PORT ORCHARD, Wash. - A 72-year-old man has been arrested for a fatal shooting near Port Orchard.

Police say he shot a younger man at the South Park Greens Apartment Complex around 3:30 a.m. Saturday.

The 72-year-old said he woke up and found somebody in his living room. He said he armed himself with a handgun and left his bedroom to investigate. He reported that he confronted a young adult male, unknown to him, in the living room. The man stated that a struggle followed where the intruder was pushed out of the apartment's front door and ran away.

The resident said that he fired several shots in the direction of the fleeing intruder.

Police later found the shooting victim dead outside the building.

How do you even know he went in his home for sure? There was no sign of forced entry and he was shot outside. And like I said he shot him when he was outside his home, like an animal! The man is only facing around 24 months for murdering someone for no reason!

No excuse for going into someones home uninvited at 3AM drunk, stupid or what ever, there is no excuse for his actions period, own up to what you do as you are responsible for your actions and he in this case paid for his stupidity with his life. As to the 72 year old man I feel for him and what he has and is having to deal with. We do not have enough evidence to really consider if he was justified or not in the shooting. The evidence I am talking about where exactly was he shot at the door way, 3 feet out 20 ft maybe and so on, it would add to what really occurred. I know this scenario scares a lot of his friends as they meet the same faith if they continue his work! Birds of a Feather Flock Together I also agree stop commending the 72 year old man until you know what happen! traciemarie wrote "was a very well manured person" so he was covered in manure?

You guys are horrible. Don't you realize this was an innocent man's life that was taken by someone that obviously should have never owned a gun in the first place, and I pray to God that he won't ever be able to own one again!

For the old guy who shot the intruder, please don't forget to tell your attorney that you remember him saying he was running to get his gun. To those who knew this young intruder and only saw the best in him, please give him the nice burial he deserves. Bottom line, drunk, mal-intent, or both, you go in to someone else's home uninvited, they will kill you and rightfully so.

I know the person who was shot and killed, he was my cousins roomate. He just had his first child a few months ago and was a very well manured person. Maybe he was drunk and stumbled into the wrong home, he did live in the same duplex area. And why would you shoot someone when they're running away from your home? It's unjust, inhumane, and against the law! This man can not win in court, he took someone's life for no justified reason.

Well it appears the old boy blew it. It was reported that he shot toward the ground in hopes to stop him. Deadly force is only to protect your life or the life of another at that moment in time, has nothing to do with trying to stop someone running off or to scare them.

firstcreekwalker there is no law requiring the prosecutor to file charges, if you feel there is find it and quote it here with a link. A claim of Self Defense requires the Prosecutor to prove beyond a reasonable doubt that he did not act in Self Defense, it is no longer an issue that he shot someone and they died as the defender admits he shot the intruder but did so in Self Defense. It is clear that Kitsap County is not in support of the citizens right to self defense when someone breaks into your home at 3 am while an elderly man is sleeping and had to be forced out and shot in the process and then be charged for protecting himself, disgraceful!

Under the law the prosucuter must charge the man for shooting him in the back outside of his home. BUT, if the prosecuter does not cut this 72yr. old guy a super great deal under the circumstances be sure to vote against him in the next election. The prosecutor has wide discretion and if he does not use it in everyone's best interest you need to vote him out.

This is outrageous, this elderly man being charged for protecting himself in the middle of the night. We need to take into account the circumstances as to it being at 3am, his own broken into, a struggle, a young strong male vs a 72 year old man. One fleeing from a crime may well not be fleeing and would be unknown to you at that point in time, they could have very well been going for weapon to return. It is what we know at that moment in time. Port Orchard Police Department and Prosecutors, you need to wake up and accept the fact that you cannot be there in the time of need and citizens have the right to defend themselves, get off your high horses and read and understand the law and abide by it. How did it even get to the prosecutor, are the Officers there that stupid? This thief was still a present threat until he was out of the area. part 1 of 2

@carlconstantine... yep cause your possessions are worth more than a human life. You must have some pretty valuable stuff. Last I checked it was illegal to shoot someone in the back that's running away. Enjoy the last few years of your life in jail.
