FEDERAL WAY, Wash. – Two high school seniors about to graduate were killed after a suspected drunk driver rammed into the back of their car on Interstate 5 in Tukwila Wednesday Night.

Derek King, who would have turned 18 on Thursday, died at the scene. Nicholas Hodgins, 18, died Thursday afternoon at Harborview Medical Center in Seattle.

The driver of their car, Anthony Beaver, was treated and released from the hospital Thursday.

The news is devastating to students and staff at Decatur High School in Federal Way, from where the boys were set to graduate on Saturday. A memorial sprang up Thursday at the school's marquee sign along South 320th Street.

"It's been very emotional for the school, it's been very tough," said Nelson Atkinson, 18, a close friend of the victims. "Nick and Anthony and Derek, they've been close to everyone."

Atkinson said if it wasn't for a last-minute change of plans, he may have been in the car too. He said a group of students had gone to Sky High, a trampoline recreation center in Bellevue that evening.

"Just all the seniors go down, have a fun time. Supposed to be a fun trip" Atkinson said.

The Washington State Patrol says the three students were traveling southbound in a Honda Civic at about 10:30 p.m. Their car stalled and they couldn't to make it to the shoulder. Beaver stopped the car on the freeway and turned on his emergency blinkers.

A Ford Explorer driven by Alexander Peder, 50 of Kirkland ran into the back of the Honda "with great force," say troopers.

"A couple of my friends were in the car right behind them, right behind the... car that hit them, and they had to swerve out of the way. It was just brutal."

The Highline School District confirms all three teens in the crash were enrolled in culinary courses at the Puget Sound Skills Center.  Friends say they talked about opening a restaurant someday.

"They were great at it, they made great food, funny, hilarious," said Atkinson.

"[Derek] was a hardworking kid, he never got in trouble, he was always helping out the teacher," said classmate Luisa Gallardo. "I had him for horticulture, and he was really helpful, he was a nice kid."

"[Nick] just lived life to the fullest, he just went out there, have fun, cheerful guy, class act," said Atkinson.

King and Hodgins were supposed to graduate high school on Saturday, from the culinary course next week.

"It tampers it. This is a joyous time for our kids, families and communities. These kids are great kids who were all loved in the community," said Federal Way School District spokesman Joshua Garcia.

"I'm sure the students are planning to commemorate them in some way," said Atkinson. "We're still going to have them in heart,  they're still going to be there."

Many students gathered on the lawn in front of the school to mourn the victims. They are also meeting with counselors.

"That's our worst nightmare," said parent Simone Thompson. "I'm sure these parents are waiting for their sons to come home and celebrate the fact he's getting out of high school, making college plans, life plans with their kid and this person took him."

Police arrested Alexander Peder, 50. He is facing two charges of vehicular homicide. Troopers say alcohol was a factor. KING 5 has learned Peder has a history of DUI arrests.

Why doesn't the "3 Strikes and you;'re out" apply here? Not that I am suggesting a drunk driver be allowed to kill 3 times, but this guy is as much a murderer as anyone can be! How is it possible that lobbyists of any kind would have any possible influence on ANY lawmaker regarding prison for drunk drivers? It would be manipulation of the most hideous and repulsive kind; money is more important than a life. And a reduced plea for a drink driver? Please. Isn't that like being a little bit pregnant? So one guy gets life in prison after he's caught with marijuana three times, but another can have a "history of drunk driving," kills two young men and gets 5 years? I have to say that if one of them was my son (who is almost 18), I would likely do something that would put me in prison for a long time. RIP Derek and Nicholas. I weep for you and your family and friends.

Perhaps Mr Peder's brain isn't getting enough oxygen. A few .45 cal vent-holes in his skull should solve that problem strait away.

Thanks to people like Dinosaur Rossi, DUI laws will never get stricter, meaning he will definitely drive again and more than likely drink. Why not make it, if you are caught drunk driving with no accident involved, you lose your license for a year. If you are caught a second time or involved in any kind of accident the first time, you lose your license for life, with no hope of getting it back. If you are caught driving with a DUI suspended license, automatic jail time. Sound harsh? Ask the two kids who will never experience college or adult life.

