Youngest suspect in bus tunnel beating pleads not guilty

SEATTLE - The youngest suspect in a brutal meeting in Seattle's bus tunnel pleaded not guilty Thursday morning at the King County Juvenile Center.

The 15-year-old girl, seen beating and kicking another teenage girl on video as security guards looked on, was arraigned on charges of first degree robbery, which is a combination charge of assault and robbery and carries a standard sentencing range of up to two and a half years in juvenile detention.

But her attorney says there's more to the story than what's on the tape.

"There's always a story that goes beyond what the obvious is. That's one of the things that's always very frustrating for defense attorneys when you're in a situation where the public sees something. It's a very small snapshot to what's really happened because there's always the whole story behind everything," said Elinor Cromwell, defense attorney.

Police believe three older boys, ranging in age from 18 to 20 years old, helped out in the crime. They will face the same charge later this month and are being held on $100,000 bail. Their arraignment is set for February 24.

In the wake of a KING 5 Investigators report on the video recorded beating, King County Executive Dow Constantine has ordered Metro Transit to review polices that restrict what unarmed Transit security guards can do when seeing criminal activity.

Seattle Mayor Mike McGinn said Thursday he's offering to put uniformed Seattle Police officers in the Metro bus tunnel. King County has jurisdiction over Metro operations and McGinn says this an offer to help. At least one King County deputy will be stationed at each of the five Metro tunnel stations.

The KING 5 Investigators uncovered the disturbing video captured on five different security cameras underneath downtown Seattle. It shows the graphic beating of a teenage girl in Seattle's Metro bus tunnel, while uniformed security guards simply look on.

The incident took place at around 7 p.m. on Jan. 28. When the beating is over, you see on the tape that not one guard bends down to see if the victim is breathing or needs help.

The 15-year-old victim says she tried to get help from the guards before the attack.

In charging papers, the teen says "I knew I was in big trouble... I went to security and told them these kids were trying to jump me... but he acted like he didn't care."

Moments later, the girl is pummeled by another 15-year-old girl who punches her and kicks her in the head, as an accomplice grabs the victim's purse.

The sister of one of the adult defendants claims the victim has been attacking people in the downtown area.

The guards are not trained police officers or Metro Transit employees. They're contract workers from Olympic Security Services out of Tukwila. According to their contract, the guards are to "observe and report" problems, not to get involved. Metro Transit General Manager Kevin Desmond says that policy is now out of date.

"You look at what's happening to the victim and you say something got to be changed," said Desmond. "That's just not going to be acceptable. We've had that ‘observe and report’ for years in our contract and this incident clearly shows that we need to change that."

Metro Transit has already launched a review to see what powers they should give the guards. They’re working with the King County Sheriff's Office to figure out how best to change the protocols.

In his order following the KING 5 report, Constantine said in a press release, "Public Safety is our top priority. I am appalled by the sight of uniformed guards standing by while a person was kicked and beaten. I have ordered a full review of all operating policies that govern Metro's contract with civilian security guards to determine what changes must be made."

Metro Transit Police and King Co. Sheriff’s deputies worked around the clock to track down the suspects. School yearbooks, MySpace pages and Facebook helped lead them to those involved.

The mother of the alleged attacker tells KING 5 of her daughter that "She's a good person, loving sister and daughter. She has a good heart but unfortunately things happen."

But those who witnessed the attack say this THING should never have been allowed to happen.

"Really? You've got three male security guards there, a young girl that's getting kicked in the head lying on the ground motionless, and they couldn't do anything? It doesn't seem like security," said a witness.

In a late day statement, Olympic Security said: "In the past, our guards have been very effective in deterring fights when only two people were involved, by verbal intercession or acting as a physical buffer. When a situation has escalated like the one depicted in the videotape, these passive approaches are not effective."

The victim's family say she is recovering well.

This incident reminds me of another from Miami Northtwestern HS, in Liberty City, Miami, Florida back in the 1990's. A teacher came to school in the morning and saw two female students fighting and beating each other. The teacher tried to brake the fight but he was badly injured. Later, the case was taken to court and the judge found the teacher....guilty of assault and battery!!! This case sent a warning to all teachers to not to brake any fight. All one can do is calling the security or the school police.

The last time security was under par we lost two big buildings and thousands of precious lives. If no one steps up to help (security, Joe bus rider, or the victims friend) somehow, someway we all feel the repercussions. We now have police in the tunnel that cost us all in taxes. Those same police officers are baby sitting the tunnel instead of being someplace that someone NEEDS a cop and can't find one. So come on be an American and step up for what is right, and watch each others backs.

