Chase apologizes to customer for wrongful arrest

AUBURN, Wash. – Chase Bank has issued an apology for having a customer arrested for trying to cash a Chase cashier’s check at a bank branch in Auburn.

Ikenna Njoku, 28, was accused of forging the check which had been mailed to him by Chase. The customer banker who handles large checks for the Chase branch told KING 5 the check looked fake, so she called police. Njoku was arrested and taken to jail June 24, 2010.

The next day, Chase Special Investigations realized there had been a mistake and the check was legitimate. According to the police report, the investigator left a voice mail for a detective, but it was her day off, so no one heard the message until the following Monday.
Njoku spent five days and four nights in jail before being released.
"This is a very unfortunate and unusual situation," wrote Darcy Donahoe-Wilmot of Chase Public Relations. "We apologize to Mr. Njoku and deeply regret what happened to him. We are working quickly to understand all the details so we can reach a fair resolution.

CHASE SUCKS! They are a virus! Stay clear of Chase bank. Chase buying up Washington Mutual was planned from the get go, it was a contrived occurrence! Use smaller banks and stay away from CHASE, BANK OF AMERICA, CITI, and KEY BANK. They are not working for your best interests, only their own!

The article should have said "his FORMER bank". I certainly would not stay with a bank that treated me like that! Credit Unions are much more customer friendly, AND they offer higher interest on savings accts and CD's. He should be a very rich man indeed when the lawyers finish taking Chase to the woodshed!

He should thank Chase, for making him a rich man. He has a cause of action for: False Arrest, Defamation of Character.The loss of his job and vehicle will also be calculated in the claim. He's due no less than 5 million dollars.

Chase has a lot of problems and procedures that need to be corrected. We sold out house and Chase was to send us the balance of our reserve account. It took almost two months and a lot of frustrating phone calls to finally get the check. We even had their customer service rep hang up on us because he didn't want to answer the question of when we could expect the check. After that experience and then immediately finding out that they planned on charging us interest on the current charges on a credit card on which we had paid the entire balance off the previous month and arguing with them about that, we cancelled everything with Chase and will never do business with them again. We have taken our business to BECU and we're glad to be away from a company that doesn't care about their customers or allows their customer service reps to hang up because they don't want to answer questions.

I too hate chase. Not only do they deduct $12 a month out of your account, but when i went there last week to get change for my workplace, they asked me for my fricken ID! WTF? ID for change? when i questioned it, they said its to keep track of whos getting how much change. and now this story of how they ruined a mans life with thier attitudes. I had no problems when it was Wamu. I told them to forget it and to close my account right then and there. Going to BECU. Chase has gotten out of hand.

A FAIR RESOLUTION???? WTFE!!!! A FAIR RESOLUTION would be AT THE VERY LEAST, 1. for the dumb B***H that called the police to lose her job, car, and dignity and be sued in civil court for untold amounts of money 2. for Chase to pay any and ALL of the costs to purchase Mr. Njoku a BRAND NEW vehicle of his choice-be it a Hummer, Maserati, Diesel Pusher, Lear Jet, WHATEVER THIS MAN DESIRES! 3. for Chase to pay triple the wages this man would have received for the time on the job he would have put in AS WELL AS the wages this man will lose in the future until he is gainfully employed in a comparable paying job. If he never works again, I wouldn't blame him! Shame on Chase!!! 4. for Chase to pay a few MILLION for the emotional suffering this man has had to endure. Our condolences go out to this gentleman. We ourselves our going through an ordeal with Chase bank. October of 2010, our mothers account was tapped for $4500.00. Chase couldn't bother to notify us anything was happening. Instead transferred the money out of savings to cover the ATM withdrawls. Police report was filed, as well as a complaint to Chase Bank. Their reply was it wasn't their problem. We would love to have the attorneys name in Auburn that is covering this case. Maybe we can file a class action lawsuit against Chase

I have been in the Customer Service Industry for most of my adult life, I worked with one company for 10 yrs and trained representitives and handled Executive Complaints. Number one rule, without customers you do not have a business, number two, you are supposed to look for ways to help the customer not disprove or deny! The biggest problem everyone is forced to deal with is the fact companies do not communicate internally, there are muliple systems not everyone is trained to use older systems/programs or to go to a second level or higher support person to help investigate the issue and provide a fact based resolution. Chase is so at fault in every way because they would rather deny a customer who had an account regardless if it was closed or not the system should show the dispersment, instead they worked to keep his money vs spending a few dollars on training and internal support. They failed this customer, they failed their employees and their stockholders.