My Brother and his partner were killed in the line of duty by an ambulance chasing attorney on 9 kinds of drugs and they left 12 kids without dads and grand dads at a very young age and he only got 7 years and less for good behavior. There is no justice. If these worthless excuses for human beings were punished right the first time there wouldn't be a second ,third, fourth etc.Criminals have more rights than the victims.God Bless all the families.

This is a very sad reminder why there are special rules for teen drivers’ under the age of 18 about carrying passenger as well as a time frame. Even more of a sad reminder that a vehicle becomes a dangers weapon when a diver is under the influence or not giving full attention to their driving. I agree with the writer that said this DUI driver should sit right in front of the graduation class permitting it’s OK with all concern. This DUI driver is no longer a DUI driver, He now is a 2 time killer. I’m sure his lawyer will do everything he can to get this killer off. I just hope the lawyer remembers that he not only killed two kid’s but also has destroyed their families and loved one lives as well. May Alexander Peder NEVER rest in peace.

I hate to say it but this is all due to our justice system. As a white woman, I know from experience how easy it is to get off or get a lesser sentence than minorities for equal crimes. I have seen 3 (white) colleagues get slapped on the wrists for DUI's while the two (2) of my minority friends/associates got the maximum penalty, HANDS DOWN, NO QUESTIONS ASKED. And they both only failed the breath test by about a point. Had this guy been punished PROPERLY the FIRST time, let alone a 2nd time, then maybe these poor kids and their families would be getting ready to celebrate their graduations...but we ALL know that's just wishful thinking. And to think that I thought Alabama was screwed up. Well, RIP to these young men and condolences to the families. (DarcieCee12 using a friend's account)

Nick was my best friend from childhood. We've been friends since we were little kids growing up. He was always a better student and better person in general than me. I would have never expected in a million years that anything like this would or could happen to him. He stayed out of trouble and didn't cause problems. ...And now because of the irresponsibility of some idiot, and the lack of strict DUI punishments from the state, Nick and Derek are gone forever. Alex Peder and HIS family should be ashamed. He is a poor excuse for a human being. He is a MURDERER. One drunk idiot effects the life of 100s of people, and ends the life of 2 people that deserve to live. The saddest thing about this is that justice may not be served. He's facing a maximum sentence of 3 years for each count. That's a MAX 6 years for both MURDERS. He shouldn't just be executed, he should be publicly beaten because his actions has tortured the public with his inexcusable incompetence.

This is so incredibly sad, yet so horribly real. We are from Salem, but two co-workers of mine were on that freeway last night, and were in the lane just left of the car about two seconds before the SOB rammed it. John still has pieces of glass in the back of his truck from the impact. He noticed an SUV coming up very quickly behind him in that lane and that the boys' car was stalled with its flashers on. All the other cars in that lane had moved over (around the stalled car) and apparently that was enough to make the drunk driver gun it. He never even tried to stop. Why are people so afraid of guns and terrorists and plots when our own families are in danger every time they get into a car? Our own homegrown drunk drivers kill thousands a year, but nothing is done until life is lost. I didn't mean to, they all say. Yes, you DID MEAN TO when you got behind the wheel drunk! My sympathy and prayers for the families and friends...

I think that since the state failed to lock this guy away after his second DUI the state should pay for all medical cost, funeral cost and for the child who did live through this accident all of his future medical cost and pay for all of his college. Since the state failed to protect the public.

I do not know the boys who lost their lives, but I can't believe they would turn off their car in the middle of the freeway to goof around!!! The car stalled, and they couldn't pull over. They turned on their 4 way flashers, I do not think this was the boys playing around. I think it is a case of a drunk driver not payting attention while driving his car. He has 2 DUI's already, and they slapped his hands. Now, many friends and family have only memories of some great boys who had just started their lives, because this person decided to drink and drive! I believe the news said something about the maximun sentence for the DRUNK would be 3 years on each count. WOW!! 6 years or less for ending 2 young boys lives and how many more years of heartache for the families left behind. To the students left behind, Please remember, Don't drink and drive!!! Don't add this heartache to your families. To the DRUNK, I hope this haunts you the rest of your days. I hope your alcohol was worth it.

