Criminally insane fugitive living in Skagit County

MOUNT VERNON, Wash. - Raymond Barter spends his afternoons roaming the streets of downtown Mount Vernon. We found him in front of the public library and asked him what he's doing for Christmas.

"I'm trying to go back home to Sicily," said Barter.

Barter believes he someone else; a member of the Sicilian Royal Family with money here in the U.S. In truth, Barter is a fugitive from Tampa, Fla.

He came to the attention of police here, when he they found him at a Mount Vernon grocery store harassing customers. When officers ran his record, they discovered he'd been found not guilty by reason of insanity on charges of attempted arson and attempted murder in Florida.

A judge there ordered Barter released on the condition he undergo mental health treatment.

"I think he was supposed to be living in a halfway house or some facility and he walked away." said Skagit County Prosecutor Rich Weyrich. "And all the sudden, he ended up in Mount Vernon."

When authorities in Florida got word, they sent off a warrant for Barter's arrest and asked he be held without bond until he could be extradited.

There was a problem - something called the "Uniform Act for the Extradition of Persons of Unsound Mind". It allows mentally ill people who flee treatment, as in this case, to be extradited. Trouble is, neither Washington nor Florida has adopted the legislation.

Barter was let out of jail.

"It's very dangerous and I do fear for the citizens here." said Rep. Kirk Pearson, R-Sedro-Woolley.

Pearson says his first order of business when the legislature reconvenes is to close this loophole and send Raymond Barter home.

"If Florida wants this person," said Pearson, "we should have the ability to extradite him to Florida."

This guy was interviewed and filmed one block from Compass Health, a Regional Service Network (RSN) mental health service provider. Regardless of his past, in Florida he was not convicted for the crime of murder. In Washington, if he is not currently at risk of harm to self or others, he cannot be hospitalized involuntarily. Nor does he have to engage in any mental health services and can refuse any medications. There is no law that forbids him from believing he is a member of the Sicilian Royal Family and currently he seems to not be presenting as a "Risk of Harm" to others. As a mental health professional working on the Intensive Outpatient Program (IOP), I am very accustomed to this procedure. The laws dictate that he has to say that he intends to hurt someone or himself before action can be taken. The most troubling concern is the waiting to see what he does next. Will some incident in the community cause him to act violently? Will he tell someone before he acts?

After reading the article my first question is why doesn't Washington have an "Uniform Act for the Extradition of Persons of Unsound Mind"? Do they not like the one year staute of limitations in the law? I agree with the prosecutor that the case is not extraditable, although the article does not say if the statute of limitations applies (although WA State has not agreed to abide by the Uniform Act anyway!). Another possible reason for not prosecuting extradition is the case of treatment could be moot on grounds similar to Sells vs U.S. establishing that invasive treatment is unconstitutional anyway (claim of seisin royalty fictitious). The oral claim of "seis silly and royalty" ( sic Sicilian royalty) may or may not be true, but at any rate if he has an entitlement, or claimed ethnic background it is not grounds for incarceration!

Raymond Barter should get a good lawyer and sue the pants off of King 5 news for defamation of character and making false statements. Unless I hear the guy say himself what he thinks and believes and wants to do, there is no legal basis or right for anyone to say "Raymond thinks this and Raymond wants this.....etc...." Now, the self-fullfilling prophecies imposed by this news station upon Raymond B. will be guaranteed to have a negative outcome. Let people speak for themselves and make their own decisions, don't superimpose or overlay your own script or story on them and claim to know their future thoughs and actions.

I stronngly doubt that King 5 had any real conscientious searching of the facts about Raymond before framing him as someone he's not. We don't know if he might actually have family in Sicily, there may be a germ of truth that is distorted or twisted by the courts and news media. If he's not guilty of anything, he's not a fugitive. Mental heatlh doctors and treatment deliberately inflict damage on patients anyway to discredit their testimony.

Judges need to follow the law. Don't blame the Judge for letting this guy loose. Don't toss all the blame to "liberals" either. These laws have been on the books (or nor adopted, in this case) through the whole range of political control. There's plenty of blame to go around in all corners. Hope this guy gets off the street and back under proper supervision fast.

Liberal politicians like Mike Huckabee, Right? Seriously... Having experience with trying to commit a mentally ill relative who was suicidal, involuntary commitment laws in this state need a BIG overhaul. Luckily we as a family were able to slow her down(we removed the firing pins from her weapons and watched her like a hawk) but we were given no help from authorities.

He should be given a place to stay in the Capitol Building in Olympia until the geniuses there can get around to dealing with this guy. When they run into him in the hallways it can be a reminder to them of the types of issues they should be working on. But then again we should remember that they are real busy putting together laws that none of us want.

Yeah, wait till he gets real paranoid and thinks you, me or anyone is out to get him, will another policeman or woman or civilian have to pay the price for our lawmakers who are guilty by reason of stupidity and seem to believe that it is okay for the likes of this individual to walk the streets. This is close to what happened at Eastern State Hospital but this patient made it to Washington state from Florida, oh I'm sorry, it wasn't an outing that this guy escaped from, it was a judge who released the individual. If the state of Florida has laws anything like Washington, this individual violated his discharge criteria and should be returned for that reason alone. Again, 200 years of making laws and still haven't got it right yet. How long will it take??How many lives need to be wasted till it is done and done right?

Common sense trumped once again to the detriment of society. There was a time when law enforcement, in the interest of the common good, would have found a reason to hold him - now due to the avarice of law suit happy lawyers and misguided liberal do-gooders a known dangerous criminal is literally allowed to roam the streets. A society afraid to protect itself is a society doomed. Btw, it's all fine and good to angrily mouth off here as I have but much better to look up your representative at: apps.leg.wa.gov/DistrictFinder/ and shout at them also, where it hopefully might actually do some good.

So, the bottom line here is that he has hurt someone first and then they can do something with him???? How about the fact that he's violated his parole by not checking in with the mental health facility and he left the State of Florida without permission???????

Hopefully the politicians will act quickly, before this guy is in the news for some tragic event. "reklessone" has the general idea, law enforcement can't be everywhere. What are you going to do to protect yourself "tracer2009"? Reason with the criminal, talk him to death, get him the help you think he needs? Good luck with that. Merry Christmas.

Ran into him yesterday, very scary person I got my son away from him as fast as I could .If he wants to be in sicily so bad I will donate some money to get him there

Thanks for reporting on this. Mentally ill persons certainly need to be treated with dignity -- but that doesn't mean we let them run their own lives when they've shown they're not capable of it. Why on earth have laws gotten so protective of criminal rights that they can no longer protect the citizens of a community?!

The one who should be tested for mental illness is the judge that let this guy out on the street! How many more tragedies do we and the cops have to endure before they wise up? Recklesone has the right idea. When seconds count, the police are only minutes away!

Whatever happened to common sense? When the law becomes so over complicated that it no longer protects the public, it needs an over hall. When worry about technicality supersedes public safety, change is needed.
