Times reporter) " She sued us, we dont like her and were not going to listen to her". I am a hermit because I know people can do anything they want to me and I will be the one the cops go after.I have begged for help. I dont have enough $ to earn cival rights.

My name is Jennifer Loran -Paxton I live in Stevens county,Wa. I was assulted by a king co officer (Paul George ) years ago. I settled a lawsuit and moved here to Stevens county. Officer Georges brother Mike George is the captain of the Srevens county police. Mike George has used his position to continuously harrass, beat and falsly arrest me for 18 years now. People say why not move. Why should I? Kendal Allen is Mike Georges right hand man and was recently elected sheriff. Just before he was elected I caught him stalking me thru safeway while off duty again. This time tried to press charges, video dissappeared. Since then I have beaten, falsely arrested three times. I was surrounded and arrested 10 minutes after getting gas, while looking at yarn for supposedly disturbing the peace while getting gas. Cops wife worked at the gas station. I have over 10 years of documents. I have begged and begged everyone I can think of for help. Gegoir,murry,ACLU,Bar assoc,FBI theres no help here.

I am monitoring items like Officer Paul as I see this behavior all over our nation by the police. It is not just this officer but the general belief that the public are subjects, not citizens. I am an Independent Candidate for President in 2012 to Restore, not Change America. We must stop this Terrorism in every community, to bring JUSTICE for the citizens of this nation. I was aware of the video of Officer Paul in the head slamming event, but did not realize the man attacked was so seriously injured. As I see comments about this kind of action against citizens all over the nation, I know WE HAVE A PROBLEM. Most people feel it's impossible to change this, that the police protect themselves, and getting any action against them is nil to none. We spend Billions for our military, yet we do not protect our own borders. I'd send Officer Paul to Iraq, where he'd meet his match. Now I've experianced this kind of police behavior since 1945 in Los Angeles, CA. I've had enough, ReVote. ReStore.

Puled that stat our of mid-air eh Jailwatcher? How about there a thousands of assaults on citizens that never see the light of day because of blue light courtesy cover-ups. Or the thousands of false arrests, like failing to kow tow to an abusive cop..which then get dismissed as soon as the arrested get a lawyer? Or worse, the sad sigh and resignation of a defeated people that this reign of police terror has to be endured. Only in Seattle..King County, Pierce County, Lakewood, Tacoma...oops pretty much all the cops and sheriffs... We cannot allow police unions to control citizen review and disciplinary procedures. It's time to demand civilian authority over any public official with any powers of arrest, firearms, or physical powers over citizenry. Referendum time....

Sue Rahr is a disgrace. Thats all.. Complete failure as an ELECTED leader. No one ran against her in the last election. She wasn't chosen. She was the only option. People forget how she marched her deputies into a County Council meeting to force a tax be put on the ballot because they refused to give up their raises. She fired deputies instead. I will never forget how she treated the Harris family like lepers after the so called "accident" because "they may sue" then put Deputy Paul back on the street one week after the shove, MONTHS before the criminal investigation was complete. Like I said.... DISGRACE! There is seriously wrong with this woman and the whole mentality of the King County and Seattle Police.

2004sccobra..... you must be a cop....first, flippin the bird is not against the law, it is not an infraction, crime, violation...it is a sign of contempt. Ya know, a free speech thing. Second, these cops are not demigods... it is called abuse under the color of authority...ya don't smash someones face for jaywalking...not even close to proportional....cops are suppposed to defuse and lower tensions not inflame them...Please put me on the jury after he beats the hell out of his girlfriend or wife...he will be the general population "sweetheart" in Monroe. Obey the big bad officer's command to comply, not run and attempt to flee. Really who starts these incidents? The poor citizen should comply, be RESPECTFUL like your parents should have taught you. The news media just loves to create news not report it. Now I know where all those LIBERAL Californians have moved to, SEATTLE. The news media want a story, they should investigate the assualt on Police Officers nationwide every year. They'll discover that officers are assaulted, run over by vehicles, stabbed, shot and tragically killed more than ten fold compared to citizens being allegedly brutalized by Police. Remember everyone if innocent until proven guilty especially not by the NEWS MEDIA bias reporting to creat the news not reporting it. Also if you need help, call the news media next time and maybe they will respond to your need of help 24/7 with their cameras and notebooks.

He is a danger to his partner. Citizen involvement is the first line of defense...if this slob was getting mugged and pummeled and I knew it was him....I'd walk away and forget I ever saw it...some good partner is going down when he goes down...this is one rotten egg. If I was a deputy...I'd refuse to patrol with him.

Dont they have psych evals to prevent this type of person from becoming a police officer. Pretty soon we wont call it "going postal" it will be called "going SPD". If your not guilty, why run? But then again, its hard to walk a straight line when the media is watching the cops 24/7 and just looking for any reason to yell brutality. Seems everyone in Seattle thinks the cops are bad, but where would you bee if the cops were not there...? I say work with them, not against them.

