Lawmakers try to jump-start successful crime-fighting tool

Washington legislators have proposed a pair of bills that would revive a successful crime-fighting tool.

The bills introduced in both the Washington House and Senate would give the Department of Licensing the authority to resume computerized facial recognition scans on all photos of driver license applicants.

Costly error

The KING 5 Investigators reported in this story last summer that the successful program was shutdown only months after it was launched because of an error by DOL. The agency learned that it did not have the proper legislative authority to conduct the photo scans.

“It was a good program. We have the money, it has some results that we can now measure,” said Rep. Judy Clibborn (D-Mercer Island), one of the bill’s sponsors.

Facial recognition software allows DOL to scan each of the 14 million photos in its database to look for duplicate photos. The software compares facial features in each photo and looks for a match.

When DOL scoured its entire database in November of 2010, it found five thousand people whose photo appeared on more than one valid ID or driver license. DOL investigators are now looking at each of those cases to determine if they involve identity fraud and whether they should be referred to law enforcement. The agency has already cancelled or suspended more than a thousand licenses.

One woman, two faces

The case of Eliza Bighetty is an example of the software at its best. She donned a wig and walked into a DOL office to apply for a driver license in the name of her deceased step-daughter. The scheme worked and for ten years Bighetty received social security benefits and food stamps.

When Bighetty applied for an enhanced driver license, her photo was run through facial recognition software and the jig was up.

“Without facial recognition software we, as law enforcement, may not have caught her,” said special agent Joseph Velling of the Social Security Administration.

Velling said once the software caught Bighetty, SSA and the State Department of Social and Health Services determined she stole nearly $100,000 in benefits over ten years in the name of her dead relative.

Not everyone is eager to see the return of the photo scans.   The American Civil Liberties Union plans to fight the legislation at a hearing in Olympia this week.

The ACLU said facial recognition is “notoriously unreliable” and it fears innocent people could lose their licenses or be charged with crimes.

The bills do not impact photo scans of applicants for higher-security enhanced driver licenses.  DOL already has the legal authority to run facial recognition software for that program.

Driving is a Privilege, not a right! The time has come to enhance the protection of people with more advanced technology. If a situation comes up that's a miss, i seriously doubt any "innocent" person will be harmed. BTW, of a million scans what percentage is wrong? Just sayin'. Oh, and you paranoid hipster wannabe ACLU fans, skip the lic. and ride your fixxie against the flow of traffic! Please!

Kudos to the ACLU for fighting against this. We need to protect our privacy even from the government from messing around with our data. This is another step towards Aldous Huxley's vision. Regarding the woman committing fraud, this is just a one-in-a-million chance of something happening. All the cost of this system will not even make up for the cost of the fraud committed... not including our freedoms.

I bet she's just mad at herself for getting the enhanced driver's license instead of feeling actual regret for the crime(s) she committed. Doesn't surprise me though that she needs extra government assistance, with that mug I doubt many men are eager to take care of her.

So far no identity theft from my lost license. I assume a clerk who wanted it did not return it when I wrote a check. I prefer Debit cards, as no check is required of my ID to stop it being lost. (Replacement was required as the punched old license could not be used at WinCo. $15. was my cost, so I avoid writing checks.) I assume the enhanced ID is the one required to go to Canada? This gal should have cleaned up her life. She looks so much better in the wig. I have been mistaken for someone else just by facial recognition, so don't thumb down me. I quickly told them they had been mistaken. Some faces look like many others; it is very expensive to defend yourself in court on any criminal or civil matter. I do like the NCIS TV program where they do this all the time to find the bad person.

a response to vffrwm: While I agree with your assessment of no accountability in WA State Gov't, I feel the need to remind you of a little secret... ...ask anyone who has ever requested an Administrative Hearing regarding a denial of medically-necessitated services from DSHS or DDD... ...the WA Attorney General is not in court to fight for the rights of the law-abiding citizens of WA State... ...the Attorney General of WA State is in court to assure that the State of Washington wins! Not the people who the AG says he "fights" for! After many years of court battles with DSHS, and DDD with the Attorney Generals' office acting as the attorney for DSHS, we have learned one thing... ...if you do not need an interpretter, you will never win your case - even when you prove in court that DSHS and the AG's office committed fraud! I hope the reintroduction of this cutting edge technology forces WA State to continue to be dragged kicking and screaming into reality!

Washington state howls and whines about having DUI checkpoints for the publics safety, but its ok to have your picture put into a data base to check your background. The hyporisy in this state can makes ones head spin.

I love this system. It's a shame it had to be shut down the first time. The ACLU can't stop progress and this tool is going to help catch a lot of evil identity thieves. I don't mind fingerprinting and facial recognition software because I'm not a criminal. I pay taxes, obey the law, and excersize my right to vote. Our school teachers all have to be finger printed and photographed to teach, why shouldn't we apply the same standard to everyone? Let those who do wrong be punished!

@tootoo - The ACLU isn't fighting for our rights in this situation...they are fighting for the rights of complete losers who steal our money, destroy our credit and completely take advantage of the system! Get it straight!! I'm all for equal rights, but has NOTHING to do with that AT ALL!!!

And while I'm at it lets go one step further. Make E Verify a mandatory law. Nobody can get paid in this state until such time as an E verify check has been run on their social security card. At the same time employers would have 90 days to run E verify checks on all present employees no matter how long they have been with the company. I say this becasue while working in CA a few years ago for an employer who hire hundreds of illegals (even with their paper work) we got a call from a 79 year old woman in Oklahoma who had her social security cut off because there was in come reportered on her SSN. Well sure enough it was one of the illegals using a number on a phony card. That is just wrong.

And it has taken this long to get something in motion on it again? Oh come on. I know those morons in Olympia are half brain dead but for this tool to be available and not being used because of an error like that is something in the private sector that would make heads roll. Thats the big challenge with government. NO ACCOUNTABILITY. Do it and do it now and if the ACLU wants a war turn them over to the Attorney General let him fight that battle while we get criminals off the street.

Exactly how is an innocent person going to be charged with a crime can you tell us ACLU. After more than one picture of the same person shows up on two different licence's or ID's they will be flagged so it can be determined if a crime has been occurred. A person who has not broken the law will have a perfectly reasonable reason why they have multiple state issued ID's.

Get over it, ACLU. I'm all for anything the state can do to cut down on ID theft.