So, how did he lose his car? They hold the cars that are impounded for 30 days prior to auction. He had the $8K check back within 2 weeks by his own admission. Why did he not go get it? It couldn't have anything to do with his criminal history could it?

They said: "they are willing to come to a fair resolution". If I was a jury deciding this case; I would have no problem coming to the conclusion that 1 million per night x 5 nights was a fair resolution. Google " Brandon Mayfield" - Brandon wrongly spent 15 days in jail and received 1 million per night that he was incarcerated.... Don't settle this case for anything less than 4 million -- And if you go to court ask the jury for 10 million!!! Good Luck!

The Auburn police should share as much blame as Chase. I find it hard to believe that anyone should have their personal assets auctioned off before any trial or proof of wrong doing has been proven in court. I find it very hard to think that this is even legal. I am very curious if anyone connected to this fiasco got the car at auction?

If we, the general public wanted to assist in punishing corporate banking farce that Chase is, we need to make more of the public aware of their treatment of their own customers. So I emailed this and posted it to my fbook page. Something I don't normally do, but this story made me sick. I have not used a bank in over 15 years. In fact I use two credit unions. No issues at all. Corporate banks are not part of the solution for the financial issues our country faces. They are part of the reason behind it though...

Yup. The actual damages alone are at least $100k: a car, a job, and some jail time falsely served plus a YEAR of trying to get them to listen? Okay, $100k might even be too low. This poor guy was seriously, seriously wronged. I can't imagine why there would have been any problem with such an ordinary transaction as cashing a check, with two IDs, in his own name, at the very institution that issued the check... at the branch into which the money had been deposited... Yet they were so sure he was guilty, they jailed him on the spot, on suspicion alone, without any proof of any kind. Hats off to Mr. Njoku and his attorneys for being gracious enough to refrain from stating the obvious, and letting the bank tellers' egregious conduct be explained away by negligence or incompetence rather than bringing up the obvious, ugly reality. "You just bought a house in Auburn, really?" Right, she's not racist at all. No siree bob, not-at-all.

I hope this man gets $100,000 at least for false imprisonment, wrongful arrest, defamation, infliction of emotional distress, etc. I've never had a good experience with Chase. There just seems to be an in your face doing you a favor arrogance and predation.

Similar Happened to me !! I Can't Believe Chase Bank OMG! This Chase Bank Story is about Earl Harris Being literally Chased by Chase Bank Employees. Source: ChasedbyChase.com In Short, Mr. Harris was instructed by Corp to Withdraw Funds and start another account with JP Morgan Chase Bank in Chino Valley, Arizona. Upon being Denied by the Vice President Branch Manager (Kathy Welsh). Earl Harris left and went to Prescott,Arizona to complete the Transaction. Shortly after Mr. Harris was chased by 6 Chase Bank Employees into WellsFargo with 30 People Dropping to the Floor "Screams" everywhere. Chase yelling "He just Robbed our Bank" and Mr. Harris being Tackled to the Ground. As the Story continues Mr. Harris is Chased for 2 miles by a Truck, filled with Chase Bank Employees Tracking Him Down. A year to respond is not acceptable. A young, hard working person's life is in ruins. Probably because of his color. That is how I read this. (White trash here) It's like the bank took great joy in having his car impounded. Oooo! It was taking up so much space!!! No other parking available. For Chase not to make sure that he was released the very minute they found out thier mistake? High neglegence!! To let him squander for days? And lose his job? And his car? Unacceptible!! To ignore things for a year, until it was publicized? So wrong, in so many ways. Do not bank with banks,unless they are local. Not too many of them around anymore. Credit Unions are pretty good. Better than money in your mattress. I quit banking with Wamu when it was eaten up by Chase. I was given attitude for closing my account, by a smooth talking adman(woman). The tone was, I was supposed to feel badly for leaving the 'family' like this.. Bull feathers.

I think we should systematically boycott all Chase products (including credit cards) and close accounts. I am carrying a copy of this article to my chase bankers and indicating I will do this. If Chase employees don't even know what their own cashiers checks look like, and can't distinguish real from fake, I wonder how many fake ones have gotten through? The "customer banker" should be fired. Chase should have to pay him back double what the check was worth, 5 days wages for him having to sit in jail, and pay for having lost his job for not showing up to work while he was in jail because of them. Once they settle this debacle, Chase should have to pay back EVERY shareholder that lost money because of them, with interest, pay back the government for their big bailouts, pay back all those they have illegally foreclosed on - then go out of business on the grounds they are too stupid (yet wiley) to be allowed to continue to do business that costs the taxpayers for their stupidity! I laughed at the poor girl at Chase inside of Fred Meyer giving away pencils and chip clips trying to get people to open an account with them. Give me the credit union.