It impacting every aspect of my life and I continue to live with the consequences of that horrifying night. Please stay strong and try not to let this "define" your future and that of your friends. It isn't much comfort to those left behind but they are at peace now leaving everyone that cared about them to somehow find a way to live without them. To the families of these young men and all the kids at Decatur High.. I am SO sorry for your loss. This is beyond horrible and I truly understand your devastation because the same thing happened to my senior class in 1987 and it still haunts me now. For all the heartless $sses that are debating whether it was the kids fault or not.. please reread "alcohol was a contributing factor" regarding the jerk that hit them. He is at fault..not these boys.. I am sure the fact that their car was stalled ON THE HIGHWAY.. which has happened to me before also.. so it can't be that rare.. was totally frightening for these kids. They didn't choose for their car to stall but that b*stard certainly chose to drink and drive. I hope they throw him UNDER the jail.. or better yet he just offs himself and saves us the money and time.. he has used up his chances in this life.

Is anyone going to investigate if the kids were screwing around? In my 20 years of driving I have never seen a vehicle not be able to pull off to the side of a road when it broke down. When I was a teenager I had a friend with a Honda Civic that thought it was funny to take the keys out while he was driving. Car usually kept running. One time he did it and the car turned off while he was going over 50 mph. Luckily we leaved out in the desert and when his steering wheel locked up and his brakes gave out, all he did was go off into the sand. I think everyone can agree that most new drivers don't have the discipline and experience that it takes to be a truly safe driver. If the guy that hit them was drinking, he should be punished to the fullest extent that the law allows,... and then some.

But, to equally fair and honest...there have been times that I have driven up very close to a car that's stopped...that did not look stopped from a distance. Some taillights do not shine brightly UNLESS the brake lights are the ones shining, and Flashers should be a bright as headlights: not little tiny things that say "Excuse me"...but bright honkers that say "Watch the F@*# out!" Experience is probably the best equipment a driver can have...and I think the boys didn't have enough experience to know to pull farther off the road...shouldn'a had to die for it though. Very sorry for those parents. And sad for the loss of those two young men.

Being the parent of 3 boys, each of whom when they reached the 18-20's age, drove everywhere...I became especially sensitive to drunk drivers who could potentially hurt or kill one of my sons, and even more critical of those bars and nightclubs who continued to serve customers who were obviously drunk. You can't stop all drivers from drinking...and you can't stop all young people from driving. But you can prosecute the hell out of drunk drivers who kill! AND the last place that served them!

A sad story we've encountered too often. When unexpectedly slowing or stopping in a lane of traffic -- due to some event ahead or a malfunction of your own vehicle, get your emergency flashers on immediately -- even if only slowing unexpectedly. While this likely wouldn't have prevented this collision, if it had caused the following driver ( however impaired he may have been) to get on the brakes for even a fraction of a second, it might have made the accident survivable. Brake lights alone won't get attention the same way brake lights and flashing lights will. My sincere sympathies to the (now 2) families suffering this cruel loss -- let's hope the third passenger makes it.

DUI laws don't deter people, nor do they stop people from re-offending. The fact is, people who get a DUI have driven under the influence 100 or more times before getting caught, and 30% of them drive 100 more times before getting caught again; Most people never get caught. I think a solution is to have a 2 drink limit at any place that serves alcohol, though, a lot of places would go out of business... But oh well.

I can't believe some of these comments. The FACTS are that someone drove drunk and killed a young man. We know this because they arrested him for it and said alcohol was a factor after their investigation. This obviously isn't going to be a lesson to anyone because the people that drive drunk are still going to drive drunk and the smart, responsible people that don't, won't. We need harsher punishment. I am sick of hearing about people's past records AFTER they kill someone. The court system needs to get a clue and get with a better program.

wow, lots of entertaining comments...kbbcoop, i suppose they can prosecute with a clear conscious because although they sell the booze in their liquor stores, our drinking age is 21, and it's that way for a reason, so that more mature, responsible adults make more mature, responsible decisions. Are you going to blame the gun store for one of their guns being used in a homicide? Thousands of people every day in our state go out and buy booze and DON'T cause mayhem, destruction, and death. Clear2copy, look, I agree that it's unforgivable to drink, drive, crash, and kill, and I think that anyone who does should face Vehicular Homicide charges, as well as DUI, and Reckless Driving. But making all DUI's felonies is a bit heavy-handed. Our DUI laws are amongst the strictest and most expensive in the country. And for most people who get a DUI, one is enough to keep them from repeating that mistake. But someone with 3, 4, or 5? Yeah they deserve felony DUI prosecutions, and most of them get it