We ARE a referendum state...specifically to allow citizens to overrule the government and protect freedoms. It is time for a referendum, to 1) make it illegal for police to unionize. 2) mandate immediate suspensions when a CIVILIAN review board, elected by the people in the general election finds excessive or unjustified use of force, for a minimum of 90 days, WITHOUT pay, 3) specifically allow for civil damages from the officer to the victim...just like the rest of us.

Is it any wonder many people show disrespect back to cops when they treat people whose only "crime" is talking back, giving the finger, or commit something that is not even a crime like jaywalking. What goes around, comes around. But this shows again the arrogant behavior in general of police, their supervisors and the politicians whose job it is to oversee the police. The public needs to demand that bad cops who time and time again show poor judgement to be fired and the only recourse without that being done is to file civil lawsuits for excessive force. If I am on the jury, i would not blink an eye to bankirupt Seattle, king or snohomish county with a mega-million dollar settlement given the right circumstances.

The person getting arrested decides what force will be used. If you obey and follow the directions of the police officer no one gets hurt. But in this State we encourage, in fact at Evergreen State College they teach it, to disobey and resist. This gets people hurt. I don't think that the police should get hurt because a criminal wants to resist arrest. The guy that got killed was running from the police, thus put himself in a position to get tackled, which caused his death. Obey the police on the street and complain about your arrest in court. That way no one gets hurt.

Im not 100% sure but I dont think Deputy Paul is a paramedic/doctor or has extensive medical training. So usually people wake up when they are knocked out. Could this have been the case? Yes. They need to plan for what if he comes to? Not, I dont think he will come to. Coldday do a test for me. Run FULL speed at something and try and come to a stop 5 feet before that object without touching it. In the video Harris is starting to stop running. Unfortunatley its the only video they have. Again him stopping and not taking off running is all it would have taken....not sure how that does not make sense? A red light has the same consequences: Run the red light (which means stop) you run the risk of getting hurt by a person doing the correct thing (green light).

Seattle and King County are unfortunately great examples of both flawed leadership and flawed training of our local law enforcement. Know your rights and make sure your children know that they also have rights when it comes to The Seattle and King County Police. Since our city and county police leadership refuses to fire officers who lie and abuse their power because of threats of lawsuits by the police unions it is beyond necessary to protect yourselves. Our officers have proven themselves to not display basic common sense always falling back on their flawed training. King County Sheriff Sue Rahr and the Seattle Police Chief have announced that they will be RETRAINING all officers because they don’t seem to grasp the obvious. An admission of Flawed training that is long overdue. Don’t allow your children to be the next victim. They could wind up being one of the many many citizens who have been victims of over use of force or a head stomping.

Cops are trained to handcuff people. When was the last time you ever saw a cop chase, fight or likewise not end in the person being placed in handcuffs. It doesnt go like this: Officer: "That was a good chase you gave me!" "I finally caught up with you!" "Now im not going to put you in handcuffs so please dont run again, pull a weapon or try and punch me". Bad Guy: "Okay I pinky promise". So yea he moved him to do just that. could it have caused more injuries...sure not contesting that. Guilty "NO" that is for a jury to decide. Did Deputy Paul have probable casue "YES". Deputy Paul told him to stop, Harris didnt and ran, that would fall under RCW:9A.76.020: Obstructing law enforcement offier, (1) A person is guilty of obstructing a law enforcement officer if the person willfully hinders, delays, or obstructs any law enforcement officer in the discharge of his or her official powers or duties. So that would be an arrestable offense - gross misdemeanor in fact.

I've taken many classes (once per year to update) in medical assistance. One of the first things they tell you is do NOT move the person so that you will not cause further injury, so yes, the cop did further damage to Mr. Harris when he grabbed him off the wall and Mr. Harris' head once again hit the pavement. One could tell by the way Mr. Harris hit the wall that it was not going to be good, and then when his head it the "floor" I knew it would be worse. I DO have experience. And PAY ATTENTION - this man was guilty of NOTHING! For those of you who think this cop is ok, I wish you a personal experience with him. Please let all of us know how that works for you.

So this is how I see it. When the cops tell you to do something....do it. I have followed this whole incident (Chris Harris') from the beginning. Only 1 news agency pointed out that right before he was hit by Deputy Paul, Harris threw a small white bag. What was it...it probably says in the case report. But that never comes up because the truths in a case like this doesnt sell. I am sorry about the condition that Harris is in. He could be at home if he would have done what the police told him to do “STOP”. The other guy also used poor judgment that day. Be responsible for your actions. In no way do I condone excessive use of force. As the Sheriff stated....Deputy Paul was within policy and did nothing wrong. Try doing the job of a police officer for a day and I think more people will have respect for what they do. They put their lives on the line everyday for people they don’t know (like you). Thank you to all the police that are out there every day doing their job!!!

