Accused fire boss cited for drug, alcohol possession

02:05 PM PST on Tuesday, January 9, 2007

Associated Press

WENATCHEE, Wash. - The fire crew boss charged in Spokane with involuntary manslaughter in the deaths of four firefighters has more legal trouble.

The State Patrol says Ellreese Daniels was given a citation accusing him of possessing marijuana and a 24-ounce container of beer.

Trooper Richard Magnussen says the Leavenworth man was a passenger in a car stopped on I-90 near Moses Lake on Thursday as he was returning from a court appearance in Spokane.

Magnussen says the car was stopped for failing to move to the left of a trooper making a traffic stop. When the car was pulled over the driver, 41-year-old Marci Muth of Peshastin, was arrested and accused of drunken driving.

Marijuana was found on the floor of the right front passenger seat where Daniels was sitting. Two pipes were found in the glove box.

Daniels was cited and released. The prosecution is being handled in Grant County District Court.

Daniels is facing up to six years in prison if he is convicted in the Spokane federal court on the charges of manslaughter and lying to investigators about the 2001 Thirtymile fire near Winthrop.
