'Barefoot Bandit' sentenced to 6.5 years for federal crimes

SEATTLE -- A Seattle federal judge on Friday sentenced Colton Harris-Moore to 78 months, or six-and-a half years, in prison for federal crimes he committed during a two-year international crime spree.

The 20-year-old pleaded guilty last month and was sentenced to seven years in prison for his state crimes.

Harris-Moore apologized to his victims shortly before U.S. Judge Richard Jones imposed the sentence, which will be served concurrently with state prison time.

"I now know a crime that took place overnight will take years to recover from," Harris-Moore said in court.

He particularly apologized for stealing planes, saying his arrogance led him to keep alive his dream of flying.

"What I did could be called daring, but it is no stretch of the imagination to say that am lucky to be alive ... absolutely lucky," he said. "I should have died years ago."

Judge Jones noted that Harris-Moore had endangered others with his "reckless conduct... and a host and variety of poor choices" and told him it was time for a "new life flight plan."

Federal prosecutors had asked for a six-and-a-half year federal term to be served while he serves his state time. Harris-Moore's attorneys had requested a federal term of less than six years.

Though the federal and state sentences will be served concurrently, it's an open question whether Harris-Moore will get "credit for time served" for the time he spent in custody awaiting trial and for time served under a juvenile court sentence. Judge Richard Jones said Friday that it will be up to the federal Bureau of Prisons whether to credit Harris-Moore with the time served.

The judge also urged that Harris-Moore's time be served in a state corrections facility, rather than a federal facility. It's likely that he will serve his time at the state prison in Monroe, and the state's formula for calculating credit for "good time" (what is sometime referred to as "time off for good behavior" while in prison) is more favorable to him.

Harris-Moore hopscotched his way across the United States, authorities said. He flew a plane stolen in Washington state to the San Juan Islands, stole a pistol in British Columbia and took a plane from Idaho to Washington state, stole a boat there to go to Oregon, and took a plane in Indiana and flew to the Bahamas, where was arrested.

The 20-year-old earned his nickname because he committed several of the crimes without wearing shoes, and he attracted fans across the nation for his ability to evade police.

But on Friday, Harris-Moore apologized to his victims shortly before U.S. District Judge Richard Jones imposed the sentence, which will be served concurrently with state prison time.

He particularly apologized for stealing planes, saying his arrogance led him to keep alive his dream of flying.

"What I did could be called daring, but it is no stretch of the imagination to say that am lucky to be alive ... absolutely lucky," he said. "I should have died years ago."

Defense attorney John Henry Browne said he expects Harris-Moore to be out of prison in about 4 1/2 years, accounting for the 18 months he's already been in custody. Federal prosecutors declined to comment on how much time he might serve, saying that will be up to the Bureau of Prisons.

Outside the courthouse, Harris-Moore's mother, Pam Kohler, said her son gave her a letter in court, but she refused to talk to reporters. She hit a television crew's microphone and camera, and a newspaper photographer's camera with her purse.

Before Friday's sentencing, defense attorneys said federal prosecutors released cherry-picked excerpts from emails in an effort to make Harris-Moore appear callous and self-aggrandizing.

He called the Island County sheriff "king swine," called prosecutors "fools," and referred to reporters as "vermin." He also described his feats -- stealing and flying planes with no formal training -- "amazing" and said they were unmatched by anyone except the Wright brothers.

But Harris-Moore's lawyers claim the full emails show that he is sorry for what he did and thankful for the treatment he received from a state judge who called his case a "triumph of the human spirit." The state judge sentenced him last month to seven years, at the low end of the sentencing range.

The attorneys acknowledged that in certain instances he bragged, but they said those writings were simply the product of an impulsive adolescent and don't reflect his true remorse.

Harris-Moore apologized for those emails in court Friday.

The judge asked Harris-Moore to speak to young people who may look up to him because of his exploits.

"I would say to younger people they should focus on their education, which is what I am doing right now," he said. "I want to start a company. I want to make a difference in this world, legally."

Federal prosecutors had asked for Jones to impose a 6 1/2 year sentence to be served while Harris-Moore serves his state time. His attorneys had asked for a federal sentence of just under six years.

The judge acknowledged that Harris-Moore had a difficult childhood, one with "complete lack of parental guidance" and alcohol abuse. But he said he was concerned that that his previous court appearances didn't have an impact on him.

Jones acknowledged that Harris-Moore committed his early crimes to survive after fleeing from home. But he said "most of the federal offenses were committed for one reason: to fulfill your passion for flying at all costs and consequences."

The judge encouraged Harris-Moore to get treatment in prison. Harris-Moore's defense lawyers said treatment was already under way.

There's a $1.3 million deal with 20th Century Fox for a movie based on Harris-Moore, but federal prosecutor Darwin Roberts said he doesn't expect that to be enough money to cover restitution.

Entertainment lawyer Lance Rosen said outside the courtroom that Academy Award winner Dustin Lance Black -- who wrote "Milk" and the recent "J. Edgar" -- has met with Harris-Moore several times and has turned in a draft of the script.