Please, do NOT tell me that this cop did NOT use excessive force. This is a bad, bad cop who has serious control issues and should NOT be allowed on the force. Probable cause? I don't think so - did he happen to see the video of the subjects in question? And even if Mr. Harris was the subject in question, he was not running away and the cop, and if the cop was really a man he could have detained Mr. Harris by other means. I'm guessing Mr. Harris would have run if he had known who he was dealing with, though. If a non-cop did something like this? Yeah, it would be agrivated assault, now wouldn't it. I see a psych eval in this cop's future.

I do not expect much depth of intellect from Sheriff Sue Rahr, so perhaps she should be relieved the interviewer did not ask how many more $10 million Matt Paul "legal" takedowns King County would be willing to tolerate before dismissing him. The fact that Matt Paul continues to wear the uniform and acts with impunity sends no clearer message by King County that his behavior is business as usual.

Sounds to me like the Sheriff's Department is positioning themselves to create a distance between themselves and "Deputy" (criminal I say) Paul once Paul eventually and expectedly kills someone. Of course this is purely precautionary on the Sheriff Dept. so when Paul does kill someone, the Dept. can say “we knew but couldn’t do anything about it, so it’s not our fault”. Huh, save yourselves and to-the-devil with the tax paying citizens, who, after all, don't deserve proper representation, protection, and respect.

I kind of see that Paul left his partner to deal with the 2 individuals at the bus shelter on his own. Not sure what the original purpose of the contact was but it was significant enough that both officers were engaged with the 2 people. He chose to pursue a j-walker leaving his partner in a 2-1 situation for the opportunity to feed his over adrenalized need for confrontation. I am sure when he suits up for work each day the first thing that comes to mind is not "protect and serve", Instead he is thinking "time to bust some heads".

Just watched the video and WOW: "Our deputy didn't break any laws..." "freak accident." NO SHERIFFS DEPARTMENT!!! WRONG! The video shows Harris basically standing there (at a stop) when he's shoulder checked hockey style into the brick wall that rendered him a vegetable. TRY DELIBERATE MANSLAUGHTER. Because that's what any regular citizen would be charged with if they wrongly identified someone they 'thought' was a criminal and did this to them. - You then see Paul move the body away from the wall, dragging the man by his arm (causing further damage to the spinal and head injuries) so that it didn't look so bad when other people showed up. Throw this guy in a cell in Monroe or Walla Walla with Birke and the gangs can take turns tag-teaming them. Almost feel bad for saying that, but COME ON PEOPLE! GET UPSET ABOUT SOMETHING! GET WORKED UP! We have become complacent, as long as something doesn't get in the way of our bike path nobody does anything.

dono - excessive force and use of force are not the same thing. The sheriff said he had a lot of uses of force, not that he had ever used excessive force. Read the department policy on use of force (included in the article). Also, while tazing might seem like a better solution, tazing a person who is fleeing, and presents no other threat, is not within the policy.

There are CIVIL ways of handling jay walkers and jay walkers who flip the bird and slamming them to the ground like a murder suspect isn't the answer. Linda Byron, who did the reporting on this, should really be ashamed of herself. She has chosen the, "this deputy is an out of control meany," approach to this story, because she knows it will appeal to a lot of people in this area. She has failed to find the true story here, which is that KCSO has not provided either defensive tactics or verbal de-escalation training to it's deputies since about 2003 (see the memo attached to the story, Oct 2009).

What is wrong with the top brass in Seattle & King Co. Police Departments? They are protecting their own officers from prosecution when they commit crimes against innocent civilians. As long as the Mayor and OUR police commanders allow cops like Matt Paul of KCP and Ian Burke of SPD to keep their jobs, avoid prosecution or get new jobs in other police departments, military or National Guard, as long as these people are free to threaten, injure and kill more civilians, no person is safe in this city. Good cops (if there are any) cannot do their jobs since our police departments have lost thier credibility with the community.

so, by the "innocent" jaywalker's own admission, he was violating the law, then decided to not only "flip off" the deputy, but to refuse a lawful command to stop. He admits he not only gave the deputy a sarcastic look, but that he kept walking and then took off running. He was not taken down for "jaywalking", that was the initial reason for him being lawfully contacted. He was taken down for refusing to obey a lawful command, being stopped for a legitimate violation he has now publicly admitted to. If he had been injured that badly, surely there would have been an actual investigation. People, all you need to do is simply comply with lawful orders, allow the officers to do their jobs, and go on with your business if you are not taken to jail. If you have issue with what the officer did, go down the next day and fill out a complaint.