wow tac, what a load of bs..."why is it we all came to the conclusion the truck driver was at fault?"...uh..gee..BECAUSE HE REAR ENDED THE HONDA! How many rear ending accidents aren't the fault of the guy behind? Not many. And why is it that the other 12 people that died aren't being mentioned? Well, sadly, accidents happen...nothing newsworthy of that, and other than it being especially tragic that the death in this case was a 17 year old boy, had the at-fault driver not been drunk, this story may or may not have been mentioned. But this isn't your run of the mill accident, this is an accident caused by a drunk driver, and getting this message out there that driving drunk is stupid, reckless, and potentially fatal is important...what exactly is your agenda? Defending drunk drivers? Please...

tacwilster, I didn't assume the driver of the SUV was drunk. My comment said that "if" he was drunk, then he should be locked up for life. The point is that he was at fault regardless of whether he was drunk or not, he rearended the kid's car, period!!!

Okay and yesterday 12 other people died in this state from accidents, but it didn't make the news, WHY? and we don't know the facts, maybe the kids were also celebrating graduation! Why is it we all came to the conclusion the truck driver was at fault? We don't know all the facts and any time the news says suspected drunk driver, we assume he was!! It is sad that this kid died in an accident and it is sad that the other 12 people that died in traffic accidents in our state yesterday were not mentioned in the news!

Enough with the debate about drunk drivers, speeders and making it a felony. The real tragedy is a 17 year old kid has lost his life due to someone elses incompetence. Cut down before his 18th birthday, before he had a chance to make his own future. All the things that everyone has said has merit, but everyone please keep the families of these kids in their prayers. We all agree that laws need to be changed to try and prevent these types of tragedies. Prayers and thoughts to the families

You may be correct tacwilster, but the ones the media want us to see are the drunk drivers. There are many dangerous drivers on our roads. I believe that we need to take it one group at a time. We can not conquer all no matter how bad we want to. God bless him and his friends and my prayers are for their families.

Don't forget the case of the fireman that killed the motorcyclist, in tacoma and got away with it, because he was a firefighter!! People think drunk drivers are the only ones to get in accidents and kill someone? come on people there are more speeders, lane changers, texters, phone callers on our roads that cause more accidents than drunk drivers but we just don't have a MADD organization out there yet. Get your facts straight and see what causes more deaths and injuries on the road! it's not drunk drivers!!

clear2copy, hopefully then they will make texting or talking on your cell phone a felony also, oh wait what about speeding, kills and injures just as many people as those who drive after a few drinks. Do you obey the speed limit laws!! Make them all felonies so we can fill up the jails because they just let out all the rapist and murders!

how can the state prosecute with a clear conscience when they are in the booze business? another reason why it needs to be privatized.

I agree clear2copy, except I believe that we should take it further when someone is killed in a DUI and call it premeditated murder.

Another call for making DUI a FELONY.. another life lost to a self-centered, worthless drunk... and another drunk that will get of far too easy as this state coddles it's worthless drunks. I hope this scumbag dies a horrible death

Let's not forget about the guy who got 45 days for killing two motorists in two different cars, while drunk & high, going the wrong way on I-5.

Hard to drop the hammer on the DUI's when our own Supreme Court Justice Bobbe Bridge did the same thing, claiming she only had a couple glasses of wine..she remained on the bench. Incredible. So sorry to the family for this unspeakable loss.

brucelee, what difference does it make what time it was? My heart goes out to the family and friends of this young man. I hope his other passengers recover fully. And that the driver of the SUV, if it is determined that he was under the influence, spends the rest of his life behind bars, as should all drunk drivers who kill someone.

1 DUI, permanent suspension of your license. Period. And that is for the DUI, if you harm someone during that 1st DUI offense, 10 years in prison AND a perm suspension. If you kill someone, 1st degree murder because you knew that you should not drink and drive and you did it anyway and it cost an innocent person their life. You should have to think about that the rest of your miserable days. hk

almost leads me to believe car manufactures need to find a way of implementing some kind of key or finger pad that can record someones alcohol levels before starting a vehicle.

Drunk drivers should be charged with premeditated murder. They know what they are doing when they choose to drink and drive.

How devastatingly sad. The poor kid was just about to start his life, and the drunk driver took it away from home. It's so heartbreaking. RIP, Derek.