Gee, 15 year old girl I am so sorry you pick the worng people to hang out with. I am pretty sure the 3 guards were NOT the only people standing there. There were plenty of people that COULD'VE stepped in and helped. Oh, wait they didn't. I don't blame them. As much as we all would love to say we would have helped if that were us, the truth is not a lot of us would have. Can you blame the cops? 6 cops have been killed in the past 3 months. They are all on edge. When you point one finger at someone else, you always have 3 pointed back at you. And I'd hate to be the bearer of bad news, but you can all say race means nothing. In places like seattle, and tacoma.... I am sorry, but truth is yes race in those areas make us hesitant, and if it were a white girl the person in the video with thier camera-phone would have been helping not filming. I think the security guards should be charged as accomplaces to the crimes of assault and robbery because they did nothing to help this girl. Even if they could not help her because of thier work contracts they had a moral and legal obligation to help her because of child protective laws that apply to everyone. If you see a child being injured any where any time you must intervine seek help and report it to the athorities ie the Police and CPS. On a personal note I think those grown men are complete COWARDS ! I mean all of those that were involved they are exactly the kind of people I can DESPISE

I just can't leave this tragic story without a comment to Ms. Elinor Cromwell. Had the fellow lived, you know - the one who shot the four officers? Had he lived you should have been his champion. You are so right, there almost always is more to the story. More than is seen as evidence. And, in the American 'legal' system (please, don't defile the word justice) it is all about winning or losing a case, not about truth. Prove me wrong. Bring in the trumpeting chorus "yes, but its the best system we have".....and..."if you don't like it, go to Iran." True enough, true enough. I wish you a win, Ms. Cromwell.

Most parents love their children to a fault. They have a hard time processing when their child does something wrong. And not every crime committed is a result of bad parenting. that is an excuse to take responsibility away from the person. You can raise your children the best you can but at the end of the day you are just hoping they listened to you. That is why you can have 2 kids that grow up so differently. That's the scary part of being a parent. You cant control everything.

Another news agency had a quote from the thugs mother that they both showed aggression. You can watch this video until you are seeing stars in front of your eyes and still not see the victim do anything but move as close to the Security personal as possible. She does nothing aggressive until she is attacked and then she fight back but is quickly knocked down and then stomped in the head. Somehow I knew the mom or a friend of the little punk would say their angel would never normally do this. Until she is in an adult prison she will be doing this many more times. Well, I guess unless she gets shot in a drive by while standing on a street corner at 2 in the morning. Then mom will be wailing and asking why her angel is dead. Well mom if that happens it is because you raised a gang member and future drag on society.

It appears to me that these security guard's wonton conduct was done with conscious or reckless disregard for the rights and safety of this victim who sought their protection. This was done needlessly manifesting a reckless indifference to the rights of this victim. In my opinion, these security guards had a duty to protect this victim.

Violence is NEVER acceptable. There is never a valid excuse. I would bet that there is violence in the home as well. The parents did not do a good job. What are their names? The parents did not make a good contribution to mankind. It is never too late for an abortion. Are these kids getting anger management classes? Sometimes, it takes 3 strikes. I believe that any and all violence should result in anger management courses and drug testing. Immediately! Perhaps we need "moral police" like they have in IRAN. What kind of society do YOU want? How are we going to get there when violence is taught in the home? And what kind of man would just stand there and watch? Seems very whimpy to me. She even asked those men for help. How many other whimpy people were just standing and watching in the video? A CRIME was happening! Aren't there any assertive people? I saw aggression and passivity in that video, no assertiveness. Look at what happened to the thugs that beat the hell out of the police officer in West Seattle they got off with a light sentence. Then look at what happened to the King Co Sheriff that put that thug in her place he got fired. What do you expect a bunch of underpaid security guards to do. If the guards had stepped in and did something they would have probably been fired for violating policy, then the race card would have been thrown in the mix.