THis is astounding. The employee who started this firestorm needs to be seriously re-trained. The man is a customer and account holder, how truely difficult do you suppose it would have been for her and the manager to verify that checks authenticity prior to involving law enforcement. And the check is deemed a "fake" because is looked like a fake to this same employee. Very poor business processes used all the way around.

Please remember that if so called "Tort Reform" is enacted, this is precisely the type of situation where corporations will be protected from lawsuits by the rabble. Corporations want to limit liability as much as possible. In this case Mr. Njoku would have no choice but to accept what happened to him quietly. Limiting him to "actual damages" may sound reasonable, but it would prevent any lawyer from taking his case on contingency. The meager settlement would also prevent Chase from changing their policies.

I hope this poor man successfully sues Chase bank into the ground. What a horrid example of racism, I can't imagine some bank clerk being suspicious of a white guy who tries to deposit a check for a house payment! Another comment stated that the Chase staff needed sensitivity training. I disagree - they should be fired, and the bank should ensure that racism is never tolerated among staff or in dealings with customers. I agree with another comment, recommending credit unions, which truly serve the member/owners. That's been my choice for 30 years. My credit union proudly offers services in many languages, and would never tolerate such appalling treatment of customers.

@lin1945, I agree. If Chase lose or settle this suit with Njoku he should demand to get it in CASH! If Chase cuts him a check...well, we heard how good the checks are from Chase, Njoku could end up getting arrested again for trying to cash it. I hope he takes Chase to the cleaners. After realizing their mistake, they leave a voicemail message at the police department, and there he sat for 5 days. They better just give him the keys to the bank, and a nice big fat deposit to his account, which I hope he has elsewhere. I would say the fee for unlawful imprisonment starts at $5 million.

All I can say, is BOYCOTT Chase, move to your local credit union, BECU is a good one. The only way they will hurt is by the consumer moving their money out of the box banks. This was so unjust-but not surprised onsidering how Chase handled homes from 2007 till now-their begging for customers, by their ads telling how wonderful they are to the community. This poor man, my heart goes for Mr. Kjoku, I can only say lawsuit: your dignity, character, reputation, credit, and the whole moral character- a good man done wrong. The person at Chase still has their job no doubt. People, move your money.

OMG, I can't even believe that Chase did such a horrible thing to this man. Sometimes people get sue-happy, but this time Chase deserves to be sued. I hope he wins! I also had a bad experience with Chase. I had an $181 balance on my credit card and they charged me a $36 late fee because I was one day late in sending my payment via e-banking. I called them, spoke to a rude female employee and asked her remove the charge as I have never been late before. She rudely refused, so I asked to speak with a supervisor. She refused my request, telling me that the supervisor would tell me the same information so I canceled my credit card right on the spot. Now, I get daily offers for Chase credit card but I will never ever do business with them again!

This Man was so wronged. I feel the gal who asked to have him arrested after finding out she was wrong.......should have taken more of a role to free this innocent man from jail. No one cared, and the poor guy spent enough time imprisoned to lose his job! This is so wrong. I am so sad this honest guy suffered. I so hope the bank does something to correct this horrible thing.

On this story and the first one there are pages and pages of comments from people who have closed Chase accounts after their own bad experiences. Watch out Chase. We know you hijacked WAMU with the help of the Feds, and we don't like you here in Washington. Chase owes a whole lot of apologies.

Any Chase employee associated with this 'mistake' needs some Sensitivity Training. I'm thinking a five-day program in the same cell(s) that this guy spent his weekend in would make each of them just a bit more 'sensitive' the next time they're presented with a similar situation.

I think Chase owes this man a lot more than an apology! He lost his job, his car, and had to spend a weekend in jail for something he did not do! I would suggest that at the very least Chase owes him an equivalent car, money to offset his lost wages, and compensation for the humiliation and embarrasment of having to be in jail!

OMG, I hope he sues the heck out of Chase. They are such jerks. I closed my account with them after they started charging fee's right and left. that and their way of handling overdrafts. If you accidently overdraft, they will pay the largest one first regardless of when it happened so they can hit you with a bunch of overdraft fee's from several smaller charges. Sheesh.