I am in no way glorifying what Colton Harris Moore did..However, I wish this young man well and hope he makes the best of his time in prison and uses those 6.5 years to study and walk out of prison with a couple degrees and lead a productive life..I understand those of you as I do that believe he should do prison time but I do not understand the hate of some who are hoping to see hurt while in prison/sexually, beatings, possibly even be killed.. I also hope that those that of you whowant to throw this kid to the wolves have to eat their hateful comments and predictions. I know, I know what he did was wrong..A big mistake for sure..He deserves to do time in prison..It might be the best thing that ever happened to him considering the sad life he lead growing up..@charlielechein..you are a sick SOB! I think intrepid1 had some great alternatives for Colton. Nice to see one person who has faith in his potential to lead a good life.

He's displayed a resourcefulness that could be put to good use in public service -- in the Military. He should work with his lawyers to strike a deal with the army and the courts to have him serve his sentence in the army, with the intent that he be trained to be as a commando or, maybe, in the CIA as a spy... put that misguided intelligence and skill to work for the nation rather than the $30 K per year it'll cost us to keep him locked up...

So Huckleberry Finn's adventure has ended, hopefully he can be reformed in prison. I am still clueless as to why reporters would continue to chase after his mother outside the courthouse, when she made it clear that she didn't want to be bothered. She is entitled to her privacy as well.

He may have talked a good story to prevent years after years of getting a longer prison sentence, lets see if he can talk his way out of others in prison having their way within him as he will be fresh meat in prison. He will take on other nicknames, such as BareBack Bandit or BareAzzed Bandit with his hiney sore from unwanted attention. With his smart mouth attitude being the big man on campus, he will be put in his place or request solitary no matter what prison he serves in. Hope he survives, hope he studies how to land a plane, and hope he keeps hi mouth shut and does not brag or he will brag about being the new boy friend to the guys that have been there the longest.

@proudamerican..You are absolutely right..Colton Harris-Moore was sadly a misguided child..I am also hoping that the time he spends in prison he will take advantage of their library..Get his GED and even another degree when serving his time..Yes, give the child a chance to have a productive life..The "proof in the pudding" will be if Colton takes advantage of all the free education that he can receive in the prison system..@noskills..Any kid that can fly an airplane without out any training, simulator time is not stupid, my friend! @sandie_morehouse06..You want to put a young man away for life that did not kill anyone, rape a child or an adult, shoot to kill anyone when caught? When you see rapist, murderes being let out of prison after serving a few years or recently murders, rapists, violent convicts who were pardoned by a governor leaving office who set them free..And the law could do nothing to overturn this governor's pardons? I'm glad he is in Monroe..He stands a chance..

Where Eric Wilkinson live? Camino Island, any area where the barefoot bandit struck? Hope Wilson consoled his children's fear after the bare foot bandit started breaking into homes. Able to give them some peace of mind Colton was a thief, and no evidence that he was out to murder anyone..Plus, didn't he break into homes when people were not in it or even living in it? I am not condoning what Colton did..It seems the only time he was caught was when naked and the home owner came home? He cold have killed that person, but he didn't..Threatened to shoot him? He deserves some prison time. This child lead a terrible life. I'm sure his IQ is well above the average. His choices were that of a foolish young person who was not nutured by a responsible mother..Never taught right from wrong.. He survived the only way he knew how as she wasn't exactly a mother of the year..Other children have risen above a poor family life..I would like to see stats on just how many did and how many didn'

I cannot believe people are glorifying this guy. He is nothing but a common criminal. Yes...he may be very intelligent and that would be noteworthy if he used his intelligence to benefit others rather than to victimize them. Hopefully he has learned his lesson but I seriously doubt it. A role model - I do not think so.

First Offender only means "first time caught." Good lawyers do select judges for their lighter sentencing patterns when they know their clients will be found guilty. Judges, lawyers, DA's are all lawyers and party together at the Bar. This has to be the lightest sentence in history for what all he did.

@King_43 and @mmullvain. I could not agree more with you as well. This is a very intelligent young man. He pled guilty for what he did. This means that he is taking responsibility for what he did. He was just a misguided young man. I am hoping that the time he spends locked up he can do what he says he wants to do. Give the kid a second chance to become a productive member of society. He is still very young and he can make changes for the positive in his life. So lets give him the chance to grow up and become a man and be a productive member of society.

@mmullvain. I could not agree more. I know what this young man did was wrong. But he is an incredibly intelligent young man too. You can't deny that. I don't think there are many young people, or old people for that matter, that could have did what he did for so long. I too, hope that he can use this time to reflect on what he wants in life, and hope that he is telling the truth that it is something better then what he has done. He has the intelligence to become something great. I pray that he will chose the right path.

Complete and utter garbage. No wonder this country is so screwed up. He ought to be thrown into prison for a very long time. Make it a work prison and make him due HARD labor, breaking rocks in the hot sun and PAY for what he did. This country is too boo hoo nice to people who don't deserve it.

I like this kid. We've all made foolish and impulsive mistakes, most when we were at his age. It's not like he's a gun firing gang member, sexual offender, or drug dealer. He's got free spirit and a smart mind, just no common sense or respect for the rules or peoples property. I hope this time in jail helps him grow onto a better person and doesn't condition him to become a harden criminal instead. My wishes and prayers go out to this young man for a better future and an understanding of how he can help the world and change it for the better.

Well the order said a minimum of 5 years so he will serve at least that long. I dont have a problem with his sentence I think its fair what I have a problem with is that he gets 5-7 years for burglary while a rapist will get 3-5 years. That kind of insane in my book.