Here's a prediction: The Alleged attacker will say something to this effect why she did it: "She was after my boyfriend". Of course the actual comments could easily be described as hateful and would not make onto past the web site. Translated into normal language: "This young lady was attempting to have a personal relationship with a male acquaintance of mine, and I was trying to discuss with her her viewpoint on all the interpersonal issues such a endeavor might bring to light within my peer group".... highly doubt it was something along the lines of "she stole my homework" or "She just kicked my dog". psssssst. We will be watching how Dow Constantine handles this situation. It should begin with the termination of the security company. Period. Cancel the joke of a contract. Then get rid of Desmond. We are a major city and our contract requirements must meet that criteria. The young woman sought assistance/help but those three security cowards stood and watched. Sad sad day for Seattle. Any able-bodied person that watched the attack is a coward with the exception of pregnant females. The Sheriff's department has jurisdiction of that area and they used mindless and helpless security down there. So wrong on so many levels. The Sheriff should be accountable. I hope they charge ALL ten of the gang/group that were part of the attack and THROW THE BOOK AT THE ATTACKER! Citing a few months, maybe 3 years as a sentence is so wrong. I doubt the woman attacker can be rehabilitated. There MUST be a message to other teen-agers that there are serious and long-term consequences for similar actions.

As a Black man, this bothers me on so many different level and I am somewhat embarrassed. To see two black girls fighting over clothes, to see three Black men do nothing as one Black girl tries to kill another one. So much for this being Black history month. One of my greater concerns is the lack of actions from our Seattle Black leaders, have not heard a peep. If roles were reversed, they would have been on the phone trying to get Jessie and Al here. Why are you not speaking up for the victim here? She did nothing wrong. When you decide to act or get involved in certain crimes and sit on your hands for other, kind of makes you a hypocrite in some people’s eyes.

The fact about self-defense: 1. Your potential attacker is usually bigger and stronger than you. 2. If not, your potential attacker usually have his/her buddies with him/her. 3. If not, your potential attacker usually have a gun or knife. --------------------> Analyse the situation and come up with a proper stratege quick. It will save your life! Take the case to court. Dont settle for a plea. We need to make a point here. She is going to argue that, that is not her shown beating up the girl. The robbery chargemight slide, but I would go for attempted murder.Seems easy to prove and you have plenty of witnesses.Oh, should we ruin the attackers future, Hell yes. Why should we care for someone who obviously has no regard for anyone elses? As for the other adults involved. I dont understand what a 20 year old man is doing running around and engaged in these childish activities.Why isnt he at work or doing something productive. He should go to jail, just becasue.He's going to end up there eventually anyway.As for the Mother, sometime the truth hurts. Dont paint your child as more than what she is. Hooligans like these girls, and their cohort boys, should be meted out the harshest punishments so that they will be livid examples of what can happen to them should they commit dastardly crimes like this. On another note, these guards should be discplined for utter disregard of the victim's safety. To hide under the veil of their job description should not be an excuse. Change the wording of their contractss and add a disciplinary clause for their criminal/negligent acts or omission.

It would've been better if the victim ducked under the first combination slaps and came up with a left hook to the jaw or a hooking palm-heel to the jaw. And always follow up with a right cross to the jaw or straight palm-heel to the jaw/nose.

Keep hearing everyone say something along the lines of "where are thier mothers" or "didn't thier mothers teach them anything". Why doesn't anyone mention the FATHER figure. Pardon my harshness but am I the only one that just assumes these kids are raise by a single mother on welfare suckin off the government teat? I'm willing to wager the only thing these kids have learned from dear mommy is that you gotta take all that you can and everyone owes you something. Why even have the Security Guards, if they aren't allowed (or have enough common sense) to help a person. She went up to them and asked for help, they just ignored her. The irresponsible Juveniles need to be charged with 1st degree Assault, if it is true this girl has a heart condition then they could have killed her, and who knows what kind of after effects she may suffer from the beating (head injuries). If there is going to be Security, then have REAL SECURITY, people that are going to protect the people in the tunnel. Just standing around isn't going to stop anyone!!

You plead guilty at your arraignment, and you get sentenced right there, with no other options. It doesn't matter if you're caught on tape or found with a bloody knife in your hand and the victim's blood all over you...an attorney will tell you to plead not guilty at your arraignment.

When I watched this video last night, my heart dropped. I truly believe, in this case, there would have been an act of forgiveness for the security employees had they intervened, but to not do so is inexcusable. She was on the ground, immobile and seemingly unconscious while being stomped on repeatedly. What does it take to intervene? Then to kick the victim out afterwards...what about keeping her safe and calling for medical/police help? Unfortunately, the attackers mother is doing a horrible injustice by excusing her behavior. Her desciption of her as "a good person, loving sister and daughter" does not align with her actions. It wasn't a fight that could be excused because it was self defense, it was an intentional, malicious criminal act. I certainly hope her consequences fit the crime and allow her to learn a valuable lesson. My prayers are not only with the victim but the attacker, as she really needs to soften her heart, be a better person and stay away from troubled peers.