When I saw this report last night, I was saddened. I hope somehow, some way, Chase can try to help this man. Perhaps a new vehicle would be a start. I would support any lawsuit he filed against Chase. He was treated so wrong. Why did it take a year for this story to surface?

What happened to this man is wrong. Im sure that everyone knows that he was jailed, his car was towed, lost his job, and could have lost his house.... Starters, sue the bank for their mistakes and have the bank rep make a presentation about fraud and profiling and then fire them. As long as we are firing, fire their supervisor, and fire another supervisor. Let those three find jobs in these tough times. Doubt that they will get UI cause they were fired because they didnt do their j-o-b-s. The bank realized the mistake. Well, have your offices all make sure they have a 24/7 phone number at the police dept where you speak to someone. The bank should pay for his house because they banks are always nice to deal with. Offfer this man a supervisors job, oh maybe one thta got fired. This man gives better customer service than he got. Did I say SUE the bank? Yes, make sure you sue the bank for discrimination, and to show them discrimination is against the law.

Sunny, sitting in jail for 5 days in NOTHING. It's a minor inconvenience. What about people who have been wrongly convicted and spent 20 years in prison? Since you only get one crack at life, 20 years is quite the chunk of years. 5 days? Give him $5,000, make a deal to not sue the bank and get on with your pathetic life. It's laughable to say it's not compensable, it sure is.

Makes me wonder if the teller just figured the check was forged because this gentleman in black and has a foreign name. Stupid, stupid, stupid. Where was this tellers supervisor? I hope he sue's Chase for millions. The pain and suffering is beyond compensationable if you ask me. I will forever remember this and will forever stay away from Chase.

It really irritates me that things like this happen. It isn't helped that tow yards can sell off cars so quickly either. I had my car stolen from a tow yard, picked up by another and sold out from under me before I could even come in and get it! That is how they found out it was stolen, they went out into the yard to get it for me. Having bank checks denied and checks written on their bank denied or having to pay fees is ridiculous. Walking into a bank that isn't close to your home, say Seattle to Southcenter and walking into a bank to cash a check you forgot to cash-and being treated like a criminal? Really? And now this poor man.. it's not right. He should get compensated as far as the law will allow.

What Chase has done to Ikenna Njoku is beyond comprehension. It is pretty hard to compensate when you have had his arrested, he lost his beloved vehicle, his job, his reputation, his sense of security . . . well done investigation but I await Chase's final response and hopefully, substantial restitution. I cannot imagine what this young man is feeling. It is wrong on every level. He had good enough credit to buy his house and then Chase works overtime to destroy it. Shame on Chase. This story broke my heart. It is hugely tragic how often in these days individuals are stomped on by huge, impersonal, multinational, capitalistic corporations. I don't even blame the employees too often as even they are treated poorly by these same corporations! I agree that everyone, I mean, everyone must find a nonprofit credit union for their banking business. Get out from under the capitalists. If a credit card company has the "balls" to send you a note, letting you know that they will charge you 30% interest if you miss a payment - Get out! Get away from the criminals who believe that is reasonable business! Don't let the garbage put out by credit agencies that closing an account hurts your rating. What do you care when they treat people like this! Credit Unions are somewhat better. They have credit cards, too. Leave Chase and all the BIG BANKS in the dust. They do not deserve our business.

i think they are only apologizing because they are being shamed in public. all it would have taken is one phone call in the beginning to confirm THEIR check was legit. they owe him bigtime and i'm sure there will be lawyers and judges to see that they pay up

Wow! So glad we do not bank or deal with Chase. We were thinking of changing our credit card to Chase to receive air miles, but definitely not now! Scary, and I feel so sad for Ikenna. What a traumatic experience for him.

"understand all the details"? What's to understand? You screwed up and sent an innocent man to jail for nearly a week for trying to cash a check you sent him. The cashier was incompetent and a) can't even recognize their own company's check, and b) instead of calling to verify the check, just assumed it was fraud and called the cops. Something about that seems fishy. A halfway decent lawyer can turn this into a real windfall. Especially if the clerk is white. Racist bank clerk assumes the unfortunate black man is a criminal, and calls the cops on him. The bank is getting sued, the clerk is getting sued, probably the manager is getting sued. I don't usually condone our sue-happy culture, but in this case, there better be some sort of financial compensation.

All the while this poor guy had to have all these blemishes on his record: jail time, lost his (nice) car, accused of a felony, and even lost his job.