To have employees dressed and identified as "Security" or "Guards" would imply to any victim of a crime that these are the go to people for help. Failure to provide this help or Security placed this young lady well being in danger. This policy of "Observe and Report" with dressed Security Guards employees maybe a liability - and in this instance it should be. I'm not saying the males should get a lighter sentence, just the whole thing seems like a slap on the wrist for such a violent act. And over what she wearing??? This story goes deeper than people think. The victim is not as innocent as people are lead to believe. There is no NEWS footage out there showing the brutal beating that the attacker in the video had received at the hands of the victim in the video when she and four of her friends jumped the attacking girl in the past. As for the security guards they did what policy dictated, to do otherwise would have cost them their jobs and speaking for myself I'm not going to lose my job for breaking policy because no one is going to step up and pay my bills or support my family when I'm unemployed or dead for breaking up a fight.

If security guards are in there to be "security" -what good are they if they are not going to step in when a blatant crime is being committed....oh, good...call for the police...but in the meantime those idiots stood by and WATCHED someone kick this person in the head repeatedly !!! Why do they need to have three security guards in one location, if all they can do is observe and report. It only takes one person to make a call. The whole idea of a security officer only being able to "observing and reporting" is asinine. I hope the victim sues everyone involved, Olympic Security Services, Metro Transit, the cowardice so-called "Security Guards" and the low-live criminals who commited the attack. Olympic Security and Metro Transit will make the nessessary changes if they have to pay for their stupidity.

Waving a "King County employment contract" around doesn't prove you're not a King County employee. The only difference is how pension benefits are structured. King County is liable and so are their "contract" employees. Personally, I want to do the same thing to those "security" guards that they were willing accomplices to doing to that poor girl. And why aren't all 10 assailants in jail -- were the remaining 6 unidentifiable? If so, those in custody should be charged with obstructing justice as well if they do not identify their co-assailants. They are all guilty of assault, though only the two girls appear to have done actual battery. The victim could have potentially defended herself, but when there are 8 men backing up her assailant, what do you think would have happened if she attempted to defend herself?

This event is amazing. I understand that the security guards have guidelines to follow. However, I'm shocked that the human factor didn't override the "rules and regulations" mode they were in. I can't say for sure, but I hope that I would have taken off my security vest or coat, and tried to do something, anything, to help this girl, as a fellow human being. I would also hope, that if I were ever in a situation like this, someone would come to my aid. The group of attackers outnumbered the guards, but yelling or running at them surely would have created some kind of threat. At least distracted them for a moment and perhaps given someone the opportunity to drag her to safety. I know, I wasn't there, so who knows. But I would like to think that I would have done something, and I'm sure these guards wish they would have done something to help as well. Our prayers are with the young lady who was attacked, and with the attackers, whose lives are forever changed by their act of violence!!!

I can honestly say I have never commented in the news in my life and I am 48yrs old, but after watching the news and listening to commentary from all areas, TV, Radio ect , I am so disturbed that I had to let it out. Everyone keeps talking about how awful it is that the Security officers couldnt help this girl because it isnt in their contract, but my god what about human decency! How could these men just stand there and watch a 15yr old girl get beaten like that and do nothing? Also, what about the by standers? What on earth was the matter with them? No one did a thing to help that poor girl! Not once have I heard anyone on the news or on the radio say anything about the fact that human decency should have had everyone there getting involved! You know it is so easy to say whatever because you are not the one in the thick of the situation. I am a guard of a similar company with a similar policy. Granted we are not allowed to touch people unless it is our personal self defense. I think that you have to remember that there is no security check into this public place. So what if one of the attackers had a knife or a gun. Also these attacks can bring retaliation to the guards and they can come back and stab or shoot the guards for just doing there job. Granted if it were me I think that I would have done a little more to help the girl that was attacked, however you open yourself up to injuries or lawsuits etc....

I am not sure at whom I should be more outraged; the security company that was negligent when notified of a threat to a minor person, King County for not being aware of their own policy that allowed this situation to occur, or the mother of the female attacker who tries to excuse the brutal attack by characterizing her daughter as "good person, loving sister and daughter. She has a good heart but unfortunately things happen". Unfortunately things happen covers natural events and other things outside of human control. It does not cover willful assault with the obvious intent to maim or even kill another person, as was shown in the video. Her daughter and her friends are the lowest scum I can imagine, and she needs to open her eyes to that fact. I am a parent of a son and a daughter. I only hope they never have the misfortune to cross paths with anyone who thinks it is all right to beat down and head-kick a person with the obvious intent to cause grievous bodily damage.
